The discretionary public transport services of passengers by road, provided with vehicles of less than ten seats, including that of the driver, and provided with documented transport authorisation by card of the class VT, they are subject to the system of administrative authorisation, subject to the tariff system and conditions of application laid down in Articles 18 and 19 of Law 16/1987 of 30 July 1987 on the Management of Land Transports, and 28 and 29 of their Regulation, adopted by Royal Decree 1211/1990 of 28 September 1990, as amended by Royal Decree 1136/1997 of 11 July 1997.

The increase in the operating costs since the approval of the Order of 28 December 1999, on the tariff regime of these services, advises the updating of the same and the consequent revision of the application rates, maintaining the maximum rate character set in the previous updates.

Even if the competition for the fixing of this tariff corresponds, in principle, to the General Administration of the State according to the national scope of the enabling authorization for the provision of such services, the (a) delegation of powers in the Autonomous Communities operated by the Organic Law 5/1987 of 30 July, allows the said Autonomous Communities to set the rates corresponding to those made by vehicles residing in their field territorial, taking into account the special circumstances in which they are present.

In its virtue, analyzed the structure and the amount of the determining costs of these services, previous report of the National Committee of the Road Transport and the National Council of Land Transports, I have:

First. -Interurban public transportation services of discretionary public transportation carried out by vehicles provided with documented authorization on the card of the class VT, will be carried out subject to the following maximum rates (including taxes):

Price per kilometer run or fraction: 62 pesetas (0.37 euros).

Wait time price: 1,645 pesetas (9.89 euros).

Minimum of perception: 345 pesetas (2.07 euros).

During the course of the first hour of waiting, the user will be entitled to have a free time of waiting of fifteen minutes, after which it will be computed by fractions of fifteen minutes, at the rate of 411 pesetas (2.47 euros) each fraction.

Perception minimums will not be cumulable to routes to which the ordinary fare per kilometer traveled has been applied.

Second. -Services will be contracted by a complete car, and the tours will be understood in a closed circuit to the point of departure for the shortest route, if the contrary is not expressly agreed.

Third.-The vehicles covered by this Order shall be provided with a form containing the applicable tariffs, in an official model, the format and conditions of which are specified in the Annex to this Order, which shall be placed on the market. in place visible from the interior of the vehicle.

Fourth. -In any case, the user will be entitled to the free carriage of his luggage, which, once the total number of places is used, will not exceed 50 kilograms for the vehicles of up to four places, and of 60 kilograms for those of higher capacity, provided that the volume of the luggage allows them to be placed in the carrier or placed in the vehicle's baca, without contravening the traffic and traffic rules and regulations.

When the total number of places is not used, these figures may be increased by 30 kilograms for each empty seat, provided that the shape, dimensions and nature of the luggage makes it possible to transport them inside the vehicle.

The excess baggage over the above figures will be paid at the rate of 7 pesetas (0.04 euros) per 10 kilograms or fraction and kilometer route, leaving the carrier free to admit them when this excess is more than 50 per 100 of these figures.

Fifth. -When the service is contracted, the routes, places and weight of the luggage will be fixed.

Sixth. -The Autonomous Communities in which the system of delegations provided for in the Organic Law 5/1987 of 30 July 1987 will apply, may freely fix the tariff rate of the services referred to in the present Order, in accordance with the provisions of the second subparagraph of Article 5 (d) of that Law, to apply the scheme to all services in the Autonomous Community, whatever the place where the services are located. finish.

7-The Order of 28 December 1999 on tariff arrangements for public passenger discretionary transport services in passenger cars is hereby repealed, as well as the number of provisions of equal or lower status. oppose the provisions of this Order.

Eighth. -By the Directorate General of Road Transport, the instructions which, if any, are necessary for the implementation of this Order will be issued.

Ninth. -This Order will enter into force on 1 January 2001.

SUMMARY OF APPLICATION CONDITIONS

A) During the first hour of the waiting time, the user shall be entitled to have a free time of waiting of fifteen minutes, after which the user shall be counted for a fraction of fifteen minutes at the rate of 411 pesetas (2.47 euros) each fraction.

B) Services will be contracted by car rental scheme and tours will be understood

in closed circuit to the point of departure, for the shortest route, if not expressly agreed otherwise.

C) In any case the user shall be entitled to the free carriage of his luggage under the conditions set out in the Order of 18 December 2000.

(D) The perceptions expressed are of a maximum nature and may be reduced by mutual agreement, except for the minimum of perception whose value will be compulsory.

(E) Irregularities or infringements observed by users must be brought to the attention of the Land Transport Inspection Services, which may be reflected in the existing claims book in the vehicle.
