Royal Decree 557/2000, of 27 April, of restructuring of ministerial departments, has created the Ministry of Education, Culture and Sport, whose powers are those conferred before the Ministry of Education and Culture, exception made from those assumed by the Ministry of Science and Technology, created by the same Royal Decree. In turn, the Royal Decree 691/2000 of 12 May, establishing the basic organic structure of the new Department, has adapted the competencies of the same to the current requirements, although some of those that are now distributed between The Directorates-General of the General Secretariat for Vocational Education and Training is a certain change in the allocation of powers made by the Royal Decree in its first provision.

It is now necessary to develop the basic organic structure of the Department through the present Royal Decree, in which the higher bodies and directors of the Ministry of Education, Culture and Sport are determined up to the level of General sub-direction and the competences of each of these bodies are defined.

In its virtue, at the initiative of the Minister of Education, Culture and Sport, on a proposal from the Minister of Public Administration and after deliberation by the Council of Ministers at its meeting on 7 July 2000,

D I S P O N G O:

Article 1. General organization of the Department.

1. The Ministry of Education, Culture and Sport is the body of the General Administration of the State responsible for the proposal and implementation of the Government's general guidelines on educational, cultural and sports policies.

2. The Ministry of Education, Culture and Sport, under the top leadership of the Department's head, develops the functions that legally correspond to him through the following higher and managerial bodies:

(a) The Secretary of State for Education and Universities.

b) The Secretary of State for Culture.

c) The General Secretariat for Vocational Education and Training.

d) The Assistant Secretary for Education, Culture and Sport.

3. The Superior Council of Sports, an autonomous body assigned to the Ministry of Education, Culture and Sport, whose President has the rank of Secretary of State, shall exercise the powers conferred on him by Law 10/1990 of 15 October of the Sport, and Royal Decree 286/1999, of 22 February, on the organic structure and functions of the Superior Council of Sports and of adequacy of the body to Law 6/1997, of April 14, of Organization and Operation of the General Administration of the State.

4. As a body of immediate assistance to the Minister, there is a Cabinet, with an organic level of general direction, with the structure and functions set out in Article 10.1 of Law 50/1997 of 27 November, of the Government, and in Article 12.2 of the Royal Decree 839/1996 of 10 May.

5. The Minister of Education, Culture and Sport holds the Presidency of the Council of Universities and of the Sectoral Conferences of Directors of Education and Culture of the Councils of Government of the Autonomous Communities.

6. It also corresponds to the Minister of Education, Culture and Sport the Presidency of the Autonomous Bodies National Museum of the Prado, Museo Nacional Centro de Arte Reina Sofía, National Library, National Institute of the Performing Arts and the Music and Institute of Cinematography and Audiovisual Arts.

7. The School Board of the State is a consultative body of the Ministry of Education, Culture and Sport and exercises the functions attributed to it in Article 32 of the Law of the Organic Law 8/1985, of 3 July, Regulatory of the Right to Education, and the Royal Decree 2378/1985 of 18 December 1985 on the organization and functioning of the State School Board.

Article 2. Secretary of State for Education and Universities.

1. The Secretary of State for Education and the Universities exercises the powers provided for in Article 14 of Law 6/1997 of 14 April of the Organization and the Functioning of the General Administration of the State.

In particular, the following functions correspond to:

(a) The top management of the competencies that correspond to the Department in the field of non-university education and vocational training.

b) The coordination, support and supervision of the activities related to the management, programming and management of the Department in the field of higher education, as well as the management of the access tests.

(c) The orientation and impetus of international relations in education, in coordination with the Ministry of Foreign Affairs, as well as the follow-up of the actions of the European Union in this field, all without prejudice to the duties of the Deputy Secretary of the Department.

d) The relationship with the professional associations or their general councils, where appropriate in accordance with the legislation in force in this field.

2. They depend on the Secretary of State for Education and Universities, the following governing bodies:

(a) General Secretariat for Vocational Education and Training.

b) General Directorate of Universities.

3. As a body of immediate assistance to the Secretary of State, there is a Cabinet, with an organic level of general sub-management, with the structure and functions set out in Articles 10.1 of Law 50/1997 of 27 November and 12.3 of the Royal Decree of 27 November 1997. Decree 839/1996 of 10 May 1996, to which the functions not attributed to other management bodies of the Secretariat of State shall correspond.

4. They are administratively related to the Ministry of Education, Culture and Sport through the Secretary of State for Education and Universities:

(a) The Council of Universities, regulated in Title III of the Organic Law 11/1983, of 25 August, of University Reform, and in the Royal Decrees 552/1985, of April 2, and 1212/1985, of July 17.

b) The National University of Distance Education.

c) The International University "Menendez Pelayo".

(d) The Institute of Spain and the Royal Academies integrated in the latter, without prejudice to the joint exercise with the Secretariat of State of Culture of the functions which affect matters peculiar to the field of competence of the latter.

5. The College of Spain in Paris is functionally dependent on the Ministry of Education, Culture and Sport through the Secretary of State for Education and Universities.

Article 3. General Secretariat for Vocational Education and Training.

1. To the General Secretariat for Education and Vocational Training, the holder of which has a rank of Under-Secretary, the following functions correspond to:

(a) Actions relating to the ordination, evaluation and innovation of the general and special rules of procedure referred to in the Organic Law 1/1990 of 3 October of General Ordination of the Educational System, as well as the compliance with the obligations of the public authorities in the field of education, the implementation of vocational training and educational innovation programmes and the promotion of equal opportunities in access to education.

b) The programming and management of education in the field of territorial competence of the Ministry of Education, Culture and Sport, the development and dissemination of educational guidance derived from the legislation in force in the In the field of special arrangements, the preparation of the rules of State competition relating to the institutions in the teaching before university, as well as the promotion of vocational training and basic academic management of their corresponding teachings.

c) The impetus and coordination of relations with the Autonomous Communities and local corporations, in educational matters, as well as the support and assistance to the Conference provided for in Article 28 of the Organic Law 8/1985, 3 July, the regulator of the Right to Education.

2. The following management bodies depend on the General Secretariat for Education and Vocational Training:

(a) Directorate-General for Education, Vocational Training and Educational Innovation.

b) Directorate-General for Territorial Cooperation and High Inspection.

3. The following units are also dependent on the General Secretariat for Vocational Education and Training at the general sub-directorate-general level:

a) Technical Cabinet, as an immediate assistance body to the Secretary General for Education and Vocational Training.

b) Higher Education Institute of the Teacher, whose director has a category of deputy director-general, who will be responsible for carrying out the training programmes and activities of the teaching professionals.

4. It will depend on the General Secretariat for Education and Vocational Training, the National Institute of Quality and Evaluation, regulated by Royal Decree 928/1993, of 18 June, whose director has a category of deputy director general.

Article 4. Directorate-General for Education, Vocational Training and Educational Innovation.

1. The Directorate-General for Education, Vocational Training and Educational Innovation will exercise the following powers:

(a) The development and dissemination of educational guidance derived from the legislation in force in the field of special regime teaching.

b) The educational orientation and the basic legal regime of the foreign centers that teach in Spain prior to the university.

c) The exercise of the educational inspection function attributed to the Department.

d) The programming and management of education in the field of territorial competence of the Ministry of Education, Culture and Sport.

e) The elaboration of the State competition rules regarding the minimum requirements to be met by the educational institutions in accordance with the legislation in force.

(f) The basic academic management of general training courses for vocational training, the drawing up and implementation of plans to promote equal opportunities in the face of vocational training and vocational training. planning and evaluation of the social security programmes.

g) The design and development of guidance plans for the integration of the labour market into the labour market and the management of support from the European Social Fund.

h) The management and management of the National Agency Leonardo.

i) The design and development of guidance in education and training throughout the life of the adult population.

k) Innovation, experimentation and curricular development of teaching, as well as the elaboration and dissemination of curriculum materials and other supporting documents that provide teachers with the performance of their functions, without prejudice to the powers conferred on the Technical General Secretariat.

l) The organization and operation of the library and archive of the Department, in educational matters.

(m) The dissemination and development of European programmes and agreements on education and training related to the teaching of the university.

n) The direction and management of the Socrates National Agency.

n) The promotion and development of programs aimed at the compensation of inequalities and attention to disadvantaged sectors.

o) The planning and management of resources and grants for actions aimed at the compensation of inequalities and the follow-up of these actions.

2. The Directorate-General for Education, Vocational Training and Educational Innovation is structured in the following units with an organic level of Subdirección General:

(a) Subdirectorate-General for Educational Action, which shall carry out the tasks assigned to the Directorate-General in paragraphs (a), (b), (c), (d), (e), (n) and (o) of paragraph 1.

(b) Subdirectorate-General for Vocational Training, which shall carry out the tasks assigned to the Directorate-General in paragraphs (f), (g), (h) and (i) of paragraph 1.

c) The National Centre for Education Information and Communication, in which the New Information and Communication Technologies Programme and the Centre for Innovation and Development of Distance Education are integrated, and which exercise the functions conferred on the Directorate-General in paragraph 1 (j).

(d) The Educational Research and Documentation Centre, which shall exercise the functions assigned to the Directorate-General in paragraphs (k) and (l) of paragraph 1.

(e) General Subdirectorate of European Programmes, which shall exercise the functions conferred on the Directorate-General in paragraphs (m) and (n) of paragraph 1.

Article 5. Directorate-General for Territorial Cooperation and High Inspection.

1. The Directorate-General for Territorial Cooperation and High Inspection shall perform the following tasks:

(a) The basic academic management of general regime teachings corresponding to the levels of early childhood education and primary education.

(b) The basic academic management of general education courses corresponding to the levels of compulsory secondary education and high school.

(c) The planning of the test of access to the University, as referred to in Article 29 of the Organic Law 1/1990, of 3 October, of General Ordination of the Educational System, without prejudice to the competences attributed to the General Directorate of Universities.

d) The promotion and promotion of the relations of coordination and cooperation with the Autonomous Communities and Local Corporations, in the field of education, as well as the promotion of information among the different administrations education.

e) Assistance and support to the Conference provided for in Article 28 of Organic Law 8/1985 of 3 July, regulating the Right to Education.

f) The organization and direction of the documentation, studies and regulatory follow-up of the Autonomous Communities.

g) The adoption or proposal of measures arising from the exercise of the powers of high inspection of the State in the field of education.

h) The study and development of reports for the declaration of equivalences between studies of the Spanish education system.

2. The Directorate-General for Territorial Cooperation and High Inspection is structured in the following units with an organic level of Subdirectorate General:

(a) Subdirectorate-General for Relations with Territorial Administrations, which shall exercise the functions assigned to the Directorate-General in paragraphs (d), (f) and (j) of paragraph 1.

(b) Subdirectorate-General for Academic Management, which shall carry out the tasks assigned to the Directorate-General in paragraphs (a), (b), (c), (h) and (i) of paragraph 1.

(c) Subdirectorate-General of High Inspection, which shall exercise the functions assigned to the Directorate-General in paragraph 1 (g).

(d) Subdirectorate-General for Education Grants and Promotion, which shall exercise the functions assigned to the Directorate-General in paragraphs (k) and (l) of paragraph 1.

3. It also depends on the Directorate-General of the Secretariat of the Sectoral Education Conference, the holder of which will have the status of Deputy Director-General, who shall exercise the functions assigned to the Directorate-General in paragraph 1 (e).

Article 6. General Directorate of Universities.

1. The General Directorate of Universities shall exercise the following powers:

(a) Those attributed to the General Administration of the State in relation to the design and planning of the innovation policy of higher education and the improvement of its quality, as well as the competencies attributed to the General Administration of the State in relation to the National University of Distance Education.

(b) The preparation of the State's competition rules on higher education and access to the University, without prejudice to the powers of the General Secretariat for Vocational Education and Training.

c) Coordination and high inspection in the field of higher education, without prejudice to the competencies attributed to the Council of Universities in Article 23 of the Organic Law 11/1983 of 25 August.

(d) The approval of diplomas of private universities and centres attached to public universities, the recognition for civil purposes of studies of the universities of the Church and the declaration of equivalence and approval of diplomas to official university degrees.

e) Those that correspond to the Department regarding the training of specialists in health sciences, relations with health institutions, the granting of Spanish titles of specialties in health sciences, as well as the type-approval of foreign certificates of the same specialities.

f) Training, mobility, improvement and updating of knowledge of university teachers and university assistants.

g) The promotion and dissemination of knowledge generated in higher education institutions, in coordination with the Ministry of Science and Technology.

h) The implementation of the evaluation, study and prospective activities in the field of the programs managed by the General Directorate of Universities, and in particular those related to innovation and improvement of the quality of the higher education.

i) The promotion and promotion of the quality of university faculty activity.

2. The General Directorate of Universities is structured in the following units with an organic level of Subdirectorate General:

(a) Subdirectorate-General for Legal Regime and University Coordination, which shall exercise the functions assigned to the Directorate-General in paragraphs (a), (b), (c) and (d).

(b) Subdirectorate-General for Specialties in Health Sciences, which shall exercise the functions assigned to the Directorate-General in the paragraph (e).

(c) Subdirectorate-General for Grants and Aid for Training, Mobility, Perfecting and Updating of Knowledge of University Professors and University Assistants, which shall exercise the functions assigned to the Directorate General in paragraphs (f) and (g).

(d) Subdirectorate-General for Studies and Analysis, which shall exercise the functions assigned to the Directorate-General in paragraphs (h) and (i).

3. It relates administratively to the Ministry of Education, Culture and Sport, through the General Directorate of Universities, the National Evaluation Commission of the Research Activity, regulated in Royal Decree 1086/1989, of August 28, on the remuneration of university teachers.

Article 7. Secretary of State for Culture.

1. The Secretariat of State for Culture exercises the powers laid down in Article 14 of Law 6/1997 of 14 April, in respect of the units which are dependent on it.

In particular, the following functions correspond to:

(a) The promotion, protection and dissemination of the Spanish Historical Heritage, the state museums and the plastic arts.

b) The promotion of books and reading, the encouragement of literary creation and the promotion, protection and dissemination of state archives and libraries.

c) The promotion and participation in cultural cooperation actions with public administrations and with natural or legal persons, public or private.

d) The promotion, protection and dissemination of performing arts, music, dance and circus.

e) The promotion, protection and dissemination of cinematographic and audiovisual activities of production, distribution and exhibition.

(f) The orientation and impetus of international relations in the field of culture, in coordination with the Ministry of Foreign Affairs, as well as the follow-up of the actions of the European Union in this field, all without prejudice to the duties of the Deputy Secretary of the Department.

g) Under the Ministry of Education, Culture and Sport, through the Secretariat of State of Culture, the autonomous bodies National Museum of the Prado, Museo Nacional Centro de Arte Reina Sofía, National Library, Institute of the Cinematography and the Audiovisual Arts and the National Institute of the Performing Arts and Music.

2. They depend on the Secretariat of State for Culture, the following governing bodies:

a) General Directorate of Fine Arts and Cultural Property.

b) General Directorate of the Book, Archives and Libraries.

c) Directorate-General for Cultural Cooperation and Communication.

3. Article 8. General Direction of Fine Arts and Cultural Property.

1. It is up to the Directorate General of Fine Arts and Cultural Property to develop the following functions:

(a) The formation of the Register of Goods of Cultural Interest and the General Inventory of Furniture.

b) The proposed acquisition of Spanish Historical Heritage assets and the measures to be taken for the protection and protection of the property.

(c) Coordination with the Ministry's units involved in the management of Spanish Historical Heritage assets, as well as with the other ministerial departments and, where appropriate, with the other public administrations.

d) The management of the State-owned museums attached to the Department, and the advice regarding State-owned museums that are dependent on other Ministries except that such management is the subject of an agreement with the Autonomous Communities.

e) The elaboration and execution of plans for the conservation and restoration of the real estate of the Historical Heritage, without prejudice to the functions attributed to the Management of Infrastructures and Equipment of Education and Culture, as well as cooperation with other public administrations and public or private entities for the development of such plans and their monitoring.

f) The elaboration and implementation of plans for the conservation and restoration of the movable property of the Historical Heritage, as well as of the funds that constitute the documentary and bibliographic heritage and the cooperation with others Public administrations and public or private entities for the development of such plans and their monitoring.

g) The archiving and systematization of the works carried out and the documentation available on Historical Heritage, research and study on criteria, methods and techniques for the conservation and restoration of the same, as the training of technicians and specialists in the conservation and restoration of the real estate and furniture belonging to that heritage.

h) The promotion of artistic creation and exhibitions and any other activities for the dissemination of plastic arts.

2. The following units with organic level of General Subdirectorate General depend on the General Direction of Fine Arts and Cultural Property:

(a) Subdirectorate-General for the Protection of the Historical Heritage, to which the execution of the functions attributed to the Directorate-General in paragraphs (a), (b) and (c) of paragraph 1 corresponds.

(b) Subdirectorate-General of State Museums, to which the execution of the function attributed to the Directorate-General in paragraph (d) of paragraph 1 corresponds.

(c) Subdirectorate-General of the Spanish Historical Heritage Institute, which is responsible for the execution of the functions assigned to the Directorate-General in paragraphs (e), (f) and (g) of paragraph 1.

(d) Subdirectorate General for the Promotion of Fine Arts, to which the execution of the functions attributed to the Directorate-General in paragraph 1 (h) corresponds.

3. The General Direction of Fine Arts and Cultural Property is attached to the Board of Qualification, Valuation and Export of Property of the Spanish Historical Heritage.

Article 9. General Direction of the Book, Archives and Libraries.

1. It corresponds to the General Direction of the Book, Files and Libraries the development of the following functions:

a) The promotion and national and international dissemination of the Spanish letters.

b) The development of programmes and concerted plans for the establishment and promotion of libraries, through the provision of technical services and advice on library matters.

c) The creation, provision and promotion of State-owned libraries, without prejudice to the management of these libraries by agreement with the Autonomous Communities.

d) The design and development of library utilization campaigns.

e) The collection, exploitation, and utilization of library statistics data.

f) Librarian assistance to special sectors of the population that cannot use the usual services of public libraries.

g) The promotion of reading through campaigns to promote the reading.

h) The promotion of the book by means of support for the editing and participation in national and international fairs and exhibitions.

i) The study and proposal of actions in relation to the publishing industry and the book in general.

j) The promotion and support of literary creation and translation, by means of convocation and grant of scholarships, prizes and any other type of stimulus.

k) The management of the State-owned files attached to the Department and the advice regarding State-owned files that are dependent on other Ministries, unless such management is the subject of an agreement with the Autonomous Communities.

2. Depending on the General Direction of the Book, Files and Libraries the following units with organic level of Subdirection General:

(a) General Librarian Coordination Sub-Directorate, which is responsible for the execution of the tasks assigned to the Directorate-General in paragraphs (b), (c), (d), (e) and (f) of paragraph 1.

(b) Subdirectorate-General for the Promotion of the Book, Reading and Spanish Letters, which corresponds to the execution of the functions attributed to the Directorate-General in paragraphs (a), (g), (h), (i) and (j) of paragraph 1.

(c) Subdirectorate-General of the State Archives, which corresponds to the execution of the functions attributed to the Directorate-General in paragraph 1 (k).

Article 10. Directorate-General for Cooperation and Cultural Communication.

1. It is for the Directorate-General for Cooperation and Cultural Communication to develop the following functions:

a) Prepare and, where appropriate, execute cultural action programs in collaboration with other institutions, entities, and public and private individuals.

b) Facilitating access to culture through programmes of promotion and cultural dissemination and of information and communication tools.

c) To promote the involvement of society in the processes of creation, cultural dynamization and the obtaining of resources through programs of sponsorship, volunteering and cultural tourism, in coordination, in the latter case, with the bodies of the General Administration of the State responsible for tourism promotion.

d) to establish and manage, where appropriate, the subsidy and aid scheme which is not a specific competence of another management body, in accordance with the objectives set out in the programmes of the Ministry.

e) Develop and implement the cultural action of the Ministry which is general in nature and which does not correspond to specific competencies of the other Directorates-General or autonomous agencies of the Department.

f) Cooperate with the cultural action of the Autonomous Communities, promoting, according to them, the cultural communication between them, the knowledge of the plurality and richness of their respective Cultural Patrimony, thus as the exchange of information on their cultural activities.

g) Facilitating knowledge of the cultural diversity of Autonomous Communities abroad, according to them.

(h) To participate in the preparation of international, bilateral or multilateral treaties, conventions and programs aimed at promoting cultural exchanges.

i) To advise on Spanish participation in international bodies, without prejudice to the competences of the Ministry of Foreign Affairs.

j) Cooperate in the cultural projection of Spain abroad.

The functions (g), (h), (i) and (j) shall be carried out in coordination with the Ministry of Foreign Affairs and diplomatic missions abroad and without prejudice to the functions of coordination and impetus in relation to relations International relations with the Secretariat.

2. The following units with the organic level of Subdirectorate General are dependent on the Directorate-General for Cultural Cooperation and Communication:

(a) Subdirectorate-General for Action and Cultural Promotion, which is responsible for the execution of the tasks assigned to the Directorate-General in paragraphs (a), (b), (c), (d) and (e) of paragraph 1.

(b) Subdirectorate-General for Cultural Communication with the Autonomous Communities, which is responsible for the execution of the tasks assigned to the Directorate-General in paragraphs (f) and (g) of paragraph 1.

(c) Subdirectorate-General for International Cultural Cooperation, which is responsible for the execution of the functions assigned to the Directorate-General in paragraphs (h), (i) and (j) of paragraph 1.

Article 11. Deputy Secretary for Education, Culture and Sport.

1. It is for the Secretariat for Education, Culture and Sport to exercise the powers referred to in Article 15 of Law 6/1997 of 14 April.

2. In particular, the following functions are assigned to the Secretariat:

(a) The elaboration and coordination of the Department's overall plans for budgetary, personal and remuneration policy, economic programming and budgetary control.

(b) The promotion, coordination, support and supervision of the activities of drafting general provisions of the Department, as well as the publication thereof.

(c) The direction, impetus and management of the functions related to the handling of the affairs of the Council of Ministers, the Government's Delegate Commissions and the General Commission of Secretaries of State and Undersecretaries.

d) The rationalization and computerization of services, statistics, information and administrative documentation.

e) The coordination and impetus of the Department's international relations, especially with the European Union, as well as international cooperation, without prejudice to the competences of the Ministry of Foreign Affairs.

f) The promotion and coordination of the relations of the Ministry of Education, Culture and Sport with the courts, with the other departments of the General Administration of the State and its peripheral organs and with the Delegates and Deputy Government delegates.

g) The direction of the inspector's function on the ministry's departments, agencies and agencies, in particular with regard to the personnel, procedure, economic regime, facilities and facilities thereof, without prejudice to the functions of the Education Inspectorate.

h) The management of general administrative services and the dispatch of matters not attributed to the competence of other higher bodies of the Ministry.

3. The following management bodies depend on the Under-Secretary for Education, Culture and Sport:

(a) Technical General Secretariat.

b) Directorate-General for Economic Programming, Personnel and Services.

4. The following units with the organic level of Subdirectorate General are also dependent on the Secretariat:

(a) Technical Cabinet, as an organ of support and immediate assistance to the Assistant Secretary, to which the functions not attributed to other executive organs of the Secretariat will be the same.

b) General Inspection of Department Services, to which the functions attributed in the current regulations correspond.

5. They also depend on the Secretariat for Education, Culture and Sport, without prejudice to the functional dependence of the Ministries of Justice and Finance, respectively, the following units with organic level of Subdirectorate General:

(a) State attorney, in accordance with the provisions of Law 52/1997 of 27 November 1997 on Legal Assistance to the State and Public Institutions, with the functions assigned to it by its specific rules.

b) The Delegated Intervention of the General Intervention of the State Administration, with the functions that the current rules attribute to it.

6. The State School Board is administratively related to the Department through the Secretariat.

Article 12. Technical General Secretariat.

1. The Technical General Secretariat is the management body of the Department to which it is responsible to exercise the following powers:

(a) The study, report, processing and elaboration, if any, of the draft general provisions to be issued or proposed to the Department, the preparation of reports on the subjects to be submitted to the Council of Ministers, Commission Delegated Commissions and General Commission of Secretaries of State and Undersecretaries, as well as actions related to the publication of provisions and administrative acts of the Department in the "Official Gazette". of the State "and" Bulletin of the Ministry of Education, Culture and Sport ".

(b) Coordination of international educational and cultural cooperation programmes, of a bilateral or multilateral nature, in particular with the European Union, as well as the management of the Department's competences related to the educational institutions and other Spanish educational services abroad and, in general, the direction of the actions in the international field in the areas of competence of the Department, according to and in coordination with the Ministry of External.

c) The guidelines for the issuance of Spanish official titles and the management of the National Register of Titles, without prejudice to the competencies attributed to the General Directorate of Universities in this Royal Decree.

(d) the approval and validation of foreign certificates and studies and the approval of the equivalence of scales of qualifications of the same at the non-university level, as well as the application of the own rules of the recognition of diplomas for the exercise of the right of establishment and freedom to provide services in the field of the Department's powers.

e) The processing and proposal for the resolution of administrative appeals against the provisions and acts of the Department and agencies that are dependent on it, as well as the claims of patrimonial liability.

f) The management of the competencies of the Ministry of Education, Culture and Sport in respect of the foundations whose protectorate corresponds to this Department.

g) The communication of the Department with the professional and industrial sectors of production and dissemination of the works of creation, the proposal of the appropriate measures for the defense and protection of the intellectual property in Spain and the exercise of the functions corresponding to the Department in the field of the registration of intellectual property.

h) The development of the functions of the Department regarding the collective management entities of intellectual property rights.

i) To provide technical assistance that requires Spanish participation in international intellectual property bodies.

j) The realization and editing of compilations and publications, as well as the editing of didactic materials of the Department.

k) Administrative information and attention to the citizen.

2. The following units with an organic level of General Subdirection depend on the Technical General Secretariat:

(a) Deputy Secretary-General, who shall perform the tasks assigned to the Technical Secretariat in paragraph 1 (a).

(b) Subdirectorate-General for International Cooperation, which shall exercise the functions assigned to the Technical Secretariat in paragraph 1 (b).

(c) General Subdirectorate of Titles, Convalidations and Homologations, which shall exercise the functions assigned to the Technical Secretariat in paragraphs (c) and (d) of paragraph 1.

(d) Subdirectorate-General for Resources, which shall carry out the tasks assigned to the Technical General Secretariat in paragraph 1 (e).

(e) Subdirectorate-General of the Protectorate of Foundations, which shall exercise the function assigned to the Technical General Secretariat in paragraph 1 (f).

(f) Subdirectorate-General for Intellectual Property, which shall exercise the functions conferred on the General Secretariat of the Technical Secretariat in paragraph 1 (g), (h) and (i).

(g) Subdirectorate-General for Information and Publications, which shall carry out the tasks of the General Secretariat as referred to in paragraph 1 (j) and (k), as well as the management of matters of a general nature allocated to other units of the said management body.

Article 13. Directorate-General for Economic Programming, Personnel and Services.

1. The Directorate-General for Economic Programming, Personnel and Services exercises the following powers:

(a) The study and economic report of the acts and provisions with economic-financial impact on the budgets of expenditure and revenue.

b) The determination of the structure of the programmes and sub-programmes in which the activity of the Department is specified, the preparation and processing of the annual preliminary draft budget, the monitoring of the implementation of the appropriations budget and the processing of its amendments.

c) Planning, elaboration and maintenance of the integrated systems of statistics of the Department and the development of studies on demographic, economic and social aspects applied to the management of the Department.

d) The coordination in the field of statistics with the autonomous agencies of the Department, with the National Statistics Institute, with other public administrations and with international organizations.

e) The development of studies, reports and analyses to support the adoption of measures or the assessment of the results of the measures implemented.

f) the coordination and monitoring of the implementation of European or international funds for programmes or projects of the Department and its self-employed bodies and of actions financed or co-financed with them.

g) Monitoring the degree of achievement of objectives with respect to programmes and actions to be determined in the annual State Budget Law.

h) The coordination of all expenditure units of the Department and its self-employed bodies for the purpose of implementing measures for the control and effectiveness of public expenditure.

i) The analysis and coordination of how many financial resources are allocated by the Ministry.

j) The proposal of the personnel policy assigned to the Department.

k) The impetus of the statutory renewal of the teaching public function as well as the coordination with the remaining educational administrations in the field of the Staff Committee of the Sectoral Conference of Education.

(l) forecasting the needs of the Department's staff, drawing up and proposing changes in their employment relationship, drawing up rules and guidelines on remuneration arrangements and their implementation, as well as the provision of staff expenditure and monitoring.

m) The management and administration of human resources and, in particular, actions related to income, mobility, promotion, and the provision of jobs for the Department's own personnel, as well as the functions aimed at ensuring mobility at the national level of teaching staff.

n) The elaboration of training plans and the carrying out of courses and activities for the Department's staff, with the exception of the teaching staff.

n) The prevention of occupational risks.

o) The relationship with trade union organizations and other representative professional associations.

p) The preparation of plans and programmes of social action concerning all the personnel of the Ministry.

q) The Ministry's enabling and paying functions.

r) The internal regime of the Department's Central Services, as well as the equipment of administrative units, the preservation, intrend, operation and safety of buildings, supplies, training and updating the inventory of your movable property. It shall also exercise the powers relating to the Central Bank Unit of the Department.

s) The elaboration and implementation of the IT plans of the Department in collaboration with its different units; the design, programming, implementation and maintenance of IT applications, the management of the Data processing and technical assistance to users of distributed office and computer resources.

2. They depend on the Directorate-General for Economic Programming, Personnel and Services the following units with organic level of Subdirectorate General:

(a) Budget Office, which shall carry out the tasks assigned to the Directorate-General in paragraphs (a), (b) and (g) of paragraph 1, in addition to those corresponding to its specific rules.

(b) Statistical Office, which shall exercise the functions assigned to the Directorate-General in paragraphs (c) and (d) of paragraph 1.

(c) Subdirectorate-General for Economic Analysis and Management Control, which shall exercise the functions conferred on the Directorate-General in paragraphs (e), (f), (h) and (i) of paragraph 1.

(d) Subdirectorate-General for Human Resources Administration, which shall exercise the functions assigned to the Directorate-General in paragraphs 1), (m) and (q) in respect of the provision of staff, paragraph 1.

(e) Subdirectorate-General for the Management and Development of Human Resources, which shall exercise the functions assigned to the Directorate-General in paragraphs (j), (k), (n), (n), (o) and (p) of paragraph 1.

(f) General Staff, which shall carry out the duties assigned to the Directorate-General in paragraph (q), as regards the payment of the payment as well as in paragraph 1 (r).

(g) General Information Treatment Subdirectorate which shall exercise the functions assigned to the Directorate-General in paragraph 1 (s).

3. It is the responsibility of the Director-General for Economic Programming, Personnel and Services, the Presidency of the Management of Infrastructure and Equipment for Education and Culture, an autonomous body governed by Royal Decree 1379/1999 of 27 August.

Additional disposition first. Management of Infrastructure and Equipment of Education and Culture.

Articles 1.1, 3, 4.1 and 5.1 and 3 of Royal Decree 1379/1999 of 27 August 1999 on the Regulation of the Management of Infrastructure and Equipment for Education and Culture are worded as follows:

" Article 1.

1. The Management of Infrastructure and Equipment of Education and Culture is an autonomous body attached to the Ministry of Education, Culture and Sport through the Directorate General of Economic Programming, Personnel and Services. " " Article 3.

The Management of Infrastructure and Equipment for Education and Culture, in the educational and cultural field, will develop the following functions:

1. The development and monitoring of the programming of educational and cultural investments.

2. The promotion and development of investments and the monitoring of their implementation, in particular those of particular relevance.

3. The supervision of the work projects.

4. The elaboration of reports and technical studies on the state of the existing buildings dependent on the Department, as well as on any other building when required by that.

5. The drawing up of technical reports on compliance with the rules in force in private centres where the teaching of general non-university education is to be provided for the purposes of administrative authorisation.

6. The development of guidelines on buildings for educational establishments, their facilities, materials, construction and testing methods, and how many studies and works are deemed necessary for the performance of the functions identified.

7. The processing of administrative procedures for the implementation of infrastructure, in particular those relating to the management of the procurement of specific works for the creation or adequacy of infrastructure and the procurement of equipment, as well as inventory, conservation and control of stored stocks.

8. The property management of the buildings which the Department uses for any title, except where it is directly attributed to another Directorate-General or an autonomous body thereof.

9. The management and formalization of agreements with public and private entities, provided that they relate to matters covered by the competition of management, as well as the assumption of economic or other obligations arising from the subscribed and thus be established in them.

10. The development of technical work for the implementation of infrastructure.

11. Surveillance and inspection of the implementation of educational and cultural infrastructures, when they are the subject of total or partial funding from the budget of the body or the Department, as well as the accreditation of compliance with the requirements for the payment of the financial contributions granted.

12. The administration of human resources, the internal arrangements, the establishment of staff, the provision of information, the general file, the implementation of the body's general accounts, the preparation of its budget and its amendments, and settlement, payment and cash.

13. The creation, management and permanent updating of an integrated information system of the body, which shall contain data relating to the processing of centralised and unconcentrated management files. " " Article 4.

1. The President of the Management of Infrastructure and Equipment of Education and Culture is the Director-General of Economic Programming, Personnel and Services. " " Article 5.

1. They depend on the President of the Management of Infrastructure and Equipment for Education and Culture, the following units with organic level of Subdirectorate General:

(a) Technical Secretariat for Infrastructure, which shall perform the tasks assigned to the body in Article 3 (1), (2), (3), (4), (5) and (6).

He will also assist the President in the direction and coordination of his or her dependent services and in the dispatch of all matters entrusted to him or in the delegation.

(b) General Economic and Administrative Subdirectorate, which shall carry out the tasks assigned to the body in Article 3 (9), (12) and (13).

(c) Subdirectorate-General for Works, which shall perform the tasks assigned to the body in Article 3 (10) and (11).

(d) Subdirectorate-General for Procurement and Heritage Management, which shall exercise the functions conferred on the body in Article 3 (7) and (8). " " 3. To the President of the Management of Infrastructure and Equipment for Education

will be supplied by the Technical Secretary for Infrastructures in the cases of vacancy, absence or illness provided for in Article 17 of Law 30/1992, of 26 November, of the Legal Regime of the Public Administrations and of the Common Administrative Procedure. '

Additional provision second. Removal of organs.

A) The following units with General Subdirection level are deleted:

1. The Cabinet of the Secretary of State for Education, Universities, Research and Development.

3. The General Training Subdirectorate of the Teacher.

7. The General Subdirectorate of Artistic Teachings.

8. The Subdirectorate General for Special Education and Attention to Diversity.

9. The Directorate-General for Vocational Training Reglada.

10. The Deputy Director General of Permanent Education.

11. The Subdirectorate-General for Promotion and Professional Guidance.

12. The Subdirectorate-General for Scholarships and Study Aid.

13. The Deputy Directorate-General for Relations with the Autonomous Communities and the High Inspectorate.

14. The Subdirectorate-General of Provincial Directorates.

15. The Deputy Directorate-General for Education Inspection.

16. The Publications Centre.

17. The General Subdirectorate for Programming and Investments.

18. The Office of Planning and Statistics.

19. The General Subdirection of Programming of Effective.

20. The Assistant General Manager of Teacher Management for Child and Primary Education.

21. The Deputy Director General of Secondary Education, Vocational Training and Special Regime.

22. The General Administration of Management of General Administration and Labor.

B) The following units with a level of General Subdirection existing in the former Ministry of Education and Culture are also deleted as regards the current competences of the Ministry of Education, Culture and Sport:

1. The Subdirectorate-General for Training, Perfecting and Mobility of Researchers 2. The Subdirectorate-General for Scientific and Technical Research Projects.

3. The General Subdirectorate of Infrastructure and Scientific Policy Actions.

4. The National Assessment and Prospective Agency.

C) The following units with a level of General Sub-direction dependent on the Management of Infrastructure and Equipment for Education and Culture are deleted:

1. The General Secretariat.

2. The Subdirectorate-General for Technical Studies and Infrastructure Implementation Monitoring.

Additional provision third. Peripheral organization of the Department.

The peripheral units of the Ministry of Education, Culture and Sport in Ceuta and Melilla depend on it through the Directorate-General for Territorial Cooperation and High Inspection.

Additional provision fourth. Functional areas of high education inspection.

The functional areas of high education inspection integrated in the respective Government Delegations and governed by Royal Decree 1330/1997, of August 1, and other rules that apply to them, are functionally dependent. of the Ministry of Education, Culture and Sport through the Directorate-General for Territorial Cooperation and High Inspection.

Single transient arrangement. Units and positions of lower rank to Subdirectorate General.

1. The units and jobs with a lower organic level to the general sub-directorate will continue to remain and will be paid from the same budgets until the corresponding employment relationship of the Ministry of Education is approved. Education, Culture and Sport adapted to the organic structure approved by this Royal Decree. Such adaptation may in no case lead to an increase in public expenditure.

2. The units and posts of work in the organs removed by this Royal Decree shall be provisionally attached by means of a resolution of the Under-Secretary of State, until the new employment relationship, to the new bodies regulated in this Royal Decree according to the privileges assigned to them.

Single repeal provision. Regulatory repeal.

1. Royal Decree 1887/1996 of 2 August 1996 is repealed with the basic organic structure of the Ministry of Education and Culture, as amended by the Royal Decrees 121/1998 of 30 January and 83/1999 of 22 January.

2. Likewise, all provisions of equal or lower rank are repealed contrary to the provisions of this Royal Decree.

Final disposition first. Powers of development.

The Minister of Education, Culture and Sport is hereby authorized to take the necessary measures for the development and implementation of this Royal Decree, prior to the necessary legal formalities.

Final disposition second. Budgetary changes.

The Ministry of Finance will carry out the necessary budgetary changes for the fulfillment of the provisions of this Royal Decree.

Final disposition third. Entry into force.

This Royal Decree will enter into force on the day of its publication in the "Official Gazette of the State".
