Royal Decree 1331/2000, of July 7, which approved the organic structure of the Ministry of Education, Culture and Sport, reflects its appropriate competence in the new organization of the Ministry of Education and the completion of the process of transferring functions and services in the field of non-university education to the Autonomous Communities.

This Order has an integrative objective, as it seeks to unify in one provision the numerous delegations of competences up to now in force, totally or partially, grouped and systematized by subjects and adjusted to the organic structure and the distribution of competences of the Ministry of Education, Culture and Sport.

The delegation affects both the competences that the legal system attributes to the head of the Department and the approval of those other that are attributed to the higher and managerial organs of the Department, affecting Likewise, the Superior Council of Sports, the Autonomous Body whose President has the status of Secretary of State, for this reason had been included in the previous Delegation Orders.

All this occurs in accordance with the provisions of Articles 13 and concordant of Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure, and as provided for in the additional provision of Law 6/1997, of 14 April, of the Organization and the Functioning of the General Administration of the State and in Article 20 of Law 50/1997 of 27 November of the Government.

In your virtue I have:

I. DELEGATION OF POWERS IN THE FIELD OF BUDGETARY MANAGEMENT

First.

1. The following powers are delegated to the Deputy Secretary of the Department:

A. The authorisation of the budgetary changes for which the holder of the Department is responsible and the proposal to the Minister for Finance of the other budgetary amendments relating to the budget of the Department and its Agencies Autonomous.

B. The authorization and provision of expenditure, the recognition of the corresponding obligations and the proposal for payments, charged to the budget of the Department, in relation to the appropriations allocated to the services of the Secretariat, up to the limit of two billion pesetas.

C. The powers entrusted to the holder of the Department by the provisions in force in relation to the system of fixed cash advances and payments to be justified.

2. The powers of authorisation and provision of expenditure, the recognition of obligations and the proposal for payments in relation to the budget are delegated to the Directors-General under the Secretariat and to the President of the School Board of the State. with the appropriations of the budget of the Department assigned to the respective services, up to the limit of one hundred million pesetas.

3. The Director-General for Economic Programming, Personnel and Services is delegated the powers of authorization and provision of expenditure, the recognition of the obligations and the proposal for payments relating to appropriations included in the budget of the Department, which refer to the staff managed by the Directorate-General.

4. It is delegated to the Deputy Directors-General or assimilated, Secretaries-General of the Directorates-General and Education Directors abroad to give the internal order of the material payment to the Paying Cashier, in respect of the credits whose the management is entrusted, in the payments made by the systems of fixed cash advances and payments to justify, in the terms of the respective Ministerial Orders in this field.

5. The powers of authorization and provision of expenditure, the recognition of the obligations and the proposal for payments relating to the appropriations allocated to them within the budgetary service are delegated to the members of education abroad. of the Technical General Secretariat up to the limit of two million pesetas. However, when the expenditure is equal to or greater than five hundred thousand pesetas, it will require prior authorization from the said management body.

Second.

1. The delegation is approved by the Secretaries of State for Education and Universities and Culture in the headlines of the General Secretariat for Vocational Education and Training, the Directorates-General under the respective Secretariats of Education and the Ministry of Education and Training. 5. Fourth.

Sixth.

1. III. DELEGATIONS IN THE FIELD OF PERSONNEL

Eighth.

1. The following powers are delegated to the Deputy Secretary of the Department:

4. The delegation of the Undersecretary to the Provincial Directors of Ceuta and Melilla, with respect to the official staff of the Corps and the Escalas assigned to the Department with destination in the respective territorial area, is approved following:

4. The delegation is approved by the Deputy Director General of Human Resources Administration, with respect to the personnel employed in the central and peripheral services and in the administration of the Department on the outside of the competencies of:

A. The recognition of previous services.

B. Recognition and change of professional category.

C. The modification of working conditions for technical, organizational or production reasons.

5. The delegation of the Under-Secretary-General of Education to the outside education, with respect to the personnel employed in their respective territorial demarcation, is approved of the following powers:

A. The management and administration of such personnel, except for the recognition of prior services and the recruitment of personnel.

B. The declaration of forced retirement by age and disability.

C. The imposition of sanctions for minor faults.

D. The acts of administration and ordinary management of labour personnel that are not attributed to other bodies.

6. The delegation is approved by the Under-Secretary of the Provincial Directors Ceuta and Melilla, in respect of the personnel employed in the territory of their respective demarcation, of the following powers:

A. The management and administration of such personnel, except for the recognition of prior services.

B. The declaration of forced retirement by age and disability.

C. The hiring of personnel, prior to and express authorization in any case of the Director General of Economic Programming, Personnel and Services.

D. The imposition of sanctions for minor faults.

E. The acts of administration and ordinary management of labor personnel that are not attributed to other organs.

7. The delegation is approved by the Assistant Secretary-General of the Department, Secretaries-General of the Directorates-General, Foreign Education Counselors and Directors of public educational institutions, in relation to the (a) the labour force in its units and centres, the powers of management, control, discipline and organisation of work.

15th.

1. H. The granting of permits or licenses.

I. The recognition of trienes.

J. The formalisation of the takeover and cessation, as well as the cessation of the cessation and the extension of the time limit for the taking of possession in the prescribed terms.

K. The acts of administration and ordinary management of labour personnel assigned by the Deputy Secretary of State and which are not attributed to other bodies in accordance with Article 10.6 of Royal Decree 2169/84 of 28 November skills in the field of work staff.

sixteenth.

1. The delegation is approved by the Undersecretary in the Directors or Presidents of Autonomous Bodies of the Department and, in the case of the Superior Council of Sports, in the Director General of Sports and Services Infrastructures, regarding the labour staff of the respective body, of the following powers:

A. The recruitment of staff. However, in the National Institute of Performing Arts and Music, this competence shall be understood as delegated to the Secretary-General of the Agency.

B. The power of proposal of the representatives of the Administration in the negotiating committees and in the own fields of relationship with the representative unions of the staff.

C. The compulsory transfer for technical, organizational or productive reasons.

D. The extinction of the contract for technological, economic and force majeure causes.

E. The extinction of the contract for objective reasons.

F. Recognition and change of professional category.

G. The opening by disciplinary record and sanction, if any, by the committee of very serious and serious faults, as well as the imposition of penalties for minor faults.

2. The delegation of the Deputy Director-General responsible for personnel of the Department's Autonomous Bodies, with respect to the staff of the respective Agency, is approved by the Assistant Secretary of State for the following powers:

A. The management and administration of such personnel, including the recognition of trienes and previous services.

B. The declaration of forced retirement by age and disability.

C. The acts of administration and the ordinary management of labour personnel assigned by the Deputy Secretary of State and which are not attributed to other bodies, in accordance with the last paragraph of Article 12 of Royal Decree 2169/84 of 28 November the allocation of powers in the field of personnel.

seventeenth.

1. The delegation is approved by the Undersecretary in the Directors General of the Department, President of the State School Board and Secretary General of the Council of Universities of the Competition for the designation of commissions of service with the right to compensation, without prejudice to the powers in respect of the implementation of expenditure which correspond to the bodies of the Management Centres with appropriations for these services, in respect of the staff assigned to the units of the latter.

2. By way of derogation from the preceding paragraph, the jurisdiction for the designation of service commissions entitled to compensation shall be delegated, without prejudice to the powers in respect of the implementation of expenditure corresponding to the bodies of the Management centres with credits for these services, in the holders of the organs and with respect to the staff assigned to them:

A. In the Technical Secretary-General in respect of the Ministry of Education abroad, Technical Advisors not attached to any Department and the staff assigned to the Ministry of Education when they are required to move outside the country or countries of accreditation of the corresponding members.

B. In the Directors of Cabinet and Heads of Technical Cabinets with respect to the staff of the units directly dependent on the Secretaries of State, Under-Secretary and General Secretariat for Education and Vocational Training with a lower rank than Director General.

C. In the Deputy Director of the General Inspection of Services of the Department regarding the personnel assigned to that Unit.

D. In the Deputy Director General of Relations with Territorial Administrations with respect to the Provincial Directors of Ceuta and Melilla E. In the Deputy Director General of Educational Action with respect to the Central Technical Inspectors of Education.

F. In the Provincial Directors of Ceuta and Melilla regarding the teaching and non-teaching staff assigned in their respective territorial demarcation.

G. In the Ministry of Education on the outside of the staff assigned to the corresponding Department whose commissions of services have to be carried out in the territorial scope of their respective accreditation.

3. The delegation by the Deputy Secretary-General to the Director-General for Economic Programming, Personnel and Services of the powers of approval of the allowances for the transfer of residence and assistance to courts of competitions and competitions is hereby approved. in charge of the selection of personnel convened by the Department as well as meetings of collegiate bodies.

4. The delegation is approved by the President of the High Council of Sport in the Directors-General of the Competition Agency to designate service commissions entitled to compensation of the staff assigned to their Directorates-General. The delegation to the Director-General for Sport and Services Infrastructure is extended to the staff directly attached to the Presidency of the Council.

IV. DELEGATION OF POWERS FOR THE REVIEW OF ADMINISTRATIVE ACTS, PATRIMONIAL LIABILITY AND PREVIOUS CLAIMS

Eighteenth.

1. The Technical Secretary-General is delegated the powers of the holder of the Department concerning:

A. The resolution of the remedies against acts dictated by the holder of the Department under his own powers as well as against those dictated by any organ of the Department under delegation of powers of the Minister.

B. The resolution of the appeals against acts of the Undersecretary of the Department that do not exhaust the administrative route.

2. The resolution of the remedies against acts adopted by delegation of the holder of the Department or of the Secretary of State in the field of grants is delegated to the Directors-General for Cooperation and the High Inspection and Universities and aids, which are given in the field of their respective competences.

Nineteenth. -The delegation to the Technical Secretary-General of the powers to resolve resources of the show or replacement is approved when, by application of the corresponding regulations such powers are attributed to the Deputy Secretary of the Department or the executive bodies of the dependents, except as referred to in paragraph twenty-sixth, number 1.

Twentieth.-The Technical Secretary-General is delegated the powers attributed to the Minister in the following cases:

A. The ex officio review and the declaration of lesivity when they corresponded to the holder of the Department.

B. The resolution of the extraordinary resources of review against acts of the holder of the Department.

C. The resolution of the procedures on patrimonial liability.

D. The resolution of the previous complaints to the civil road.

Twenty first.

1. The delegation is approved by the Technical Secretary General of the competences which correspond to the different organs of the Department to solve extraordinary resources of review against the firm acts in administrative way dictated by those.

2. The exception of the previous delegation is the resolution of the extraordinary resources for the review of the acts on grants and aid to the study.

V. DELEGATIONS IN THE FIELD OF CULTURE

Twenty-second. -Powers in the following subjects are delegated to the Secretary of State for Culture:

A. The authorization of the departure of Cultural Interest as well as the members of the Documentary and Bibliographic Heritage in Archives, Libraries and Museums of State ownership.

B. The admission to the deposit of the members of the Spanish Historical Heritage and the Documentary and Bibliographic Heritage in Archives, Libraries and Museums of State ownership or similar center of public character.

C. The allocations of the members of the Spanish Historical Heritage to the State-owned Museums, the revision of the same and the constitution or the lifting of deposits of goods assigned to the stable collection of the Museums of State ownership in museum institutions of any ownership and in other institutions.

D. The exercise of the right of tanteo or retraction on the members of the Spanish Historical Heritage.

E. The acceptance of donations, inheritances or legacies in favor of the State, even if it is pointed out as a beneficiary to some other organ of the Administration, of goods that constitute expression or testimony of human creation and have a cultural value is of a historical, artistic, scientific or technical character, as well as cash donations that are made for the specific purpose and concrete of acquiring, restoring or improving some of these goods.

F. The declaration as unexportable of a good member of the Spanish Historical Heritage.

G. The granting of a guarantee by the State for compensation for the destruction, loss, subtraction or damage of those works of relevant artistic, historical, paleontological, archaeological, ethnographic, scientific or technical interest temporarily for public display in legally qualified institutions.

H. The acceptance of the offers of sale of goods subject to final departure or temporary departure with possibility of sale abroad.

VI. DELEGATIONS IN THE FIELD OF NON-UNIVERSITY TEACHING CENTRES

Twenty-third.

1. The following are delegated to the Secretary-General for Education and Vocational Training for the purposes of resolving the procedures:

A. Opening and functioning of private schools.

B. Opening and functioning of private Spanish centers abroad.

C. Amendment of the authorisation of private educational institutions.

D. Termination of the authorisation for cessation of activities.

E. Subscription of conventions with prior access to the concert regime.

F. Modification of educational concerts.

2. The following powers are delegated to the Director-General for Education, Vocational Training and Educational Innovation:

A. The authorisation of teaching and programmes to be carried out in the public teaching centres managed by the Directorate-General.

B. The modification and transformation of public schools.

VII. DELEGATIONS IN OTHER MATTERS

Twenty-fourth.

1. The Secretary of State for Education and the Universities is delegated the resolution of the procedures for the granting of qualifications of specialists in health sciences and the approval of foreign certificates of higher education to the corresponding Spanish official titles of a specialization.

2. The Department's Assistant Secretary of State is delegated the approval powers of the Department's editorial program and the inclusion of extraordinary modifications in the department for reasons of urgency or necessity.

3. The following powers are delegated to the Technical Secretary-General:

A. The fixing or modification of the sales prices to the public of the publications of the Department.

B. The powers conferred upon the Minister as the holder of the Protectorate by Law 30/1994 of 24 November, of Foundations and of tax incentives for participation in activities of general interest and other implementing rules and application, with the exceptions set out in paragraph 5 of this paragraph.

C. The resolution of the procedures for the approval of foreign certificates of higher education as well as the procedures for the approval and validation of foreign certificates and non-university studies.

D. The resolution of the procedures on the professional recognition of diplomas of the European Union in application of the Directives on the recognition of diplomas.

E. The resolution of recognition of foreign academic degrees to the only effects of continuing studies in Spain, in the cases of agreements signed between Spain and other States provide for this figure.

4. The responsibility for the resolution of procedures for the validation and declaration of equivalence of studies and titles of artistic teaching is delegated to the Director-General for Education, Vocational Training and Educational Innovation.

5. They are delegated to the Subdirector General of the Protectorate of Foundations, as long as the Register of the Foundations of State Competition, the registration, deposit or incorporation to the Registry, as appropriate, of the acts and The following documents:

A. Appointment, renewal, replacement, suspension and termination of the members of the Board of Trustees and other bodies created by the Statutes.

B. General delegations and proxies granted by the Patronato and its extinction.

C. Amendment or redrafting of the Statute.

D. Fusion of the Foundations, already constituting a new one, already incorporating one another already constituted, and the extinction, if any, of the merged foundations.

E. Extinction of the foundation, liquidation of the same and destiny given to the foundational assets.

F. Budget and explanatory memory; Inventory, Situation Balance, Results and Memory Account; Revenue and Expense Budget Liquidation; External Audit Reports.

G. Enajenations and levies.

Twenty-fifth.-The delegation is approved by the President of the Superior Council of Sports in the Director General of Sports of the competition to authorize or deny the celebration in Spanish territory of the competitions International official sports, as well as the participation of Spanish national teams in international competitions, without prejudice to the privileges that correspond to other authorities, agencies or entities.

VIII. EN-IT PROVISIONS

Twenty-sixth.

1. The delegation of powers referred to in this Order is subject to the limitations set out in Article 13.2 of the Law

30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure.

2. All the powers delegated to this Order may be the subject of an endorsement by the relevant delegating bodies in the form provided for in Article 14 of Law No 30/1992 of 26 November 1992.

3. In all the decisions which are made under delegations of powers laid down in this Order, such circumstances must be expressly stated and shall be deemed to have been given by the delegating body, as laid down in the Article 13.3 of the aforementioned law.

Twenty-seventh. -There is no effect as many Orders on delegations of competences affecting the management of the current Ministry of Education, Culture and Sport, object to the provisions of this Order and in particular the following:

Order of 4 September 2000 delegating powers to the Deputy Director-General of European Programmes for the implementation of the Socrates programme.

Order of 4 August 2000 on the delegation of competences in the field of personnel of the Ministry of Education, Culture and Sport and others of the Management of Infrastructure and Equipment of Education and Culture in the field of personnel and services.

Order of 3 July 2000 on the delegation of powers in various bodies of the Ministry of Education, Culture and Sport.

Order of the Minister of Education and Culture of 23 March 2000 to delegate powers to the Director-General for Vocational Training and Educational Promotion for the implementation of the Leonardo da Vinci Programme (2000-2006).

Order of the Minister of Education and Culture of 18 May 1999 for the delegation of powers, in the field of foundations.

Order of the Minister for Education and Culture of 4 June 1997 amending the Order of the Minister for Education and Science of 1 March 1996 on the delegation of powers.

Order of the Minister for Education and Culture of 10 September 1996 amending the Order of the Minister for Education and Science of 1 March 1996 on the delegation of powers.

Order of the Minister of Education and Culture of 23 July 1996 to revoke the delegation of the Deputy Secretary of the Department of Competition to resolve the liability procedures for damages and harm to pupils in non-university public teaching centres as a result of the normal or abnormal functioning of the public education service.

Twenty-eighth. -This Order shall have effect from the day following that of its publication in the "Official Gazette of the State".
