Royal Decree 929/1995, of 9 June, approving the technical regulation of control and certification of fruit nursery plants, collected the prior national legislation in the field and incorporated into the legal system (a) a Community legislation integrated by Council Directive 92/34/EEC of 28 April on the marketing of fruit plant propagating material and fruit plants intended for fruit and vegetable production and for a further three years Commission directives issued in accordance with that Directive, in particular the Directive 93 /48/EEC, of the Commission of 23 June laying down the information sheet concerning the conditions to be met by fruit plant propagating material and fruit plants intended for fruit production, Directive 93 /64/EEC, by the Commission of 5 July laying down detailed rules for the application of the supervision and control of suppliers and establishments and Directive 93 /79/EEC of the Commission of 21 September laying down detailed rules for the application of the additional provisions for the application of the lists of varieties of propagating material of fruit plants and fruit plants produced by the suppliers.

Article 7 of Commission Directive 93 /48/EEC determined that, pending the adoption of a Community certification scheme, the initial, basic and certified materials must meet the conditions laid down in this Directive. for each category in the national certification schemes, provided that they are, as far as possible, consistent with the existing international certification schemes.

The olive tree is a species of great importance in the agricultural economy of Spain and in which, in recent years, have consolidated technical advances both in the production systems of the nurseries and in the methodologies of analysis of the plant material. This Royal Decree establishes the requirements for the control and certification of the quality of the olive nursery plants, adapting them to the recent technical advances operated in the sector. To this end, the scope of the fruit term, as set out in Annex V to the technical regulation for the control and certification of fruit nursery plants, is defined in accordance with the provisions of Article 1 thereof and the title of the Annex is amended. V and a new Annex IX is introduced which sets out the specific requirements for the certification of olive nursery plants.

This provision has been submitted to the procedure for information on technical standards and regulations provided for in Directive 98 /34/EC of the European Parliament and of the Council of 22 June, as amended by the Directive 98 /48/EC, of the European Parliament and of the Council of 20 July, which is incorporated into the internal legal order by Royal Decree 1337/1999 of 31 July.

In its preparation, it has been submitted to the representative entities of the sectors concerned and the Autonomous Communities.

This Royal Decree is issued under the provisions of Article 149.1.10.a and 13.a of the Constitution, which reserves the State exclusive competence in the field of foreign trade and the bases and coordination of planning general of the economy.

Under its virtue, on the proposal of the Minister of Agriculture, Fisheries and Food, in agreement with the Council of State and after deliberation by the Council of Ministers at its meeting on 29 October 1999,

D I S P O N G O:

Single item. Amendment of Royal Decree 929/1995.

1. The Title of Annex V to Royal Decree 929/1995 of 9 June 1995, approving the technical regulation for the control and certification of fruit nursery plants, is drawn up in the following terms:

"Specific standards for the certification of plant breeding plants for nugget and bone fruit."

2. A new Annex IX is introduced in Royal Decree 929/1995, with the title and content set out in the Annex to this Royal Decree.

Single transient arrangement. Olive-tree plants.

1. The competent bodies of the Autonomous Communities, at the request of the interested parties, shall qualify the existing olive-mother feet prior to the entry into force of this Royal Decree and which do not satisfy the requirements of established clonal origin. in paragraph 3.1 of Annex IX as the mother feet of certified propagating material, when they meet the following conditions:

a) Having known origin b) Haber been checked varietal and sanitarily.

(c) No initial or basic material of the variety in question.

2. After five years after the entry into force of this Royal Decree, the mother feet referred to in the preceding paragraph shall lose the status of mother feet of certified material.

Final disposition. Entry into force.

This Royal Decree shall enter into force on the day following that of its publication in the "Official Gazette of the State".

ANNEX IX

Specific rules for the certification of olive nursery plants

1. Requirements for the production and maintenance of initial material

1. The original material mother plants comprise the clone head plant, the reserve plants and the starting plants.

2. At least five staquillas of the clone head plant shall be rooted for the production of the reserve and the starting plants.

Two of them will be grown on sterile substrate and the vector coat, constituting the reserve plants.

The rest can be cultivated in the field, under conditions of isolation that ensure the absence of contamination by diseases and allow the expression of the varietal characters constituting the starting plants.

The planting site shall be free of "verticillium dahliae" and of virus-transmitting nematodes.

3. Each parent plant of initial material shall be verified by official inspection to be free of the harmful organisms listed in Table A, by sampling, where appropriate, and its analysis by appropriate and approved techniques. responsible official body and that its varietal characteristics coincide with the official description of the variety.

4. The health status of the parent plants of initial material for easily transmissible diseases and virosis shall be checked annually.

Tolerance will be 0 per 100.

5. The offspring of each clone head shall be identified with a code, called a clone number, which shall be maintained throughout its multiplication and marketing together with the variety denomination.

2. Requirements for the production and maintenance of base material

1. The parent plants of base multiplication material, hereinafter referred to as basic parent plants, shall be obtained directly from initial multiplication material.

2. Base parent plants may be grown in field, in isolation conditions that ensure the absence of disease contamination and at least with the isolation distances identified in Table B. These distances may be reduced if establish other effective isolation measures, approved by the responsible official body.

The substrate or planting soil shall be free of "verticillium dahliae" and of virus-transmitting nematodes.

3. All the basic mother plants shall have their varietal identity checked, at least for visual observation of characters. The maintenance of the health status shall be verified annually for the easily transmissible diseases and virosis and, where appropriate, by appropriate sampling and analysis techniques and approved by the responsible official body.

Tolerance will be 0 per 100.

3. Requirements for the production of propagating material and certified nursery plants

1. The parent plants of certified multiplication material, hereinafter referred to as the parent certificate plants, shall be obtained directly from basic propagating material or from initial propagating material.

2. Certified mother plants may be grown in field, in isolation conditions which ensure the absence of contamination of diseases and at least with the isolation distances identified in Table B. These distances may be to reduce the number of other effective isolation measures approved by the responsible official body.

The substrate or planting soil shall be free of "verticillium dahliae" and of virus-transmitting nematodes.

3. Mother plants and nurseries shall be free, at least for visual observation, of symptoms of the harmful organisms listed

4. Certified mother plants shall have their varietal identity checked for at least visual character observation.

5. The varietal purity of the certified nursery plants shall be verified at least by visual inspection and shall be 99,99 per 100 at least.

6. The producers must make the appropriate treatment to ensure that the nursery plants comply with the requirements of varietal purity and health status. The absence of up to 5 per 100 of plants purified by plant health or varietal causes shall be permitted.

7. The substrates in which the nursery plants are produced and placed on the market shall be free of "verticillium dahliae" and of virus-transmitting nematodes.
