The Royal Decree-Law 10/2001 of 1 June, of the adoption of measures of an urgent nature to alleviate the effects produced by persistent rains on certain crops in the Autonomous Community of Andalusia, establishes, in its Article 3.1, an interest subsidy on loans granted by financial institutions to holders of agricultural holdings, with policies in force on agricultural insurance at the time of their perception, affected by the rains on the basis of the terms referred to in Article 1, in the case of strawberry or citrus crops and, in their Case, associations or organisations of agricultural producers and cooperatives in the sector of the affected strawberry sector, for whose purposes the supply of inputs to the associated holders and, where appropriate, other holders within the limits legal.

Article 3 (2) of Royal Decree-Law 10/2001 provides that the Ministry of Agriculture, Fisheries and Food shall regulate the conditions for granting interest subsidies on loans.

Likewise, the final provision of the Royal Decree-Law, empowers the Minister of Agriculture, Fisheries and Food to dictate how many provisions are necessary for the implementation and development of the law.

As a result of the indicated regulatory clearance, this Order regulates the conditions and the procedure for granting the aid referred to in Articles 3 and 4 of Royal Decree-Law 10/2001 of 1 June.

In its virtue, consulted by the Autonomous Community of Andalusia and the sectors affected, I have:

Article 1. Interest subsidy.

1. Interest subsidy concessions on loans granted by financial institutions to holders of agricultural holdings, provided for in Article 3.1 of Royal Decree-Law 10/2001 of 1 June 2001, for the adoption of measures of a nature urgent to alleviate the effects caused by the persistent rains in certain crops in the Autonomous Community of Andalusia, are conditioned to the concurrency of the circumstances of the gross production losses established in the article 1 of that provision and the existence of combined agricultural insurance policies subscribed by the beneficiaries, which are in force at the time of receipt of the bonuses.

2. For the purposes of determining the amount of loans with interest to be paid to associations or organisations of agricultural producers and cooperatives in the strawberry sector, only the associated holders and, where appropriate, other operators shall be taken into account. holders, within the established legal limits, who are not beneficiaries of loans with interest on interest, provided for holders of agricultural holdings in Article 3 of Royal Decree-Law No 10/2001 and provided that they comply with the conditions required of these for the perception of the bonus.

Article 2. Right to Bonus Recognition.

1. The application for the interest rate subsidy, as provided for in Article 3.1 of Royal Decree-Law 10/2001, shall be addressed to the competent authority of the Autonomous Community of Andalusia within the time limit laid down by the latter and, in any event, before 31 October 2001. The competent authority shall decide on the recognition of the right to bonus.

2. The decision of the Autonomous Community of Andalusia on the procedure for granting or refusing, where appropriate, the interest rate subsidy, shall fix the time limit for the depreciation and the amount of the pres, in the interest of the interest rate, within the the limits provided for, in each case, in Royal Decree-Law 10/2001.

3. Only loans formalised after the entry into force of the said Royal Decree-Law 10/2001 shall be subject to the right to interest subsidies.

Article 3. Payment procedure.

The Ministry of Agriculture, Fisheries and Food will proceed to the territorialization of the existing credit for the fulfillment of the obligations recognized in the granting of these aids managed by the Autonomous Community of Andalusia, as set out in Article 153 of the General Budget Law, a recast text approved by Royal Decree No 1091/1988 of 23 September 1988.

Article 4. Collaboration agreements.

The Ministry of Agriculture, Fisheries and Food will be able to enter into collaboration agreements with financial institutions on a bilateral basis or, where appropriate, jointly with the Autonomous Community of Andalusia, in order to obtain the greater efficiency in the application of the aid provided for, linked to the granting of loans.

Article 5. Grant to loan guarantees.

1. Applications for subsidised loans for loans requested from financial institutions shall be directed to the State Society of Agricultural Cautioning (SAECA), together with the decision to grant the interest subsidy issued by the institution. competent authority of the Autonomous Community.

2. The grant at the cost of the guarantee provided for in Article 4 of Royal Decree-Law 10/2001 will be paid directly by the Ministry of Agriculture, Fisheries and Food to SAECA under the conditions set out in the collaboration agreement they subscribe to. both parties, on a bilateral basis or, where appropriate, jointly with the Autonomous Community of Andalusia.

Additional disposition first. Limit of the aid.

The total amounts of aid granted to holders of agricultural holdings, beneficiaries of the measures regulated in Royal Decree-Law 10/2001, in order to alleviate the losses caused by the persistent rains in the Strawberry or citrus crops must not exceed the limits laid down in the Community guidelines on State aid to the agricultural sector.

Additional provision second. Financing.

The financing of the cost of the grants provided for in this Order will be carried out under the budget concept 21.1.1.711A.770 "Financial support for damage caused by drought and other extraordinary causes".

Single end disposition. Entry into force.

This Order shall enter into force on the day of its publication in the Official Gazette of the State.
