Article 4 of Royal Decree 2062/1999, of 30 December 1999, which regulates the minimum level of training in maritime professions, establishes the professional card models of the Merchant Navy for those in possession of a professional title, and the second final provision authorizes the Minister of Public Works to dictate the complementary rules of the same, among which are the issues relating to the Merchant Marine cards.

In turn, Royal Decree 2061/1981, of 4 September, on professional titles of the Merchant Navy, and Royal Decree 930/1998, of 14 May, on general conditions of suitability and qualification of certain professions of the Marine Merchant and the fisheries sector, empower the Minister of Public Works to dictate, in the field of their competence, how many provisions are necessary for the best compliance with the provisions of those rules.

This Order comes to complete the regime established in the above mentioned norms, by regulating the procedure for the issuance of the titles and professional cards of the Merchant Navy, of its renewal and revalidation, the accreditation of the periods of embarkation and the acquisition of the practical training required to obtain the professional qualifications.

In its virtue, with the prior approval of the Minister of Public Administrations, I have:

Article 1. Object.

purpose of this Order is to regulate the procedure for issuing the titles and professional cards of the Merchant Navy, for the renewal and revalidation, the conditions of validity of the periods of embarkation and the practical training required to obtain professional qualifications.

Article 2. Expedition of professional titles and cards of the Merchant Navy.

1. The Directorate-General of the Merchant Navy, of the Ministry of Public Works, shall issue the respective professional title at the request of the person concerned, in accordance with the model set out in Annex I to this Order.

2. With the same validity of the professional title, the professional card of the Merchant Navy, the model of which is set out in Annex II, shall also be issued. The Merchant Navy card will be the document required by the maritime authorities to exercise professionally on the ships or in the activities that are determined in the current regulations.

3. On the back of the Merchant Marine card, the endorsement required for the exercise of ships engaged in maritime transport to which the International Convention on Standards of Training, Titling and Guard for the Protection of the Sea is applicable shall be expressly included. seafarers, 1978, as amended (hereinafter the STCW Convention). This international endorsement shall be the certificate of professional competence and the physical fitness required by the said Convention and shall be valid for five years, and may be revalidated after this period, in the manner in which it is determines in this Order.

4. The international endorsement will determine the limitations of the attributions of the title that are based on the periods of the accredited embarkation, in accordance with the current regulations.

Article 3. Procedure for the issuance of professional titles of the Merchant Navy.

1. The person interested in obtaining a professional title must apply to the General Directorate of the Merchant Navy or the Maritime Capitanies, providing the following documentation:

I. Request.

II. Two passport size photographs.

III. Certified copy of the national identity card or passport.

IV. Certified copy of the academic qualification in the cases provided for in the current regulations, or examination certification in the rest of the cases.

V. Accreditation of the professional exercise required in the current regulations or the performance of professional practices, as stipulated in this Order.

VI. Certification of having passed the test of professional suitability, understanding of the compliance of the competition rules, for the professional qualifications provided in the current regulations.

VII. Medical certificate of the Social Institute of the Navy accredited to physical fitness.

VIII. Justification for the payment of the corresponding fees.

2. The title will be issued by the General Directorate of the Merchant Navy, which will simultaneously issue the Merchant Marine Card.

3. At the request of the person concerned, the Directorate-General of the Merchant Navy may issue copies of the certificates of evidence of a professional title, for which the applicable fees for the issue of securities shall be paid.

4. The maximum period for notifying the decision of the applications referred to in the preceding paragraphs shall be three months. That resolution shall put an end to the administrative route. After the aforementioned deadline, without any express resolution, the request shall be deemed to be dismissed.

Article 4. Procedures for revalidation or renewal of the cards of the Merchant Navy.

1. The Merchant Navy card may be revalidated or renewed at the request of the person concerned.

2. The revalidation shall consist of the updating of the data of the Merchant Navy card, relating to the international endorsement and professional privileges, and shall proceed in the following cases:

(a) Where the person concerned requests to update the international endorsement required by the STCW Convention, the maximum duration of which is five years. To this end, the card holder must provide documentary evidence demonstrating physical fitness and professional competence as determined in this Order.

b) When the person concerned requests to update the limitations of the privileges determined on the card, because he has completed the required embarkation periods in the current regulations to acquire greater privileges professional.

3. The renewal may also be carried out when the person concerned requests it for loss, deterioration or updating of the photograph or data contained in the card, except in the case of updating the international endorsement. The renewal shall consist exclusively of the transcription or literal copy of the data that appears at the time of its issuance in the Register of professional titles and certificates of specialty of the General Direction of the Merchant Navy. Consequently, the same data relating to the dates and expiry of the endorsement, as well as the privileges and limitations determined in the last revalidation of the Merchant Marine card, will be included.

4. The revalidation or renewal of a Merchant Marine card shall be requested from the General Directorate of the Merchant Navy or the Maritime Capitanies, providing the following documentation:

a) Request.

b) Two passport size photographs.

c) A certified copy of the national identity card or passport.

d) In cases of revalidation, the accreditation of the professional exercise or professional competence required in the current regulations, as stipulated in this Order.

e) Certificate of the periodic medical examination of physical fitness performed by the Social Institute of the Navy.

f) Justification of the payment of the corresponding fees.

5. The revalidations and renewals of Mercante Marina cards will be carried out by the Maritime Capitanies of First category or by the General Direction of the Merchant Navy.

6. The maximum period for notifying the decision of the applications referred to in the preceding paragraphs shall be three months. That resolution shall put an end to the administrative route. Article 5. Accreditation of the professional competence required for the revalidation of the Merchant Navy card.

1. The accreditation of the professional competence required by the STCW Convention may be carried out by one of the following conditions:

(a) Have completed a period of embarkation of at least one year within the course of the last five years, exercising professional functions of the card to be revalidated.

(b) There has been a period of embarkation of at least three months in the last year, exercising professional functions of the professional title which is owned and occupied by ships at a maximum of two levels lower than that of the card you own.

c) Have passed a test or an upgrade course recognized by the General Direction of the Merchant Navy.

2. The professional functions shall be the respective Capitan, Head of Machines or Officer in civil ships, as well as Port Practices, functions directly related to navigation and operations in the handling of ships, such as teaching (a) theoretical or practical training in teaching centres leading to the attainment of maritime qualifications, ship loading or unloading terminals, maritime safety and rescue, maritime and port administration. The periods of embarkation mentioned above will be accredited in the general form determined in this Order.

3. Professional competence shall be exempt from professional competence for holders of professional titles and cards of a bridge or machine of the Merchant Navy, but must comply with the rest of the requirements determined in this Order.

Article 6. Accreditation of the periods of embarkation required to obtain the professional titles and the cards of the Merchant Navy.

They will apply to the issuance of professional titles and the revalidation of the cards of the Merchant Navy. The following rules:

1. The exercise of functions and activities to be carried out during the embarkation periods shall be determined in the regulations in force governing the respective professional titles.

2. For the calculation of the embarkation periods required by the current regulations, the ship must have been sailing, at least, 50 per 100 of the respective period.

3. The periods of embarkation made on civil vessels engaged in recreation or sport must be carried out in the exercise of professional duties, for which the person concerned must present official evidence of the professional exercise, such as contract of employment and certifications of the Social Security of the seafarers.

4. For the validity and computation of the embarkation periods performed on Spanish or foreign vessels, the person concerned must present the following documentation:

(a) A declaration in the official model of the comprehensive Annex III of ships where it has provided services.

(b) A certificate of the shipping company in the model of Annex IV, for each of the ships that has provided services, signed by the Captain or the shipping company. In the case of foreign vessels, this certification may be issued in English in accordance with the model in Annex IV.

(c) In the case of Spanish vessels, the seagoing and landing seats of the sea book, and in the case of foreign vessels, shall be accompanied by certified copies of the contracts of employment and the official documentation of the In each vessel ("discharge book" or "seamen book").

5. From the date of entry into force of this Order, the "service sheet" shall cease to be valid for the staff of the Merchant Navy, for the purpose of verifying periods of embarkation and tests or professional examinations.

Article 7. Conditions of the vessels for the validity of the embarkation periods.

1. For the purpose of obtaining the professional title of Captain of the Merchant Navy, the periods of embarkation performed on Spanish or foreign merchant ships of gross tonnage equal to or greater than 100 GT or TRB shall be valid, exercising as Captain or Officer of bridge.

2. For the purpose of obtaining the professional title of Head of Machines of the Merchant Navy, the periods of embarkation performed in Spanish or foreign civil vessels of a power equal to or greater than 1,400 kW, as well as in warships, shall be valid. exercising as Chief or Officer of Machines.

3. For the purpose of obtaining the professional title of Pilot First of the Merchant Navy, the periods of embarkation performed on Spanish or foreign civil vessels of gross tonnage equal to or greater than 100 GT or TRB, as well as on warships or warships, shall be valid. ships from the eighth list above 20 GT or TRB, in any case exercising as Captain or Bridge Officer.

4. In order to obtain the professional title of Officer of First Marine Machines, the periods of embarkation made on Spanish or foreign civil vessels, warships or vessels of the eighth list shall be valid, with one power equal to or greater than 750 kW, in any case exercising as Head or Machine Officer.

5. For the purpose of obtaining the professional titles of first-or second-class radio-electronic officers of the Merchant Navy, professional services shall be valid in maritime radio communications stations on land or on board vessels. Civilians.

6. For the revalidation of the card of the Merchant Marine of Height Patron shall be valid the periods of embarkation carried out on the Spanish or foreign civil ships, warships or vessels of the eighth list, of equal gross tonnage or more than 20 GT or GRT, in accordance with the provisions laid down in the rules in force.

7. For the purpose of obtaining the professional title of Master Master of Cabotage, the periods of embarkation performed on Spanish or foreign civil vessels, warships or vessels of the eighth list, of gross tonnage equal to or greater than 20 GT shall be valid. or TRB, exercising as Captain, Patron or Bridge Officer.

8. In order to obtain the professional title of Master of Cabotage, the periods of embarkation carried out on Spanish or foreign civil vessels of gross tonnage equal to or greater than 20 GT or TRB shall be valid, exercising as a bridge Marinero or a pupil of bridge, following a training programme.

9. In order to obtain the professional titles of Major Naval Mechanics of first or second class, the periods of embarkation made in Spanish or foreign civil ships, warships or vessels of the eighth list, of power equal to or greater than 200 kW.

10. In order to obtain the professional title of the port Patron, the periods of embarkation carried out in Spanish civil vessels of gross tonnage greater than 5 GT or GRT and 100 kW will be valid.

11. In order to obtain the professional titles of Marinero de puente or Marinero de machines de la Marina Mercante, the periods of embarkation performed in civil vessels of gross tonnage greater than 10 GT or TRB and 150 kW, respectively, shall be valid.

12. Those who have previously held a professional qualification in a section of those regulated in this Order, and intend to obtain another professional qualification in a different section, may be counted as valid for 50 per 100 of the previous embarkation period. carried out at similar level of the title and in order to obtain the new professional qualification.

13. For the revalidation of the card of the Merchant Navy of Naval Mechanics, the periods of embarkation made in Spanish or foreign civil ships, warships or vessels of the eighth list, of equal or higher power, shall be valid. to 500 kW, in accordance with the provisions laid down in the rules in force.

14. For the revalidation of the card of the Merchant Marine of the Coast Patron, the periods of embarkation performed on Spanish or foreign civil vessels, warships or vessels of the eighth list, of equal gross tonnage or more than 20 GT or GRT, in accordance with the provisions laid down in the rules in force.

15. For the revalidation of the card of the Merchant Navy of Naval Mechanics, the periods of embarkation made in Spanish or foreign civil ships, warships or vessels of the eighth list, of power equal to or greater than 200, shall be valid. kW, in accordance with the provisions laid down in the rules in force.

Article 8. Provisions common to the practices of bridge and machine pupils.

1. The practices of bridge students or machines may be carried out on Spanish or foreign civil vessels as a student or sailor in the relevant section, carrying out the tasks and experiences identified in the respective book the training in each of the vessels in which the practices are carried out.

2. The books of the students of bridge and machines will be approved by the General Direction of the Merchant Navy, prior to the use by the student. The above approval must appear in the respective books. The records of the training shall contain at least the information approved by the International Maritime Organisation, as well as the contents of the ships and training programmes specified in Annex V.

3. The practices shall be certified in the book of the training and shall be signed by the Captain and the Officer who supervised them, for each of the vessels in which they were carried out. The person concerned shall also provide the documentation relating to the accreditation of the embarkation periods laid down in Article 6 of this Order.

4. Where the student has a professional qualification in another section, the minimum period of practice in the new section shall be six months.

5. Periods of practice on a school vessel approved by the General Directorate of the Merchant Navy may be taken into account up to 50 per 100 of the period required in each case. For the purposes of the calculation of the traineeship, the vessel must have the following conditions:

(a) The vessel must be registered in the eighth or second list and must have at least the tonnage or power specified in Articles 9 and 10, depending on the section of the bridge or machinery.

b) To have the complete equipment for sailing near the coast and to carry out the practices of the respective section, in accordance with the requirements of the STCW Convention and its Training Code.

c) Contar with similar elements required to perform the basic courses of fire fighting, survival at sea, radar observer and General Operator of the World System of Maritime Relief and Safety.

Article 9. Bridge pupils ' practices.

1. The practices will be carried out under the supervision of the Captain or the most experienced bridge officer in whom the Captain is delegated. According to the professional qualification to be obtained, the practices must be carried out on the following vessels:

(a) For obtaining the title of 2nd of the Merchant Navy, embarking as a pupil on merchant ships of gross tonnage exceeding 100 GT or TRB and certified school ships of gross tonnage exceeding 50 GT or TRB.

b) For the purpose of obtaining the titles of Patron de altura o Patron de littoral, embarking as a pupil or a bridge seaman in civil vessels of gross tonnage exceeding 20 GT or TRB, including approved school ships.

2. The seamen, as provided for in paragraph 1 (b) above, may be able to reconcile the practices with the performance of functions in the section of the navigation bridge, assisting the on-call officer in carrying out the tasks. guards. 3. Bridge students who have completed at least one teaching course of teaching leading to the achievement of a professional title of the Merchant Navy, justified by certification of the official centre complying with the provisions of the Sections A-II/4 and A-VI of the STCW Convention Training Code may apply for the issue of the title of the Merchant Marine Bridge Marinero.

Article 10. Practices of the students of machines.

1. The practices shall be carried out under the supervision of the Head of Machines or the most experienced Machine Officer in whom the Head of Machines is delegated. According to the professional qualification to be obtained, the practices must be carried out on the following vessels:

(a) For the purpose of obtaining the title of the second-tier machines officer of the Merchant Navy, embarking as a student on civilian vessels of more than 750 kW.

b) To obtain the title of Naval Major Mechanics, embarking as a student or sailor of machines in civilian ships of greater than 500 kW.

c) For the acquisition of the title of Naval Mechanics, embarking as a student or sailor of machines in civilian vessels of between 200 and 3,000 kW.

2. The persons who have been taken on board, pursuant to the provisions laid down in the headings (b) and (c) of the preceding paragraph, may be able to reconcile the practices with functions in the section of the machinery chamber, by assisting the on-call officer in carrying out the duties. guards. At least for six months they must perform machine guard duties.

3. Students of machines who have completed at least one teaching course of teaching leading to a professional title of Merchant Marine, justified by the certification of the official centre complying with the provisions of the Sections A-III/4 and A-VI of the STCW Convention Training Code, may apply for the issue of the title of Marinero de machines of the Merchant Navy.

Additional disposition first. Medical examinations of physical fitness to obtain professional cards from the Merchant Navy.

The content of medical examinations and initial and periodic physical fitness tests will be determined and performed by the Navy's Social Institute.

As long as the provisions on physical fitness are not developed, the provisions on this matter will continue to apply in the Order of 7 December 1964 governing the examinations for the purposes of to professional maritime certificates or certificates.

Additional provision second. Recognition of professional qualifications of citizens with nationality of a State of the European Union and with qualifications issued by one of these States.

The General Directorate of the Merchant Navy will be able to recognize directly the citizens with the nationality of a State of the European Union, to access the jobs of the envelopes of the Spanish merchant ships, the titles professional or certificate of specialty issued by one of those States, in accordance with the following provisions:

I. The recognition of a professional title shall be formalised by the issue of the professional card of the Merchant Marine, the model of which is set out in Annex VI and shall contain the same privileges and limitations of the respective professional title, in the tonnage conditions of the vessel, power propulsion, navigation area, or any other nature.

II. The interested party or the shipping company must request the recognition of the title to the General Direction of the Merchant Navy or the Maritime Capitanies, providing in full the following documentation:

a) Request.

b) Two passport size photographs.

(c) Identity card or passport of the person concerned in which the personal data relating to his name, surname, date of birth, nationality and address are included.

(d) Professional title issued by the Maritime Administration of the respective State of the European Union in which the international endorsement is given in accordance with the STCW Convention, with a translation

to the Spanish by official jury of the attributions, positions, functions and limitations of the title to recognize.

(e) Medical certificate of physical fitness issued by the Social Institute of the Navy or by the competent body of the State of nationality of the Community citizen with a translation into Spanish by a sworn interpreter official.

f) Justification of the payment of the fees corresponding to the issuance of a professional title.

g) Comppressed copies of documents (c) and (d) shall be obtained which shall be attached to the appropriate file.

The maximum period for notifying the resolution of the requests referred to in this paragraph shall be three months. That resolution shall put an end to the administrative route. After the aforementioned deadline, without any express resolution, the request shall be deemed to be dismissed.

III. In accordance with Regulation I/10 of the Annex to the STCW Convention, during the period of processing of the recognition of the title, by the Directorate General of the Merchant Navy, it will be issued, through the corresponding Maritime Captaincy that the in the case of a three-month period of time, the corresponding documentary evidence concerning the application for recognition of the title.

IV. In order to authorize boarding, the Maritime Capitania shall require the documentation of the liability insurance arising from the exercise of the functions on board, as set out in Article 7 of Royal Decree 2062/1999, as well as the possession of similar safety and maritime craft certificates required by the regulations in force for the ship to be taken on board, issued by a Maritime Administration of a State of the European Union. The acceptance period for these certificates will be the same as the documentary proof of the previous paragraph and can be validated by the General Directorate of the Merchant Navy by the Spanish counterparts.

V. During the period of validity of the documentary evidence referred to above, the Directorate-General of the Merchant Navy shall verify the accuracy of the documentation submitted by the person concerned to the respective administration of the State of the Union. European.

VI. The professional card and endorsement shall be valid for a maximum of five years, after which it may be revalidated in accordance with the provisions of Article 6 of this Order.

VII. Where the Community citizen intends to practise as a captain or as a first bridge officer, he must prove the existence of the right of reciprocity of the State of his nationality as defined in Article 8 of Royal Decree 2062/1999, as well as a test on knowledge of Spanish maritime legislation, relating to the exercise of functions as Captain or First Bridge Officer. This test will be carried out in Spanish by the General Directorate of the Merchant Navy or the authorized Maritime Capitania.

First transient disposition. Exchange of Merchant Marine cards to professional card holders prior to the entry into force of this Order.

Professional card holders who have the power for professional exercise on merchant ships such as Captain, Patron, Head of Machines and Officers, as well as Sailors or Mechanics with their corresponding certificate of competition, may exchange these cards for those set out in this Order, in accordance with the equivalences and conditions of Annex VI. For such purposes, they must apply at the General Directorate of the Merchant Navy or in the Maritime Capitanies, presenting the documentation of the embarkation periods and the payment of the current renewal fees. The issuance of the new Merchant Navy card will not result in the issuance of the professional title.

Second transient disposition. Graduates of vocational training.

1. The General Directorate of the Merchant Navy may issue the Mercante Marine cards regulated in this Order to the holders of academic qualifications of Auxiliary Technician or Specialist Technical of the Merchant Maritime Branch that correspond to academic validation and training content with the respective academic qualifications of medium-grade and senior technical technicians.

2. The General Directorate of the Merchant Navy will accept the certificates of examination of the Master of Cabotage and Master of Cabotage, Naval Mechanics Major, first and second class, issued by an authorized Vocational Training center until on 1 February 2002, in order to issue the Merchant Marine cards.

3. The Directorate General of the Merchant Navy may issue the corresponding Merchant Marine cards to the holders of the above examination certificates and are carrying out the required shipping periods for the current regulations up to 31 December. of December 2008. For such purposes, vocational training students may carry out the examinations concerned, without having obtained a prior professional card.

4. The General Directorate of the Merchant Navy may issue the Merchant Marine cards of Major, first and second class Naval Mechanics directly to those who present the corresponding examination certificates issued by an official center. or holders of fishing cards issued by the Ministry of Agriculture, Fisheries and Food or the competent Autonomous Communities. To this end, the interested parties must present the supporting documentation of the professional exercise, in the general form determined in this Order and, in particular, the following:

(a) For the Merchant Marine Card of Major Naval Mechanics, accreditation of having performed officer functions of machines during a period of embarkation not less than twenty-four months and possessing the certificate of fight against II-level fires.

(b) For the Merchant Marine Card of First Class Naval Mechanics, accreditation of having performed Officer of Machine functions for a period of embarkation not less than twenty-four months and possessing the certificate of II-level fire fighting.

(c) For the Merchant Marine Card of the second class Naval Mechanics, accreditation of having performed the functions of an Officer of Machines for a period of not less than twelve months and possessing the certificate of struggle against II-level fires.

Repeal provision. Regulatory repeal.

All provisions of the same or lower rank that are opposed to the provisions of this Order are repealed and, specifically, the following rules:

(a) Order of 8 February 1990, amending the Order of 18 April 1983, on conditions of embarkation for the attainment of professional qualifications.

(b) Order of 10 September 1986 amending Article 6 of the Order of 18 April 1983 on conditions for the provision of professional qualifications.

c) Order of 19 April 1983, on obtaining the professional maritime identity card by Mechanics and Naval Electricians.

(d) Order of 18 April 1983, on conditions of embarkation for obtaining professional qualifications.

(e) Order of 23 December 1981 establishing a new model for a professional maritime identity card.

(f) Order of 31 January 1975 on the processing and resolution of the files of documents issued by the Ministry of Commerce, in respect of Marina Mercante.

(g) Order of 3 March 1965, for which rules are issued for the application of certificates, identity cards and diplomas of professional maritime specialties, in respect of the Merchant Marine.

(h) Order of 9 March 1964, which regulates the way in which a particular time of embarkation is justified, either to opt for professional titles of the merchant and fishing marinas, or in other circumstances in which it is It is necessary to have fulfilled a certain time, in that it affects Marina Mercante.

(i) Order of 2 May 1963, declaring the application form for certificates, certificates and cards of professional maritime identity and the model of the registration card for maritime personnel.

Final disposition. Entry into force.

This Order will enter into force within two months of its publication in the "Official State Gazette".
