Royal Decree 2200/1986 of 19 September 1986 on the regulation of fishing gear and methods in the waters of the Canary Islands ' fishing grounds, empowers the Ministry of Agriculture, Fisheries and Food to issue, in the field of their powers, the provisions necessary for its development.

Considering the special characteristics of the Canary Islands, from the fishing point of view, and the economic and social importance of certain traditional fishing methods in their fishing grounds, it is desirable that certain areas are reserved for the exercise of traditional fishing.

In this sense, the Government of the Canary Islands has adopted, in the inland waters of its competition of the islands of El Hierro and Fuerteventura, measures regulating the different modes of fishing.

Article 149.1.19 of the Constitution gives the State exclusive competence in the field of sea fishing.

In its preparation, the representative entities of the sector and the Autonomous Community of the Canary Islands have been consulted. He has also been submitted to the Spanish Institute of Oceanography.

In its virtue, I have:

Article 1. Scope of application.

This Order will be applicable to Spanish flag vessels, which, appearing on the Census of the Operational Fishing Fleet, exercise fishing in the outer waters of the canary fishing grounds.

Article 2. Zones reserved for traditional fishing.

Reserved for the exercise of fishing with traditional gear and gear, the following areas:

1. Outer waters of the island of El Hierro, within the polygon bounded by the following points:

A) 28o 00 'N, 18o 15' W.

B) 28o 00 'N, 17o 50' W.

C) 27o 30 'N, 18o 15' W.

D) 27o 30 'N, 17o 50' W.

2. Outer waters of the island of Fuerteventura within the polygon bounded by the following points:

A) 28o 47 'N, 14o 03' W.

B) 28o 47 'N, 13o 40' W.

C) 28o 08 'N, 13o 47' W.

D) 27o 53 'N, 14o 34' W. E) 27o 53 'N, 14o 51' W.

F) 28o 20 'N, 14o 51' W.

G) 28o 20 'N, 14o 20' W.

Article 3. Authorized gear and gear.

In the areas defined in the previous Article, only fishing with the gear and gear set out in the Annex to this Order may be exercised.

The use of authorized gear and gear will, in any case, be adjusted to the provisions of the Royal Decree to 2200/1986, of 19 September, of regulation of fishing gear and modalities in the waters of the canary fishing grounds.

Article 4. Infringements and sanctions.

The violations of the provisions of this Order shall be sanctioned in accordance with the provisions of Law 53/1982 of 13 July on infringements of sea fishing by foreign vessels in waters under Spanish jurisdiction and Spanish vessels, whatever the scope of their commission and their sanctions, and other provisions in agreement.

Final disposition first. Power of application.

The Secretary-General of Maritime Fisheries is empowered to adopt the necessary measures for the implementation and enforcement of this Order.

Final disposition second. Entry into force.

This Order shall enter into force on the day following that of its publication in the "Official State Gazette".
