The Spanish Agency for International Cooperation was created by Royal Decree 1527/1988 of 11 November, by recasting and integrating the extinct autonomous bodies Institute of Ibero-American Cooperation and Institute Spanish-Arab Culture, the Office of Cooperation with Equatorial Guinea and some units of the Directorate General of International Technical Cooperation. Subsequently, Royal Decree 2492/1994 of 23 December, partially modified the organic structure of the Agency and, finally, Royal Decree 1141/1996, of 24 May, restructured the agency, remodelling its governing bodies, which passed to be structured around a President, an Executive Secretary-General and a Management Committee.

On the other hand, Law 23/1998, of July 7, of International Cooperation for Development, sets up the Spanish Agency of International Cooperation as the organ of management of the Spanish policy of international cooperation for development and determines that, in terms of its organisation, purpose, functions and powers, it shall be subject to the provisions of its Statute, which shall be approved by the Government, as provided for in Article 62 of the Law of the Organization and Operation of the General Administration of the State.

The Law itself establishes that the Spanish development cooperation policy is based on two priorities, which will determine their preferred lines of action: on the one hand, those of a geographical nature, and on the other, the sectoral, first to the regions and countries which are the main object of the Spanish cooperation and to the latter to certain areas of preferential action. As a result, a number of changes have been made to the Agency's organic structure, which has so far been basically organised on the basis of geographical criteria, in order to reconcile this criterion with the sector, thus accommodating the criteria of Priority of the Law, which will provide the Spanish Agency of International Cooperation with greater capacity and agility to serve effectively the principles and objectives that the Law of Cooperation points out as orientators of Spanish politics international cooperation for development.

It should be noted, moreover, that the regulatory development of the Law of Cooperation and the regulation and composition of the Development Cooperation Council, the Interterritorial Commission and the Inter-Ministerial Commission have ensuring the presence of the Agency in these important consultative and cooperation bodies, facilitating dialogue with the social partners and representatives of other public administrations.

In addition, taking into account that the Agency already has in accordance with its specific rules important roles in the field of cultural cooperation and dissemination, the need to achieve greater coordination of all cooperation activities carried out by the Secretariat of State for International Cooperation and for Ibero-America, together with the greater management agility that the autonomous agencies allow, advises the integration into the structure of the Agency Spanish for International Cooperation of the part of the activity of the Directorate General of Relations Cultural and Scientific, which aims at development cooperation, with the consequent redistribution of powers and functions.

To these same effects it has seemed convenient that the Office of Planning and Evaluation, which depends organically on the Secretariat of State for International Cooperation and for Latin America, will do so functionally the General Secretariat of the Spanish Agency for International Cooperation.

Finally, a series of restructurings by the ministerial departments and the Ministry of Foreign Affairs themselves, as well as the willingness to give the Agency's Management Committee greater representativeness, determine the updating and extending its composition.

In its virtue, at the initiative of the Minister of Foreign Affairs, at the proposal of the Ministers of Finance and Public Administrations, according to the Council of State and after deliberation of the Council of Ministers at its meeting on 15 December 2000,

D I S P O N G O:

Single item. Approval of the Staff Regulations.

The Statute of the Spanish Agency for International Cooperation is approved, the text of which is inserted below.

Additional disposition first. Partial amendment of Royal Decree 1473/2000 of 4 August 2000.

1. Article 1.2 (3) of Royal Decree 1473/2000 of 4 August 2000, for which the basic organic structure of the Ministry of Foreign Affairs is developed, is amended, which is worded as follows:

"3. The Secretariat of State for International Cooperation and for Latin America, on which the General Directorate of Foreign Policy for Ibero-America depends."

2. Article 13 (6) of Royal Decree 1473/2000 of 4 August 2000 is amended as follows:

" 6. The following bodies are also directly dependent on the Secretary of State for the organic level of Subdirección General:

(a) The Office of Planning and Evaluation, which corresponds to the exercise of the powers of planning of development cooperation activities and their evaluation, as well as relations with agencies (a) international law resulting from the implementation of those powers.

(b) The Subdirectorate-General of Cultural and Scientific Programs and Conventions which, without prejudice to the respective competences of other Ministries and, where appropriate, in close collaboration with them, performs the following functions:

1. It plans and evaluates the foreign relations of Spain in the field of culture, science, technology and the environment with other countries and with international organizations.

2. It coordinates the external relations of Spain with the different ministerial departments and other administrations and public and private entities, in the areas mentioned.

3. Prepara, negotiates and proposes International Agreements and Conventions, organizes the Joint Commissions that develop them in the field of their competences and manages the actions derived from them.

4. Asegura and coordinates the institutional presence of Spain in international cultural or scientific bodies.

5. It plans and manages the dissemination of Spanish culture in countries that do not belong to the scope of the Spanish Agency for International Cooperation.

6. It plans and manages scholarships, exchanges and readies in countries that do not belong to the scope of the Spanish Agency for International Cooperation. "

3. Article 14 (2) of Royal Decree 1473/2000 of 4 August 2000 is amended as follows:

" 2. For compliance with the above mentioned functions, the Directorate-General is structured in the following bodies:

a) Subdirectorate General of Mexico, Central America and Caribbean Countries.

b) Subdirectorate General of Mercosur and Chile.

c) Subdirectorate General of Countries of the Andean Community.

These Subdirectorates General are responsible for the defense and promotion of the interests of Spain in these areas and the promotion of bilateral relations with the countries that compose them. "

Additional provision second. Removal of organs.

The Directorate General of the Ibero-American Cooperation Institute and the Directorate General of the Institute for Cooperation with the Arab World, Mediterranean and Developing Countries are deleted.

The following General Subdirection organic-level drives are deleted:

a) Subdirectorate General of International Cultural Relations, dependent on the Directorate General of Cultural and Scientific Relations.

b) Subdirectorate General of International Scientific Relations, dependent on the Directorate General for Cultural and Scientific Relations.

c) Subdirectorate General of External Cultural Action, dependent on the Directorate General for Cultural and Scientific Relations.

d) Subdirectorate General of Mercosur, Chile and Countries of the Andean Pact, dependent on the General Directorate of Foreign Policy for Latin America.

e) Subdirectorate General for Institutional, Cultural and Communication Cooperation, under the aegis of the General Directorate of the Ibero-American Cooperation Institute.

(f) Subdirectorate-General for Cooperation with the Arab and Mediterranean Countries, under the aegis of the Directorate-General of the Institute for Cooperation with the Arab World, Mediterranean and Developing Countries.

g) Subdirectorate-General for Cooperation with Sub-Saharan African Countries, under the aegis of the Directorate-General of the Institute for Cooperation with the Arab World, Mediterranean and Developing Countries.

(h) Subdirectorate-General for Cooperation with the Countries of Eastern Europe and Asia, dependent on the Directorate-General of the Institute for Cooperation with the Arab World, Mediterranean and Developing Countries.

First transient disposition. Units and jobs with an organic level lower than Subdirección General.

The units and jobs with lower organic level to General Subdirection, affected by the deletions of this Royal Decree, will continue to remain and will be paid from the same budget credits, Until such time as the correspotient relations of jobs are adapted to the organic modifications established by this Royal Decree.

Until the new relations of employment enter into force, those posts that depend on the organs suppressed by this Royal Decree will be provisionally attached, by the corresponding resolutions of the Secretary of State for International Cooperation and for Latin America and the President of the Agency, in the light of the tasks assigned to them.

Second transient disposition. Management staff abroad.

Until the relations of the posts of the organs of the Spanish Agency of International Cooperation are approved abroad, the management personnel of these organs will be able to continue to contract under a relationship of special character of those provided for in Article 2.1.a) of the Staff Regulations, in accordance with Article 30 of Law 23/1998 of 7 July 1998 on International Cooperation for Development.

Single repeal provision. Regulatory repeal.

As many provisions of the same or lower rank are repealed as set out in this Royal Decree and, in particular, Royal Decree 1141/1996 of 24 May, for which the Spanish Agency of International Cooperation; Royal Decree 1870/1998 of 4 September amending the previous one; Royal Decree 1660/1998 of 24 July establishing the bodies of the Spanish Agency for International Cooperation in the field of foreign affairs; and Article 15 of Royal Decree 1473/2000 of 4 August, for which the organic structure is developed The Ministry of Foreign Affairs.

Final disposition first. Powers of development.

The Minister of Foreign Affairs is hereby authorized to take the necessary measures for the development and implementation of this Royal Decree.

Final disposition second. Budgetary changes.

The Ministry of Finance will make the necessary budgetary changes to comply with the provisions of this Royal Decree.

Final disposition third. Entry into force.

This Royal Decree will enter into force on 29 December 2000.

STATUTE OF THE SPANISH AGENCY FOR INTERNATIONAL COOPERATION

CHAPTER I

Nature and membership

Article 1. Nature.

The Spanish Agency for International Cooperation is an autonomous body of those provided for in article 43.1.a) of Law 6/1997, of 14 April, of the Organization and the Functioning of the General Administration of the State, attached to the Ministry of Foreign Affairs through the Secretariat of State for International Cooperation and for Latin America.

Article 2. Legal framework.

The Spanish Agency for International Cooperation has its own distinct public legal personality, equity and treasury. Within its sphere of competence, the precise administrative powers for the fulfilment of its purposes correspond to it in the terms laid down in this Statute.

It is governed by Law 23/1998 of July 7, International Cooperation for Development; Law 6/1997, of April 14, of the Organization and the Functioning of the General Administration of the State; the recast of the General Law Budget, approved by Royal Legislative Decree 1091/1988 of 23 September; by this Statute and by the other provisions applicable to the autonomous bodies of the General Administration of the State.

Article 3. Efficiency control.

corresponds to the Ministry of Foreign Affairs, through the Secretariat of State for International Cooperation and for Latin America, the strategic direction, the evaluation and control of the results of its activity; It is also for the control of effectiveness, without prejudice to the control established by the General Budget Law.

CHAPTER II

Purposes and Functions

Article 4. Finnish.

It is for the Spanish Agency of International Cooperation, without prejudice to the competences of the various ministerial departments and the entities and bodies assigned to them, the achievement of the following purposes:

a) Contribute to the economic growth and social, cultural, institutional and political progress of the developing countries and, in particular, those with a Hispanic ascendant.

b) Promoting the cultural and scientific cooperation of Spain with the developing countries.

(c) Ensure the coordination of development policies with the developed countries, especially in the field of the European Union.

Article 5. Functions.

The Agency, as the support body of the Ministry of Foreign Affairs for the management of international development cooperation policy, is expressly empowered to perform the following functions:

a) Support the Secretary of State for International Cooperation and Latin America in their role of assisting the Department's holder in defining and implementing the development cooperation policy, leading to the tasks of programming, implementation, monitoring and control of the resulting activities.

(b) Promoting cultural cooperation and the promotion of Spanish culture with developing countries, without prejudice to the powers of the Ministry of Education, Culture and Sport and other bodies and bodies of the General Administration of the State.

(c) Design, coordinate and implement development cooperation programmes and projects in the economic field, as well as those of a social, cultural, educational, scientific and technical nature, without prejudice to and activities carried out in these areas by other ministerial departments.

d) Ensure and coordinate the institutional presence of Spain in international non-financial development agencies, without prejudice to the powers assigned to other ministerial departments.

e) Support and encourage public or private initiatives that contribute to the achievement of the Agency's objectives.

f) Carry out and disseminate studies relevant to the progress of the least developed countries.

g) Support and collaboration with other ministerial departments in the development of international cooperation programmes and projects.

(h) To develop, within the framework of existing legislation, how many other activities can contribute to the fulfilment of its objectives.

2. In order to achieve its objectives, the Agency may, under the conditions laid down in the applicable legislation, promote foundations, associations and companies or participate in those already established for the purpose of achieving matching the ones that you own. It may also promote the dissolution of participating companies or the disposal of the shares of which it is a holder.

CHAPTER III

Governing Bodies

Article 6. Governing bodies.

The Spanish Agency for International Cooperation has the following governing bodies:

1. President.

2. Secretary-General.

3. Steering Committee.

Article 7. The President of the Agency and his duties.

1. The President of the Agency shall be the Secretary of State for International Cooperation and for Latin America.

2. The President of the Agency is responsible for the following tasks:

1. Ost the representation of the Body.

2. Vellar for the achievement of the purposes to which it is entrusted.

3. Name and cease the Agency's Deputy Directors General.

4. Propose the Agency's organic structure, as well as its modifications, for approval by the competent body, prior to compliance with the appropriate legal procedures.

6. Approve the programme of activities of the Agency and of each of its management bodies.

7. Approve the preliminary draft budget, the management memory and the accounts of the Agency, prior to its referral to the competent bodies for approval, as the case may be.

8. Authorize the expenses and order the payments of the agency without prejudice to its eventual delegation.

3. In the event of absence, vacancy, illness or other legal impediment to the President, these functions correspond to the Secretary-General.

Article 8. The Secretary-General of the Agency and his/her duties.

1. The Secretary-General of the Agency, who will rank as Undersecretary, will be appointed and separated by Royal Decree approved in the Council of Ministers, on the proposal of the Minister of Foreign Affairs.

2. It shall be the responsibility of the Secretary-General to ensure that the purposes assigned to the Agency are attained and to exercise the day-to-day management of the Agency, for which the following tasks are assigned:

1. To elaborate the proposals concerning the cases attributed to the President, which are set out in Article 7 (2).

2. Run the resolutions adopted by the President.

3. Exercise the management of the Agency's staff, directing and promoting the activity of its management and services centers.

4. Inspect the operation of all the units of the Agency, with its own means or through the competition of the General Inspection of Services of the Ministry of Foreign Affairs.

5. Develop the preliminary draft budget, as well as the management memory and the body's accounts.

6. To participate, with a voice but without a vote, in the Development Cooperation Council.

7. Any other function delegated to you by the President or confide in the current regulations.

3. The Secretary-General shall be replaced in the event of vacancy, absence, illness or other legal impediment by the Director-General appointed by the President.

Article 9. The Management Committee.

1. The Management Committee shall be composed as follows:

President: the President of the Spanish Agency for International Cooperation.

Vice President: the Secretary General of the Spanish Agency for International Cooperation.

Vocals:

1. The Secretary-General for European Affairs.

2. The Secretary-General for Foreign Affairs.

3. The Director-General for Cooperation with Latin America.

4. The Director-General for Cooperation with Africa, Asia and Eastern Europe.

5. The Director General of Cultural and Scientific Relations.

6. The Director General of Foreign Policy for Latin America.

7. The Director-General for the Coordination of General and Technical Affairs of the European Union.

8. The Director General of Foreign Policy for the Mediterranean, Middle East and Africa.

9. The Director General of Foreign Policy for Asia and the Pacific.

10. The Director General of International Economic Relations.

11. A representative, with the rank of Director-General, of each of the following Ministerial Departments:

(a) Ministry of Finance.

b) Ministry of Labour and Social Affairs.

c) Ministry of Agriculture, Fisheries and Food.

(d) Ministry of Public Administration.

e) Ministry of Health and Consumer Affairs.

f) Ministry of Environment and Environment.

g) Ministry of Economy.

h) Ministry of Science and Technology.

i) Ministry of the Presidency.

12. º Two representatives, with the rank of Director General, of the Ministry of Education, Culture and Sport, one representing the Secretary of State of Education and Universities and another representing the Secretariat of State Culture.

In case of vacancy, absence or disease or other legal cause, the vowels may be replaced by the one who is appointed with the rank, at least, of the Deputy Director General.

Secretary: the Deputy Secretary-General of the Agency, who will participate with a voice and without a vote.

2. Other senior administration officials may be invited to the meetings of the Management Committee, where their contribution may be useful in the light of the case to be dealt with in the Management Committee, with a voice but without a vote.

3. The Management Committee shall have the power to take decisions in relation to the Agency's general guidelines for action in accordance with the provisions of the Annual Plan for International Cooperation, without prejudice to the powers of the Management Committee. The President and the Secretary-General of the Agency are expressly assigned by this Royal Decree.

4. The Management Committee shall adjust in its operation to the provisions of Chapter II of Title II of Law 30/1992 of 26 November 1992 on the Legal Regime of Public Administrations and the Common Administrative Procedure.

CHAPTER IV

Basic organic structure

Article 10. Structure.

1. Under the immediate dependence of its Secretary-General, the Spanish Agency for International Cooperation is structured in the following management bodies:

1. General Directorate of Cooperation with Latin America.

2. Directorate-General for Cooperation with Africa, Asia and Eastern Europe.

3. General Directorate of Cultural and Scientific Relations.

2. The holders of the Directorates-General referred to in the preceding paragraph shall be appointed and separated by Royal Decree agreed in the Council of Ministers, on a proposal from the Minister for Foreign Affairs, each of them acting in their capacity. the respective area of competence, in the event of the absence, vacancy or illness of the Secretary-General, the ordinary management functions corresponding to the latter.

Article 11. Directorate-General for Cooperation with Latin America.

1. It is the responsibility of the Directorate-General for Cooperation with Latin America to promote, strengthen and develop the Spanish policy of development cooperation with the Ibero-American countries and, in particular, the exercise of the following functions, without prejudice of the respective competences of other Ministries:

(a) The coordination, in the field of their geographical competences, of the Spanish policy of development cooperation, within the framework established by the Director Plan and the Annual Plans, in order to provide coherence and greater effectiveness in the actions carried out in this field.

b) The implementation of the development cooperation policy of the Secretariat of State for International Cooperation and for Latin America with the countries of Latin America, through the corresponding projects and programmes, agreement with the strategy papers approved by countries and sectors.

c) The promotion and development of bilateral or multilateral programs and projects that will enhance and strengthen dialogue and cooperation with the Ibero-American countries.

d) The completion of training and improvement projects for Ibero-American professionals in Spain and Spain in Latin America.

e) The promotion of initiatives aimed at creating permanent Ibero-American institutions with Spanish participation; and of those that promote the strengthening of ties between associations, foundations and companies in Spain. the entire Ibero-American group.

f) The planning, supervision, coordination, monitoring and monitoring of the activities of the Technical Cooperation Offices and the training centres in the geographical area of their competence.

These functions will be developed through direct execution projects and programs and projects in collaboration with other public and private entities, national and foreign, and with multilateral organizations that pursue these activities. the objectives of the cooperation agreements and the conclusion of bi-national joint committees, in the case of programmes of the multilateral financial institutions, will be carried out in coordination with the Ministry of Economy.

2. The Directorate-General is structured in the following organic units, which shall carry out the tasks listed in paragraph 1, in their respective territorial scope:

a) Subdirectorate General for Cooperation with Mexico, Central America and the Caribbean.

b) Subdirectorate General for Cooperation with the Countries of South America.

Article 12. Directorate-General for Cooperation with Africa, Asia and Eastern Europe.

1. It is for the Directorate-General for Cooperation with Africa, Asia and Eastern Europe to promote, strengthen and develop the Spanish policy of development cooperation with the countries of these geographical areas for which it will, inter alia, the following tasks, without prejudice to the respective competences of other Ministries:

(a) The coordination, in the field of their geographical competences, of the Spanish policy of development cooperation, within the framework established by the Director Plan and the Annual Plans, in order to provide coherence and greater effectiveness in the actions carried out in this field.

b) The implementation of the development cooperation policy of the Secretariat of State for International Cooperation and for Latin America with the countries of Africa, Asia, Oceania and Eastern Europe, through the corresponding projects and programmes, in accordance with the strategy papers approved by countries and sectors.

c) The promotion and development of bilateral or multilateral programmes and projects aimed at promoting a space for dialogue and cooperation with the Mediterranean.

(d) The promotion of relations with public or private entities in Spain and in the countries of reference, in order to promote their participation in bilateral, regional or multilateral cooperation projects.

e) The planning, monitoring, coordination, monitoring and monitoring of the activities of the Technical Cooperation Offices and the training centres in the geographical area of their competence.

Article 13. Directorate-General for Cultural and Scientific Relations.

1. It is up to the Directorate-General for Cultural Relations and Scientific Affairs to exercise the powers of the Ministry of Foreign Affairs with regard to the Spanish cultural and scientific cooperation with the developing countries, in close cooperation. collaboration with the Ministries of Education, Culture and Sport and Science and Technology. These powers shall be exercised through the elaboration, proposal and implementation of the same in the following general areas:

a) Institutional cultural relations of Spain.

b) Institutional scientific relations of Spain.

c) Cooperation and cultural promotion in developing countries.

d) Scholarships, lectorados and international exchanges.

2. The Directorate-General for Cultural and Scientific Relations is structured in the following Subdirectorates General:

a) Subdirectorate General of Foreign Cultural Cooperation and Promotion.

b) General Subdirection of Scholarships, Lectorates and Exchanges.

3. The Subdirectorate-General for Foreign Cultural Cooperation and Promotion, without prejudice to the respective powers of other Ministries, and, where appropriate, in

close collaboration with them, performs the following functions:

a) It plans and executes the cultural cooperation of the Agency and promotes the Spanish culture, mainly through diplomatic and consular representations, with special attention to the cultural and cultural historically with Spain.

b) Manages cultural action derived from commitments made in agreements, agreements and programs signed by Spain with developing countries.

c) Plans, supervises, coordinates and controls the activities of the cultural institutions and institutions of Spain abroad attached to this Directorate General.

d) Directs the activities of the Agency's libraries and cultural and scientific publications.

4. The General Subdirection of Scholarships, Lectorates, and Exchanges performs the following functions:

a) Plans and manages the grants awarded by the Agency.

b) It plans and manages the assistance to Spanish culture and language readers in foreign universities, within the Agency.

c) Manages the scholarships and the exchange of experts, in the field of their competence, derived from the commitments acquired in agreements, agreements and programs signed by Spain.

d) Oversees the functioning of the major schools linked to the Agency.

5. The Spanish National Commission for Cooperation with UNESCO, which is regulated by specific rules, is organically attached to the General Directorate of Cultural and Scientific Relations of the Spanish Agency for International Cooperation.

Article 14. Other executive bodies dependent on the Secretary-General.

1. The following units are directly dependent on the General Secretariat of the Agency:

1. Technical Cabinet. It is up to the Technical Cabinet to carry out the activities and work of advice and immediate assistance entrusted to it by the Secretary-General of the Agency. It will also be responsible for the coordination and management of emergency and food aid actions.

2. Deputy General Secretary. The Agency's Deputy Secretary-General is responsible for the functions of the human resources administration, the management of economic and financial resources, the organisation of purchases and supplies, the advice, the documentation and the other General services of the Agency.

3. Sub-Directorate General for Multilateral and Sectoral Cooperation. It is up to this Subdirectorate General to ensure and coordinate the Spanish policy of development cooperation in international organizations in collaboration with the relevant bodies of the Ministry, as well as the development and coordination of the horizontal content projects of the Agency, allowing for a common approach in all geographical areas and in particular the management of micro-credit, aid and grants to non-governmental organisations and other sectoral policies.

2. Without prejudice to its organic dependence on the Secretary of State for International Cooperation and Ibero-America, the Office of Planning and Evaluation, with an organic level of Subdirectorate General, is functionally dependent on the Secretary-General. of the Agency and exercises the functions listed in Article 13.6 of Royal Decree 1473/2000 of 4 August 2000.

3. It is attached to the General Secretariat, without prejudice to its functional dependence on the General Intervention of the State Administration, the Intervention Delegate with the level to be determined in the corresponding relation of jobs.

Article 15. Organs of the Spanish Agency for International Cooperation abroad.

1. For the exercise of its functions abroad, the Spanish Agency for International Cooperation shall have the following bodies:

(a) The Technical Offices of Cooperation.

b) The Spanish Cooperation Training Centres.

c) The Cultural Centers.

2. The Technical Offices for Cooperation are organs for the management, control and monitoring of development cooperation projects and programmes, within the framework of the powers of the Spanish Agency for International Cooperation and without prejudice to the allocated to other Ministries, sectoral offices and institutions of the Spanish Administration, to which the following tasks are carried out:

(a) The management of the activities of the Spanish cooperation, under the direction of the Head of the diplomatic mission and in collaboration with the other organs of the mission.

b) The identification, monitoring and control of bilateral cooperation projects.

c) The preparation of the Joint Cooperation Committees.

d) Within the competence of the Spanish Agency for International Cooperation, the detection of opportunities for co-investment projects and offers of Spanish goods and services, generated by the cooperation projects and the transmission of the information to the corresponding Spanish institutions.

e) Within the competence of the Spanish Agency for International Cooperation the provision of support to Spanish institutions in the development of cooperation projects in the country concerned.

(f) At the request of other Spanish administrations and public institutions implementing cooperation projects, the management and administration of the economic resources for such projects.

3. The Spanish Cooperation Training Centres are bodies for the preparation, coordination and implementation of cooperation activities in the specific field of training they perform, under the direction of the Head of the Diplomatic Mission. The following functions:

(a) Identification, selection, organisation and monitoring of programmes, courses, seminars and other training activities.

b) Management and administration, where appropriate, of the economic resources provided by other Spanish institutions and public administrations.

c) Provision of support to Spanish institutions in the development of training activities.

4. The Cultural Centres are bodies for the preparation, coordination and implementation of cultural cooperation activities that are attributed to the exercise of the following functions:

a) Identification of the topics that could be promoted by the cultural presence of Spain, as well as the programming and execution of cultural activities.

b) Manage their activities under the direction of the Head of Mission in the diplomatic mission and in collaboration with other bodies of the Head of Mission, acting in the field of culture and promoting cultural cooperation with the countries in which they radiate.

c) Management and administration, if this is the case, of the economic resources provided by other Spanish institutions and public administrations.

d) Provision of support for Spanish institutions in the development of cultural activities.

5. The organs of the Spanish Agency for International Cooperation, referred to in the preceding numbers, shall be integrated organically in the diplomatic mission or, where appropriate, in the relevant consular post.

It will be the responsibility of the Spanish Agency for International Cooperation, which corresponds to its internal organization and budgetary allocation, as well as its technical inspection and control, without prejudice to the Article 37.3 of Law 6/1997 of 14 April of the Organization and the Functioning of the General Administration of the State.

The Technical Cooperation Offices and the Spanish Cooperation Training Centres will be attached to the Directorate General for Cooperation with Latin America and the Directorate General for Cooperation with Africa, Asia and Europe. Eastern according to the geographical area of its competition. The Cultural Centers will be attached to the General Directorate of Cultural and Scientific Relations.

Article 16. Establishment, modification and deletion of the Agency's bodies abroad.

1. Without prejudice to those that may be created in the future, they have the consideration of organs of the Spanish Agency of International Cooperation abroad, the following:

(a) The Technical Offices of Cooperation in Buenos Aires (Argentina); La Paz (Bolivia); Sarajevo (Bosnia and Herzegovina); Brasilia (Brazil); Bogota (Colombia); San Jose (Costa Rica); Havana (Cuba); Santiago (Chile); Quito (Ecuador) ; San Salvador (El Salvador); Guatemala (Guatemala); Port-au-Prince (Haiti); Tegucigalpa (Honduras); Mexico, D.F. (Mexico); Managua (Nicaragua); Panama (Panama); Asunción (Paraguay); Lima (Peru); Santo Domingo (Dominican Republic); Beijing (People's Republic of China); Montevideo (Uruguay); Caracas (Venezuela); Luanda (Angola); Manila (Philippines); Malabo (Guinea Equatorial); Rabat (Morocco); Nouakchott (Mauritania); Maputo (Mozambique); Windhoek (Namibia); Jerusalem (Occupied Territories) and Tunisia (Tunisia).

b) The Training Centers in Santa Cruz de la Sierra (Bolivia); Cartagena de Indias (Colombia) and La Antigua (Guatemala).

c) The Cultural Centers of Buenos Aires (Argentina); San Jose (Costa Rica); Havana (Cuba); Mexico (Mexico); Asunción (Paraguay); Lima (Peru) and Santo Domingo (Dominican Republic).

2. The Minister of Foreign Affairs is enabled to create by ministerial order, on a proposal from the President of the Spanish Agency for International Cooperation, new bodies of the regulated in the previous article, as well as to modify or delete the existing ones, after the approval of the Minister of Public Administration and with the authorization, if any, of the Ministry of Finance.

CHAPTER V

Staff Regime

Article 17. Personnel on national territory.

1. The staff of the Spanish Agency for International Cooperation which provides services at the head office of the agency shall be official or work, as determined in the corresponding relations of posts and catalogue of personnel. In accordance with the provisions of Article 15 of Law 30/1984 of 2 August, of Measures for the Reform of the Civil Service.

2. The system of coverage of destinations by official staff shall include measures which tend to favour their specialisation in cooperation tasks.

Article 18. Staff of the Spanish Agency for International Cooperation abroad.

The Spanish Agency for International Cooperation will have outstanding personnel abroad for the performance of its functions.

The staff providing services in the organs of the Spanish Agency for International Cooperation abroad may be an official or work officer, as determined by the corresponding relations of jobs and catalogues of labour staff.

Non-management personnel of official development cooperation may be hired in countries where such cooperation is conducted, in accordance with the local legal regime.

CHAPTER VI

Heritage, economic and financial arrangements

Article 18. Economic resources and heritage.

1. The Agency's economic assets and resources are as follows:

(a) The assets and securities that constitute their assets, as well as the income and products thereof.

(b) Transfers and grants which are recorded annually in the general budget of the State, and those which may be included in the budgets of the autonomous agencies and public entities of the State.

c) The income of public or private law that corresponds to you as a result of your activities.

(d) Grants, voluntary contributions or donations granted to or awarded to other public entities or private persons.

e) Other economic resources, ordinary or extraordinary, that may be legally attributed to them.

2. The patrimonial regime of the Spanish Agency for International Cooperation will be provided for in article 48 of Law 6/1997, of 14 April, of the Organization and the Functioning of the General Administration of the State.

Article 19. Economic and financial arrangements.

The budgetary, economic-financial, accounting, intervention and financial control regime in the

the Spanish Agency for International Cooperation will be established in the Royal Legislative Decree 1091/1988 of 23 September, approving the recast text of the General Budget Law.

The hiring regime will be established in the Royal Legislative Decree 2/2000 of 16 June, approving the recast text of the Law on Public Administration Contracts.

CHAPTER VII

Acts and resolutions of the President of the Spanish Agency for International Cooperation

Article 20. Acts that deplete the administrative route.

End to the administrative route all acts, agreements and resolutions of the President of the Spanish Agency of International Cooperation, in accordance with the provisions of the additional 15th of the Law of Organization and Operation of the General Administration of the State.

Against the acts, agreements and resolutions of the President of the Spanish Agency for International Cooperation to bring proceedings for a judicial-administrative appeal, without prejudice to the capacity of the replacement provided for in the Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure, as amended by Law 4/1999, of 13 January.
