The Organic Law 1/1990 of 3 October of General Ordination of the Educational System, in Title II, Chapter I, establishes an extensive regulation of the artistic teachings which, with respect to its previous situation, implies a a profound transformation that affects the elevation of their academic degrees, while seeking their timely vertebrate in the structure of the educational system.

Royal Decree 986/1991 of 14 July, approving the timetable for the implementation of the new management system of the education system, subsequently amended by Royal Decree 1487/1994 of 1 July 1994, established, inter alia questions, the deadlines for the implementation of the artistic teachings.

However, regarding the implementation of the higher degree of the teaching of Music and Dance, the reflection on the quality model of these studies, to which completion is obtained an equivalent degree to all the The aim of the programme is to extend the period of consultation, contrast and preparation in relation to what is initially planned, and to ensure the highest level of professional qualifications pursued. In terms of the training cycles of Plastic Arts and Design, the aforementioned generalized implementation and, therefore, the configuration of the educational offer map of the network of centers, which must be imparted, requires have completed the process of processing the corresponding titles that make up the entire catalogue of the training cycles of Plastic Arts and Design of medium and higher grade.

In this case it seems more reasonable to adjust the dates of implementation planned for the times that the different educational administrations require in order to develop the respective curricula and the corresponding norms of ordination and centres. In addition, the necessary communication, the sectors concerned, the generic approaches to the new management of this education sector, as regards the quality values it entails and the commitment to ensure a better quality of life, must be carried out. training of future skilled professionals in the field of plastic arts and design, while facilitating the adaptation of these new demands.

At the same time, it is appropriate to specify the timing of the extinction of studies related to the previous ordination of the teaching of applied arts and artistic crafts. Thus, Article 45.1 of Royal Decree 986/1991, of 14 June, established the beginning of the extinction in the same academic year 1997/1998 of the common courses and the specialties of these teachings. In this way, the wording of this precept could be interpreted as the extinction of two academic levels without relation in their formative stages. To avoid this possible confusion, it is necessary to sequence that extinction according to the courses in which these teachings are configured which have been regulated by Decree 2127/1963 of 24 July; by Royal Decree 799/1984 of March 28, or by Royal Decree 942/1986 of 9 May.

The transitional provision of Royal Decree 1004/1991 of 14 June 1991 provides that such approval will be maintained until the end of the 1997/1998 course.

In order not to prejudice the rights of students who in the course of 1997/1998 carry out the first of these lessons, the extension of the type-approval granted in order to enable such students to be able to finish your studies.

Therefore, it is necessary to amend the timetable for the implementation of the new system of education, established by Royal Decree 986/1991 of 14 June, and amended, in turn, by means of the Royal Decree 1487/1994 of 1 July 1994 and the approval of the above mentioned centres in the sixth transitional provision of Royal Decree 1004/1991 of 14 June 1991; for which the reports of the Communities have been taken into account Autonomous regions in the full exercise of their competence in the field of education, as well as that of the Council School of State.

In its virtue, on the proposal of the Minister of Education and Culture, in agreement with the Council of State and after deliberation of the Council of Ministers at its meeting on September 19, 1997,

D I S P O N G O:

Article first.

Articles 28, 31, 38, 40, 45, 47 and 49 of Royal Decree 986/1991 are amended from 14 June, and are worded in the following terms:

" Article 28.

From the academic year 1998/1999, the implementation of the courses of the higher grade will be initiated which, according to the new ordination, will be established. "

" Article 31.

From the 1998/1999 course in which the implementation of the higher level of the new management of the educational system is initiated, students who have already started the middle grade studies as established in the Decree 2618/1966, of 10 September, may choose to continue their studies of higher degree as established in the aforementioned standard or to be incorporated to this degree according to the new ordination. In the latter case, and in accordance with the level shown in the access test, these students may be incorporated in a course other than the first course, provided that the course has already been implemented. "

" Article 38.

From the academic year 1998/1999, the implementation of the higher degree courses will be initiated which, according to the new management, will be established. "

" Article 45.

1. In the academic year 1998/1999, the introduction of the studies corresponding to the medium-grade training cycles and the higher degree courses of Plastic Arts and Design will be initiated.

2. From the academic year 1998/1999, the progressive extinction of the curricula of the common courses of the teaching of Applied Arts and Arts, regulated, respectively, by Decree 2127/1963, July 24, and by Royal Decree 799/1984 of 28 March.

3. From the academic year 2001/2002, the progressive extinction of the curricula of the specialties of the teaching of Applied Arts and Arts, regulated by Decree 2127/1963, of July 24, will begin.

4. From the academic year 2000/2001 will begin the progressive extinction of the curricula of the specialties of the teaching of Applied Arts and Arts, regulated by Royal Decree 799/1984, of March 28, or by the Royal Decree 942/1986 of 9 May. '

" Article 47.

In the academic year 1998/1999, the implementation of the higher design studies will be initiated, which will be determined in a timely manner. In addition, and from this academic year, the introduction of other higher-character studies resulting from the new ordination of these teachings will begin. "

" Article 49.

Until the end of the year 2002/2003 extraordinary tests will be called for obtaining the degree of Graduate in Applied Arts, under the conditions that will be established in due course, for those students affected by the extinction of the plans of studies referred to in Article 45 of this Royal Decree. "

Article 2.

Until the end of the 1998/1999 period, the approvals granted to the centres under the provisions of Articles 35 and 36 of Royal Decree 707/1976 of 5 March on the management of vocational training remain extended until the end of 1998/1999. in order to enable pupils who have completed the first course during the academic year 1997/1998 to finish their studies.

Final disposition first.

This Royal Decree is of a basic nature under the provisions of Article 149.1.30.a of the Spanish Constitution and of the additional provision of the Organic Law 1/1990, of 3 October, of General Ordination of the Educational System.

Final disposition second.

The holder of the Ministry of Education and Culture and the competent body of the Autonomous Communities are empowered to make any precise provisions for the implementation and development of the provisions of this Royal Decree.

Final disposition third.

As soon as this Royal Decree is opposed, paragraph 1 of the additional provision of Royal Decree 617/1995 of 2 April 1995 governing the basic aspects of the curriculum of the higher grade of the Music teachings and proof of access to these studies.

Final disposition fourth.

This Royal Decree shall enter into force on the day following that of its publication in the "Official Gazette of the State".
