Article 2.2. j) of law 50/1997, of 27 November, the Government, attributed to the competition Chairman for create, modify, and delete, by Royal Decree, ministerial departments and secretariats of State.


In order to boost the action of the Government, facilitating the development of its political programme and provide greater efficiency to the General Administration of the State, it is considered convenient to reform the current ministerial structure.


By virtue, on the proposal of the President of the Government: D I S P O N G O: article 1.


The General Administration of the State is structured in the following ministries: Ministry of Foreign Affairs.


Ministry of Justice.


Ministry of defence.


Ministry of finance.


Ministry of the Interior.


Ministry of public works.


Ministry of education, culture and sport.


Ministry of labour and Social Affairs.


Ministry of agriculture, fisheries and food.


Ministry of the Presidency.


Ministry of public administration.


Ministry of health and consumption.


Ministry of the environment.


Ministry of the economy.


Ministry of science and technology.


Article 2.


1 corresponds to the Ministry of finance the exercise of the powers so far attributed to the Ministry of economy and finance, through the following bodies: the Secretary of State of finance.


The Secretary of State budgets and expenses.


The General direction of the heritage of the State.


The General direction of Treasury and financial policy in the area of Treasury and public debt.


2 they are attached to the Ministry of finance, in addition to the Agencia Estatal de Administración Tributaria, the Fábrica Nacional de Moneda y Timbre-real Casa de la Moneda, the mobile State Park, the national agency of Loterías y Apuestas del Estado and the State industrial holdings company.


3. the Ministry of finance is structured in the following governing bodies: Ministry of finance.


Secretary of State budgets and expenses.


Article 3.


1 correspond to the Ministry of education, culture and sport skills so far attributed to the Ministry of education and culture, with the exception of the transferred to the Ministry of science and technology in the field of scientific research and technological development.


2. the Ministry of education, culture and sport is structured in the following governing bodies: Secretary of State for education and universities.


Secretary of State for culture.


Article 4.


1 correspond to the Ministry of economy the following powers: to) the hitherto attributed to the Ministry of economy and finance, through the following bodies: the Ministry of State of the economy, except for those corresponding to the General direction of Treasury and financial policy in the area of Treasury and public debt.


The Secretary of State of trade, tourism and small and medium-sized enterprises.


(B) so far attributed to the Ministry of industry and energy, through the following bodies: the Department of energy.


The Directorate General of mines.


2 correspond, also to the Ministry of economy until now powers conferred on the Ministry of public works, in relation to the regulation, establishment and control of the rates for telecommunication services.


3 they are attached to the Ministry of economy, as well as entities and agencies currently dependent on the Ministry of economy and the Ministry of trade, tourism and small and medium-sized enterprises, the National Commission of the stock market, the Commission for the telecommunications market, and the National Energy Commission.


4. the Ministry of economy is structured in the following governing bodies: Ministry of economy, energy and small and medium-sized enterprises.


Secretary of State for trade and tourism.


Article 5.


1 corresponds to the Ministry of science and technology, as the Department responsible for the policy of promotion and general coordination of scientific and technical research, technological development and the management of communications, the exercise of the powers so far attributed to the following bodies: the Secretary of State of education, universities, research and development, scientific research and technological development.


The General Secretary of communications, the Ministry of public works, except the powers corresponding to the public entity business post and telegraph.


The Office of science and technology, attached to the Presidency of the Government.


The Directorates-General for industry and technology and industries and information technology, the Ministry of industry and energy.


2 are assigned to the Ministry of science and technology, the Spanish Office of patents and trademarks and the following entities and bodies of scientific and technical research: Consejo Superior de Investigaciones Científicas.


Instituto de Astrofísica de Canarias.


Centre for energy, environment and technology research.


Institute for the diversification and saving of energy.


Centre for technological and Industrial development.


National Institute of agricultural research.


Spanish Oceanography Institute.


Spain Geomining technological Institute.


3. the Ministry of science and technology is structured in the following governing bodies: Ministry of scientific and technological policy.


Secretary of State for telecommunications and the information society.


Article 6.


1. the Ministry of Foreign Affairs is divided into the following governing bodies: Ministry of Foreign Affairs.


Secretary of State for the European Union.


Secretary of State for international cooperation and Latin America.


2. the Secretary of State for Foreign Affairs shall exercise the powers currently attributed to the Secretary of State for foreign policy and for the European Union, with the exception of that attribute in the following section to the Secretary of State for the European Union, as well as those corresponding to the Directorate General of Legal Affairs and consular.


3. the Secretary of State for the European Union will be responsible for the formulation and execution of foreign policy in the field of the European Union.


4. the Secretary of State for international cooperation and for Latin America will keep its current powers and assume the corresponding to the Directorate-General of foreign policy for Latin America.


Article 7.


The Secretary of State for territorial administrations of the Ministry of public administration, becomes known as Secretary of State for Territorial Organization of the State. In addition to the powers currently attributed, it will assume the related with the Government delegations, in accordance with the provisions of article 32 of law 6/1997, of 14 April, of organization and functioning of the General Administration of the State.


Sole repeal provision.


Many provisions of equal or lower rank to oppose provisions of this Royal Decree are repealed.


First final provision.


I(i) the following ministerial departments and Secretaries of State are: Ministry of economy and finance.


Ministry of education and culture.


Ministry of industry and energy.


Secretary of State and foreign policy for the European Union.


Ministry of education, universities, research and development.


Secretary of State for industry and energy.


Secretary of State for communication.


Secretary of State for territorial administrations.


Second final provision.


Public bodies shall be attached to the ministerial departments in accordance with the distribution of powers laid down in the present Royal Decree, and on terms to be determined in the royal decrees that approval of the corresponding organizational structure.


Third final provision.


The Ministry of finance will perform the deletions, transfers and credit ratings necessary to give effect to the provisions of this Royal Decree. Executive bodies, administrative units, and the jobs of government ministries will remain, until the implementation of the corresponding Royal Decrees of organizational structure, object of abolition or reform.


Fourth final provision.


This Royal Decree shall enter force the day of its publication in the "official bulletin of the State".
