With the publication of Law 28/2006, of July 18, of State Agencies for the Improvement of Public Services, the creation of the State Aviation Safety Agency is authorized. Its creation takes place with the publication of Royal Decree 184/2008, of 8 February, for which its Statute is approved, and by Royal Decree 452/2012 of 5 March, for which the basic structure of the Ministry of Public Works is developed the organic dependency of the General Secretariat of Transport.

The Status of the State Aviation Safety Agency, hereinafter referred to as AESA, states in its Article 25.1 that the Director is the executive body of the Agency, and the Director is responsible for the management and management of the Agency.

In order to bring the organization and functioning of EASA into line with the principles of efficiency, speed, economy and flexibility, and based on the provisions of Article 13 of Law 30/1992 of 26 November, of the Legal Regime of Public Administrations and the Common Administrative Procedure, as amended by Law 4/1999, in the additional provision of Law 6/1997, of 14 April, of the Organization and the Functioning of the General Administration of the State, and in Article 26.2 of the Statute of the State Aviation Safety Agency, approved by Royal Decree 184/2008, of 8 February, meeting the Council Rector of AESA, resolute:

First. Administration of personnel.

1. It is delegated to the holder of the General Secretariat, in relation to the staff seconded to the Agency:

A) Name and separate job holders, with the exception of posts whose appointment is to the Board of Directors.

B) The formalization of the takes of possession and cesses, as well as the decisions to defer the cessation and to extend the term of taking of possession in the prescribed terms regulentarily.

C) Agree on changes in the administrative situation of officials assigned to the Agency.

D) The granting of re-entry to the active service in the Agency's jobs.

E) The declaration of forced retirements and incapacity as well as the resolution on the prolongation of stay in the active service.

F) The appointment of representatives of the Administration in negotiating committees and in the own areas of relations with representative trade union members of the staff.

G) The resolution of the procedures for the deduction of assets for non-compliance with the working day.

H) The granting of permissions and licenses.

I) The granting and crediting of reintegrable payroll advances.

2. It is delegated to the head of the Head of Division of Human Resources in relation to the staff seconded to the Agency:

A) Recognition of the acquisition and change of personal degrees.

B) The recognition of trienes.

C) The recognition of the previous services provided and their accumulation, in accordance with the provisions of Law 70/1978, of December 26, of Recognition of Previos in the Public Administration, and in Article 25.2 of the Basic Status of Public Employment, approved by Law 7/2007, of 12 April.

D) In general, all acts of administration and ordinary management of official personnel assigned by the head of the State Aviation Safety Agency and not delegated to other bodies.

3. It is delegated to the holder of the General Secretariat in relation to the Agency's workforce:

A) The termination of the contract of employment for objective, economic, technological or force majeure.

B) The mandatory transfer for economic, technical, organizational or production reasons.

C) The appointment of representatives of the Administration in negotiating committees and in the own areas of relations with representative trade union members.

D) The resolution of the procedures for the deduction of assets for non-compliance with the working day.

E) The declaration of forced retirement by age and disability.

F) Professional category recognition or change, as per specific regulations in this respect.

4. It is delegated to the head of the Head of Division of Human Resources in relation to the Agency's workforce:

A) The recognition of trienes and previous services.

B) The granting and crediting of reintegrable payroll advances.

C) In general, all acts of administration and ordinary management that are attributed to the head of the State Aviation Safety Agency and are not delegated to other bodies.

5. With the prior approval provided for in the additional provision of Law 6/1997, of 14 April, of the Organization and the Functioning of the General Administration of the State, the Secretary General delegates to the head of the Chief of Staff Human Resources division:

The endorsement of training courses in the personal files of the Agency's official and working staff.

Second. Service commissions entitled to compensation.

It is delegated to the General Secretariat and the Directorates, in respect of the personnel assigned to its units, to exercise the competence to authorize commissions of service in national territory with the right to compensation, including for, where appropriate, fixing the amount of the compensation for eventual residence, and the granting of advances, as well as the authorisation of posting in the same locality of the official residence for the purposes of the Royal Decree 462/2002, of 24 May, on compensation for the service.

Third. Recruitment.

Be delegated to the holder of the General Secretariat:

A) The exercise of the powers conferred on the Director by the legal order as the contracting authority, when the estimated value of the contract does not exceed 72,600 €.

B) The competence to report the certificate of human media failure prior to recruitment.

C) The certifications and relations referred to in the " Resolution of 6 April 2009, of the Presidency of the Court of Auditors, for which the Agreement of the Plenary of 26 March 2009 is made public, which approves the Instruction General concerning the referral to the Court of Auditors of the extracts of the procurement files and of the relations of contracts and agreements concluded by the State and Autonomous Public Sector Entities. '

D) The management of the return or cancellation of the provisional or final guarantees, as well as, where appropriate, complementary and special, required for the conclusion of contracts with the Agency.

Fourth. Management of expenses and proposals for payment.

It is delegated to the holder of the General Secretariat the faculty that the legal order grants to the head of the Agency's Directorate for:

A) Approving the expenses of the Agency's budget appropriations is spent on the limit of 72,600 €.

B) Authorize the commitments and settlements that come with respect to the approved expenses and order the timely payments.

C) Authorize the accounting documents referred to in the regulations of the Ministry of Finance and Public Administrations on accounting operations for budgetary implementation.

Fifth. Fixed cash advances.

It is delegated to the holder of the General Secretariat that the legal order grants to the head of the Management of the Agency for:

A) Determine the scope of application within the Agency of the "fixed cash advances" system.

B) Set the maximum expenditure on the "fixed cash advances" system and distribute such maximum expenditure, determined by budgetary applications, at the level of unbundling deemed appropriate, and by the time periods which proceed.

C) Set the maximum overall amount "fixed cash advances" within the legally established limit.

D) Approve the expenses and order the payments to be charged to the "fixed cash advance" of the Agency's Paying Fund.

E) Order payments to be made for the extra-budgetary allocation or replenishment of the "fixed cash advance" allocated to the Agency's paying agencies, authorising the appropriate accounting documents.

F) Approve the accounts of the Agency's Paying Fund.

Sixth. Payments to justify.

It is delegated to the holder of the General Secretariat that the legal order grants to the head of the Management of the Agency for:

A) Authorize the payment proposals "to justify", within the limit of the specific budget consignment that in each case is pointed out.

B) Approve the accounting accounts of bookies to justify.

C) Authorize timely accounting documents.

Seventh. Management starts.

It is delegated to the holder of the General Secretariat the power that the legal system grants to its Director in matters of management in accordance with the provisions of Articles 4.1.n. and 24.6 of the Recast Text of the Law of Public Sector Contracts and the instructions issued by the Ministry of Public Works, in respect of these, from the respective budget appropriations, except those relating to:

A) Approval of the expense.

B) Formalization of the charge.

Eighth. Return of undue revenue.

It is delegated to the holder of the General Secretariat the faculty that the legal system grants to its Director in matters of resolution of the procedures from which the returns of income of nature can be derived (a) tax or penalties, the management of which is attributed to the Agency and, where appropriate, the recognition of the obligations arising from them and the authorisation of the corresponding accounting documents.

Ninth. Direction and Avocado.

The delegation regime set out in this Resolution is without prejudice to the powers of management and the provision of the delegation of the head of the Agency's Directorate.

10th. Revocation of previous delegations.

The delegation of powers contained in the Resolution of 23 November 2012, of the Directorate of the State Aviation Safety Agency, on the delegation of powers, and the other, are revoked. provided in this Resolution.

11th. Entry into force.

The delegations contained in this Resolution shall enter into force on the day following their publication.
