Key Benefits:
Article 16 of Law 24/2013, of 26 December, of the Electricity Sector, states that the Minister of Industry, Energy and Tourism, after the Agreement of the Government Delegation for Economic Affairs, will dictate the provisions necessary for the establishment of:
(a) The prices of the tolls for access to the transport and distribution networks, which will be established in accordance with the methodology established by the National Commission of the Markets and the Competition in view of these effects, cost of the remuneration for these activities.
(b) The necessary charges to be established in accordance with the methodology provided for in this Article to cover other costs of the corresponding system activities.
In addition, Article 13 of the aforementioned law, concerning the economic and financial sustainability of the electricity system, states that, by means of the revenues of the electricity system, the costs of the electricity system will be financed. to be determined in accordance with the provisions of the law and its implementing rules. This article sets out the revenue and costs of the electricity system.
In addition to the foregoing, the first transitional provision of Law 24/2013 of 26 December states that, as long as the implementing rules are not dictated by the application of any of its The provisions in force for electrical energy will continue to apply, and the references made in the regulations to Law 54/1997 of 27 November of the Electrical Sector will be understood as equivalent concepts regulated in the new law.
The transitional provision of Law 24/2013, of 26 December, on the application of charges, determines that up to the development of the methodology of calculation of the charges in accordance with the provisions of Article 16 of the This law, the amounts to be met by consumers to cover the costs of the system will be fixed by the Minister of Industry, Energy and Tourism, after the Government's Delegation for Economic Affairs Agreement.
On the other hand, the second provision of Law 15/2012 of 27 December 2012 on fiscal measures for energy sustainability determines that in the General Budget Laws of the State of each year it will be allocated to to finance the costs of the electricity system provided for in Article 13 of Law 24/2013 of 26 December, an amount equivalent to the sum of the estimate of the annual collection resulting from the taxes and charges included in that Law 15/2012, of December 27, and of the estimated revenue from the auction of the rights of emission of effect gases greenhouse.
In relation to the fixing of the tolls for access to the transport and distribution networks, Article 7.1.a) of Law No 3/2013 of 4 June, of the creation of the National Commission of the Markets and the Competition, contains between the functions which the Commission has to exercise in the electricity sector:
" 1. Establish by means of circulars, issued in accordance with Article 30 of this Law, prior to the hearing and with criteria of economic efficiency, transparency, objectivity and non-discrimination:
(a) The methodology for the calculation of the part of the tolls for access to the electricity networks corresponding to the transport and distribution costs, as set out in Article 17.1 of Law 54/1997, of 27 November, of the Electrical Sector, in accordance with the tariff and remuneration framework established in that Law and in its development regulations.
For these purposes, it is understood as a methodology for the calculation of tolls, the efficient allocation of transport and distribution costs to consumers and generators. "
Furthermore, the provisions of the first transitional provision of Royal Decree-Law 13/2012 of 30 March, which transpose directives on the internal market in electricity and gas and in the European Union, must be taken into account. (a) electronic communications, and for which measures are taken for the correction of deviations from the mismatch between the costs and revenues of the electricity and gas sectors, under which the then National Energy Commission, On 18 June 2012, the National Commission on Markets and Competition referred to the members of the of the Electricity Advisory Council the text of the Public Consultation on "Cost allocation methodology for electric access tolls", approved by its Council at its meeting on 14 June 2012.
Subsequently, after the public consultation process, on 17 May 2013, the National Energy Commission referred to the members of the Electricity Advisory Board, for observations, a draft Circular for which it was establishes the methodology for the calculation of the tolls for the transport and distribution of electricity in compliance with Royal Decree-Law 13/2012 of 30 March, implementing directives on internal market for electricity and gas and in the field of electronic communications, and by which measures are adopted for the correction of deviations from mismatch between the costs and revenues of the electricity and gas sectors. On the current date, the circular cited has not been approved.
In addition to the foregoing, the first transitional provision of Law 24/2013 of 26 December on the application of previous provisions and references to Law 54/1997 of 27 November of the Electrical Sector determines " 1. As long as the detailed rules for the application of this law are not required for the application of any of its provisions, the relevant provisions in force in the field of electrical energy shall continue to apply.
2. The references made in the regulations to Law 54/1997, of 27 November, of the Electrical Sector, will be understood to be realized to the equivalent concepts regulated in this law. [...] "
Also, the provisions of the aforementioned transitional provision of Law 24/2013 of 26 December of the Electrical Sector should be considered.
Taking into account the above, the categories of currently existing access tolls are those defined in Chapter VI of Order ITC/1659/2009 of 22 June establishing the mechanism for the transfer of the customer's market for the supply of the last resource of electric power and the procedure of calculation and structure of the rates of last resort of electric power, in the Royal Decree 647/2011, of 9 of May, for which the activity of manager is regulated of charges of the system for the performance of services of energy recharge and in the Royal Decree 1164/2001 of 26 December 2001 establishing rates of access to the transmission and distribution networks for electrical energy.
It should also be noted that the additional twenty-first provision of Law 54/1997 of 27 November of the Electrical Sector provides for the procedure to be followed in the event of temporary disadjustments for 2013, establishing that the amounts provided shall be returned by recognition of an interest rate on terms equivalent to those on the market. Furthermore, the additional 18th of Law 24/2013 of 26 December 2013 recognises the existence of a deficit in the revenue of the electricity system to the maximum amount of EUR 3.6 billion, without prejudice to the temporary mismatches that may occur in the electricity settlement system for that year.
This implies that up to a maximum of 3.6 billion of the revenue mismatch in the financial year 2013 will be determined in the supplementary liquidation of that financial year referred to in paragraph 1 of this Article. The mentioned additional twenty-first provision of Law 54/1997, of 27 November, has the character of deficit.
In short, the forecasts are developed in this order in terms of system costs and access tolls, in order to comply with the provisions of Law 24/2013 of December 26.
This has been taken into account in the additional fifteenth provision of that law as regards the financing of the extraction of production activity in electrical systems in the non-peninsular territories for the purposes of 2013 and from 1 January 2014.
Thus, it is considered in relation to the financing from the system of liquidations of the electricity sector of the extracoste generation in the island and extra-island territories in the year 2013, established in the Transitional provision sixteenth and paragraph 1 (g) of the single derogating provision of Law 24/2013 of 26 December which led to the repeal of the fourth additional provision of Royal Decree-Law 9/2013 of 12 July 2013, whereby the take urgent measures to ensure the financial stability of the electricity system.
Royal Decree-Law 9/2013 of 12 July 2013 adopting urgent measures to ensure the financial stability of the electricity system, as set out in Articles 4.2 and 5.2 thereof, which the remuneration to be paid by the electricity distribution and transport activities from 1 January 2014 until the beginning of the first regulatory period under the royal decree of remuneration for the distribution activity referred to in Article 5 of the Royal Decree Decree-law 13/2012 of 30 March shall be calculated in accordance with the methodology set out in Annexes II and IV to that actual decree-law in which the detailed wording for the calculation of the remuneration is collected.
This order complies with the provisions mentioned in Articles 4.2 and 5.2, in which the Minister of Industry, Energy and Tourism, after agreement of the Government's Delegation for Economic Affairs, has been agreed. and on a proposal from the National Commission of the Markets and the Competition, shall approve the remuneration for each of the electricity distribution companies and the operators of the transport facilities.
Thus, for the transport activity, Article 1 of this Ministerial Order contains the result of applying the methodology contained in Annex IV to Royal Decree-Law 9/2013 of 12 July 2013 for the calculation of remuneration recognised to each transport undertaking for the year 2014, for the exercise of the transport activity associated with all its installations in service in the year 2012, all without prejudice to the quantities which are then calculated and approved corresponding to the incentive of availability and the investment and the operation and maintenance associated with Individual installations which are in service by 31 December 2012.
With regard to the incentive to the availability of the transport network to be collected for the year 2014, the same methodology as set out in Order IET/2442/2013 of 26 December 2013, for which it is based, is applied. establish the remuneration of the second period of 2013 for the activities of transport and distribution of electricity and other measures are established in relation to the remuneration of the transport and distribution activities of years above.
Regarding the electrical energy distribution activity, this order includes the result of applying the methodology contained in Annex II to Royal Decree-Law 9/2013 of 12 July 2013 for the calculation of the remuneration recognized for the exercise of the distribution activity to each distribution company for the year 2014.
In relation to the incentives to be received by the distribution companies, it is appropriate to establish the amount of the quality incentive of the service corresponding to the remuneration of the year 2014 in application of the Order ITC/3801/2008, On 26 December, for which the electricity tariffs were revised from 1 January 2009 and the amount corresponding to the remuneration for the year 2012 of the incentive of ITC/2524/2009 of 8 September for the calculation method of the incentive or penalty for the reduction of losses to be applied to the remuneration of the distribution for each of the electricity distribution companies.
Also and as a result of the amendments made to Article 15 of the unified regulation of the measurement points of the electrical system approved by Royal Decree 1110/2007, of 24 August, by the final provision Third of Royal Decree 1623/2011 of 14 November 2011 regulating the effects of the entry into operation of the link between the peninsular electricity system and the Balearic Islands, the amount of the incentive or penalty for the reduction of the losses corresponding to the remuneration of the year 2011, associated with the loss levels of the network year 2010.
On the other hand, the necessary aspects for the financing of the remuneration of OMI-Polo Espanol, S.A. are contemplated. (OMIE), an operator of the market, and of Red Electrica de España, S.A.U., as an operator of the system, pursuant to Article 14 of Law 24/2013 of 26 December, and taking into account the transitional provision of Law 24/2013, of 26 December, on the application of previous provisions and references to Law 54/1997 of 27 November of the Electrical Sector.
In relation to the financing of the market operator and the system operator, in the seventh additional provision of Order IET/221/2013 of 14 February 2013 establishing the access tolls from 1 January 2013 2013 and the tariffs and premiums of the facilities of the special regime was given to the National Energy Commission, the current National Commission of the Markets and the Competition (CNMC) the mandate to elaborate and to send to the Ministry of Industry, Energy and Tourism a proposal for a methodology for the calculation of the remuneration of such operators, as well as for the fixing the prices that they must charge from the agents participating in the market in accordance with the provisions of Law 24/2013 of 26 December.
As the Commission therefore comes to the submission of the above proposals, the prices charged by both operators and market players for their financing are set out in this order. As regards the market operator, the fixing of those prices is carried out in line with the methodology laid down in Article 6 of Order IET/221/2013 of 14 February 2013 laying down the access tolls from 1 January 2013. 2013 and the fees and premiums of the special scheme facilities. For their part, the price fixing to be paid by the persons to the system operator is carried out in the light of the provisions of Article 7 of the IET/221/2013 order of 14 February 2013.
Likewise, it is expressly included in the present order that the liquidations to be performed by the system operator shall be in accordance with the provisions of Article 18 and the transitional provision of Law 24/2013, of 26 December, resulting from the application of the provisions of Article 19 of the said law to the subjects.
It should be noted that until the time of entry into force of this order the prices of the terms of power and active energy of the access tolls set out in Order IET/1491/2013, of August 1, have been applied. on the revision of the electricity access tolls for its implementation from August 2013 and on the revision of certain tariffs and premiums for the special arrangements for the second quarter of 2013.
According to the provisions of article 5.2 of Law 3/2013, of 4 June, of the creation of the National Commission of the Markets and Competition, the provisions of this order have been reported by the National Commission of the Markets and Competition. The hearing procedure of this order has been evacuated through consultation with the representatives in the Electricity Advisory Council, as provided for in the transitional provision of Law No 3/2013 of 4 June.
By agreement of January 30, 2014, the Government's Delegation for Economic Affairs has authorized the Minister of Industry, Energy and Tourism to issue this order.
Under the agreement of the Government's Delegation for Economic Affairs, I have:
Article 1. Remuneration of the operators of transport facilities for the year 2014.
According to the provisions of Article 5.2 of Royal Decree-Law 9/2013 of 12 July, and in accordance with the calculation methodology set out in Annex IV thereto, it is established as the final remuneration for the companies holding the transport facilities for the year 2014 without including the incentive for availability and without prejudice to the amounts which are calculated at the time and are approved for the payment of the investment and the operation and maintenance associated with investments that are declared as unique and that will be in service before 31 of December 2012, the amounts shown in the table below:

Article 4. Quality incentive of the service corresponding to the remuneration for the year 2014.
The amount of the incentive or penalty for the improvement of the quality of service corresponding to the remuneration of the year 2014, associated with the quality levels of the year 2012, called Q2012, will amount to 92,557 thousand euro, according to the breakdown shown in the following table:

Article 7. Income mismatch annuities for 2014.
1. In accordance with the provisions of the additional twenty-first provision of Law 54/1997 of 27 November 1997, of the Electrical Sector and without prejudice to the annuities that correspond to satisfy the charging rights of the electrical system pending the entry into force of this order, the amounts intended to satisfy those duties during the financial year 2014 are as follows:

For the purposes of its settlement and recovery, these costs shall be considered as costs of the regulated activities.
2. The amount corresponding to the annuity of the temporary disadjustments for 2013, up to the maximum of EUR 3.6 billion of the deficit provided for in the additional 18th of Law 24/2013 of 26 December of the Electricity Sector, amounts to 280,172 thousand euros.
In the light of the provisions of the additional twenty-first provision of Law 54/1997 of 27 November 1997, of the Electrical Sector, as in the abovementioned additional provision of Law 24/2013 of 26 December, the of interest which shall bear the receivables for such a temporary mismatch from 1 January 2014 until a definitive calculation methodology is developed, it shall be provisionally 2,00%.
These amounts will be cleared from the liquidations of the regulated activities as of 2014.
Article 8. Forecast the costs of the Interruptibility Demand Management Service for 2014.

2. The compensation for the extraction of the production activity in the electrical systems in the non-peninsular territories foreseen for 2014 amounts to 1,806,000 thousand euros. 50 percent of this amount will be funded from the 2014 State General Budget, according to the provisions of the additional 15th of Law 24/2013, of December 26.
Article 10. Access tolls.
1. The prices of the terms of power and active energy of application from the entry into force of this order for each of the access tolls defined in Chapter VI of Order ITC/1659/2009 of 22 June, establishing the the mechanism for the transfer of customers from the market at tariff to the supply of last electric energy resource and the procedure for the calculation and structure of the rates of last resort of electric power, in Royal Decree 647/2011, of 9 May, by the system load manager activity is regulated for reloading services energy and in Royal Decree 1164/2001 of 26 December 2001 establishing tariffs for access to the transmission and distribution networks of electrical energy are those set out in Annex I to this order.
2. The coefficients for the calculation of transport and distribution losses, for each access toll, to transfer the energy supplied to consumers at a voluntary price for the small consumer and consumers on the market in their Energy meters supplied in central bars for the purposes of the liquidations provided for in Royal Decree 2017/1997 of 26 December, for which the procedure for the settlement of transport costs is organised and regulated, and marketing at tariff, the permanent costs of the system and the costs of diversification and security of supply and in the Royal Decree 2019/1997, of December 26, for which the Market for the Production of Electrical Energy is organized and regulated, are the contents in Annex III of this order.
Additional disposition first. Settlement of the costs of island and extra-island electricity systems.
By virtue of the provisions of the transitional provision sixteenth of Law 24/2013 of 26 December, the National Markets and Competition Commission or, as the case may be, the body in charge of liquidations, shall include in the (a) the costs of the activities and costs of the electricity system of the year 2013 as a whole of the amount of the island and extra-island compensation as provided for in Article 3.2 of Order IET/1491/2013 of 1 August 2013; review the electricity access tolls for their application as of August 2013 and for which they are review certain fees and premiums for the special scheme facilities for the second quarter of 2013.
Additional provision second. Application of the medium-term availability service.
The medium-term availability service defined in Order ITC/3127/2011 of 17 November, which regulates the availability of power of payments for capacity and changes the incentive for investment to with reference to Annex III to Order ITC/2794/2007 of 27 September 2007 for the review of electricity tariffs from 1 October 2007, will be applicable for the period of one year from 1 January 2014.
The period referred to in the preceding paragraph may be adapted according to the regulatory development of the capacity mechanisms referred to in Article 14 of Law 24/2013 of 26 December.
Additional provision third. Mandates to Red Electrica de España, S.A. as operator of the system.
1. Within two months of the entry into force of this order, Red Electrica de España, S.A., as the system operator, will draw up and send to the Ministry of Industry, Energy and Tourism a proposal for a methodology for calculating the the strength coefficients of each of the electrical energy production technologies, which shall be established taking into account the contribution to the coverage of the system demand tip according to historical values, as well as a value concrete coefficients of firmness obtained as a result of applying this methodology.
2. In addition, the system operator shall include a proposal for a methodology for the allocation of costs corresponding to the remuneration of the availability service between marketing and direct consumers on the market and the holders of the production facilities, differentiating a payment for each of the technologies. In the case of production facilities, the firmness of each of the technologies shall be taken into account from the calculations made in accordance with paragraph 1 above of this provision.
This methodology may be applicable for the distribution of the fixed costs of the service of management of the demand for interruptibility regulated in Order IET/2013/2013 of 31 October.
Additional provision fourth. Liquidations to be carried out by Red Electrica de España, S.A. as operator of the system.
From January 1, 2014, the liquidations to be performed by the system operator shall be in accordance with the provisions of Article 18 and the transitional provision of Law 24/2013 of 26 December.
For these purposes, the system operator shall declare on a monthly basis to the settlement body the amounts corresponding to those persons who are receiving the payment of their remuneration through the said operator and from the different cost items in the system. Such amounts shall be taken into account in the general settlement procedure.
In the event that the funds transferred by the body in charge of the liquidations to the System Operator after the provisions of Article 18 have been applied and the transitional provision of Law 24/2013 of 26 of 26 December, do not cover the total amount of the settlement communicated by the said operator, these funds shall be prorated among the subjects concerned, in accordance with the provisions of Article 19.3 of that law.
Additional provision fifth. Allocation of costs in the accounts for the financial year 2013.
The amounts to be borne by the electricity system during the financial year 2014 as a result of the execution of previous judicial decisions shall be considered, as long as their credit is paid up to the additional liquidation of the financial year 2013, as referred to in paragraph 1 of the additional 20th of Law 54/1997 of 27 November 1997, of the Electricity Sector, as amended by Law 24/2013 of 27 December, as costs of the system from that financial year 2013.
First transient disposition. Consumers who are not entitled to the voluntary price for the small voluntary price for the small consumer, are temporarily lacking a supply contract in force with a marketer and continue to consume electricity.
The price to be paid by customers without the right to avail themselves of the voluntary price for the small consumer, and who are temporarily lacking a supply contract in force with a marketer and continue to consume electricity, for the electricity consumed to the reference marketer shall be the one corresponding to the application of the voluntary price billing for the small consumer without application of the time discrimination modality, increasing its terms by 20 percent.

1. In accordance with the provisions of Article 14.11 of Law 24/2013 of 26 December, and until the development of the methodology referred to in that Article, the overall amount determined for the remuneration of the IMO-Spanish Polo Company, S.A. for the year 2014 will be 14,568 thousand euros.
According to the provisions of Article 13.3.l) of Law 24/2013 of 26 December, the difference, positive or negative, between the amount resulting from the collection to the agents of the production market and the The following paragraph shall be considered as an income or a liquidable cost and shall be included in the process of liquidations of the electricity system managed by the body responsible for the settlement of the closure of the exercise 2014.

As from the entry into force of this order, electricity producers operating in the field of the Iberian Electricity Market will pay the Market Operator for each of the net power plants or installed in the market. the renewable case, cogeneration or waste, with a primary or specific remuneration scheme of more than 1 MW, a fixed monthly amount of EUR 8,75/MW of available power.
For the calculation of the available power, the value of the coefficient shall be applied to the net power or installed in the case of renewable technologies, cogeneration and waste with primary or specific remuneration for each installation. the availability of the applicable regime and technology, as set out in the table below:

3. As from the entry into force of this order, traders, direct consumers on the market and system load managers, acting in the field of the Iberian Electricity Market will pay the Market Operator 0.02481 euros. for each MWh listed in the last hourly schedule of each hour.
4. The payments as set out in points 2 and 3 shall be made on a monthly basis according to the market operator's calendar of liquidations.
5. For agents selling and buying energy on the market, the Market Operator may execute the monthly payment of the month to be paid by such agents, or their representatives, by incorporation into the charges and payments from the market. market not before the first day of collection after the third working day of the month n + 1. To this end, the agents or their representatives must send the Market Operator the data necessary for the billing.
6. Transitional provision third. Remuneration and financing of the system operator.
1. In accordance with the provisions of Article 14.11 of Law 24/2013 of December 26, and until the development of the methodology referred to in that article, the overall amount determined for the remuneration of Red Electrica de España, S.A. As the operator of the corresponding system for the year 2014 will be of 56,000 thousand Euros.

According to the provisions of Law 24/2013 of December 26, and in coherence with the provisions of Article 7 of Order IET/221/2013 of 14 February 2013, establishing the access tolls from 1 January 2013 and the fees and premiums of the special scheme facilities, the remuneration set out in the first subparagraph of this point shall be assumed equally by all the electricity producers located in the national territory. on the one hand, and on the whole of marketers, direct consumers on the market and charge managers of the system operating in the national geographical area.
3. As from the entry into force of this order, electricity producers located in the national territory shall pay the operator of the system for each of the net power plants, or installed by CIL in the case of the installation of renewable technologies, cogeneration and waste with a primary or specific remuneration of more than 1 MW a fixed monthly amount of EUR 38.43/MW of available power.
For the calculation of the available power it shall apply to the net or installed power, in the case of renewable technologies, cogeneration and waste with primary or specific remuneration, of each installation the value of the coefficient the availability of the applicable regime and technology, as set out in the table below:

4. From the date of entry into force of this order, traders, direct consumers on the market and system load managers acting on a national geographical basis shall pay the system operator EUR 0,10865 for each MWh which figure in the last hourly operating schedule.
5. The payments as set out in paragraphs 3 and 4 shall be made on a monthly basis according to the system operator's calendar of settlements.
The system operator may execute the monthly payment of the month to be made by such subjects, or their representatives, by incorporation into the collections and payments from the settlements that correspond not to the first day of charges after the third working day of the month n + 1. To this end, the subjects or their representatives shall send the system operator the data necessary for the billing.
6. The prices to be applied until the entry into force of this order into the generators and to the traders, direct consumers on the market and system load managers shall be those laid down in Article 7.3 and 7.4, as appropriate, of the Order IET/221/2013 of 14 February 2013 establishing the access tolls from 1 January 2013 and the fees and premiums of the special scheme facilities.
7. The amounts provided for in this provision may be amended once the methodology laid down in Article 14.11 of Law 24/2013 of 26 December is adopted.
Transitional disposition fourth. Methodology for access to cross-border infrastructures, and procedures for allocating capacity and managing congestion in international interconnections.
Until the time when the National Markets and Competition Commission approves by Circular the methodology for access to cross-border infrastructures, including procedures for allocating capacity and manage congestion in the interconnections in accordance with the provisions of Law 3/2013 of 4 June, of the creation of the National Commission of the Markets and the Competition, these procedures will be in accordance with the provisions of the annexes of the Order ITC/4112/2005 of 30 December 2005 laying down the arrangements applicable to the implementation of intra-Community and international trade in electrical energy, and in the relevant operating procedures and market rules. Such methodology may include aspects relating to the provision of cross-border balancing services.
Transient disposition fifth. Tariffs and premiums applicable to installations for the production of electrical energy from renewable energy sources, cogeneration and waste.
