The Organic Law 9/1995 of 20 November ("Official State Gazette" of 21), of the Participation, Evaluation and Government of the Teaching Centers, determines that in the procedures for the admission of students in the teaching of (a) the higher degree of vocational training, where there are not enough places, criteria based on the priority of academic requirements will be applied, replacing the criteria laid down in the Organic Law 8/1985 for this educational stage; 3 July, the regulator of the Right to Education.

In line with the above, Royal Decree 366/1997 of 14 March ('Official State Gazette ' of 15), which regulates the system of choice of educational establishment, determines, in its second provision, that the (i) the admission of pupils to centres with public funds to pursue specific vocational training courses of a higher degree will be governed by the rules of procedure established by the Ministry of Education and Culture, in accordance with paragraphs 2 and 3 of the third provision of the Organic Law 9/1995, of 20 November.

Royal Decree 777/1998 of 30 April 1998 (Official Journal of the State of 8 May), for which certain aspects of the organisation of vocational training in the field of the education system are developed, includes a chapter for the regulation of issues relating to the access, admission and registration of students. In the same, the conditions of access determined in the Royal Decrees are modified by which the different titles of Superior Technician and the corresponding minimum teachings are established and, in development of the precept in the Organic Law On 20 November, new criteria are applied in the procedures for the admission of students to higher education courses in vocational training.

The purpose of this Order is to adapt the admission of students in the courses of higher education to that of the legislation and to develop the criteria and the procedure applicable to such admission, seeking to reconcile freedom and equity, with the ultimate goal of continuous improvement in education and training.

In its virtue, this Ministry has arranged:

General criteria for the admission of pupils First.-The admission of students wishing to teach higher-grade specific vocational training in centres with public funds in the territorial area of Management of the Ministry of Education and Culture shall be governed by the provisions of this Order.

Second. -For those who meet the academic requirements of direct access, the order of precedence in admission to higher-grade training cycles, in accordance with the provisions of the Article 5andadditional provisions First, point 2, and second of Royal Decree 777/1998, of April 30, will be according to the following groups:

1. Those who prove to be in possession of the title of Bachiller (LOGSE) or have passed the second course of any modality of Experimental Baccalaureate or the Course of University Orientation (COU).

2nd. Those who prove to be in possession of the title of Technical Specialist, Technical Superior or equivalent for academic purposes.

3º. Those who prove to be in possession of a university degree or equivalent.

Third.-Those who prove that they have passed the test of access regulated by the Order of 7 July 1994 ("Official State Gazette" of 13), will have reserved, at least, 20 per 100 of the places that are offered for each cycle Vocational training of a higher degree.

Fourth. -If the number of direct access claimants is higher than the number of places offered, then the students of the groups 1st., 2nd. and 3rd. of the second section will be admitted, taking into account the following rules apply in the process of admission to higher-grade training cycles:

a) For group 1. Priority criteria are as follows:

a.1 There will be some of the forms of Baccalaureate or the corresponding options of the University Orientation Course which, for each training cycle, are listed in Annex I. a).

In the case of students from the Experimental Baccalaureate, the ratio set out in Annex I (a) for each training cycle shall be applied, taking into account the correspondence between the forms of Baccalaureate and the Experimental Baccalaureate as set out in the Order of 21 October 1986 ("Official State Gazette" of 6 November), which is set out in Annex I. b).

a.2 The average note of the academic record of the student in the Baccalaureate, in the Experimental Baccalaureate or in the Unified and Polivalent Baccalaureate and in the University Orientation Course.

a.3 Having completed the Baccalaureate subjects listed in the corresponding column of Annex I. a) to this Order.

b) In the 2nd and 3rd groups, the highest average of the academic record of vocational training or university studies, respectively, will be used as the tiebreaker criterion.

c) Once the applicants have been ordered in accordance with the priority criteria a.1, a.2 and a.3 for group 1 and b) for the 2nd and 3rd groups., in the cases that may occur, priority will be given to those who have taught Baccalaureate or Vocational Training during the academic year immediately preceding the same educational center where admission is requested.

(d) Finally, if the tie still persisted, the competent body for admission of pupils will go to the public draw for the tie-breaker by extracting two consecutive letters, which will decide the order of the admission up to the number of places available; it will be started by those whose first last name matches or is later alphabetically to the letters that have been chosen.

Fifth. -1. For the purposes of the preceding paragraph, the average note of the academic record of those in possession of the title of Bachiller (LOGSE) or of a Superior Technician shall be credited by the Book of Qualifications or, failing that, by Certification Personal Academic.

2. In the remainder of the studies giving direct access, the calculation of the average note shall be carried out by means of the arithmetic mean of the qualifications obtained in each of the subjects of the different courses of the Academic Certification. Personnel, after processing of the qualitative qualification in quantitative terms, according to the following scale:

Enough: 5.5.

Well: 6.5.

Notable: 7.5.

Outstanding or Outstanding (M.H.): 9.

Sixth. -1. In the process of admission to higher-grade training courses, where there are not enough places on offer for the number of applicants from the access test, the following order of priority shall apply:

a) Those who credit work experience related to the training cycle that is desired to be cured, according to criteria of greater to lesser seniority.

b) Those who credit work experience in any productive sector, according to criteria of greater to lesser seniority.

(c) For the remaining applicants, a public draw shall be drawn up as provided for in the fourth paragraph of this Order.

2. The accreditation of work experience shall be carried out by means of the following documents:

Certification of the General Treasury of Social Security or of the labor mutual insurance to which it is affiliated, where the company, the labor category (contribution group) and the period of employment, or, where appropriate, the Period of contribution in the Special Regime for Self-Employed Workers.

Certification of the company where you have acquired the work experience, including specifically the duration of the contract, the activity developed and the period of time in which that activity has taken place. In the case of self-employed persons, certification of high in the Tax of Economic Activities and proof of payment of such tax.

Procedure for the admission of students to the schools Seventh. -1. The application for admission to these training cycles shall be made in the centres to be determined by each Provincial Directorate in the territory of its management, by means of the official triplicate model as Annex II to this Order, For the teaching centre, another for the School Commission and a third for the person concerned.

2. Applications for admission to higher education courses will be made from 20 to 25 June for applicants from the 1st group. and those who have obtained the access requirement in previous years, and from 26 June to 2 July for the rest of the applicants. The Provincial Directorates of the Ministry of Education and Culture may, in cases where necessary, open an extraordinary period of admission between 1 and 10 September.

3. The interested parties shall submit a single instance, in the educational establishment, requesting first of all, to which the academic credential required to access the training cycle and, where appropriate, the documentation relating to the criteria, shall be attached. of priority of the fourth and sixth paragraphs of this Order. In the instance, the cycle or courses of higher education which they wish to pursue and the educational centre or centres in which they are requested to be admitted shall be the order of preference.

Eighth. -1. The School Board of each public centre is the body responsible for deciding the admission of pupils who have applied for such a public centre in the first place. In the agreed private centres, the holders will be responsible for strict compliance with the general rules on the admission of pupils, corresponding to the School Board.

2. The competent authority of the centres may obtain from the applicants the documentation which it considers appropriate in order to justify the situations and circumstances alleged.

3. The functions of the competent organ of the centres, with regard to the process of admission to higher education courses, shall be as follows:

(a) Make the selection of applications, transform, as appropriate, the qualitative qualifications of the academic record of applicants in quantitative and assign the school places in accordance with the order of priority and priority criteria listed in the fourth paragraph.

b) Make public the lists of applicants admitted and not admitted, classified and ordered according to the priority groups and criteria set out in this Order.

c) Resolve the submitted claims.

(d) To issue to the School Commission the requests of those who have not obtained a place in the teaching center.

4. In no case will free places be left if there are requests that meet the access requirements.

Completion of the vacancy allocation process, the competent body of each centre shall decide on the admission of applicants and shall publish, in the bulletin boards of the centre, the list of eligible pupils and, where applicable, of those not admitted, classified and ordered according to the groups and criteria of priority set out in this Order.

Those lists, which shall be of a provisional nature, may be the subject of a complaint to the competent authority referred to in the preceding paragraph for a period of three working days. After that period, the final lists must be submitted and forwarded to the respective School Committees within the maximum period of 48 hours.

Ninth School Commissions. -1. The Commission for the School of Education for Vocational Training in a higher grade is the body responsible for deciding on the admission of pupils who have not obtained a place in accordance with the previous procedure. The provincial directors of the Ministry of Education and Culture will constitute the Commission fifteen days before the beginning of the process, and may constitute as many School Commissions as they deem necessary, according to the specificity of the studies, as well as to ensure compliance with the rules on admission of pupils.

The territorial scope of action of the School Committees in the localities in which more than one Commission is set up will be the one to be determined by the corresponding Provincial Directorate of the Ministry of Education and Culture. it shall also establish appropriate procedures to ensure coordination between them for the fulfilment of the tasks set out in the following point.

2. The School Commissions will be dealt with in their respective areas of:

(a) Report on the places available in higher-grade training courses in publicly funded centres.

(b) Receive applications which, by way of derogation from paragraph 7 (3), are not submitted directly to the centre in which it is intended to be admitted and referred to the centre concerned.

c) Check that each student has presented a single instance, verify the number of vacancies and requests without attending to the centres of the appropriate scope.

d) Receive the instances of those who have not obtained a place in the requested centre first, order them in accordance with the priority and the priority criteria listed in the fourth paragraph and assign places in the centres where there are vacancies, according to the preferences indicated in the case in relation to other training courses or other educational establishments.

3. If the School Commission finds that an applicant has lodged an application in more than one centre, none of them shall be taken into account and shall give them the same treatment as for applications submitted outside the time limit. They shall be awarded only if, after the registration of those who submitted their application and were admitted in accordance with the procedure laid down, there are vacancies.

4. The Scholastic Commissions shall be composed as follows:

(a) The provincial director or person to whom he delegates, who will act as president.

b) Two Education Inspectors, appointed by the Provincial Director.

(c) A member of the Educational Programs Unit who performs functions in support of Vocational Training, designated by the Provincial Director.

(d) A Director of a public educational establishment in which higher education courses are to be provided, designated by the Provincial Director of the territorial area where the Commission is acting.

(e) A holder of an educational establishment with public funds included in the territorial area in which the Commission acts, in which higher education courses are offered, on a proposal from the respective holders.

(f) An official of the Provincial Directorate, appointed by the Provincial Director, who shall act as the Secretary of the Commission.

5. The School Committees shall ensure that each of the educational institutions included in its territorial scope of action, in its bulletin board, has previously and during the period of application for admission, the following information:

(a) Regulatory standards for the admission of students to publicly funded teaching centres.

(b) Number of existing vacancies for training courses of higher-grade specific vocational training courses.

c) Deadline for formalization of requests.

(d) Calendar including: The date of the tiebreaker draw, if necessary, the date of publication of the relationships of admitted students and the time limits for submitting claims.

Tenth. -1. The centres supported by public funds will, at least, reserve 3 per 100 of the places offered for each training cycle of higher-grade vocational training for people who, together with the access requirements, provide evidence of Degree of physical, motor or sensory impairment and have obtained favourable opinion from the School Committee.

The School Board will rule on the basis of the certificate of the disability status issued by the Institute of Migration and Social Services (IMSERSO) or competent body of the Autonomous Communities and the report A person who accredits the candidate's fitness to cure the teachings.

2. The centres supported by public funds shall reserve at least 3 per 100 of the places offered for each training cycle of higher grade vocational training for those who have obtained the approval of their foreign studies by one of the Spaniards listed in the second paragraph. The order in the admission shall be adjusted to the ranking set out in the same paragraph, using the criterion of priority as determined in paragraph (d) of this Order.

3. In the event of not being covered by the places reserved in paragraph 1 (2), the Commission for the School of the School of School will award these vacancies, taking into account, first of all, the applicants included in this paragraph, third paragraph, and finally, direct access.

Enrolment of pupils

11th. -1. The enrolment of pupils admitted to higher education courses will take place from 25 to 30 July. The Provincial Directorates of the Ministry of Education and Culture may, where necessary, open an extraordinary period of registration from 15 to 25 September.

2. In the event of registration, only the certification certificate of having passed the test of access to the higher education cycles in the corresponding option shall be required, provided that the same has not been possible accompany the application for admission on the basis of the dates of conclusion of the said access test.

3. If the registration period laid down in point 1 of this paragraph has not been completed, the registration period shall not be the right to the place obtained.

Review of the Acts of Admission Twelfth. -1. Agreements and decisions on the admission of pupils of the School Councils of public institutions and of the School Committees may be the subject of an ordinary appeal to the Provincial Directors of the Ministry of Education and Culture, whose resolution will put an end to the administrative route.

2. In the case of centres supported by public funds, agreements and decisions on the admission of pupils may be the subject of a complaint by the persons concerned to the Ministry of Education and Culture.

3. Without prejudice to the above points, the letters of complaint and complaint that are addressed to the School Councils of the public institutions, to the holders of the private centers and to the Commissions of the School, shall be resolved within three working days.

Application and Development Decimal-Third. -1. The Directorate-General for Vocational Training and Educational Promotion and the Directorate-General of Educational Centres are authorised to issue any Resolutions for the interpretation and application of this Order.

2. Where there are reasons for any modification of the time limits for admission or registration in higher education courses, the Provincial Directorates of the Ministry of Education and Culture may make such changes. prior communication to the Directorate-General for Vocational Training and Educational Promotion.

3. In the event that special time arrangements have been authorised, as provided for in the Resolution of the Secretary of State for Education of 30 April 1996 (Official State Gazette of 17 May), in order to contribute to the (a) to provide for the permanent training of citizens and to meet the demands for qualification of the production system, the pupils of the specific groups which are to be excluded from the admission procedure laid down in this Order.

Additional disposition.

A point 7 is added to the fourth paragraph of the Order of 26 March 1997 ("Official State Gazette" of 1 April 1997), which regulates the procedure for the choice of educational establishments and the admission of students to schools. supported with public funds for Child Education, Primary Education and Secondary Education, with the following text:

" Those who prove that they have passed the test of access regulated by the Order of 7 July 1994 (the Official Gazette of the State of 13), will have at least 20 per 100 of the places to be offered for each training cycle. Middle-grade vocational training. " Transitional arrangement.

For the academic year 1998/1999, exceptionally, the time limits for the submission of applications for admission and registration as referred to in paragraphs 7 and 11 of this Order are those set out in the Resolution of 11 June 1998, of the Directorate-General for Vocational Training and Educational Promotion.

Regulatory repeal.

The Order of 20 April 1994 is hereby repealed, on the admission of students in training courses of higher-grade specific vocational training in centres with public funds and how many provisions of equal or lower This Order shall be opposed to this Order.

Final disposition first.

Against this Order, the interested parties may institute litigation-administrative proceedings before the National Court, in accordance with the provisions of Article 107 of the Law on the Legal Regime of Public Administrations. and the Common Administrative Procedure.

Final disposition second.

This Order shall enter into force on the day following that of its publication in the "Official State Gazette".
