The Ministerial Order of 27 July 1994 ("Official State Gazette" of 29) regulated the automated files of personal data of the Central Services and Autonomous Bodies of the Ministry of Economy and Finance, in compliance with the mandate contained in the second provision of the Organic Law 5/1992 of 29 October ("Official State Gazette" of 31), of Regulation of the Automated Treatment of Personal Data, which provided for the Regulation by the Public Administrations responsible for the automated files prior to the entry into force of the Law.
Subsequently repealed the aforementioned Organic Law 5/1992, of October 29, by the Organic Law 15/1999, of December 13, of Protection of Personal Data ("Official State Gazette" of the 14), and also repealed the Royal Decree 1884/1996 of 2 August, of basic organic structure of the Ministry of Economy and Finance, and replaced by the Royal Decrees 1371/2000 of July 29, and 1330/2000 of July 7 ("Official State Gazette" of 8), which develop the (a) the respective organic structures of the Ministries of Economy, on the one hand, and the Finance Ministry, another, in compliance with the provisions of Article 20 of the Organic Law 15/1999, the creation, modification or deletion of the files of public ownership whose responsibility corresponds to the management bodies of the Ministry of Hacienda, as well as to certain public bodies attached to it, by means of a general provision published in the "Official Gazette of the State".
Therefore, according to the provisions of the first provision of the Organic Law 15/1999 of 13 December, the Protection of Personal Data, and the Royal Decree 1330/2000 of 7 July, for which the develops the basic organic structure of the Ministry of Finance, and in use of the privileges that I have, I have:
First. Field of application.-Automated files containing personal data existing in the Ministry of Finance, as well as in certain Public Bodies attached to it, are those listed in Annex I of the present Order.
Second. Deletion of files.-The automated files of personal data created by the Order of 27 July 1994, regulating the automated files of personal data of the Central Services and Organisms are deleted. Self-employed persons of the Ministry of Economy and Finance, which are listed in Annex II to this Order.
Third. Management and organizational measures. -The owners of the organs responsible for each automated file shall take the necessary management and organizational measures to ensure the confidentiality, security and integrity of the data, as well as the drivers to make effective the guarantees, obligations and rights recognized in the Organic Law 15/1999 of December 13, and in its implementing rules.
Fourth. Data transfers. -Without prejudice to the data transfers provided for in the description of each file in Annex I, the data included in the file may be transferred, within the scope of the Ministry of Finance, to the performance of the functions that gives it the task of legal order and dealing with powers and similar matters.
In addition, they may be transferred to the National Statistics Institute for the performance of the functions attributed to it by article 26 of Law 12/1989, of May 9, of the Public Statistics Service, to the statistical services of the ministerial departments for the tasks conferred on them by Article 33 of the same Law and the statistical services of the Autonomous Communities under the conditions laid down in Article 40 (2) and (3) of the Law on the Statistical Function Public.
Single repeal provision. Regulatory repeal.
The Order of 27 July 1994, which regulates the automatic files of a personal nature of the Central Services and the Autonomous Bodies of the Ministry of Economy and Finance, is hereby repealed. Current responsibilities of the Ministry of Finance.
Single end disposition. Entry into force.
This Order shall enter into force on the day following that of its publication in the "Official State Gazette".
