By Royal Decree 1283/1987 of 2 October, the functions and services of the State Administration in the field of professional nautical fishing were transferred to the Autonomous Community of Galicia.

At present, it is necessary to carry out an extension of the functions and services that were transferred in the aforementioned Royal Decree, with those corresponding to the issue of cards of Patron de Pesca Local, Mechanic of Litoral, Standard 2.a class of Litoral Fishing, Local Fishing Pattern and Multi-purpose Coastal Pattern.

Royal Decree 581/1982, of 26 July, determines the rules and procedure to be followed by the transfer of functions and services of the State Administration to the Autonomous Community of Galicia.

In accordance with the provisions of the Royal Decree cited, which also regulates the functioning of the Joint Commission of Transfers, provided for in the transitional provision fourth of the Statute of Autonomy for Galicia, this Commission adopted at its meeting on 31 July 1997 the appropriate Agreement, the practical virtue of which requires the Government to approve it by means of a Royal Decree.

In its virtue, in compliance with the provisions of the transitional provision fourth of the Statute of Autonomy for Galicia, on the proposal of the Minister of Public Administrations and after deliberation of the Council of Ministers in its Meeting of the day of 29 August 1997,

D I S P O N G O:

Article 1.

The Agreement of the Joint Committee on Transfers, provided for in the transitional provision fourth of the Statute of Autonomy for Galicia, adopted by the plenary on 31 July 1997, is hereby approved. and services of the State Administration transferred to the Autonomous Community of Galicia by means of Royal Decree 1283/1987, with those corresponding to the issue of cards of Patron of Local Fishing, Mechanic of Litoral, Pattern of 2.a kind of Fishing Littoral, Local Fishing Pattern and Versatile Coastal Pattern, which is transcribed as an annex to the Royal Decree.

Article 2.

Consequently, personal means and corresponding budgetary appropriations are transferred to the Autonomous Community of Galicia, in the terms of the Agreement itself and the annexed relations.

Article 3.

The extension of functions and services referred to in this Royal Decree will be effective from the day indicated in the Agreement of the Joint Commission, without prejudice to the Ministry of Agriculture, Fisheries and Food. produces, until the entry into force of this Royal Decree, where appropriate, the administrative acts necessary for the maintenance of the services in the system and level of operation which they had at the time of the adoption of the Agreement.

Article 4.

The budgetary appropriations to be determined, in accordance with the ratio number 2 of the Annex, will be discharged in the corresponding budgetary concepts and transferred by the Ministry of Economy and Finance to the The Ministry of Agriculture, the Ministry of Agriculture, and the Ministry of Agriculture, said that the concepts set out in Section 32 of the General Budget of the State, intended to finance the cost of the services assumed by the Autonomous Communities, will once be submitted to the Department of Agriculture. Fisheries and Food, the respective certificates of credit retention, to give compliance with the provisions of the current Law 12/1996 of December 30, of the General Budget of the State for 1997.

This Royal Decree will be published simultaneously in the "Official Gazette of the State" and in the "Official Journal of Galicia", taking effect from its publication.

CERTIFICATE

That at the plenary session of the Joint Committee on Transfers, held on 31 July 1997, agreement was adopted on the extension of the functions and services of the State Administration transferred to the Autonomous Community de Galicia by the Royal Decree No 1283/1987 of 2 October 1987 on the issue of the issuing of cards for the Patron de Pesca Local, Mechanic of Litoral, Patron of the 2nd Class of Fisheries Litoral, Local Patron of Fishing and Versatile Coastal Pattern, in terms of The following are expressed:

A) Competences that correspond to the Autonomous Community of Galicia.

B) Services and institutions that are transferred.

The Autonomous Community of Galicia, for the area of its territory, assumes the functions and services of the State Administration corresponding to the issue of cards of Patron de Pesca Local, Mechanic de Litoral, Patron de 2.a class of Litoral Fishing, Local Fishing Pattern and Multi-purpose Coastal Patron, as well as the convalidations that correspond according to the basic regulations of the State.

The exercise of these functions will be carried out in accordance with the criteria established by Royal Decree 662/1997 of 12 May, establishing the minimum requirements for the professional activity of Patron. Local Fishing and Multi-purpose Coastal Patron.

C) Goods, rights and obligations of the Administration of the State to be transferred. There are no goods, rights and obligations in this transfer.

D) Staff assigned to the services and institutions that are transferred.

1. The personal means to be transferred are referred to nominally in the attached relation number 1, and they will become dependent on the Autonomous Community of Galicia in the terms legally provided for by the Statute of Autonomy and other rules in each case. and in the same circumstances as specified in their personnel files.

2. The Ministry of Agriculture, Fisheries and Food will notify interested parties of the transfer, as soon as the Government approves this Agreement by Royal Decree. In addition, a certified copy of all the files of this past staff, as well as of the certificates of haberes referring to the amounts due in 1997, shall be sent to the competent authorities of the Autonomous Community of Galicia.

E) A definitive assessment of the financial burdens of the services being transferred. 1. The definitive assessment of the effective cost, which, in pesetas of 1996, corresponds to the means attached to the services transferred to the Autonomous Community of Galicia rises to 3,151,134 pesetas.

2. The financing, in pesetas of 1997, which corresponds to the effective annual cost of the means that are transferred is detailed in the ratio number 2.

3. The actual cost as detailed in the valuation tables for the ratio number 2 shall be financed as follows:

Transiently, until the effective cost is computed to review the percentage of the Autonomous Community's share of the State's revenue, the total cost will be financed by consolidation in Section 32 of the General budget of the State of the appropriations relating to the various components of this cost, for the amounts to be determined, which may be updated by the general mechanisms in each Budget Law.

Any differences arising during the transitional period, as referred to in the preceding paragraph, in respect of the financing of the transferred services shall be subject to regularisation at the end of the financial year, by the presentation of the accounts and supporting statements relating to a settlement committee, which shall be lodged at the Ministry of Economic Affairs and Finance.

F) Documentation and records of the services being transferred.

The delivery of the documentation and files of the services transferred will be made within one month from the entry into force of the Royal Decree approving this Agreement, subscribing to this effect the corresponding minutes of delivery and receipt.

G) Date of effectiveness of the transfers.

The extension of this Agreement will be effective from 30 September 1997.
