To comply with the provisions of the Organic Law 5/1992, of 29 October, of Regulation of the Automated Treatment of Personal Data (LORTAD), by Order 75/1994, of July 26 ("Official State Gazette"). Number 178), extended by Orders 34/1995, 9 March ('Official State Gazette 'number 64) and 33/1996, of 15 February ('Official State Gazette' number 46), the automated files of the Ministry of Defence were regulated.

On the other hand, Article 14.2 (d) and (i) of Royal Decree 1883/1996 of 2 August 1996 determining the basic organic structure of the Ministry of Defence provides for the functions of the Directorate-General for Personnel to direct the Career and Employment Military Personnel Registry and to coordinate and control the Department of Military and Civil Personnel Management Information System.

In order to comply with the above mentioned, a system of information of personnel has been constituted, which, in a progressive way, will replace the existing ones.

In its virtue, I have:

The content of the Annex is extended to Order 75/1994, of 26 July, extended by Orders 34/1995, of 9 March ("Official State Gazette" number 64) and 33/1996, of 15 February ("Official State Gazette" number 46), with the inclusion of the following automated personal data file:

38. Automated file of the Ministry of Defense Personnel Information System:

a) Responsible: Deputy Secretary of Defense. Directorate-General for Personnel.

b) Purpose: To allow the execution of the functions resulting from the maintenance and updating of the Military Personnel Registry of Career and Employment and the Information System for the Management of Military and Civil Personnel Department and its Autonomous Bodies.

(c) Uses: By duly authorized staff of the Secretariat and its organs and dependent units for the management of each of the collectives, through the introduction, modification and cancellation of data relating to the same.

It is also used for the production of statistics in accordance with the provisions of Law 12/1989, of the Public Statistical Office.

d) Persons or collectives source of data: Military and civilian personnel of the Department and its autonomous agencies, except for personnel subject to military service.

e) Data collection procedure: Data is collected through personal files, through the data subjects themselves or as a result of the documentation generated by the administrative activity, " Official Gazette of the State "and" Official Defense Bulletin ".

f) Basic file structure and description of the personal data included in the file:

Basic structure: ADABAS structure file.

Data types: Identifiers, family, administrative, professional, destination, and economic, academic, administrative infractions.

g) Recessions of data to be provided: The Ministry of Economy and Finance, Public Administrations, Social Security, Court of Auditors, Courts, collaborating banking entities and entities with which the Ministry of Defense maintains Conventions and concerts.

(h) Authority to which the rights of access, rectification and cancellation may be exercised, where applicable: Directorate-General for Personnel, Ministry of Defence, Paseo de la Castellana, number 109, 28071 Madrid.

i) Deadline for rectifying or cancelling data: The Regulentarily established.

j) Provisions that cover the automated file: Law 30/1984, of 2 August, of Measures for the Reform of the Civil Service, and Law 17/1989, of July 19, regulating the Regime of the Professional Military Personnel and others Provisions that develop and Royal Decree 1883/1996, of 2 August, of Basic Organic Structure of the Ministry of Defense.

Final disposition. Entry into force.

This Order shall enter into force on the day following that of its publication in the "Official State Gazette".
