Royal Decree 1837/2008 of 8 November incorporating Directive 2005 /36/EC of the European Parliament and of the Council of 7 September 2005 and Directive 2006 /100/EC of the European Parliament and of the Council into the Spanish legal order of 20 November 2006 on the recognition of professional qualifications, as well as certain aspects of the exercise of the profession of lawyer, incorporates Directive 2005 /36/EC of the European Parliament into Spanish law and the Council, of 7 September, and Council Directive 2006 /100/EC of 20 December November 2006, establishing for nationals of the Member States of the European Union, the right to pursue a profession, on a self-employed or employed basis, in a Member State other than that in which they have acquired their qualifications professionals.
Both the national standard and the directives transposing it, depart from the Community principle of the freedom to provide services and, as a consequence of this principle, both national and Community rules, include, inter alia, the necessary and essential requirements which may be required by the host State for the service provider to move to its territory on a temporary or occasional basis.
In this way, Article 13 of Royal Decree 1837/2008 of 8 November, which transposes Article 7 of Directive 2005 /36/EC of 7 September, provides that, prior to the first posting, the service provider it must inform the competent authority of the provision it intends to make by submitting a declaration to the Spanish competent authority.
Article 13 (2) (b) of Royal Decree 1837/2008, cited above, provides that the person concerned will give a description of the services to be provided, making particular reference to the duration of the services, its continuity and its periodicity. This requirement for the duration of the service is not included in Directive 2005 /36/EC, and it is excessive and disproportionate to require the migrant to anticipate and plan his or her professional activities in order to inform the Spanish authorities in the framework of the prior declaration.
Furthermore, Annex VIII to Royal Decree 1837/2008 of 8 November covers the relationship of professions and activities for the purposes of the application of the system of recognition of qualifications. In point 1 of the said Annex, the professions are related according to the different levels of training required and described in the various paragraphs of Article 19 of the Royal Decree 1837/2008 of 8 November. In particular, in relation to the professions that require a level of training described in Article 19.3, the Delineant figure, which according to what was indicated in the Pilot Project 824 /10//MARK that has given rise to the procedure of Infraction PI -Letter of Formal Notice 2013/4108, the Law on Professional Services and Colleges is hereby approved on a level of training provided for in Article 19 (2). This inclusion in a separate section of the Delineant profession is also different from the levels of training provided for in Article 11 of Directive 2005 /36/EC of 7 September.
Furthermore, on 10 June 2013, the Council Directive 2013 /25/EU of 13 May 2013 was published in the Official Journal of the European Union, adapting certain directives in the field of the right of establishment and of the freedom to provide services, on the occasion of the accession of the Republic of Croatia. The directives to be adapted include Directive 2005 /36/EC of 7 September on the recognition of professional qualifications and Directives 77 /249/EEC and 98 /5/EC on the legal professions.
The Council of Ministers agreed on 21 June 2013 on the application in Spain of the two-year transitional period provided for in point 2 (2) of Annex V to the Act of Accession of the Republic of Croatia to the European Union. on the access of Croatian nationals to the labour markets of the Member States. That period may be extended in accordance with the provisions of the Act of Accession.
It is therefore necessary to proceed with the amendment of Royal Decree 1837/2008 of 8 November, in order to bring its provisions into line with Community requirements for the freedom to provide services, as well as to transpose In part, Directive 2013 /25/EU of 13 May, in particular Parts A and B of its Annex, concerning the amendments to be made by the accession of Croatia to the European Union, are made in Directives 2 0 0 5/3 6/EC, 77 /249/EEC and 98 /5/EC.
As a result of this last objective, the Royal Decree 607/1986 of March 21, of the Council of the European Communities, of 22 March 1977, was amended, as follows: to facilitate the effective exercise of the freedom to provide services of lawyers and Royal Decree 936/2001 of 3 August, governing the permanent exercise in Spain of the profession of lawyer with professional qualifications obtained in another Member State of the European Union.
To ensure that the transposition of Part A of the Annex to Directive 2013 /25/EU of 13 May is correct, the last indent of paragraph 2 (iii) of Directive 2013 /25/EU is to be incorporated, concerning the amendment of the 'Medical Genetics' table, including the reference to Croatia. However, currently in the text of Royal Decree 1837/2008 of 8 November, this table is not provided for, as it was included in Directive 2005 /36/EC of 7 September by Regulation (EU) 213/2011 of the Commission of 3 March.
Therefore, in spite of the direct applicability of the Regulations, with the objective of successfully transposing Part A of the Annex of the directive 2013 /25/EU and at the same time, for a greater and better compression of the norm, by the This royal decree includes the table of 'Medical Oncology' and 'Medical Genetics' in the Annex to Regulation (EU) No 213/2011 of 3 March amending Annexes II and V to Directive 2005 /36/EC of 7 September 2005, on the recognition of professional qualifications.
In the handling of this royal decree, the Ministry of Finance and Public Administrations has been informed and the autonomous communities, the Economic and Social Council, and the professional corporations have been consulted.
In its virtue, on a joint proposal of the Ministers of Education, Culture and Sport, of Foreign Affairs and Cooperation, of Justice, of Defense, of Economy and Competitiveness, of the Interior, of Promotion, of Agriculture, Food The Committee of the Regions on the Environment, Employment and Social Security, the Presidency, Health, Social Services and Equality, and Industry, Energy and Tourism, in agreement with the Council of State and after deliberation by the Council of Ministers at its meeting on 21 March February 2014,
DISPONGO:
Article 1. Amendment of Royal Decree 1837/2008 of 8 November incorporating Directive 2005 /36/EC of the European Parliament and of the Council of 7 September 2005 and Directive 2006 /100/EC of the Council of 20 December 2005 on the Spanish legal system November 2006, concerning the recognition of professional qualifications, as well as certain aspects of the profession of lawyer.
The Royal Decree 1837/2008 of 8 November is amended, incorporating Directive 2005 /36/EC of the European Parliament and of the Council of 7 September and Directive 2006 /100/EC of the European Parliament and of the Council on the Council of 20 November 2006 on the recognition of professional qualifications, as well as certain aspects of the profession of lawyer, in the following terms:
1) The wording of Article 13 (2) (b) concerning the "advance declaration in cases of posting" is worded as follows:
"(b) The person concerned shall provide a description of the services to be provided."
2) In Article 66 (1), concerning the "specific acquired rights of architects for the existence of a professional certificate", paragraph (c) is amended and a new paragraph (d) is added with the following wording:
" c) On July 1, 2013, for Croatia.
(d) On 5 August 1987, for the other Member States. "
3) In Annex V, concerning the "recognition based on the coordination of minimum training conditions", the following modifications are introduced:

Article 3. Amendment of Royal Decree 936/2001 of 3 August regulating the permanent exercise in Spain of the profession of lawyer with professional qualifications obtained in another Member State of the European Union.
Article 2 of Royal Decree 936/2001 of 3 August 2001 regulating the permanent exercise in Spain of the profession of lawyer with a professional title obtained in another Member State of the European Union is amended. point (a) is worded as follows:
