The changes in the basic organic structure of the Ministry of Agriculture, Fisheries and Food as a result of the enactment of the Royal Decrees 839/1996 of 10 May, establishing the structure basic organic structure of various ministerial departments, and 1890/1996 of 2 August, of basic organic structure of the Ministry of Agriculture, Fisheries and Food, among which the abolition of the General Secretariats of Agriculture, Rural Development and Conservation of Nature, and Food, as well as that of the Directorates-General for Services and Economic and Budgetary Analysis which were directly attached to the Secretariat and, on the other hand, the assumption by the Ministry of the Environment of the In the case of nature conservation, they have been directly and radically affected by the very existence or, at least, the composition of many of the collegiate bodies set up in this ministerial department.

For that reason, the Order of 9 October 1996 attributed to the Technical General Secretariat and to its holder the powers that the late Director General of Services exercised in the Ministerial Commission of Informatics of the Ministry. In addition, the orders of this Ministry of 6 March and 8 May 1997, respectively, have been the Publications Advisory Commission and the Ministerial Commission for the introduction of the euro.

It is also necessary to adapt to this new structural situation the composition of several other collegiate bodies formed within the Central Services of the Ministry, having been totally out of date. This adaptation to the current organic structure of the same is the one that requires updating the components of the National Committee of the National Agrarian Network that act on behalf of the Department.

Finally, it is necessary to comply with the provisions of Article 13 of Royal Decree 208/1996 of 9 February, which regulates the services of administrative information and attention to the citizen, and constitute, without further delay, the Administrative Information Commission of the Ministry of Agriculture, Fisheries and Food, with the composition, functions and operating arrangements that are determined in the above.

In its virtue, and after the approval of the Minister of Public Administrations, I have:

First. Establishment of the Ministerial Information Commission of the Ministry of Agriculture, Fisheries and Food (MAPA).

The plenary session of the Ministerial Information Committee of the Ministry of Agriculture, Fisheries and Food, provided for in Article 13 of Royal Decree No 208/1996 of 9 February 1996, shall be composed of the following: members:

(a) President: The Undersecretary of Agriculture, Fisheries and Food.

b) First Vice-President: The Technical Secretary-General.

c) Second Vice President: The Deputy Secretary-General.

d) Vocals: The Head of the Technical Cabinet of the Assistant Secretary, the Inspector General of Services, the Deputy Directors-General for Support and Coordination of the General Secretariat for Agriculture and Food and Maritime Fisheries, the Deputy Director-General for General Affairs of the Directorate-General for Rural Planning and Development and the Secretaries-General of the autonomous bodies attached to the MAPA.

The Undersecretary may also decide to participate in the meetings of the Commission, with the character of Vocals, those officials whose assistance is advisable for the subjects to be dealt with.

e) Secretary: An official of the administrative information area designated by the Undersecretary, who will speak with voice and vote.

The Commission may also act in the Permanent Commission, with the composition fixed for the latter in point 4 of Article 13 of Royal Decree 208/1996, and will develop, among others, the specified functions. in point 1 of that provision, by adjusting its action and legal status to the provisions of Section 3 of Chapter II of the Royal Decree and to Chapter II of Title II of Law No 30/1992 of 26 November 1992 on the legal framework of the Public administrations and the Common Administrative Procedure.

Second. Commission of Remuneration.

The first, third and sixth paragraphs of the Order of 27 February 1992 are worded as follows:

" First. -The Committee on Remuneration of the Ministry of Agriculture, Fisheries and Food will have the following composition:

a) President: The Assistant Secretary of the Department.

(b) Vocals: The Secretaries-General of Agriculture and Food and Maritime Fisheries, the Technical Secretary-General, the Directors-General of the Secretaries-General of the Ministry, the Directors of the Autonomous Bodies assigned to it, the Financial Controller of the General Intervention of the State Administration, the Chief of the Technical Cabinet of the Assistant Secretary and the Deputy Directors General of the General Staff and the Office of the Budget Office of the Department.

c) Secretary: The Deputy Director-General of Personnel, who will act with voice and vote. "

" Third. -Under the immediate dependency of the Committee on Remuneration is created an Executive Committee, which will be composed of the following members:

(a) President: The Chief of the Technical Cabinet of the Assistant Secretary.

(b) Vocals: The Deputy Directors-General for Support and Coordination of the General Secretariat for Agriculture and Food and Maritime Fisheries, the Deputy Director-General for General Affairs of the Directorate-General for Planning and Rural Development, the Deputy Director-General of Planning of the Directorate-General for Food Policy and Agricultural and Food Industries, the Deputy Secretary-General, the Deputy Directors-General of the General Inspectorate for Services, Office Major and Budgetary Office, and the General Secretaries of the agencies self-employed by the Department, as well as the Financial Controller of the General Intervention of the State Administration.

c) Secretary: The Deputy Director-General of Personnel, who will speak with voice and vote.

The meetings of the Executive Committee may be attended by a representative, with voice and vote, of the management centre to which the matter is concerned, designated by the corresponding Director-General among the officials assigned to the Executive Committee. itself. "

" Sixth. -Without prejudice to the peculiarities provided for in this Order, the Committee on Remuneration of the Ministry of Agriculture, Fisheries and Food and its Executive Committee shall be governed by the provisions of the The Court of Justice of the European Communities, in Chapter II of Title II of Law 30/1992, of 26 November 1992, of the Legal Regime of Public Administrations and of the Common Administrative Procedure. '

Third. Commission of Laboratories and Methods of Analysis.

The Coordinating Committee of Laboratories and Methods of Analysis, created by Order of 18 May 1976, will have the following membership, composition and functions:

1. The Coordinating Committee of Laboratories and Methods of Analysis, attached to the General Secretariat of Agriculture and Food of the Ministry of Agriculture, Fisheries and Food, is composed of the following members:

(a) President: The Secretary General of Agriculture and Food.

(b) Vocals: The Assistant Directors-General for Analysis, Quality and Agri-Food Standardization, Agri-Food Industries, Quality And Planning Denominations, all of them from the Directorate-General for Food Policy and Agricultural and Food Industries.

The Deputy Director General of Semillas and Plants of the General Directorate of Agricultural Productions and Markets.

The Deputy Directors-General for Plant Health and Animal Health of the General Directorate of Health for Agricultural Production.

Deputy Director-General of Coordination of the Directorate-General for Rural Planning and Development.

A representative, with the category of Deputy Director General, of the General Secretariat for Maritime Fisheries.

The Deputy Director-General for Research and Technology of the National Institute of Agricultural and Food Research and Technology (INIA).

A representative, with the category of Subdirector general, of the Spanish Agricultural Guarantee Fund (FEGA).

A representative of the Spanish Institute of Oceanography (IEO), appointed by its Director among its technical officials.

A representative of the Olive Oil Agency (AAO), appointed by its Director among the technical officials of the Agency.

The Director of the Center for Animal Health Research (CISA) of INIA.

The Directors of the Agri-Food Arbitration Laboratory and the Agro-Food Laboratory of Santander.

The Directors of the Animal Health and Production Laboratories of Algete (Madrid) and Santa Fe (Granada).

A representative of each of the Autonomous Communities who wish to be part of the Commission, appointed by the respective Counsellor with competence in the field.

(c) Secretary: An official, with the category of Head of Service, of the General Sub-Directorate of Analysis, who will act with voice and vote.

The Commission will operate in plenary and in the Executive Committee, exercising the functions entrusted to it by the plenary.

The Executive Commission will act under the chairmanship of the Deputy Director General of Analysis, the Directorate General for Food Policy and Agricultural and Food Industries, and will be composed of five Vocals appointed by the Executive Committee. Plenary session between the representatives of the Ministry of Agriculture, Fisheries and Food and five other elected representatives of the Autonomous Communities, themselves, at the constituent assembly of the plenary session. He will act as Secretary of the Assembly of the Coordinating Committee.

2. They will be the functions of the Coordinating Committee of Laboratories and Methods of Analysis:

a) Coordinate the activities of the different laboratories of the State, in accordance with the competencies attributed to each one of them, harmonizing the use of human and material means, as well as the acquisition of these last.

b) Monitor the execution functions that are of their own to each laboratory of the State, through previous studies.

c) Unify and update the analytical methods to be used in the official laboratories. To this end, the Secretary-General for Agriculture and Food, acting on a proposal from the Commission, shall appoint the relevant Working Groups.

(d) Ensure the participation in these Working Groups of specialists from the Central Administration and Autonomous Communities, as well as from public and private entities based on greater experience and superior knowledge of the techniques to be studied. It will also facilitate the carrying out of collaborative and contrast analysis between the official laboratories represented.

e) Propose, for approval, the methods of analysis to be applied by all official laboratories.

f) Establish and enhance the necessary contacts with national and international organizations for the study of methods of analysis. It will also keep up to date national and international documentation and information regarding laboratories and methods of analysis.

(g) The Commission shall also be aware of the functions in which the State Administration and the Autonomous Communities are to participate, cooperate and collaborate in the field of agri-food and animal health and production laboratories, according to the Royal Decrees of transfers.

3. The functioning of the Commission, whether acting in plenary or in the Executive Committee, shall be governed by the provisions of Chapter II of Title II of Law No 30/1992 of 26 November 1992 on the legal framework of public and public administrations. Common Administrative Procedure.

The Ministerial Commission may approve the rules of internal rules it considers to be necessary for the best development of its work.

Fourth. Commission of Management and Monitoring of the marine reserves of the island of Tabarca and of the islands Columbretes.

The Commission for the Management and Monitoring of the Marine Reserve on the island of Tabarca, set up by Article 2 of the Order of 15 June 1988, and the Commission on the Management and Monitoring of the Marine Reserve of the Columbretes Islands, established by Article 5 of the Order of 19 April 1990, shall be chaired by the Director-General of Fisheries Resources of the General Secretariat for Maritime Fisheries.

Fifth. Maritime Fisheries Advisory Board and Local Fisheries Boards.

They are declared extinct, expressly, the Local Fisheries Boards, as well as the Maritime Fisheries Advisory Board, whose competencies have been assumed by the Sectoral Fisheries Conference.

Additional disposition. National Committee of the National Agricultural Network.

The Vowels representatives of the Ministry of Agriculture, Fisheries and Food in the National Committee of the National Agricultural Network, created by Royal Decree 1417/1986 of 30 May, will be the Deputy Director General of Statistics of the Technical General Secretariat, the Head of the Microeconomic Analysis Service of the abovementioned General Statistics Subdirectorate, and another official of the same, in place of at least the Head of Service, who shall act as the Secretary of the Committee, with voice and vote.

Transitional disposition. Purchasing Board of the Ministry of Agriculture, Fisheries and Food.

Until the Board of Contracting of the Ministry of Agriculture, Fisheries and Food is regulated, in accordance with Law 13/1995 of 18 May, and Royal Decree 390/1996 of 1 March, the Board of Purchasing of the same, with the powers laid down in the first Article of the Order of 6 March 1992, and the following updated composition, so that the said precept shall be drawn up in this way:

" Article 1.o 1. Attached to the Secretariat, and in accordance with the provisions of Article 2 of Decree 3186/1968 of 26 December 1968, and in the transitional provision of Law 13/1995, of 18 May, of Contracts of Public Administrations, the Board of Directors Department Purchasing shall be composed of the following members:

(a) President: The Undersecretary of Agriculture, Fisheries and Food.

b) Vice President: The Deputy Director-General, Senior Officer of the Department, who will replace the President in cases of vacancy, absence, illness or material impossibility.

c) Vocals: The Head of the Technical Cabinet of the Deputy Secretary, the Deputy Directors-General for Support and Coordination of the General Secretariat for Agriculture and Food and Maritime Fisheries, the Deputy Director-General for General Affairs of the Directorate-General for Rural Planning and Development, the Deputy Director-General for Planning of the Directorate-General for Food Policy and Agricultural and Food Industries, the Deputy Secretary-General, the Deputy Director-General of Computer science and two officials assigned to the General Staff, appointed by the Deputy Secretary-General at the Deputy Director-General.

d) Secretary: The Chief of the Recruitment Unit of the General Staff, who will act with voice and vote.

2. Whenever the Purchasing Board is to act as a Contracting Board, a State Advocate of the Department of the Legal Service of the Department and a delegate of the General Intervention of the Administration of the State. '

Repeal provision.

The Orders of 18 May 1976, for which the Coordinating Committee of Laboratories and Methods of Analysis was established, and the Commission of 17 September 1982, which updated its composition, and amended paragraphs 1, 3, 3 and 3, were repealed. and 6.o of the Order of 27 February 1992, and Article 1 of the Order of 6 March 1992.

Final disposition.

This Order shall enter into force on the day following that of its publication in the Official Gazette of the State.
