The Spanish Constitution reserves the State, in Article 149.1.17, the exclusive competence in matters of basic legislation and the economic regime of Social Security, without prejudice to the execution of its services by the Autonomous Communities.

For its part, the Statute of Autonomy for Cantabria, approved by Organic Law 8/1981 of 30 December, and reformed by the Organic Laws 2/1994, of 24 March, and 11/1998, of 30 December, establishes in its article 26.4 that corresponds to the Autonomous Community of Cantabria, in terms that establish the laws and regulations that in the development of its legislation dictate the State, the executive function in matters of management of the services and services social security system: IMSERSO.

By Royal Decree 1383/1996 of 7 June, the functions and services of Social Security were transferred to the Autonomous Community of Cantabria, in the areas entrusted to the National Institute of Social Services. (INSERT).

Finally, the Royal Decree 1152/1982, of 28 May, determines the rules and the procedure to be followed by the transfer of functions and services of the State to the Autonomous Community of Cantabria.

In accordance with the provisions of the Royal Decree cited, which also regulates the operation of the Joint Commission of Transfers provided for in the transitional provision seventh of the Statute of Autonomy for Cantabria, this At its meeting on 15 March 1999, the Commission adopted the appropriate agreement, the practical virtue of which requires its approval by the Government through Royal Decree.

In its virtue, in compliance with the provisions of the transitional provision seventh of the Statute of Autonomy for Cantabria, on the proposal of the Minister of Public Administrations and after deliberation of the Council of Ministers in its Meeting of 9 April 1999,

DISPONGO:

Article 1.

The Agreement of the Joint Committee provided for in the seventh transitional provision of the Statute of Autonomy for Cantabria is approved, extending the means of social security transferred to the Autonomous Community of Cantabria, in the subjects entrusted to the Institute of Migration and Social Services (IMSERSO), adopted by the plenary session of the said Commission, at its meeting on 15 March 1999, and which is transcribed as an annex to this Royal Decree.

Article 2.

Consequently, the material, personal and budgetary resources that are related to the Joint Commission Agreement are transferred to the Autonomous Community of Cantabria, on the terms there. specified.

Article 3.

The extension of means referred to in this Royal Decree shall be effective from the day indicated in the Agreement of the said Joint Committee, without prejudice to the Institute of Migration and Social Services or other competent bodies produce, until the entry into force of this Royal Decree, where appropriate, the administrative acts necessary for the maintenance of the services in the same system and level of operation as they had at the time of adoption to the Agreement.

Single end disposition.

This Royal Decree shall enter into force on the day following that of its publication in the "Official Gazette of the State".

Dona Pilar Andrés Vitoria and don Manuel Valentin-Fernández de Velasco, Secretaries of the Joint Commission on Transfers provided for in the seventh transitional provision of the Statute of Autonomy for Cantabria,

CERTIFICATE

At the plenary session of the Joint Committee, held on 15 March 1999, an Agreement was adopted on the extension of the social security means transferred to the Autonomous Community of Cantabria in the areas entrusted to the Institute for Migration and Social Services (IMSERSO), in the following terms:

A) Reference to constitutional, statutory and legal norms in which the extension of media is amenable.

The Constitution in its Article 149.1.17 gives the State exclusive competence in the field of basic legislation and the economic system of social security, without prejudice to the execution of its services by the Communities. Autonomous.

The Statute of Autonomy for Cantabria, approved by Organic Law 8/1981 of 30 December, and reformed by the Organic Laws 2/1994 of 24 March, and 11/1998 of 30 December, establishes in its article 26.4 that it corresponds to the Autonomous Community of Cantabria, in terms that establish the laws and regulations that in the development of its legislation dictate the State, the executive function in matters of management of the social services and services of the system Social Security: INSERT.

Finally, the transitional provisions of the Statute of Autonomy for Cantabria and Royal Decree 1152/1982 of 28 March 1982 regulate the manner and conditions to be followed by the transfer of functions and services of the State administration to the Autonomous Community of Cantabria.

On the basis of these normative provisions, the extension of the means transferred to the Autonomous Community of Cantabria, by the aforementioned Royal Decree 1383/1996, of 7 June, should be operated.

B) Goods, rights and obligations of the State that are expanded.

1. The assets, rights and obligations of the Institute of Migration and Social Services that correspond to the services that are expanded are transferred to the Autonomous Community of Cantabria.

2. Within one month of the date of effectiveness of this Agreement, the corresponding minutes of delivery and receipt of the furniture, equipment and inventoried material shall be signed.

3. The assets assigned to the Institute of Migration and Social Services are assigned to the Autonomous Community of Cantabria, which are included in the detailed inventory of the attached ratio number 1.

This membership is without prejudice to the unity of the patrimony of Social Security, other than the State and has affected the fulfillment of its specific purposes, the title of which corresponds to the General Treasury of Security Social.

C) Staff attached to the services and institutions that are expanded.

1. The staff assigned to the services which are extended and which are nominally referred to in the attached relationship number 2, will become dependent on the Autonomous Community of Cantabria, in the terms legally provided for by the Statute of Autonomy and the other rules in each applicable case, and in the same circumstances as specified in the attached relationship and with their personnel registration number.

2. The General Secretariat of the Migration and Social Services Institute will notify those interested within one month of the transfer and its new administrative situation, as soon as the Government approves this Agreement by Royal Decree. The competent authorities of the Autonomous Community of Cantabria shall also be sent a certified copy of all the files of this staff, as well as of the certificates of haberes, relating to the amounts due during 1999, (i) the necessary modification of the organic and budgetary templates in the light of the transfers made. It shall also be forwarded to the competent bodies of the Autonomous Community of Cantabria, certifying the assets accrued in the month immediately preceding the effectiveness of the transfer.

D) Job vacancies that are expanded.

The vacant posts which are available in the budget are as detailed in the attached ratio number 3, with an indication of the Body or Scale to which they are attached or assimilated, professional category, level Organic and budgetary allocation.

E) Valuation of the financial burdens of the expanding media.

The budget appropriations for the 1999 financial year that are extended to the Autonomous Community of Cantabria are those that are determined in the attached ratio number 4.

F) Documentation and records of services that are expanded.

The delivery of the documentation and files of the media that will be expanded will be made within one month of the date of effectiveness of this Agreement. The resolution of the files which are being processed shall be made in accordance with the provisions of Article 8 of Royal Decree 1152/1982 of 28 May 1982.

G) The effective date of the media extension.

The extension of the means covered by this Agreement will be effective from 1 July 1999.
