The results of animal production depend to a large extent on the use of adequate food with healthy, fit and commercial quality feed.

In addition, the use of feed in animal feed should not pose a risk to the health of the animal or human itself. Finally, it is necessary to provide the user with accurate and clear information on the nature and composition of food in a way that cannot be misleading.

On the other hand, the role of raw materials for animal feed is of great importance in agriculture, especially as a result of the progressive introduction of the criteria of quality, effectiveness and protection of the environment. environment in the processes of production, processing and consumption of agricultural products.

In the light of the above, and as regards compound feedingstuffs, the Order of 8 October 1992 on the movement of compound feedingstuffs was issued, in which the provisions of the Directive were incorporated into the Directive. 79 /373/EEC of the Council of 2 April concerning the placing on the market of compound feedingstuffs and Directive 91 /334/EEC of the Commission of 6 June amending Directive 82/475/EEC fixing the categories of animal feed ingredients that can be used for the labelling of compound foods for domestic animals, as well as Commission Directive 91 /357/EEC of 13 June laying down the categories of ingredients for use in the labelling of compound feedingstuffs intended for animals other than those of a company.

Likewise, and in relation to the raw materials for animal feed, Royal Decree 1489/1998 of July 10 on the circulation and use of raw materials for animal feed, incorporated into the legal system Directive 96 /25/EC of 29 April 2000 on the movement and use of raw materials for animal nutrition, amending Directives 70 /524/EEC, 74 /63/EEC, 82 /471/EEC and 93 /74/EEC and repealing the Directive 77 /101/EEC.

The obligation to transpose Directive 2000 /16/EC, of the European Parliament and of the Council of 10 April amending Directives 79 /373/EEC and 96 /25/EC into national law, determines the the need to vary the contents of Royal Decree 1489/1998 and the Order of 8 October 1992.

On the other hand, the measures taken to eradicate bovine spongiform encephalopathy advise to reflect in this Royal Decree the provisions contained in Council Decision 2000 /766/EC of 4 December 2000. on certain measures for the protection against transmissible spongiform encephalopathies and the use of animal proteins in animal nutrition; Commission Decision 2001 /9/EC of 29 December 2001 on the measures to be taken against control required for the implementation of Decision 2000 /766/EC; in the Decision 2001 /165/EC, of the Commission of 27 February, amending, with regard to hydrolysed proteins, Council Decision 2001 /9/EC and Regulation (EC) No 999/2001 of the European Parliament and of the Council of 22 May 2001 on the lay down rules for the prevention, control and eradication of certain transmissible spongiform encephalopathies and in Commission Regulation (EC) No 1326/2001 of 29 June laying down transitional measures to allow the passage to Regulation (EC) No 999/2001 and Annexes VII and XI to that Regulation are amended Regulation.

In accordance with the settled case-law of the Constitutional Court, it is necessary that the transposition of Community Directives into Spanish law be carried out, except in exceptional cases, by means of have at least Royal Decree range.

This Royal Decree thus responds to a double necessity: to incorporate Directive 2000 /16/EC into the Spanish legal system and to respect the principle that the rules transposing Community Directives have the appropriate range.

The publication of this standard, which is therefore a recast of the existing fundamental rules on raw materials and feed in animal feed, therefore entails the repeal of the Order of 8 October 1992, concerning the placing on the market of compound feedingstuffs, and of Royal Decree 1489/1998 on the movement of raw materials for animal feed, for passing the content of both feed materials into that of the animal.

This Royal Decree is dictated by article 149.1.13.a and 16.a of the Constitution, which attributes to the State exclusive competence in the field of bases and coordination of the general planning of the activity economic and basic health and coordination, except in Articles 10, 21 and 22 (a), which are issued under Article 149.1.10.a and 16.a of the Constitution, which confers on the State exclusive competence on trade external health and external health.

In the process of elaboration of the same have been consulted the Autonomous Communities, as well as the organizations and entities representative of the interests of the affected sectors.

This provision has been favourably informed by the Interministerial Commission for Food Management.

In its virtue, on the proposal of the Ministers of Agriculture, Fisheries and Food and of Health and Consumer Affairs, in agreement with the Council of State and after deliberation of the Council of Ministers at its meeting of 18 January 2002,

D I S P O N G O:

CHAPTER I

General provisions

Article 1. Object and scope of application.

1. The purpose of this Royal Decree is to establish the legal regime applicable to the movement and use of raw materials for animal feed and compound feedingstuffs put into circulation throughout the Spanish territory.

2. This Royal Decree shall apply, without prejudice to the provisions on:

(a) The additives used in feeding the animals.

b) Undesirable substances and products in the feeding of animals.

c) The fixing of maximum levels for pesticide residues in and on products intended for human and animal feed.

(d) Market organisations for agricultural products.

e) Certain products used in the feeding of animals.

(f) The incorporation into the Spanish legal system of the Community legislation on the mass or volume preconditioning of certain products on prepackages.

g) Food for animals intended for specific nutritional purposes.

Article 2. Definitions.

For the purposes of this Royal Decree, the following definitions shall apply:

(a) Raw materials for animal nutrition: products of plant or animal origin, in the natural state, fresh or preserved, and products derived from their industrial processing, as well as organic substances or inorganic, with or without additives, intended for the feeding of animals by mouth, processed or without transformation, to the preparation of compound feed or as pre-mix vehicles.

(b) Food for animals: Products of natural or vegetable origin or animal origin, fresh or preserved and those derived from their industrial processing, as well as organic or inorganic substances, simple or mixed, contain or do not contain additives, which are intended for oral animal feeding.

(c) Compound feed: mixtures of feed materials, with or without additives, intended for the feeding of animals by mouth, in the form of complete or complementary feed.

(d) Daily ration: The total quantity of food, referred to a moisture content of 12 per 100, needed as a daily average to satisfy the set of needs of an animal of a species, an age category and a determined performance.

e) Full feed: mixtures of animal feed which, by their composition, are sufficient to ensure a daily ration.

(f) Supplementary feed: mixtures of foods containing high percentages of certain substances and which, by their composition, only ensure daily ration if they are associated with other animal feed.

g) Mineral feed: Complementary feed consisting mainly of minerals and containing at least 40 per 100 of gross ash.

(h) Melated feed: complementary feed prepared from molasses and containing at least 14 per 100 of total sugars expressed as sucrose.

(i) Breast-feeding stuffs: compound feedingstuffs administered in a dry state or after dilution in a certain quantity of liquid, intended for the feeding of young animals, as a supplement or in replacement of milk Postcalostral maternal, or calves for meat.

(j) Animals: Animals belonging to species normally fed and bred or consumed by the human being, and animals that live freely in the wild, in case they are fed with feed.

k) Family or companion animals: Animals belonging to species that are reared and held normally, but are not consumed by man, with the exception of animals reared to take advantage of their skin.

l) The durability deadline for a compound feed: The date to which this feed retains its specific properties under appropriate conservation conditions.

m) In circulation or circulation: the holding of any product intended for animal feed for sale, including the offer of sale, or other form of transfer to third parties, either free of charge or by payment, as well as the sale itself and other forms of transfer.

CHAPTER II

Raw materials for animal feed

Article 3. Requirements for their circulation.

1. Feed materials may only be put into circulation within the Spanish territory if they meet the following requirements:

(a) Be healthy, fair and of sufficient commercial quality, in the opinion of the competent health authorities, so as not to pose a danger to human health, animal health and the environment.

b) Reunite the documentary requirements of this Royal Decree, so that its putting into circulation in no way can lead to error or confusion.

2. The circulation or use of raw materials shall be subject to the documentary requirements, restrictions and prohibitions which, for each case, are included in Community legislation.

Article 4. Documentary requirements.

1. The producer, packer, importer, seller or distributor of a raw material for animal nutrition shall, on a label attached to it or in an accompanying document, record the information in its container or package, the information to which it is refers to the following article.

2. The particulars referred to in this Chapter shall be expressed, at least, in the official Spanish language of the State, without prejudice to the use of any other official language in the territory of the Autonomous Communities with their own language.

Article 5. Mandatory information.

1. The following data shall be visible, clearly legible and indelible, in the container or container on the label attached to it or in the accompanying document for any product intended for animal nutrition:

a) The expression "raw materials for animal feed".

(b) The name of the raw material concerned.

(c) The data specified in Annex IV, where applicable.

(d) The net quantity expressed in units of mass, in the case of solid products, and in units of mass or volume, in the case of liquids.

(e) The name or social name and the registered office or registered office of the producer establishment, the approval number, the reference number of the lot or any other indication to enable the origin of the raw material to be traced, if that establishment must be authorised in accordance with Royal Decree 2224/1993 of 17 December 1993 on health rules for the disposal and processing of dead animals and waste of animal origin and protection against agents pathogens in animal feed, as well as with the measures to be taken as a result of the Community legislation.

(f) The name or social name and the address or registered office of the person responsible for the information referred to in this paragraph, where the person responsible is different from the producer referred to in paragraph e).

2. The information relating to the raw materials listed in Annex II shall also include the mandatory declaration data contained in column 4 of that Annex. The information relating to the materials not mentioned in Annex II shall include the mandatory declaration data referred to in column 2 of Annex III.

Article 6. Supplemental information.

In addition to the data referred to in the previous Article, any other information referring to objective or quantifiable elements may be added, provided that it can be justified, cannot mislead the consumer and be duly separated from the mandatory particulars.

Article 7. Special assumptions.

1. Where the raw material is marketed in quantities equal to or less than 10 kilograms and is directly intended for the final consumer, the information referred to in Articles 5 and 6 may be contained in a poster displayed at the place of sale.

2. When a lot is split during circulation, the data contained in Article 5, together with a reference to the initial batch, must be included in the documentation for each of the resulting fractions, in its container or container.

3. Where the composition of a raw material is modified during circulation, the data contained in Article 5, together with a reference to the initial batch, must appear in the product documentation resulting from the packaging or container. In this case, the data referred to in paragraph 1 (e) of that Article shall be construed as referring to the person supplying the new information.

Article 8. Reduction of the scope of the required information.

1. The data referred to in Article 5 shall not be included in the accompanying documentation in the case of feed materials not treated with additives, except in the case of preservatives, which are transferred between a producer farmer and a user farmer established both on national territory, without prejudice to the provisions of Royal Decree 2224/1993 of 17 December 1993.

2. The data referred to in Article 5.2 and the data referred to in paragraphs 2 and 3 of paragraph V of Annex I shall not be included in the accompanying documentation in the following cases:

a) When the buyer renounces in writing to receive this information prior to the transaction.

(b) In the case of raw materials intended for the feeding of pet animals and marketed in quantities equal to or less than 10 kilograms which are delivered directly to the final consumer, provided that the products and the consumer are established in the national territory and without prejudice to the provisions of Royal Decree 2224/1993.

3. In the case of putting into circulation by-products of animal or plant origin resulting from an agro-industrial processing process and the water content of which is more than 50 per 100, it shall not be necessary to include in the accompanying documentation the data referred to in paragraphs (c) and (d) of Article 5 (1) or in paragraph 2 of the same Article.

Article 9. Exchanges with third countries.

1. The competent authorities may authorise the entry of feed materials from third countries without sufficient means to facilitate the guarantees of composition referred to in Article 5.2 and in the paragraphs 2 and 3 of Annex I, paragraph V, provided that those responsible for placing it on the market:

a) Previously inform the authorities in charge of carrying out the checks.

(b) Provide the provisional data relating to its composition, accompanied by the text contained in Annex IV.

(c) Present to the buyer and the competent authorities within 10 days of their arrival in the Spanish territory, the final data relating to their composition.

This authorisation shall be understood in the case of raw materials entering for the first time in circulation within the territory of the European Union.

2. The competent authorities shall inform the European Commission, through the established channels, of the circumstances in which the authorisation referred to in the previous paragraph was granted.

3. The provisions of this Royal Decree shall also apply to the raw materials for which it has been tested, at least, by an appropriate indication, which are intended for export to third countries.

4. By way of derogation from the above paragraph, where a third country has established, by means of an agreement or not, the fulfilment of requirements and conditions other than those laid down in this Royal Decree, it shall be subject to the provisions of the third country.

When raw materials for export to third countries comply with the relevant legislation of the eligible countries and set requirements other than those contained in this Royal Decree, these raw materials will have to be produced at different times from the rest of the production. In addition, in order to avoid deviations from the internal market, as well as to enable them to be monitored, the following rules must be complied with:

(a) The products to be exported shall be issued directly from the place of origin to the place of departure of the Spanish territory, and must be accompanied by the corresponding authorization issued by the authority. the competent authority of the Autonomous Community in question, in which, in addition to the name or social name and address of the manufacturer or seller and of the exporter, the nature and composition of the product, the destination, the quantity to which the product is intended, amfor the authorization, the place of departure of the Spanish territory, the date of validity of the authorization and the country of destination.

(b) On the label, printed on the packaging or accompanying document, where appropriate, shall include at least the following data, written at least in the official language of the Spanish State:

1. º The mention: "to export to ..." (third country).

2. No. Name or social reason and address or registered office of the manufacturer or seller and of the exporter.

3. The name and nature of the product and destination.

4. º. Where appropriate, quality characteristics in accordance with the legislation of the country of destination.

5. º Any other specification noted in the authorization document.

In cases where the third country of destination informs the General Administration of the State of the requirement for specific certification for a given product, the Unit responsible will communicate this to the the relevant authorities of the Autonomous Community concerned.

Article 10. Name of the raw materials.

1. The animal feed materials listed in Annex II may be put into circulation only with the names specified in that Annex and provided that they are in accordance with the descriptions set out in that Annex.

2. The movement of feed materials not included in the list referred to in paragraph 1 shall be permitted, provided that they are circulated with names or designations other than those listed in the Annex and which cannot be misleading. to the buyer as to the actual identity of the product being offered.

Article 11. Undesirable substances and products.

1. Raw materials intended for animal feed containing substances or products which are not desirable in quantities in excess of those legally tolerable may be put into circulation only by authorised establishments of compound feedingstuffs and which appear on the national list provided for by Royal Decree 1191/1998 of 12 June 1998 on the authorisation and registration of establishments and intermediaries in the animal nutrition sector.

2. The raw materials referred to in the previous paragraph shall be labelled as 'feed materials for approved establishments manufacturing compound feed'.

CHAPTER III

Compound Feed

Article 12. Requirements for their circulation.

1. Compound feed may only be put into circulation if it complies with the following requirements:

(a) Be healthy, fair and of sufficient commercial quality, and do not pose any danger to animal or human health or the environment.

b) Reunite the documentary and packaging requirements contained in this Royal Decree, so that its presentation and circulation in no way can be misleading.

2. The general provisions laid down in Part A of Annex V are applicable in the movement of compound feedingstuffs

3. For reasons of protection of human and animal health, and without prejudice to the provisions on micro-organisms in feedingstuffs, the use in compound feed of the related feed materials in the animal feed shall be prohibited. Annex VII.

4. Where the circumstances so require for animal health, the use of raw materials in the manufacture of compound feedingstuffs may be prohibited from those included in Annex II to this Royal Decree and in accordance with the provisions of this Regulation. Chapter II.

II.

5. The circulation or use of compound feed shall be subject to the documentary requirements, restrictions and prohibitions which, for each case, are included in Community legislation.

Article 13. Documentary requirements.

1. Compound feedingstuffs may be put into circulation only when they appear in a space reserved for that purpose, on the packaging, in the container or on a label affixed thereto or, where appropriate, in the accompanying document, the particulars listed in Article 15, which must be clearly visible, clearly legible and indelible and which shall bear the responsibility, where appropriate, of the producer, packer, importer, seller or distributor established within the territory of Spain.

2. The particulars referred to in the preceding paragraph shall be expressed, at least, in the official Spanish language of the State, without prejudice to the use of any other official language in the territory of the Autonomous Communities with their own language.

Article 14. Packaging requirements.

1. Compound feed may only be put into circulation in closed containers or containers. The packaging shall be closed in such a way that the closure is damaged by opening and cannot be re-used.

2. By way of derogation from the above paragraph, compound feed may be put into circulation in bulk or in non-enclosed containers or containers, in the case of:

(a) deliveries between producers of compound feed.

(b) Delivery of compound feed producers to packaging companies.

c) Of compound feed obtained by mixing grains or whole fruits.

d) Of lamer blocks or stones.

e) For small quantities of compound feed intended for the end user, the weight of which does not exceed 50 kilograms, and which comes directly from a container or container which, before the opening, responds to the provisions laid down in Paragraph 1 of this Article.

3. Compound feed may be put into circulation in bulk in non-enclosed containers, but in no case in non-enclosed containers, if this is the case:

a) Of compound feed delivered directly by the manufacturer to the end user.

(b) Melazate feed consisting of three raw materials for animal feed.

(c) Agglomerated feed which is presented in the form of granules.

Article 15. Mandatory information.

1. In the container, on the package, on the label affixed thereto, or in the space reserved for that purpose, the following particulars must appear under the conditions laid down in Article 13:

(a) The name "complete feedingstuff", "complementary feed", "mineral feed", "melazado feed", "complete lactation feed" or "complementary lactation feed", as appropriate.

(b) The animal species or type of animals to which the feed is intended.

(c) The mode of employment which indicates the exact destination of the feed and which permits its proper use.

(d) For all compound feedingstuffs, with the exception of those intended for pet animals other than dogs or cats, the feed materials to be declared in accordance with the provisions of Article 18 of the Regulation Present Royal Decree.

e) Where appropriate, the statement of the analytical constituents, as provided for in Part A of Annex V to this Royal Decree.

(f) According to the cases, the declarations provided for in Annex V, Part B, columns 1, 2 and 3.

g) The name or social reason and the address or registered address of the person responsible for the information referred to in this paragraph.

h) The net quantity expressed in units of mass in the case of solid products and in units of volume or mass for liquid products.

i) The durability deadline, to be indicated in accordance with the provisions of Article 19.1 of this provision.

j) The reference number of the batch, when the date of manufacture is not indicated.

k) The authorisation number or, as appropriate, the registration number which has been attributed to the establishment of conformity, respectively, with Articles 5 and 9 of Royal Decree 1191/1998 of 12 June 1998 on authorisation and registration of establishments and intermediaries in the animal feed sector.

2. For feed manufactured and marketed in the Spanish territory, in addition to all the above, the official code number of the manufacturer shall be indicated where the manufacturer is not responsible for the labelling particulars, if not the name or social name and address or registered office of the manufacturer is mentioned.

3. Where compound feedingstuffs are put into circulation in tankers or similar vehicles or in accordance with the provisions of Article 14 (2) and (3), the particulars referred to in paragraph 1 of this Article may be given on the accompanying document. In the case of small quantities of feed intended for the last user, it is sufficient that these indications appear in appropriate labels at the place of sale.

Article 16. Other information.

1. In addition to the indications provided for in the previous Article, and in the same space reserved for this purpose, the following additional information may be given:

(a) The identification mark or trade mark of the person responsible for the indications of the labelling.

(b) The name or social name and address or registered address of the manufacturer, if the manufacturer is not responsible for the indications of the labelling.

c) Where appropriate, the reference number of the batch.

d) The production or manufacturing country.

e) The price of the product.

f) The name or trademark of the product.

g) For compound feed intended for pet animals other than dogs or cats, the feed materials for animal feed to be declared under Article 18 of this Royal Decree.

h) The indications regarding the physical state of the feed or specific treatment to which it has been submitted.

i) Where appropriate, the statements of the analytical constituents, in the cases provided for in Annex V, Part A.

(j) The declarations provided for in Annex V, Part B, columns 1, 2 and 4.

k) The date of manufacture, to be indicated in accordance with Article 19.2 of this Royal Decree.

2. The person responsible for the labelling particulars of the compound feedingstuff may provide further information in addition to those referred to in this standard which, in any case, shall comply with the following conditions:

(a) They may not refer to the declaration of the presence of the content of analytical components other than those whose declaration is provided for in Article 5 of Royal Decree 1999/1995 of 7 December 1995 on the food for animals intended for specific nutritional purposes.

(b) It shall not mislead the purchaser, in particular by attributing to the feed effects or properties it does not possess or suggesting that the feed has particular characteristics which are common to all similar feedingstuffs.

c) They should not refer to disease prevention, treatment or cure properties.

(d) You must refer to objective or measurable elements that can be justified.

e) They must be clearly separated from all the indications referred to in Article 15 and in paragraph 1 of this Article.

Article 17. Reduction of the scope of the required information.

1. For compound feedingstuffs containing at most three feed materials, the particulars referred to in Article 15 (1) (b) and (c) shall not be required if the feed materials are to be supplied to the feed material. animals used are clearly mentioned in the name.

2. For mixtures of whole grains, the declarations referred to in Article 15 (1) (e) and (f) shall not be required; however, such statements may be included.

3. The names 'complete feedingstuff' or 'supplementary feed' for food intended for pet animals other than dogs or cats may be replaced by the name 'compound feedingstuff'. In this case, the declarations required or accepted in this Article shall not be those for complete feedingstuffs.

4. The final date of durability, the net quantity and the reference number of the lot may be mentioned outside the space reserved for the markings provided for in Article 15; in that case, the space shall be indicated where figure.

5. In the case of compound feed for pet animals, the name 'feed' may be replaced by the name 'food'.

Article 18. Declaration of raw materials for animal feed.

In relation to the declaration of raw materials for animal feed, as referred to in Article 15.1 (d), the following is available:

1. Where a declaration of raw materials for animal feed is included, all of them shall be mentioned.

2. The enumeration of feed materials for animal feed shall be subject to the following rules:

(a) Compounds intended for animals other than those of a company: a decreasing enumeration according to its weight.

(b) compound feedingstuffs intended for pet animals: enumeration of the feed materials for animal feed, or indicating their content, or mentioning them in descending order, according to their weight.

3. Feed materials for animal feed shall be designated by their specific name.

However, the categories grouping several raw materials for animal feed, as set out in Annex VI to this Royal Decree, may be replaced by the specific name of a raw material for animal feed. animal feed for the indication of the category to which it belongs, subject to the conditions specified below:

(a) Only the categories listed in Annex VI, Part A

may be indicated on the packaging, in the container or on the label of compound feed intended for animals other than those of the company.

(b) Only the categories listed in Annex VI, Part B.

may be indicated on the packaging, in the container or on the label of compound feed intended for pet animals.

The use of one of these forms of declaration excludes the other, except if one of the raw materials for animal feed used does not belong to the defined categories. In this case, the raw material for the animal feed designated by its specific name shall be quoted in the order of weight, in relation to the categories.

4. The labelling of compound feedingstuffs for pet animals may also make it possible to highlight the presence or the low content of one or more feed materials essential for the determination of the characteristics of the animal. food. In this case, the minimum or maximum content expressed as a percentage by weight of the raw material or feed materials considered essential shall be clearly indicated in one of the following three forms:

(a) Outside the full ratio of raw materials for animal feed and against the indication of the raw material or raw materials for essential animal feed.

b) In the same ratio of raw materials for animal feed.

(c) Outside the category relationship and in relation to the raw materials for the essential animal feed, mentioning their percentage by weight.

Article 19. Indication of dates.

1. The durability deadline referred to in Article 15.1 (i) of this Royal Decree shall be indicated by means of the following particulars:

a) "Use before ...", followed by the indication of the date (day, month and year), in the case of microbiologically highly perishable food.

b) "Use preferably before ...", followed by the indication of the date (month and year), in the case of other foods.

Where other provisions of the existing rules on compound feed require the mention of a durability deadline, or the date of a date of guarantee, a single date shall be indicated, namely the date of expiry of the term of next.

2. The date of manufacture shall be indicated by the following entry: 'Made (x) days, month (s) or year (s)' before the stated durability deadline.

Where the provisions of Article 17 (4) are applied, in the space reserved for the requirements of the labelling, the place in which the date of manufacture is given shall be indicated.

Article 20. Exchanges with third countries.

1. In compound feedingstuffs from third countries, the particulars referred to in this Chapter shall be drawn up at least in the official Spanish language of the State, and the goods shall be accompanied by a certificate issued by the competent official of the country of origin where it is stated that the feed to be exported has been produced by an officially approved or approved manufacturer. Such feed shall meet the requirements laid down for national production.

2. The importer shall inform the Ministry of Agriculture, Fisheries and Food and, where appropriate, the Autonomous Community of the nature, composition and destination of the product.

Article 21. Exceptions to the application of this Royal Decree.

This Royal Decree shall not apply to compound feedingstuffs for which it is proved, at least, by an appropriate indication that they are intended for export to third countries for scientific or experimental purposes. However:

(a) For compound feedingstuffs for export, the manufacturer shall be duly authorised and such feed shall be placed in closed containers or containers in which, either printed on them or on the label, they shall appear, as minimum, the following data, registered in the official Spanish language of the State:

1. º The mention " To export to ... (third country) ".

2. No. Name or social reason and address or registered office of the manufacturer and the exporter.

3. The name and nature of the product, and destination (species and type of animals).

4. Content in additives and their identity.

(b) The following indications shall be given on the packaging or on the label of compound feed intended for animals for scientific or experimental purposes:

1. The mention "... for experimentation".

2. The name or social reason and address or registered address of the manufacturer.

3. The animal species or type of animals to which it is intended.

4. The date of manufacture.

CHAPTER IV

Sanctioning Regime

Article 22. Sanctioning regime.

Failure to comply with the provisions of this Royal Decree shall be sanctioned in accordance with the provisions of the Epizootic Law of 20 December 1952 and its Rules of Procedure of 4 February 1955; Article 103 of Law 50/1998, On 30 December, on the subject of tax, administrative and social order measures; Law 10/1998 of 21 April of Waste; Law 26/2001 of 27 December on the establishment of the system of infringements and penalties in respect of encephalopathies In the case of the case-law of the Court of Law, the Court of regulates the Integrated Programme for the coordinated surveillance and control of transmissible spongiform encephalopathies of animals, and in Royal Decree 1945/1983 of 22 June 1983 regulating infringements and sanctions in respect of the protection of the consumer and agri-food production.

ADDITIONAL DISPOSITION

Unica. Competence title.

This Royal Decree is dictated by article 149.1.13.a and 16.a of the Constitution, which attributes to the State exclusive competence in the field of bases and coordination of the general planning of the activity economic and basic health and coordination, except in Articles 9, 20 and 21 (a), which are given in accordance with Article 149.1.10.a and 16.a of the Constitution, which confers on the State exclusive competence on trade external health and external health.

REPEAL PROVISION

Unica. Regulatory repeal.

All provisions of the same or lower rank are repealed in that they object to the provisions of this Royal Decree and, in particular, Royal Decree 1489/1998 of 10 July on the movement of raw materials for animal feed, with the exception of its second final provision, and the Order of 8 October 1992 relating to the placing on the market of compound feedingstuffs.

FINAL PROVISIONS

First. Faculty of development.

The Ministers for Agriculture, Fisheries and Food and Health and Consumer Affairs are empowered to develop, within the scope of their powers, the provisions of this Royal Decree and to adapt the Annexes thereto to the amendments introduced by Community legislation.

Second. Entry into force.

This Royal Decree shall enter into force on the day following that of its publication in the "Official Gazette of the State".

ANNEX I

Generalities

I. Explanatory notes

1. The following criteria have been followed for the relationship and denomination of the feed materials of Annex II to this Royal Decree:

a) Origin of product or by-product, e.g. plant, animal, mineral;

b) Part of the product or by-product used, for example, whole, seeds, tubers, bones;

(c) Treatment to which the product or by-product has been subjected, for example, decorticate, extraction, heat treatment, and the resulting product or by-product, for example, flakes, bran, pulp, fat;

d) Maturity of the product or by-product, as well as its quality or characteristics, for example, "low fat content", "low-sugar content".

2. The list set out in Annex II to this Royal Decree is divided into 12 chapters:

1. Grains of cereals, their products and by-products.

2. Oilseeds, oleaginous fruits, their products and by-products.

3. Seeds of legumes, their products and by-products.

4. Tubers, roots, their products and by-products.

5. Other seeds and fruits, their products and by-products.

6. Fodder and coarse fodder.

7. Other plants, their products and by-products.

8. Dairy products.

9. Land-based animal products.

10. Fish, other marine animals, their products and by-products.

II. Provisions relating to botanical purity

1. By way of derogation from Article 3 of this Royal Decree, raw materials for animal feed, in so far as they are permitted by the correct processing practices, must be free of chemical impurities from the use, during their manufacturing process, of technological aids referred to in Royal Decree 2599/1998 of 4 December 1998 on additives in the feeding of animals, unless Annex II to this Royal Decree has been fixed a specific maximum residue level in relation to a given raw material for the animal feed.

2. The botanical purity of the products and by-products listed in Annexes II and III to this Royal Decree shall be at least 95 per 100 unless a different percentage is mentioned in those Annexes.

Are considered botanical impurities:

(a) Natural but harmless impurities (e.g. straw or straw waste, seeds of other cultivated species or weed seeds).

(b) Inoffensive residues of other seeds or oil fruits from a previous manufacturing process, provided that their content does not exceed 0 ' 5 per 100.

3. The percentages indicated refer to the weight of the product and by-product as is.

III. Provisions relating to denominations

Where the name of a raw material for animal feed listed in Annex II to this Royal Decree contains one or more words in brackets, the inclusion of such words shall be optional. Example, soya bean oil may be referred to as soya bean oil or soya bean oil.

IV. Provisions relating to the glossary

This glossary below refers to the main procedures used for the preparation of the feed materials mentioned in Annexes II and III to this Royal Decree. Where a name or common term of this glossary is included in the names of those raw materials, the procedure used shall be in accordance with the definition.

V. Provisions relating to the contents indicated or necessary in accordance with Annexes II and III.

1. The indicated or necessary statement of contents shall be expressed in relation to the weight of the feed material, unless otherwise specified.

2. Without prejudice to Article 3 and Article 8 (3) of this Royal Decree, and provided that no other content has been determined in Annexes II and III to this Royal Decree, the moisture content of the raw material For animal feed, it must be provided that it exceeds 14 per 100 of its weight. The moisture content of feed materials which do not exceed that limit must be declared at the request of the purchaser.

3. Without prejudice to Article 3 of this Royal Decree and provided that no other content has been determined in Annexes II and III to this Royal Decree, the content of ash insoluble in hydrochloric acid from raw materials For animal feed it shall be indicated if it is more than 2,2 per 100 dry matter.

VI. Provisions relating to denaturing agents and binders

Where the products referred to in column 2 of Annex II to this Royal Decree or in column 1 of Annex III thereto are used to denature or bind raw materials for animal feed, Provide the following information:

(a) Denaturing agents: Nature and quantity of the products used.

b) binders: Nature of the products used.

The amount of binders used may never exceed 3 per 100 of the total weight of the product.

VII. Provisions relating to the permitted minimum levels indicated or required in accordance with Annexes II and III

When, on the occasion of an official control carried out in accordance with Article 5 of Royal Decree 557/1998 of 2 April 1998 laying down the principles governing the organisation of official controls in the the field of animal feed, it is found that the composition of a feed material for animal feed is removed from the declared composition until its value is reduced, the following minimum tolerance margins shall apply:

a) Gross protein:

Two units for content declared equal to or greater than 20 per 100.

VIII. Provisions relating to the labelling of feed materials containing processed animal protein

1. The labelling of feed materials containing processed animal protein, as defined in Article 1 of Council Decision 2000 /766/EC, shall bear the following words:

"Contains processed animal proteins prohibited in the feeding of farmed animals kept, primed or reared for the production of food."

2. This provision does not apply to the following products:

a) Milk and dairy products,

(b) Gelatine of non-ruminants for the coating of additives within the meaning of Council Directive 70/524 of 23 November on additives in feedingstuffs.

3. However, on the labelling of fishmeal, dicalcium phosphate from degreased bones and water proteins, which must have been obtained in accordance with the conditions laid down in Decisions 2001 /9/EC and Commission Regulation (EC) No 2001 /165/EC shall bear the following words:

"Contains fishmeal, and/or dicalcium phosphate from degreased bones and/or hydrolysed proteins, and cannot be destined for ruminant food."

Part A

General provisions

1. The contents indicated or to be declared shall relate to the weight of the compound feed as it is, unless otherwise specified.

2. The water content of the feed shall be declared in cases where it exceeds:

(a) 7 per 100 in lactation feed and other compound feed containing a milk product content of more than 40 per 100.

(b) 5 per 100 in mineral feed containing no organic substances.

c) 10 per 100 in mineral feed containing organic substances.

d) 14 per 100 in other compound feed.

In the case of compound feed the moisture content of which does not exceed the limits referred to in the previous indents, this content may also be declared.

3. The ash content insoluble in hydrochloric acid shall not exceed 3,3 per 100 in respect of dry matter in the case of compound feed containing mainly by-products of rice, nor of 2,2 per 100 with respect to the dry matter. dry matter in other cases.

However, a content of 2.2 per 100 may be exceeded in the case:

7. Labelling of compound feed containing processed animal protein.

7.1 Compound feedingstuffs intended for animals other than farmed animals kept, primed or reared for the production of food, containing processed animal protein as defined in Article 1 of Regulation (EC) No 71/2020. Council Decision 2000 /766/EC shall bear the following words on its labelling:

"Contains processed animal proteins prohibited in the feeding of farmed animals kept, primed or reared for food production."

This provision does not apply to feed intended for pet animals, nor to compound feed containing only the following products:

Milk and dairy products.

Gelatine, not ruminants for the coating of additives within the meaning of Council Directive 70/524 of 23 November on additives in animal nutrition.

7.2 Compound feed containing fishmeal, and/or dicalcium phosphate from degreased bones and/or hydrolysed proteins, which must have been produced in accordance with the conditions described in the Decisions Commission Regulation (EC) No 2001 /9/EC and 2001 /165/EC shall bear the following words on their labelling:

"Contains fishmeal, and/or dicalcium phosphate from degreased bones and/or hydrolysed proteins, and cannot be destined for ruminant food."

ANNEX VII

List of feed materials that are prohibited from being used in compound feed

1. Faeces, urine and other gastrointestinal contents from the emptying or removal of the digestive system, regardless of the form of treatment or mixture applied.

2. Skins treated with tanning substances, including their residues.

3. Seeds, plants and other plant propagating material which have been treated with plant protection products after harvest due to their destination; their derivatives.

4. Wood, sawdust and other wood-derived materials treated with protective products.

5. All waste obtained in the different phases of the urban, domestic and industrial waste water treatment process (*), regardless of any subsequent process to which the waste is subjected and independently also from the source of the waste water.

The term "waste water" does not refer to "process waters", i.e. water from independent conduits integrated into food or feed-making industries; when these ducts are supplied of water, it must be healthy and clean (**). In the case of fishing industries, the ducts may also be supplied with clean seawater (***). Process waters may contain only materials from feed or food products and should be technically free from cleaning agents, disinfectants or other substances not authorised by animal feed legislation.

The materials of animal origin present in the process waters shall be treated in accordance with the provisions of Council Directive 90 /667/EEC.

6. Solid urban waste, such as household waste.

7. Untreated waste from collective canteens, with the exception of residues of food of plant origin, inappropriate for human consumption as a result of not being considered fresh.

(*) As defined in Article 2 of Council Directive 91 /271/EEC of 21 May on the treatment of waste water (urban waste water: domestic waste water or the mixture of waste water) with industrial waste water and/or stormwater. 'Domestic waste water' means waste water from housing and service areas and mainly generated by human metabolism and domestic activities. 'Industrial waste water' means any waste water discharged from premises used for any commercial or industrial activity, other than domestic waste water or stormwater.).

(**) As defined in Article 4 of Council Directive 98 /83/EC of 3 November on the quality of water intended for human consumption (" Water intended for human consumption is salubrious and clean when: a) do not contain any type of micro-organism, parasite or substance, in an amount or concentration which may present a hazard to human health, and (b) meet the minimum requirements specified in Parts A and B of Annex I ').

(***) As defined in Article 2 of Council Directive 91 /493/EEC of 22 July laying down the health rules applicable to the production and placing on the market of fishery products ("Sea water") "clean": sea water or brackish which does not present microbiological contamination, harmful substances and/or toxic marine plankton in quantities likely to alter the health quality of fishery products, to be used under the conditions set out in this Directive).

8. Packaging and parts of packaging from the use of products from the agri-food industry.

9. Processed animal protein, as defined in Article 1 of Council Decision 2000 /766/EC, used in the feeding of farmed animals kept, primed or reared for the production of food, with the following: exceptions:

a) For ruminants and non-ruminants:
