Law 10/1998 of 21 April, of Waste, establishes the basic legal regime applicable to waste in Spain and, in this sense, enables the Ministry of the Environment to publish a series of measures adopted by the Community institutions through various decisions, such as the case of recovery and disposal operations and the European lists on waste.

Thus, in the second subparagraph of paragraph 2 of the third final provision of the aforementioned Law it is established that the aforementioned Department will publish the list of recovery and disposal operations, approved by the Decision 96 /350/EC, which is carried out in Annex 1 to this Order, in such a way as to apply to all types of waste and allows for the correct application of the concepts of 'recovery' and 'disposal', in accordance with the Article 3 (k) and (l) of Law 10/1998.

Similarly, in the first subparagraph of paragraph 2 of the same third final provision of Law 10/1998, the Ministry of the Environment is empowered to publish the European Waste Catalogue (CER) and the Waste List Dangerous, approved respectively by Commission Decisions 94 /3/EC of 20 December and 99 /404/EC of the Council of 22 December.

These Community Decisions have been repealed by Commission Decision 2000 /532/EC of 3 May (subsequently amended by Commission Decisions 2001 /118/EC of 16 January 2001 and 2001/119 of 22 January 2001) and by the Commission Decision of 22 January 2001. Council Decision 2001/573 of 23 July approving the European Waste List, which, in addition to other amendments, recast the two lists mentioned above in one. It is therefore appropriate to proceed with the publication of the said European Waste List in Annex 2 to this Order, in accordance with the aforementioned rating.

As regards the own consideration of the waste as hazardous, in Article 3 (c) of Law 10/1998 it is established that they will have such a condition that they have been classified as dangerous by the Community legislation. In this respect, Decision 2000 /532/EC identifies the waste that has such a rating on the European Waste List and establishes the relevant mechanisms that result from the implementation of such an identification, and therefore all this is public by means of this Ministerial Order, both in the Articles and in Annex 2, in which a practically literal translation of Decision 2000 /532/EC is carried out, in accordance with the corresponding clearance of Law 10/1998, previously mentioned.

Finally, in the final provision of Royal Decree 952/1997 of 20 June 1997, amending Royal Decree 833/1988 of 20 July, which approves the Regulation for the implementation of Law 20/1986 of 14 May 1988, Basic of Toxic and Dangerous Waste, the Minister of the Environment is enabled to publish the successive modifications of the list of hazardous waste approved by the Community institutions.

In the procedure for the elaboration of this Order, which has the consideration of basic legislation on environmental protection, in accordance with the provisions of Article 149.1.23 of the Constitution, the Autonomous Communities and the sectors concerned.

In its virtue, I have:

First. Operations for the recovery and disposal of waste.

1. In accordance with the second subparagraph of paragraph 2 of the third final provision of Law 10/1998 of 21 April of Waste, Annex 1 to this Order, the recovery and disposal operations of the waste, established by Commission Decision 96 /350/EC of 24 May.

2. Annex 1 to this Order shall apply to all waste falling within the scope of Law 10/1998.

Second. European List of Waste.

1. In accordance with the first subparagraph of paragraph 2 of the third final provision of Law 10/1998 of 21 April of Waste, the European Waste List, approved by the Decision, is published in Annex 2 to this Order. 2000 /532/EC, of the Commission of 3 May, as amended by Commission Decisions 2001 /118/EC of 16 January and 2001/119 of 22 January and by Council Decision 2001/573 of 23 July.

2. In accordance with Article 3 of Decision 2000 /532/EC, the Government or, where appropriate, the Autonomous Communities in their respective fields of competence, may decide in exceptional cases:

That a waste listed in the European Waste List as hazardous does not have such a consideration if, in accordance with the relevant documentary evidence provided by the holder, it does not present any of the characteristics of the hazard listed in Table 5 of Annex I to the Regulation for the implementation of Law 20/1986 of 14 May, Basic for Toxic and Dangerous Waste, approved by Royal Decree 833/1988 of 20 July 1988 and amended by the Royal Decree 952/1997 of 20 June 1997.

For a waste to be considered dangerous, even if it is not listed as such in the European Waste List if, in its view, it presents any of the hazard characteristics listed in Table 5 of Annex I to the Regulation. for the implementation of the Law 20/1986 of 14 May, Basic for Toxic and Dangerous Waste.

If the Autonomous Communities adopt any of the decisions referred to in the preceding paragraphs, they shall inform the Ministry of the Environment for the purpose of notifying the European Commission, through the corresponding.

3. For the purposes of Article 4 of the Regulation for the implementation of Law 20/1986 of 14 May, Basic for Toxic and Dangerous Waste, consideration as hazardous waste of packaging waste shall be in accordance with the provisions laid down in Article 4 of Regulation (EEC) No 2054/86. the European Waste List set out in Annex 2 to this Order, and in particular point 6 of paragraph B of that Annex.

Third. Constitutional foundation and basic character. -This Order has the consideration of basic legislation on environmental protection, in accordance with the provisions of Article 149.1.23 of the Constitution.

Fourth. Regulatory repeal-The entry into force of this Order will be without effect the Resolution of the Directorate-General for Quality and Environmental Assessment of 17 November 1998, which provides for the publication of the European Waste Catalogue (CER) approved by Commission Decision 94 /3/EC of 20 December.

Fifth. Entry into force. -As set out in this Order it shall enter into force on the day following that of its publication in the "Official Gazette of the State".

INTRODUCTION

A)

Waste classified as hazardous is considered to have one or more of the characteristics listed in Annex III to Directive 91 /689/EEC and, in respect of the H3 to H8, H10 (1) and H11 characteristics of the Annex, one or more of the following properties:

Inflammation point s 55 oC.

Contain one or more classified substances (2) as very toxic in a total concentration s 0.1 per 100.

Contain one or more substances classified as toxic in a total concentration s 3 per 100.

Contain one or more substances classified as harmful in a total concentration s 25 per 100.

Contain one or more corrosive substances classified as R35 in a total concentration s 1 per 100.

Contain one or more corrosive substances classified as R34 in a total concentration s 5 per 100.

Contain one or more irritant substances classified as R41 in a total concentration s 10 per 100.

Contain one or more irritant substances classified as R36, R37 or R38 at a total concentration of 20 per 100.

(1) In Council Directive 92/32/EEC, seventh amendment of Directive 67 /548/EEC, the term "toxic for reproduction" was introduced, with which the term "teratogenic" was replaced. The term 'toxic for reproduction' is considered in accordance with feature H10 of Annex III to Directive 91 /689/EEC.

(2) Classification and R-numbers refer to Council Directive 67 /548/EEC of 27 June 1967 on the approximation of provisions laid down by law, regulation or administrative action relating to classification, packaging and labelling of dangerous substances (OJ L 196, 16 August 1967, p. 1), and subsequent amendments thereto. The concentration limits refer to those laid down in Council Directive 88 /379/EEC of 7 June 1988 on the approximation of the laws, regulations and administrative provisions of the Member States relating to the classification, packaging and labelling of dangerous preparations (OJ L 187, 16 July 1988, p. 14) and its subsequent amendments.

Contain a substance that is a known carcinogen of category 1 or 2 in a concentration s 0.1 per 100.

Contain a substance that is a known carcinogen of category 3 in a concentration s 1 per 100.

Contain a toxic substance for reproduction of category 1 or 2, classified as R60 or R61, at a concentration s 0.5 per 100.

Contain a toxic substance for reproduction of category 3 classified as R62 or R63 at a concentration s 5 per 100.

Contain a category 1 or 2 mutagenic substance classified as R46 at a concentration s 0.1 per 100.

Contain a category 3 mutagenic substance classified as R40 at a concentration s 1 per 100.

B)

1. This list is a harmonised list of waste which will be regularly reviewed in the light of new knowledge and, in particular, of the results of the investigation and, if necessary, amended in accordance with Article 18 of the Directive. 75 /442/EEC. The inclusion of a material in the list does not, however, mean that such material is a waste in all circumstances. A material is considered as waste only when it complies with the residue definition of Article 1 (a) of Directive 75 /442/EEC.

2. The waste listed in the list is subject to the provisions of Directive 75 /442/EEC unless the provisions of Article 2 (1) (b) of Directive 75 /442/EEC apply.

3. The different types of waste in the list are classified by six-digit codes for the waste, and four and two figures for the sub-chapters and chapters respectively. To locate a residue in the list, it must be done as follows:

3.1 Locate the source that generates the residue in chapters 01 to 12 or 17 to 20 and look for the appropriate six-figure code for the residue (excluding the codes completed in 99 of those chapters). Note that some specific production units may need several chapters to classify their activities: for example, a car manufacturer can find its waste in chapters 12 (waste from moulding and treatment). Surface of metals and plastics), 11 (inorganic residues containing metals from the treatment and coating of metals) and 08 (waste from the use of coatings), depending on the different phases of the process manufacture.

Note: the selectively collected packaging waste (including mixtures of different packaging materials) shall be classified under code 15 01, not 20 01.

3.2 If no appropriate residue code is found in Chapters 01 to 12 or 17 to 20, chapters 13, 14 and 15 shall be consulted for the location of the residue.

3.3 If the residue is not found in any of these codes, please refer to Chapter 16.

3.4 If it is not found in Chapter 16, code 99 (waste not specified in another category) must be used in the part of the list corresponding to the activity identified in the first step.

4. The waste listed under an asterisk (*) is considered to be hazardous waste in accordance with Directive 91 /689/EEC on hazardous waste whose provisions are subject to the application of paragraph 5 of the Directive. Article 1 of that Directive.

5. For the purposes of this List, 'dangerous substance' means any substance that has been or is to be used.

to be classified as dangerous in Directive 67 /548/EEC and its modifications; "heavy metal" means any compound of antimony, arsenic, cadmium, chromium (VI), copper, lead, mercury, nickel, selenium, tellurium, thallium and tin, as well as these substances in their metallic forms, provided that they are classified as dangerous substances.

6. Any residue classified as hazardous by a specific or general reference to hazardous substances shall only be considered to be dangerous if the concentrations of these substances (i.e. the percentage by weight) are sufficient for the (a) residue of one or more of the characteristics listed in Annex III to Council Directive 91 /689/EEC. In the case of categories H3 to H8, H10 and H11, paragraph A of this Annex shall apply. This paragraph does not currently contain provisions for the characteristics H1, H2, H9 and H12 to H14.

7. In accordance with Directive 99/45, which states in its preamble that it is considered that the case of alloys needs to be assessed in greater depth because the characteristics of the alloys are such that it may not be possible to define With the accuracy of their properties using the conventional methods currently available, the provisions of paragraph A of this Annex shall not apply to pure metal alloys (not contaminated with dangerous substances). This will be the case pending the completion of the work which the Commission and the Member States have undertaken to undertake on the specific method for the classification of alloys. The waste specifically listed in this list shall continue to be classified as at present.

8. The following numbering rules have been used for the entries in the list: In the case of waste where no changes have been made, the code numbers of Decision 94 /3/EC have been used; the waste codes which have been amendments have been removed and left blank to avoid confusion following the implementation of the new list; the added waste has been assigned codes not used in Decision 94 /3/EC and in Commission Decision 2000 /532/EC.
