Law 50/1998 of 30 December, of fiscal, administrative and social measures, provides, in the second paragraph of Article 61, that the Government at the initiative of the respective ministries of membership and of the Ministers of Public Administrations and Finance, shall approve the Statutes of each of the public research bodies.

The Center for Energy, Environmental and Technological Research, hereinafter CIEMAT, is a public research body attached to the Ministry of Science and Technology, in accordance with Law 13/1986 of 14 April, Promotion and General Coordination of Scientific and Technical Research, which establishes a common framework of organization and operation for public research bodies, setting up their functions and governing bodies, while introducing elements to streamline your management.

The Center for Energy, Environmental and Technological Research, given its background in energy and environmental research and its multidisciplinary reality, is a fundamental institution in the research and development in the field of energy, and it makes an essential work of approximation between the most basic research and industrial innovation. On the other hand, Law 50/1998, of 30 December, of Tax, Administrative and Social Order, in its Article 61, provides that the public research bodies referred to in Article 13 of Law 13/1986, 14 April, for the Promotion and General Coordination of Scientific and Technical Research, shall adopt the configuration of the Autonomous Body, established in Article 43.1.a) of Law 6/1997, of 14 April, of the Organization and the Functioning of the General administration of the State, with certain peculiarities.

In this context, the present Royal Decree aims to define the functions that correspond to the Center for Energy, Environmental and Technological Research, both in its quality of public research body and in its vocation of service to the Spanish industry, establishing the mechanisms to ensure collaboration between this body and the various forums, national and international.

Consequently, an organic structure is proposed in which there is a clear differentiation between those areas whose activity is focused on the technological and research fields and those that need to be supported. to these.

The first ones are available in departments that group related technical and research activities, and they coordinate the research projects that with their own entity are developed in their field. While the latter ensure adequate management within the Center for Energy, Environmental and Technological Research, as well as a regulation of the aspects of organization and operation that allows for precise flexibility for that the Centre for Energy, Environmental and Technological Research can respond, with the necessary agility in technical matters and human and economic resources, to the changes arising from scientific and technical developments and demands of society.

In its virtue, at the initiative of the Minister of Science and Technology and at the joint proposal of the Ministers of Public and Finance, in agreement with the Council of State and after deliberation of the Council of Ministers in their meeting on 1 December 2000,

D I S P O N G O:

Single item. Approval.

The Statute of the Center for Energy, Environmental and Technological Research (CIEMAT) is approved, the text of which is inserted below.

Additional disposition first. Change of name of CIEMAT organs.

The Subdirectorate General for Economic Control and Services and the Department of Fusion and Elementary Particles are renamed, respectively, under the General Administration of Economic Management, Administration and Services and Department of Fusion and Physics of Elementary Particles.

Additional provision second. Collaboration with the Ministry of Economy.

The Center for Energy, Environmental and Technological Research will collaborate with the Ministry of Economy to achieve the objectives of energy policy, developing research and technical-scientific character that is necessary.

To this end, an Inter-Ministerial Commission, chaired by the Director-General of the Centre for Energy, Environmental and Technological Research, will be set up and whose Vice-Presidency will be the responsibility of the Director-General of Energy Policy and Mines of the Ministry of Economy, in which representatives of the Ministries of Economy and Science and Technology will participate. It will be up to this Commission, inter alia, to coordinate the joint actions of the two departments, in relation to the Centre for Energy, Environmental and Technological Research, to propose the necessary budget for their execution, as well as the monitoring of such activities.

Single transient arrangement. Units and jobs with lower organic level to General Subdirection.

The units and positions of the lower organic level to Subdirección General, in the units affected by this Royal Decree, will continue to remain until the corresponding relation of the (a) the employment of the employees, moving on to a provisional basis of the corresponding units, in accordance with the tasks assigned to them by the Staff Regulations. Single repeal provision. Regulatory repeal.

The Ministry of Finance will carry out the necessary budgetary modifications for the fulfillment of the provisions of this Royal Decree.

Final disposition third. Entry into force.

This Royal Decree shall enter into force on the day following that of its publication in the "Official Gazette of the State".

STATUS OF THE ENERGY, ENVIRONMENTAL AND TECHNOLOGICAL RESEARCH CENTRE (CIEMAT)

CHAPTER I

Nature and functions

Article 1. Legal nature, membership and purposes.

1. The Centre for Energy, Environmental and Technological Research (hereinafter CIEMAT) is a public research body, with the status of an autonomous body, in accordance with the provisions of Article 43.1.a) of Law 6/1997, of 14 April, Organization and Functioning of the General Administration of the State, attached to the Ministry of Science and Technology through the General Secretariat of Scientific Policy.

2. CIEMAT aims to promote and develop basic research, applied research, innovation and technological development, with special attention to the energy and environmental fields, contributing to the development of more efficient industrial processes, with the restrictions inherent in the preservation of human health and the conservation of the environment.

3. It is for the Ministry of Science and Technology, through the General Secretariat for Scientific Policy, the strategic direction, the evaluation and the monitoring of the results of the activity of the CIEMAT, without prejudice to the competencies attributed to the General Intervention of the State Administration, in terms of the evaluation and control of the results of public bodies in the state public sector.

4. The CIEMAT has its own distinct public legal personality, its own assets and its own treasury, as well as its autonomy of management and full legal capacity, and within its sphere of competence, the precise administrative powers for the fulfilment of its purposes, in accordance with the terms laid down in this Statute, except for the expropriation.

Article 2. Legal framework.

CIEMAT is governed by the provisions contained in Law 13/1986 of 14 April, of the Promotion and General Coordination of Scientific and Technical Research; by Law 6/1997, of 14 April, of the Organization and the Functioning of the General Administration of the State; by Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure; by the recast text of the General Budget Law, approved by Royal Legislative Decree 1091/1988 of 23 September; by the Royal Decree of Law 2/2000 of 16 June, for which the recast text of the Law of Contracts of Public Administrations is approved; by the articulated text of the Law of State Heritage, approved by Decree 1022/1964, of April 15; by article 61 of Law 50/1998, (a) of 30 December, of fiscal, administrative and social measures, by this Statute and, in general, by the rules implementing the provisions referred to above and by those provisions which are applicable.

Article 3. Functions.

1. The following are the functions of the Center for Energy, Environmental and Technological Research (CIEMAT):

a) The development of R & D policy, within the scope of its competencies, in accordance with the guidelines of the Secretariat of State for Science and Technology Policy.

b) The management and implementation of energy R & D programmes to be agreed jointly with companies or other public or private, national or foreign institutions.

c) The management and implementation of cooperative R & D programmes agreed with associations of companies or other private organisations.

d) Participation and collaboration, in coordination with the Secretariat of State for Scientific and Technological Policy, with the Ministries of Foreign Affairs and Economy and with the Inter-Ministerial Committee on Science and Technology, in international bodies and programmes whose activity is linked to energy and environmental research and development, in particular at the level of the European Union.

e) The collaboration with the Autonomous Communities for the development of R & D programs, advising and supporting their activities, as well as encouraging the existence of adequate channels of information or the creation of mixed centers.

(f) The provision of technical support, performance of services and the issuing of certifications of the measures, tests and calibrations performed in their laboratories, when requested and under the conditions which, in each case, are set.

g) The patent of results, the signing of technology transfer agreements and the realization of dissemination and training activities related to their work.

h) Coordinate and cooperate in international research programmes, through the Secretariat of State for Scientific and Technological Policy, without prejudice to the powers conferred on the Ministry of Foreign Affairs.

2. For the fulfilment of the functions listed in the above paragraph, CIEMAT may carry out the following activities:

(a) Promote the creation, maintenance, organization and, where appropriate, the suppression of research and development units of their own, giving them, as appropriate, the personnel and means necessary for the fulfilment of their aims, all within the budgetary limits, the availability of human resources and in accordance with the general rules for the establishment of administrative bodies and units.

b) Participate in the creation and maintenance of research and development units of a mixed or other nature, by agreement, with universities or other institutions, giving the account to the General Secretariat of Policy Scientific and General Council for Science and Technology in the cases prescribed by the current regulations.

c) Grant, by agreement, the character of research and development units belonging to public or private institutions.

(d) to develop, within the framework of the legal system of staff at the service of the Public Administrations, the policy on the body's own staff and in charge of carrying out research and other functions of support, as well as evaluate the activity developed by the staff of the body, its departments and units.

e) To contribute, by granting or granting scholarships or the organization of specialized courses, to the training of research and support staff of the Institution, as well as other professionals, to adapt their capabilities to the requirements of the advancement of science and technology.

f) Facilitate the exchange of own personnel among the various research and development units of the body and other institutions, both national and other countries.

g) To support large scientific and technological facilities and laboratories which, due to their complexity, must be of state or supra-institutional use.

(h) Establishing agreements with public and private bodies, both national and international, for the implementation of research projects and other scientific and technological activities, giving the Commission the Interministerial of Science and Technology, as provided for in Article 15 of Law 13/1986 of 14 April, for the Promotion and General Coordination of Scientific and Technical Research.

i) Establish mechanisms for the transfer of the results of their research activities, without prejudice to the competencies of the Secretariat of State for Scientific and Technological Policy. To this end, it will collaborate with the competent institutions and agencies of the State Administration and the Autonomous Communities, integrating as much as possible their projects in the National Plan for Scientific Research, Development and Innovation Technology.

j) Propose the creation or participation in commercial companies, in accordance with the provisions of Article 19 of Law 13/1986 of 14 April, of the Promotion and General Coordination of Scientific and Technical Research, and to enter into contracts with the companies involved in the acquisition of the results generated by their research groups, strengthening the creation of competent units for the management of technology transfer and valuation.

k) Facilitate the dissemination of the results of own research by publishing publications and organizing conferences, congresses and scientific meetings of a national and international nature.

l) Any other that contributes to the fulfillment of the purposes and functions of the organism.

CHAPTER II

Governing Bodies

Article 4. Governing bodies.

1. The governing bodies of the Center for Energy, Environmental and Technological Research (CIEMAT) are the following:

1.o Collegiate Organs:

a) The Rector Board.

b) The Management Committee.

2.o Single-Personal Organ:

a) The President.

b) The Vice President.

c) The CEO.

2. The Governing Council and the Management Committee shall be governed by the provisions of this Statute and by the provisions of Chapter II of Title II of Law No 30/1992 of 26 November 1992 on the Legal Regime of the General Administration and the Common Administrative Procedure, and Chapter IV, Title II, of Law 6/1997, of 14 April, of the Organization and the Functioning of the General Administration of the State.

Article 5. The Governing Council.

1. The Governing Council shall be composed of the following members:

(a) The President, who will be the Secretary of State for Science and Technology Policy who will be able to delegate to the Secretary-General for Scientific Policy.

b) The First Vice President, who will be the Director-General of CIEMAT.

c) The second vice president, who will be the Director-General of Energy Policy and Mines at the Ministry of Economy.

d) Vocals, the number of which shall not exceed 13.

e) The Secretary, who will be the Secretary General of External Relations and Institutional.

2. They will be Vowels of the Governing Council:

(a) A representative of the Ministry of Foreign Affairs.

b) A representative of the Ministry of Education, Culture and Sport.

c) A representative of the Ministry of Health and Consumer Affairs.

d) A representative of the Ministry of the Environment.

e) Two representatives of the Ministry of Economy.

f) Four representatives of the Ministry of Science and Technology, one of which will belong to the Center for Technological and Industrial Development (CDTI) and another to the Institute for Diversification and Energy Saving (IDAE).

g) A representative of the Nuclear Security Council.

h) Two representatives of private R & D institutions or centres or energy companies, who are responsible for R & D activities in the same.

The vowels referred to in paragraph h shall be appointed by the holder of the Ministry of Science and Technology. The vowels referred to in the other paragraphs shall have a minimum rank of Deputy Director-General and shall be appointed by the holder of the Ministry of Science and Technology, on a proposal from the holders of each Department and the President of the Council. Article 6. Functions of the Rector Board.

1. The duties of the Governing Council shall be as follows:

a) Establish the lines of action of the body, in accordance with the guidelines of national scientific and technological policy.

b) Approve the body's preliminary draft budgets and report annually the basic lines of its preparation.

c) Approve the body's annual memory.

d) Learn about the activities of the scientific-technical units.

e) Having knowledge and monitoring the evaluation of the center projects.

(f) Any other functions expressly attributed to him by the Minister of Science and Technology or the President of CIEMAT.

2. The Governing Council, convened by its President, shall meet at least once a year, in ordinary session or in extraordinary meetings, on the initiative of the same President or at the request of the third party of the members.

Article 7. The Management Committee.

1. The Management Committee shall be composed of the following members:

(a) The Director-General of CIEMAT, who will be President.

b) The Secretary-General for External Relations and Institutional Affairs, who will act as Committee Secretary.

c) The remaining Subdirectors general of the body, who will act as vowels.

2. It is for the Management Committee to develop the guidelines established by the Rector Board, to ensure compliance and, in general, to work with the Director in the coordination and administration of the body.

3. The Management Committee shall meet, in ordinary session, at least once a month, and, in extraordinary session, when deemed necessary by the President or at the request of the majority of its members.

4. The President may convene the meetings of the Management Committee, when he considers it appropriate and in consideration of the issues to be dealt with, to the holders of other CIEMAT bodies, as well as to persons other than himself, all of whom are in quality of advisors.

Article 8. The President.

1. The Chair of CIEMAT is the Secretary of State for Science and Technology Policy.

2. The President's functions are the institutional representation of the body, the Presidency of its Governing Council, the approval of the expenditure and the management of the payments of the body exceeding 100,000,000 pesetas (601,012.10 euros), the signature of contracts and conventions involving economic commitments exceeding 100,000,000 pesetas (601,012,10 euro) and the accountability of the body.

Article 9. Acts and resolutions of the President.

End the administrative life of the acts and resolutions adopted by the President of the Center for Energy, Environmental and Technological Research in the exercise of their functions.

Against the acts of the President-in-Office proceedings, without prejudice to the powers of reimposition provided for in Law No 30/1992 of 26 November 1992 on the legal system of administrations Public and the Common Administrative Procedure.

Article 10. The Vice President.

1. The Vice Presidency of CIEMAT is the Secretary-General of Scientific Policy.

2. These are the functions of the Vice-President: The replacement of the President in the absence, vacancy or illness, and the performance of the duties that are expressly entrusted to him or delegated by the President.

Article 11. The Director General.

1. The Director-General of CIEMAT will be appointed and separated from his position by Royal Decree, on a proposal from the Minister of Science and Technology.

2. These are the functions of the Director-General:

a) Address the actions of the body in accordance with the guidelines established by the Rector Council and its President.

b) Develop the preliminary draft budget to be submitted to the Governing Council.

c) To exercise the management of the staff and services of the body.

d) The signing of contracts and agreements up to a sum of 100,000,000 pesetas (601,012.10 euros).

e) Establish evaluation mechanisms for the best control of projects developed by the body.

f) Play the First Vice Presidency of the Governing Council.

g) Chair the Management Committee.

(h) The approval of the expenditure and the management of the payments of the body up to a sum of 100,000,000 pesetas (601,012,10 euros).

i) To perform as many functions as are expressly entrusted to or delegated to you by the President or the Governing Council.

3. The Director-General shall have a Scientific Advisory Committee, as a support and advisory body, for the performance of his/her duties.

This Committee will be chaired by the Director General of the body and will form part four researchers of the center itself and six national or foreign scientists of recognized prestige and accredited experience, all appointed by the Secretary of State for Scientific and Technological Policy, on a proposal from the Director-General of CIEMAT.

CHAPTER III

Management organs and technical departments

Article 12. Organic structure.

The organic structure is set up in eight units with an organic level of Subdirectorate General, three of which are management and technical support bodies and the remaining five corresponding to the scientific-technical areas of the body.

Article 13. Scope of management and technical support.

The following units of technical and management services, with the rank of Subdirectorate General, will depend on the General Directorate of the CIEMAT:

1. General Secretariat for External Relations and Institutional Relations, to which it will be:

(a) The development of relations with other institutions, both national and international, in matters affecting the body.

b) Relations with collaborators, the celebration of concerts and the actions in the field of technology transfer.

c) The direction and supervision in the field of safety, both conventional and radiological, of the organism.

d) The direction of the organization's training activities in its areas of activity.

e) The direction of the body's R & D business relationships.

(f) The exercise of the functions of the Secretariat of the Governing Board and of the Management Committee.

g) The coordination and monitoring of the quality policy of the center.

h) The address of the center's documentation and publications management.

The Secretary-General for External Relations and Institutional Relations will replace the Director-General in the cases of vacancy, absence, or illness.

2. Sub-directorate-General for Economic Management, Administration and Services, to which it shall be:

a) The elaboration of the preliminary draft budget of revenue and expenditure of the body.

b) The financial and accounting management of the budget.

c) The management and procurement of goods and services.

d) The direction and supervision in the field of computer management systems.

e) The planning, management and execution of the maintenance works and the infrastructure of the centre.

f) The direction and supervision of the services of workshops and others of a common character in support of scientific and technical areas.

3. Sub-Directorate-General for Human Resources, to which it shall be:

(a) The management of matters relating to legal status, administrative situations, enabling and sanctioning of the staff of the body.

b) Planning and management of the body's human resources policy and relations with trade union organizations.

c) The analysis of activities and jobs, with proposals for modification, deletion and incorporation of these.

d) The development and improvement of the quality of the human resources of the body through training actions.

e) The coordination of the supporting functional units.

f) The management of the body's internal system services.

4. The Intervention Delegated to the CIEMAT, with the rank to be determined in the relation of jobs, shall be attached to the Director General of the agency, without prejudice to its functional dependence on the General Intervention of the Status.

Article 14. Scientific and technological field.

1. Scientific and technical activity shall be organised in R & D projects, led by a project manager appointed by the Director-General. R & D projects shall be carried out in technical departments where the activities of research, technological development, innovation and the provision of technical services of CIEMAT shall be developed.

2. R & D projects will be evaluated and proposed for approval by the Steering Committee. Project managers will have the task of planning, programming, and controlling the activities to be carried out in R & D projects, and take the necessary steps to correct the deviations that occur in the performance of the projects. cost, time, and quality objectives.

3. The Deputy Directors-General responsible for the technical departments will have the following functions:

(a) The promotion of scientific debate and the coordination of the activities of R & D projects or other technical units, framed in their department.

c) The monitoring of the correct management of the assigned financial, economic and human resources as well as their maintenance and improvement.

d) The supervision of agreements and contracts with other public or private entities in the field of research and development, as well as new lines of action or new R & D projects, in their field of competence.

e) Planning for the expected revenue and its control.

Article 15. Scientific-technical areas of the organism.

1. The Technical Departments shall be the following five:

(a) Nuclear Fission Department, which will be responsible for the coordination of research and development activities, and technical support, aimed at increasing the safety and availability of nuclear plants, and adequate management of radioactive waste.

b) Department of Fossil Fuels, which will be responsible for the coordination of research and development activities, and technical support for the improvement of the technologies available for more energy production clean and effective from fossil fuels, and from the cleaning and efficiency of other industrial processes.

c) Department of Fusion and Elementary Particle Physics, which will coordinate research and technological development activities in relation to the physics of elementary particles and the demonstration of fusion as an alternative In the future, it is the European dynamic in this field. The National Fusion Laboratory for Magnetic Confinement will also be attached to the Department.

d) Department of Renewable Energy, which will be responsible for coordinating the activities of

research and development, and technical support, necessary for the improvement of the availability of renewable energy sources, in particular solar, wind and biomass, both in terms of knowledge of energy resources as well as the development of conversion and exploitation technologies.

The activities carried out in the facilities that CIEMAT has in the provinces of Almeria and Soria will also be attached to this Department.

e) Department of Environmental Impact of Energy, which will be responsible for the coordination of research, development, technical support and services aimed at facilitating the compatibility between industrial activity and the preservation of health and the environment.

2. The administrative and management activities necessary for the implementation of the research projects shall be carried out by the functional units of support, which shall be organised organically in the Subdirectorate-General for Resources. CHAPTER IV

Creating R & D units or specialized centers

Article 16. Creation of R & D units

CIEMAT may establish agreements with universities and agencies of public administrations or the European Union for the temporary organization or adaptation of their own research and development units. necessary to achieve the objectives of the National Programmes or the Autonomous Communities, as described in Article 6.2 of Law 13/1986 of 14 April, of the Promotion and General Coordination of Scientific and Technical Research, or of programmes Community framework programmes under the relevant Framework Programme.

Article 17. Creating units or mixed centers and association of units.

1. CIEMAT may participate in the creation and maintenance of R & D units or of technology centres of mixed character and shared ownership with universities and other public or private bodies.

2. The CIEMAT, by means of a convention, may associate research and development units or research staff of its own to universities, research organisations or technology centres, without losing their membership or connection to the CIEMAT.

3. The CIEMAT may, by agreement, associate its departments, R & D units or research staff from Universities or other research bodies, or technological centres, without, under any circumstances, losing their membership or linking to the Source Agency.

4. The Management Committee shall regulate the conditions and procedures for the creation, modification, management or deletion of the institutional arrangements described in the preceding paragraphs.

Article 18. Special units of R & D.

For the implementation of projects or research, development or technological innovation programs that are considered to be of special interest by the Ministry of Science and Technology, CIEMAT may constitute special units of R & D by means of agreements with ministerial departments, Autonomous Communities, Local Authorities or other public bodies. These special units shall be governed by the bodies established in the respective creation conventions.

CHAPTER V

Economic and Personal Regime

Article 19. Economic-financial regime.

The budgetary, economic, financial, accounting, intervention and financial control regime will be established for the autonomous organizations in the General Budget Law and other provisions in force in the field, in accordance with the specifications contained for the public research bodies in Article 61 of Law 50/1998 of 30 December 1998 on Fiscal, Administrative and Social Order Measures.

The Ministry of Science and Technology will exercise control of effectiveness, provided for in Article 51 of Law 6/1997 of 14 April, of the Organization and the Functioning of the General Administration of the State, without prejudice to the control of the established in this respect by the General Budget Law.

Article 20. Heritage.

The CIEMAT will count, for the fulfillment of its purposes, in addition to its own patrimony, with those goods that are assigned to it by the General Administration of the State, the goods and rights that it acquires in the course of its management or to be incorporated by any person, public or private, and by any title, which shall be included in the inventory of goods and rights of the body and shall be managed in accordance with the provisions of Article 48 of Law 6/1997, of 14 April, Organization and Operation of the General Administration of the State.

Article 21. Economic resources.

Economic resources can come from the following sources:

a) The assets and values that constitute your heritage.

(b) The products and income of such assets.

(c) The specific consignations assigned to them in the General Budget of the State.

(d) Current transfers or capital transfers from public administrations or entities, as well as contributions or donations granted or awarded in their favour by any public or private person, Spanish or foreign.

e) The derivatives of shares held by CIEMAT as a shareholder in commercial companies for purposes related to the activity of the body.

(f) The ordinary and extraordinary income that you are entitled to receive, in accordance with the provisions for which they are governed, including derivatives for the provision of services.

g) Any other resource that might be attributed to you.

Article 22. Recruitment scheme.

The hiring of the CIEMAT is governed by the general rules of procurement of public administrations, in accordance with the provisions of article 49 of Law 6/1997, of April 14, of the Organization and the General Administration of the State.

However, the contracting authority of the body shall include the specifications laid down for the public research bodies in Article 19.2 of Law 13/1986 of 14 April of Promotion and General Coordination of the Scientific and Technical Research.

Article 23. Staff scheme.

1. The CIEMAT staff consists of:

(a) The official staff assigned to the CIEMAT, including the research and technological character.

(b) Scientific and technical personnel contracted in accordance with Article 17 (a) of Law 13/1986 of 14 April for the Promotion and General Coordination of Scientific and Technical Research.

c) The contracted researchers, in the practice mode, in accordance with article 17.b) of Law 13/1986, of 14 April, of the Promotion and General Coordination of Scientific and Technical Research.

d) The permanent and temporary staff employed by the CIEMAT.

2. CIEMAT shall select and recruit temporary staff in accordance with the regulations and in accordance with the procedures in force in this field.

3. The training staff will not have a legal/working relationship with CIEMAT and will be integrated by those who develop activities to extend their training through pre-doctoral, post-doctoral and research grants, or any other nature, in accordance with its specific rules.
