Article 39 of Le and 8/2003 of 24 April of animal health provides for the compulsory identification of animals in accordance with the provisions of European Community legislation or the established system. The government is regulated. Furthermore, in the third additional provision states that the provisions of this law, when they affect animals attached to the Ministries of Defence and the Interior and their public bodies, shall be applied by the competent bodies of the aforementioned bodies. departments.

Due to this, the Order of the DEF/2625/2005 of 18 July, establishing the rules for the registration, identification and control of dogs in the Armed Forces, as well as sanitary measures for the prevention of diseases and zoonoses transmissible by these animals.

Article 12 of Law 33/2011 of 4 October, General of Public Health establishes in point 2 that public health surveillance will take into account, among other factors, communicable diseases, including zoonoses and emerging diseases. In addition, in its second provision, the second point is that in the field of the Armed Forces, the General Inspection of Defense Health, as the health authority of the department, will carry out the necessary actions to fulfill its obligations. provisions and of those that are consistent.

Since the entry into force of Order DEF/2625/2005 of 18 July, it has become apparent that certain aspects of this rule are not sufficiently developed and there are others to be deleted, taking into account the purpose and purposes of Law 8/2003 of 24 April, of which it is published.

On the other hand, the development of new systems that allow to handle information from the Ministry of Defense with a specific classification degree and under certain conditions of confidentiality, integrity and availability, make it necessary for data collected in a computerised central register to be integrated into such systems, thereby protecting against accidents or illicit actions that could lead to their loss and allowing access to such data from the competent bodies of the Ministry of Defence, for monitoring, updating and exploitation.

It is therefore necessary for the Ministry of Defense to draw up rules for the management of its canine agents by adapting to the new technological means available.

In its virtue, I have:

Article 1. Purpose.

This ministerial order aims to establish measures for the registration, identification and sanitary control of dogs belonging to the Ministry of Defense.

Article 2. Scope.

This ministerial order will apply to the canine agents of all the units, centers and agencies (UCO, s) of the Ministry of Defense.

Article 3. Registration and identification of dogs.

1. The Canine Sanitary Registry of the Defense is constituted, hereinafter "Registration", which will depend on the General Inspection of Health of the Defense, for the sanitary control and identification of the dogs belonging to the Ministry of Defense.

2. All dogs that pass on to the Ministry of Defense, regardless of their origin (purchase, breeding or donation) and after approval by the competent authority of the Headquarters or the corresponding Steering Center, according to to the operational requirements of the different UCO.s. subject to, they shall be entered in the Register, in which all data determined by the General Inspection of Defence and which are of interest to its health and identification control shall be collected.

3. The Registry will be constituted in a database that will be integrated into the Military Health Information System within the general corporate wide area network of general purpose, maintained by the Corporate Center for the Obtention and Maintenance of the Information Systems of the Ministry of Defense. It shall be managed by the General Inspection of Defence Health and updated by the Health Directorates of the Armies and the Head of Health or equivalent bodies of those other independent units and self-employed bodies. have dogs. The General Inspection of Defense Health shall establish the levels of access to the information contained in the Register and authorize the access of those departments of the department with responsibility for the tasks of management of the personnel. canines.

4. The identification by implantation of microchip, approved according to ISO standards or other standards specifying the current State regulations, will be mandatory in all dogs from the age of three months.

The responsible military veterinarian will proceed to the implantation of the microchip when the corresponding sanitary document is accurate and diligent, requesting both in good time to the General Inspection of Health the Defence or bodies in which it delegates.

Article 4. Identity document.

1. The passport of the European Union for pet animals, hereinafter referred to as a passport, the model of which was established by Commission Decision 2003 /803/EC of 26 November 2003 establishing a model of passport for the Intra-Community movements of dogs, cats and ferrets shall be the official identity document of the dog at the service of the Ministry of Defence.

2. The passport will be guarded by the dog responsible, and must be presented when required by the military or civil health authorities. It shall also be provided to the veterinarian responsible for animal health care to ensure that clinical data, treatments, vaccinations and any other information are necessary.

3. In case of loss of the passport, the competent health bodies referred to in Article 5.1, subject to the supporting report, may issue a duplicate.

Article 5. High and low dogs in the Canine Sanitary Registry of Defense.

1. The competent health bodies to authorise the high and low dogs in the Register and to update the data contained in it are:

a) Health Addresses for Armies.

b) General Inspection of Defence Health for units dependent on the central organ of the Ministry of Defence.

c) Health or equivalent organs for the rest of the UCO.s.

2. The head of the UCO in which the animal is to provide service shall request the competent health authority to discharge it in the Register, with the appropriate veterinary certificate of aptitude and, where appropriate, a copy of the health documentation. After checking the documentation provided, the applicant's registration and notification shall be made to the applicant UCO.

3. Where the dog ceases to serve in the Ministry of Defence by death, loss of fitness, sale or auction as a result of a reduction in the number of canine agents, or any other cause, the head of the UCO shall forward the request for on the Register to the competent health authority, accompanied by a veterinary certificate specifying in detail the reason for the origin, together with a copy of the passport. Once the documentation provided has been verified, the registration will be recorded and the applicant UCO will be notified. In the event that the discharge is due to the death of the animal or its loss, the applicant UCO shall return the passport to the competent body.

4. When an army/body maintains a dog, following its loss of fitness, on the basis of its meritorious activity developed over time of service in the Ministry of Defence, that dog shall continue to be registered in the Register until its death or change of ownership.

5. Where the change of ownership of a dog involving an animal identification civil registry occurs, both parties must comply with the procedures legally established by the civil health authorities of the autonomous communities. respective. The original holder of the dog shall also accompany the documentation to deliver a certificate of absence in the relevant register.

6. In the event that the discharge or discharge in the Register is not approved, the competent body shall return the file to the applicant UCO, duly justifying its decision.

7. When a dog is lost, the head of the UCO shall report such disappearance to be carried out in order to search and locate the dog. If after 15 days, the dog has not been located, the Head of the UCO shall request the animal's discharge, notifying the fact to the competent body to record such a vicissitude in the Register.

Article 6. Change of destination.

1. When a dog's change of destination occurs, the receiving UCO shall notify the competent body for entry in the Register.

If the change takes place between units of different armies or agencies, once approved by the authorities involved, the UCO of destination will notify the General Inspection of the Health of the Defense, through its organ competent, for logging.

2. The armies, units dependent on the central organ, and autonomous bodies shall determine the bodies responsible for the authorisation of the changes of destination of the canine agents.

Article 7. Conditions of aptitude for the acquisition and employment of the dogs of the Ministry of Defense.

The General Inspection of Defence Health may establish technical standards, definition of breeds, animal characteristics, additional health controls and other specifications for the acquisition of dogs by the Ministry of Defense. It will also determine the functional or organic disorders that can motivate your loss of fitness.

Article 8. Hygiene-sanitary care.

1. The staff responsible for the care of the dog or the guide, if assigned, shall comply with all the obligations laid down in Article 7 of Law 8/2003 of 24 April of animal health for the prevention of disease in the canines, asking the competent health authority for the regulatory pipeline, which is necessary for such compliance. In the event of any infringement of the provisions of that law, it shall be subject to the corresponding penalties provided for therein.

2. All dogs of the Ministry of Defense shall be vaccinated and dewormed in accordance with the health protocols established by the General Inspection of Defense.

3. Every dog belonging to the Ministry of Defence shall be vaccinated against rabies from the age of three months and shall be revaccinated on a compulsory basis annually. Where it is not possible to vaccinate against rabies, due to any clinical contraindication, it shall be duly justified by the official veterinary certificate.

4. All such actions shall be recorded in the corresponding section of the passport by the veterinarian who carries them out.

5. The competent bodies shall record all the health-care data collected in the Register.

Single additional disposition. Directive powers.

The Assistant Secretary of Defense and the Inspector General of Defense Health will take the necessary instructions for the implementation of this ministerial order.

Single transient arrangement. Recognition of canine sanitary documents.

Any canine health card issued prior to the date of publication of this ministerial order shall remain in force as a sanitary document until the animal is discharged from the register, and must in any case be replaced by the passport when the animal is to be sent outside the national territory.

Single repeal provision. Regulatory repeal.

1. Order DEF/2625/2005 of 18 July, establishing the rules for the registration, identification and control of dogs in the Armed Forces, as well as sanitary measures for the prevention of communicable diseases and zoonoses, is hereby repealed. for these animals.

2. Similarly, any provisions of equal or lower rank shall be contrary to the provisions of this ministerial order.

Single end disposition. Entry into force.

This ministerial order shall enter into force on the day following that of its publication in the "Official State Gazette".
