By Decree of 16 January 1953 the Patronato of the then called "González Martí" Ceramics Museum was created, with the functions of preserving and improving the artistic funds of this museum, taking care that its conditioning serves (a) to the extent to which it is intended, to administer the flows which for whatever reason are provided to it and to propose the technical staff to whom the implementation of their agreements and decisions is to be entrusted.

By Decree 2517/1969, of October 9, the National Museum of Ceramics "González Martí" becomes "National Museum of Ceramic and Suntuary Arts".

In 1986, the Patronato was again regulated by Royal Decree 2093/1986 of 1 August, with its constitution being determined by Order of 25 April 1989.

The new social realities and the organization of public administrations, derived from the current Spanish Constitution, make it necessary to modify structural and functionally the Patronato of the National Museum of Ceramics and Arts Suntuarias "González Martí", to configure it as a collegiate body that promotes and orients the activity of the museum as a national reference center within the singular and relevant scope of its collections, in the same line of other Patronates recently constituted.

In its virtue, on the proposal of the Minister of Education and Culture, with the approval of the Minister of Public Administrations, and after deliberation of the Council of Ministers at its meeting on November 26, 1999,

D I S P O N G O:

Article 1. Object.

The Board of Trustees, the collegiate governing body of the National Museum of Ceramic and Suntuary Arts "González Martí", will have the composition and functions that are established in this Royal Decree.

Article 2. Composition of the Board.

1. The Board of Trustees shall be composed of the following members:

a) President: the Minister of Education and Culture.

b) Nates Vocals:

The President of the Valencian Generality.

The Mayor of Valencia.

The Secretary of State for Culture.

The Director General of Fine Arts and Cultural Property.

The President of the Consell Valencia de Cultura.

The Deputy Director General of the State Museums.

The Director of the National Museum of Ceramic and Suntuary Arts "González Martí".

(c) Vocals by designation of the Minister of Education and Culture:

Two members of Academies related to the cultural field of the Museum.

Two directors of museums, one of which, at least, will be a museum of state ownership.

Up to 12 vowels appointed among persons of recognized prestige or competence in matters related to the Spanish Historical Heritage or who have distinguished themselves for their services or aid to that Heritage and, in particular, to the Museo Nacional de Cerámica y Artes Suntuarias "González Martí".

The appointed vowels will perform their duties for a period of three years from the date of their respective appointments.

2. The Board of Trustees will have a Vice-President who will be elected by the plenary session among the members appointed and appointed by the Minister of Education and Culture.

The Vice President shall preside over the Standing Committee and may replace the President in the performance of his duties, in the case of vacancy, absence, illness or other legal cause.

The Vice President will cease in office at the end of his term as vowel.

3. The Board of Trustees will appoint a Secretary from the staff assigned to the Museum, who will act with a voice, but without a vote, in the Permanent Commission and in the plenary.

4. The President and the vowels may delegate their attendance to a given meeting of the plenary session or of the Standing Committee on the persons appointed by them.

The vowels by designation may delegate to another member of the Board.

5. The members of the Board of Trustees shall not receive any remuneration for the performance of their duties except, where appropriate, for the compensation for the service provided to them pursuant to Royal Decree 236/1988 of 4 March.

Article 3. Operating system.

1. The Board of Trustees acts in plenary and standing committee.

2. The plenary session is composed of all the vowels and appointed.

3. The Permanent Commission is composed of the Vice President of the Board of Trustees, the Director General of Fine Arts and Cultural Property, who will be able to delegate to the Deputy Director General of the State Museums, the Director of the Museum and three vowels appointed by the the plenary session.

4. The plenary sessions and the Standing Committee are ordinary and extraordinary:

(a) The ordinary plenary shall be held at least every four months and those of the Standing Committee at least once every two months.

(b) The extraordinary shall be held upon convocation by the President of the Board of Trustees, on his own initiative, or at the reasoned request of the third party of his/her vowels.

5. The Board of Trustees may agree to the attendance of certain sessions of museum experts or non-museum experts, whose presence is considered to be of interest for the matters to be dealt with.

Article 4. Functions of the plenary session.

1. It is for the Board of Trustees, in any case:

1. Promote compliance with the general guidelines that the Ministry of Education and Culture establishes for the museum.

2. To encourage and promote the participation of society in the enrichment of the museum's collections and in its support.

3. Inform grants, contributions, donations, inheritances or legacies in favor of the museum.

2. The following functions, which may be delegated to the Standing Committee, shall also be delegated to the Board of Directors:

1. Acordar, where appropriate, modifications to the collection of the museum's collections; approve, on a proposal from the Director, treatments of an extraordinary nature or of special importance for the conservation or restoration of the works of the museum and approve the organization of temporary exhibitions.

2. º Require, through the Director, the referral of how much data, reports, and studies it deems useful for the performance of its functions.

Article 5. Functions of the Standing Committee.

Corresponds to the Permanent Commission:

1. To study, deliberate and report proposals to be submitted for approval by the Board of Trustees.

2. Inform the departure, whatever their destination, of museographic funds outside the museum premises or the premises specified in the respective deposit contracts and apply for the required authorization from the Ministry of Education and Culture, previous report of the Museum Director.

3. To take care of the fulfillment, development and implementation of the agreements adopted by the Board of Trustees.

4. Assume all other functions entrusted to it by the Board of Trustees.

5. In any case, account for the plenary of the agreements adopted in the exercise of the above powers.

6. To obtain from the Advisory Board the reports and advice that it deems appropriate, for its transfer to the Board of Trustees.

Article 6. Applicable rules.

Without prejudice to the peculiarities established in this Royal Decree, the operation of the Patronato of the National Museum of Ceramic and the Arts "González Martí" shall be governed in accordance with the provisions of Chapter II of the Title II of Law 30/1992 of 26 November 1992 on the Legal Regime of Public Administrations and the Common Administrative Procedure.

Single additional disposition. Commencement of the exercise of the duties of the members and appointment of the members appointed by the Ministry of Education and Culture.

1. The members of the Board of Trustees shall perform their duties from the entry into force of this Royal Decree.

2. The members appointed by the Ministry of Education and Culture shall be appointed by Order within one month of such entry into force.

Single repeal provision. Regulatory repeal.

The Royal Decree 2093/1986, dated August 1, is repealed, which regulates the Patronato of the National Museum of Ceramics and the Arts Suntuarias, of Valencia, and how many other norms of equal or lower rank are opposed to the established in this Royal Decree.

Final disposition first. Regulation of the Advisory Board.

By Order of the Minister of Education and Culture, the composition, competence and functioning of the Advisory Board referred to in Article 5 (6) of this Royal Decree will be regulated. The creation of the Advisory Board will not increase public spending.

Final disposition second. Entry into force.

This Royal Decree will enter into force on the day following its publication in the "Official State Gazette".
