Royal Decree 1614/2008 of 3 October concerning animal health requirements for aquaculture animals and products, as well as for the prevention and control of certain diseases of aquatic animals, Council Directive 2006 /88/EC of 24 October 2006 on the animal health requirements for aquaculture animals and products and on the prevention and control of certain diseases in the field of animal health aquatic animals.

Annex IV to that royal decree was amended by Order AAA/275/2013 of 18 February, in order to incorporate into the Spanish legal order the amendments established by the Implementing Directive 2012/31/EU, of the Commission of 25 October 2012 amending Annex IV to Council Directive 2006 /88/EC as regards the list of species of fish susceptible to viral haemorrhagic septicaemia and the deletion of the entry for that species epizootic ulcerative syndrome.

In the month of May 2013, the World Organisation for Animal Health (OIE) amended Chapter 10.5 of the Sanitary Code for Aquatic Animals as regards infectious salmon anaemia listed in Annex IV to the Directive. Decree 1614/2008 of 3 October, as a non-exotic disease. According to this review, infectious salmon anemia is designated as an infection by HPR genotype with deletion or by genotype HPR0 of the genus Isavirus, of the family Orthomyxoviridae, considering the detection of both genotypes mandatory notification in accordance with Articles 1.3.1 and 10.5.1 of the OIE aquatic code. Following this, Commission Implementing Directive 2014 /22/EU of 13 February 2014 amending Annex IV to Council Directive 2006 /88/EC with regard to infectious salmon anaemia (AIS) was published.

For the purposes of Royal Decree 1614/2008 of 3 October, infectious salmon anaemia should be defined as an infection by HPR genotype with the deletion of the genus Isavirus, so that only infections with this genotype comply with the the criteria set out in Section B of Part I of Annex IV to Directive 2006 /88/EC of the Council of 24 October 2006 and therefore should therefore be included in Annex IV to that Royal Decree 1614/2008 of 3 October 2006, that genotype.

Consequently, the Commission's Directive 2014 /22/EU, of 13 February 2014, should be incorporated into our legal order, which entails the consequent amendment to Annex IV to the Royal Decree 1614/2008, dated October 3.

Reasons for legal certainty advise, given the scope of the amendments, the replacement of Annex IV in its entirety.

This order is issued under the enabling provision in the fourth final provision of Royal Decree 1614/2008 of 3 October, which empowers the Minister for the Environment, and the Rural and Marine Environment, the current Minister of Agriculture, Food and the Environment, in order to modify, within the scope of their respective competences, the content of the annexes thereto for their adaptation to the European Union legislation.

In the preparation of this provision, the autonomous communities and representative entities of the sectors concerned have been consulted.

In its virtue, according to the State Council, I have:

Final disposition second. Entry into force.

This order shall enter into force on 16 November 2014.
