CHAPTER I

General provisions

Article 1. Admission places in official university studies.

1. Students may apply for a place in public universities, in order to attend the first or second cycle of university studies leading to the acquisition of official titles and valid throughout the national territory. required by the legislation in force for access to them and those set out in this Royal Decree.

2. The universities shall make public the deadlines and procedures for applying for a place in their teaching, on the dates determined by the competent bodies of the Autonomous Communities, within the framework of the general regulation to be established for this purpose. In the case of the National University of Distance Education (UNED), it is up to the Ministry of Education and Culture, the determination of these deadlines and procedures.

3. The right to be admitted to the teaching referred to in paragraph 1 above shall be subject to the number of seats which, in accordance with the objective modules established by the Council of Universities, shall provide for each of the universities.

4. No university may leave vacancies previously offered, as long as applications for them are in place, formalised within the application period referred to in paragraph 2 by students meeting the requirements referred to in paragraph 1. of this Article.

Article 2. Access test.

1. Applicants for the first time to start university studies, where appropriate, shall carry out the test of access at the university corresponding to the requirements of Articles 5 to 8 of this Royal Decree. In the case of conducting this test in more than one university, all of them will be cancelled.

2. Once the test has been passed, the students will be able to present themselves again in successive, ordinary and extraordinary calls, in order to improve the note. The overall rating obtained in the calls for improvement of the note shall be taken into account only if it is higher than that previously granted.

When this capability is used, the test will be performed by a single one of the different paths or access options.

The new test must be performed at the same university, unless a change of residence is duly justified or has obtained a place in another university, in which case it will be the latter where the new test must be carried out.

The possibility of repetition of the test will not be an obstacle to the student being able to formalize his tuition at the university in which he has obtained a place in the current academic year in which he will for the first time test.

Article 3. Application of this Royal Decree.

It is up to the universities to take the necessary measures to ensure compliance with the provisions of this Royal Decree and to resolve, according to criteria of guarantee, transparency and immediacy, the requests, incidents and complaints filed by students in the exercise of their rights, without prejudice to the provisions of Article 22 of the Organic Law 11/1983, of 25 August, of University Reform.

CHAPTER II

University in which the access test should be performed

Article 4. General rules.

The proof of access referred to in Article 2 (1) shall be carried out at the university which, as the case may be, is indicated in Articles 5 to 8 of this Royal Decree.

Article 5. High school students.

1. Students who have completed the baccalaureate studies provided for in the Organic Law 1/1990 of 3 October of General Management of the Educational System (LOGSE) will carry out the test of access at the university to which they are assigned. For the purposes of this Regulation, the secondary education centre in which the second course was completed. This will apply to the students who have completed the experimental baccalaureate.

2. Students of a unified and multi-purpose high school (BUP) of Law 14/1970, of 4 August, General of Education, shall carry out the test of access at the university to which, for the purposes indicated, it is attached to or coordinates the centre in which they have passed the university orientation course (COU).

3. The students of baccalauréat completed in accordance with plans of studies prior to those of Law 14/1970, of 4 August, General of Education, will carry out the test of access in the university of their province of residence or, in their absence, in the university to which the secondary education institutes of the province are attached.

Article 6. Students from Spanish public centers abroad.

Students from Spanish public centres located abroad will carry out the access tests at the National University of Distance Education (UNED), unless the centre concerned is attached to the a university other than the one mentioned, in which case it will be where the access tests will have to be carried out.

Article 7. Students who have completed pre-university studies according to foreign education systems.

Students who have completed foreign studies that can be validated by the Baccalaureate of the Organic Law 1/1990 (LOGSE) or by the COU, including those made in foreign centers authorized in Spain, will be able to choose between the access test at the Universidad Nacional de Educación a Distancia (UNED) or to be carried out:

(a) In the public university they choose, if they are a foreign national or if they are a Spanish nationality and justify their residency abroad.

b) Any public university in the province of its residence in Spain or, where appropriate, in the province of which the secondary education institutes of that province are attached, if they are students of Spanish nationality which does not justify residence abroad.

Article 8. Students over the age of 25.

Students over twenty-five years of age will perform the access test referred to in Article 53.5 of Organic Law 1/1990 (LOGSE) at the university of their choice and will be subject to their specific regime.

CHAPTER III

Open District

Article 9. General rules.

1. The students referred to in Article 1 (1), who are to pursue the first cycle of university studies, may apply for a place at any university, irrespective of the university in which, by application of the items 5 to 8, have passed the access test.

2. The universities shall order the applications and award the available places, taking into account, first of all, the priorities set out in Articles 10 and 11 and, secondly, the assessment criteria which are also set out in the Article 12 of this Royal Decree.

Students will include in their application an orderly relationship of the studies in which they wish to be admitted, in accordance with established procedural rules.

Article 10. Priorities for the allocation of places.

Without prejudice to the additional provision of this Royal Decree, for the award of first-cycle places, universities will consider the applications of those students as a priority. who have passed the test of access to one of the routes or options provided for in Article 8.2 of Royal Decree 1640/1999 of 22 October, governing the testing of access to university studies, and wish to initiate related studies with the above mentioned routes or options, in turn related to the modalities of the Baccalaureate regulated in Organic Law 1/1990 (LOGSE). The provisions of the foregoing paragraph shall also apply to students from the experimental baccalaureate and the baccalaureate of Law 14/1970 of 4 August, who have passed the access test, and wish to initiate studies. related to the paths or options exceeded.

Article 11. Temporary priority in the allocation of places.

1. Applications received and prioritised in accordance with Article 10 shall in any event be dealt with in the successive stages which are determined by the following order of precedence:

(a) First of all, those of students who have passed the test of access to the university in the ordinary course of the current year or in calls for previous courses, as well as those of those students who credit the assessment criteria referred to in paragraphs (b), (c) and (d) of Article 12.

b) Second, those of those students who have passed the access tests in the extraordinary convocation of the current year.

c) Third, and for admission into teachings that lead exclusively to the acquisition of first-cycle titles (Diplomacy, Technical Architect or Technical Engineer), that of those students who have passed the COU in the ordinary call of the current year or in calls for previous courses.

Students who have passed the second course of the Baccalaureate regulated in Organic Law 1/1990 (LOGSE) may not be admitted to the studies mentioned in the previous paragraph without the previous one being exceeded access test.

(d) Fourth, the applications of students referred to in paragraph (c) of this article that have exceeded the corresponding studies in the extraordinary convocation of the current year.

2. For the first cycle of university studies reserved for students from the higher education courses of vocational training, and for the purposes only of the studies to which they have direct access with the it is related to the vocational training courses which have been completed, shall be considered, first, the applications of those who have completed such studies in the ordinary course of the current year or in ordinary calls; or of previous courses and, secondly, those of the students who have passed The above mentioned lessons in extraordinary calls for the current year.

Article 12. Assessment criteria for the allocation of places.

Applications which are on an equal footing, taking into account the criteria set out in Articles 10 and 11, shall be ordered by applying the criterion which, among the following, corresponds to:

(a) The definitive qualifications obtained in the test of access to the university.

(b) The average note resulting from averaging the score obtained, in the day, in the maturity tests and the average of the academic record of the upper secondary school and the pre-university course.

(c) The average note of the academic record of the multi-purpose unified baccalaureate (BUP) or, where appropriate, of the upper secondary school and the course of university orientation, for those who have passed the latter prior to the course 1974-1975.

d) The middle school academic record for those who have completed plans for studies prior to the year 1953.

e) The average note of the university file, when it is credited to be in possession of a university degree or equivalent, calculated according to the general criteria agreed by the Council of Universities to which it refers the second final provision of Royal Decree 1497/1987 of 27 November 1987 laying down common general guidelines for the plans of studies of university degrees of official character and valid throughout the national territory, in the wording given by Royal Decree 1267/1994 of 10 June 1994.

In the case of plans for unstructured credit studies, the calculation of the average note shall be carried out in accordance with the following criterion: the sum of the subjects exceeded by multiplying each of them by the value of the rating corresponds, from the same table set out in Annex I to the Royal Decree cited in the preceding paragraph. The result will be divided by the total number of subjects in the corresponding teaching.

In the case of four-monthly or half-yearly subjects, half of the value of the qualification in the sum and half of the subject in the divider will be counted. For these purposes, the subjects that appear to be exceeded without notice, or the voluntary subjects, will not be taken into account.

The Autonomous Communities or, where appropriate, the universities may modulate the average note thus obtained, by application of the correction coefficient which results from dividing the average of the qualifications corresponding to the promotion of in the case of the receiving university for the average of the qualifications corresponding to that of the university.

(f) The average note of the academic record of vocational training calculated in accordance with the provisions of the Resolution of 25 April 1996 ("Official State Gazette" of 7 May), as amended by 3 June 1998 ("Official State Gazette" of 18), in the case of studies in Spanish centres, and in the Resolution of 7 May 1996 ("Official State Gazette" of 15), for the case of foreign studies validated by the training professional, or in the rules that replace them.

Article 13. Reserved places: general rules.

1. By way of derogation from Articles 10 and 11, where the demand for places is higher than the offer, the universities shall reserve each year a number of places to be awarded to the students referred to in the Articles 14 to 19, provided that they meet the requirements of the legislation in force for access to the university.

2. The exact determination of the places reserved, within the limits set by Articles 14 et seq. of this Royal Decree, shall correspond, in the proportion and in respect of the studies which they consider appropriate, taking into account the In the case of this type of space, the Autonomous Community, on a proposal from the universities located in its territory.

3. In the case of students with a university degree and of national students from non-EU countries or from the European economic area, there will be a single application period corresponding to the ordinary call.

Article 14. Places reserved for students with a university degree or equivalent.

For students who are in possession of a university degree or equivalent, who do not allow them access to the second cycle of the studies they intend to take, a number of places shall be reserved not less than 1 per 100 more than 3 per 100.

Article 15. Places reserved for national students from non-EU countries or from the European economic area.

For national students from non-EU countries or the European economic area who have passed the test of access to Spanish universities in the current year or in the previous year and whenever their Member States shall apply the principle of reciprocity in this field, with a number of seats not less than 1 per 100 and no more than 3 per 100.

Article 16. Places reserved for students of vocational training.

For students who have passed vocational training courses which enable them to have direct access to university teaching which, in each case, are determined, taking into account their relationship with the studies of vocational training which they have completed, a number of places of no less than 15 per 100 and no more than 30 per 100 shall be reserved, in the case of university studies leading to the achievement of official first-cycle degrees.

In the case of university studies leading to the obtaining of first and second-cycle official titles, the number of places indicated above will be in a band between a minimum of 7 per 100 and a maximum of 15 per 100.

Article 17. Places reserved for disabled students.

1. 3 per 100 of the places available for students who are recognised as having a disability equal to or greater than 33 per 100, or suffer total speech impairment or total hearing loss, as well as for students with permanent special educational needs associated with the personal conditions of disability which during their previous schooling have specified extraordinary resources.

2. The certificate, opinion or procedure for the assessment of disabled persons shall be carried out by the competent authority of each Autonomous Community.

Article 18. Places reserved for athletes.

For students who, bringing together the relevant academic requirements, the Higher Sports Council qualifies and publishes as high level athletes before June 15 of the current year, or who meet the conditions that establish the Council of Universities, reserve places in a number not less than 1 per 100 and not more than 3 per 100 of the available and, additionally, 5 per 100 of the places corresponding to the Bachelor of Science of the Activity Physics and Sport.

Article 19. Places reserved for over twenty-five years.

For students over the age of 25 who have passed the specific tests for access to the university provided for in Article 53.5 of the Organic Law 1/1990 (LOGSE), places shall be reserved in numbers not less than 1 per 100 or more than 3 per 100.

CHAPTER IV

Admission of Spanish or foreign university students

Article 20. Change of university and/or Spanish studies.

1. Students who wish to continue their studies at a university other than that in which they have begun may apply for admission in the first one, provided that they meet the following requirements:

(a) Have passed the first complete course of such studies, in the case of non-renewed teaching, or 60 credits in the case of renewed teaching, understanding by credit the unit of assessment of the teachings according to the forecasts of Royal Decree 1497/1987 of 27 November, as amended by the Royal Decrees 1267/1994 of 10 June; 2347/1996 of 8 November; 614/1997 of 25 April and 779/1998 of 30 April.

(b) Not having exhausted the calls set out in the applicable rules of stay.

2. The decision on admission of students referred to in the previous paragraph corresponds to the Rector, who will decide according to the criteria of ordination and prioritization that, in accordance with the provisions of this Royal Decree, determine the Board of Government of each University.

3. Applications for students who wish to change university and who do not meet the requirements laid down in paragraph 1 of this Article shall be subject to the general arrangements for the allocation of places set out in this Royal Decree.

4. In the cases provided for in this article, the granting of a place in the chosen university will have the same effects as the request for the transfer of the corresponding academic files, which must be dealt with by the university, a the person concerned has been admitted to another university.

5. Applications from students who wish to start university studies other than those started will be subject to the general system for the allocation of places set out in this Royal Decree.

6. Where, during the course of the award of places, a pupil who has been admitted by a university is justified on the grounds of admission to another university, he may make the first provisional registration, the public prices for which he provides University academic services will pay at the time of their final formalization.

Article 21. Admission of students with foreign university studies.

Applications for places of students with partial, or complete, foreign university studies but the approval of which would have been refused by the Ministry of Education and Culture expressly indicating the possibility of partial validation for the purpose of continuing the same teaching or equivalent in Spanish universities, will be decided by the Rector of the University, according to the following rules:

1. Applications for students with foreign university studies for which the first full course or a minimum of 60 credits will be received will be resolved by the University Rector, who will act according to the criteria to be laid down by the Governing Board which shall, in any event, take into account the qualifications of the university file.

2. If the request for a place is for studies in which the demand for places is lower than the offer, it will be sufficient for the students to have validated a minimum of 15 credits or, where appropriate, a subject.

3. Students who do not obtain partial validation must pass the test of access to the Spanish universities, unless the pre-university studies that have been validated give them direct access to the without prejudice to the temporary priorities and assessment criteria set out in this Royal Decree, without any need to overcome access tests.

CHAPTER V

Admission to the second cycle of official university studies

Article 22. Applicable regime.

The admission of students to the second university cycle, when the demand for places is higher than the offer of the same, shall be governed by the provisions of the following articles.

Article 23. Access to the second cycle of teaching which is a direct continuation of a first cycle.

Access to the second cycle of teachings that constitute the direct continuation of a previous first cycle will be performed in accordance with the following criteria:

1. All students who are pursuing or have completed the corresponding first cycle of the same degree at the same university will be able to access, without prejudice to the provisions of the to remain in the university or in the regulation which, on the basis of prerequisites and incompatibilities between subjects, contains, where appropriate, the corresponding curricula.

2. In the event that the university has only the second cycle of the teaching in question, the students of the university itself who have completed the first cycle studies will be able to access it. 2. In the case of access to second-cycle teaching, universities shall consider on an equal basis, together with the applications of their own students, those of those who wish to have access to such teaching by not be established in public institutions integrated in the university from which they come.

Article 25. Admission to the National University of Distance Education (UNED) of students in the second cycle.

The admission of students in the second cycle of university studies to the National University of Distance Education (UNED), in which the demand for places exceeds the offer of the same, will be governed by criteria similar to those provided for in the previous articles, corresponding to the Ministry of Education and Culture the powers conferred on the Autonomous Communities in those articles.

Article 26. Recognition of training complements.

Additional disposition first. Personal aptitude tests for certain lessons.

1. Universities will be able to carry out specific assessment tests on the personal skills of those who request access to the following lessons:

a) In the Bachelor of Fine Arts, in order to evaluate the skills and abilities for the plastic arts.

b) In the degree in Translation and Interpretation, in order to evaluate the skills and abilities for linguistic translation in one of the known modern foreign languages.

c) In the Bachelor of Science in Physical and Sports Activity, in order to evaluate the skills and abilities for physical activities and sport.

Except for these specific tests are those classified as high level athletes by the Superior Council of Sports.

Universities may adapt to the special conditions of students with disabilities the tests for the assessment of personal skills for physical activity and sport, as referred to in the previous paragraph.

d) In the case of second-cycle teaching, it will be at the same time as the respective rules of access to them.

2. The universities may carry out evaluation tests for the control of skills and abilities in the oral and written communication of the foreign language concerned, in the case of double qualifications referred to in Article 12.2 of the Royal Treaty. Decree 1497 /l987 of 27 November.

3. In all the tests referred to in the previous two paragraphs, only the qualifying or unfit qualification shall be granted.

Additional provision second. Autonomous and inter-regional districts.

1. Where one or more Autonomous Communities have established that all or some of the universities which are dependent on them, after conformity with them, and in respect of the teachings and percentages which are determined in their case, shall be regarded as a single university for the purposes of the present Royal Decree, the references to the university contained therein shall be understood to be realized, when appropriate, to the autonomic or inter-regional district, as the case may be.

2. In any case, the provisions of the previous paragraph will not apply in the case of the National University of Distance Education (UNED).

Additional provision third. Students from centres attached to public universities.

For access to studies in centers attached to public universities, the priorities and assessment criteria set out in this Royal Decree will be applied.

Additional provision fourth. Deadlines and procedures.

1. For better coordination, the Ministry of Education and Culture, on a proposal from the Council of Universities, will establish, before 31 July 2000, the procedure, deadlines, percentages of gradual implementation in three courses and the other forecasts which, as a general rule, will apply to applications and the allocation of places in the open district.

The proposal of the Council of Universities should be carried out before April 30 of the same year.

2. The coordination rules referred to in the preceding paragraph shall take into account, in any event, that the number of places to be offered annually, during the period of gradual implementation of the open district, shall comprise all and each of the the lessons to be taught in the various universities which, for the academic year 2001-2002, will represent at least 20 per 100 of the places indicated.

3. Within the framework of the rules referred to in this Article, the Autonomous Communities may, after reporting by the universities in their territory, take measures to adapt them to the peculiarities arising from their situations. specific.

Additional provision fifth. Competence title.

This Royal Decree, which is issued under the provisions of Articles 149.1.30.a of the Constitution and 26.1 of the Organic Law 11/1983, of 25 August, of University Reform, has the character of a basic rule.

First transient disposition. Vocational training.

As the extinction of second-degree vocational education studies begins, the percentage of places to be reserved for students from vocational training will be maintained at 30 per 100. From that moment on, and until its extinction, the reduction of the percentages of places to be reserved can only be carried out in a progressive way.

Second transient disposition. General offer of places in Spanish universities.

1. As long as the Council of Universities does not establish the objective modules referred to in Article 1.3 of this Royal Decree, the universities, according to the respective Autonomous Communities, will determine the capacity of the institutions and the number of places for each of the degrees that are given in the same courses, for each academic year, taking into account the minimum requirements of Royal Decree 557/1991, of 12 April, on the creation and recognition of universities and centres university.

The offer of seats will be communicated to the Council of Universities, which will approve the general offer of teaching that must be published in the "Official State Gazette" before June 30 of the current year.

2. The provisions of paragraph 1 above shall also apply to centres attached to public universities.

Transitional provision third. Requirements met before the 1988-1989 course.

1. For the purposes referred to in the first paragraph of Article 10:

(a) Students who, having approved the course of university orientation before the academic year 1988/1989, perform the test of access to the university after the entry into force of this Royal Decree, choose, for the purpose of a request for a place, between the studies legally linked to the options of the superimposed COU.

b) Students who, meeting the conditions required to access the university prior to the course 1988/1989, request the commencement of university studies after the entry into force of this Royal Decree, they will elect, for the purpose of application of the square, between the studies legally bound to the options of the superadas COU.

2. The provisions of the second subparagraph of Article 10 shall apply to the cases referred to in paragraph 1.

It is for the Minister of Education and Culture in the field of his or her competence and without prejudice to the Autonomous Communities to dictate how many provisions are necessary for the development and implementation of the provisions of the present Royal Decree.

Final disposition third. Entry into force.

This Royal Decree, including the fourth additional provision, shall enter into force on the day following that of its publication in the "Official Gazette of the State", with the exception of the provisions of Article 9 and concordant relating to the district open, which will apply to those who will start university studies in the academic year 2001-2002.

During the period of gradual implementation of the open district, as referred to in the fourth additional provision of this Royal Decree, the application and award of places not offered in the same shall be carried out in the form established in Royal Decree 704/1999 of 30 April 1999, without any application of the rules which on the reservation of places of the so-called shared district are contained in its article 18 and concordant.
