The Constitution, in Article 149.1.13.a, reserves the State exclusive competence on the bases and coordination of the general planning of economic activity, establishing in the same article 149.1.7.a, that the State has exclusive competence in matters of labour law, without prejudice to its implementation by the bodies of the Autonomous Communities.

Also, in Article 149.1.30.a of the Constitution, the exclusive competence of the State on the regulation of the conditions for obtaining, issuing and approval of academic and professional titles and basic standards is established. for the development of Article 27 of the Constitution; Article 1, which recognises the role of the public authorities in the general programming of education, inspection and approval of the education system, in order to guarantee the compliance with the laws. Article 30 of the Organic Law 1/1990, of 3 October, of General Management of the Educational System, refers to the organization of occupational vocational training to its specific regulations of a working nature.

For its part, the Statute of Autonomy of CastillaLa Mancha, approved by Organic Law 9/1982, of 10 August, and reformed by Organic Laws 7/1994, of 24 March, and 3/1997, of 3 July, has in its article 33.11 to the Board of Communities, in terms of the laws and regulations governing the development of its legislation, the executive function in the field of work and Article 37.1 is established to be the responsibility of the Community Autonomous competition for legislative development and the execution of the teaching in all its extension, levels, modalities and specialties, in accordance with the provisions of Article 27 of the Constitution and Organic Laws which, in accordance with Article 81 (1) thereof, develop and without prejudice to the powers conferred on the State the article 149.1.30.a and the high inspection for its compliance and guarantee.

Moreover, Article 31.un.120, also of the aforementioned Statute of Autonomy, provides that the Board of Communities of Castilla-La Mancha has exclusive competence in the area of economic activity planning and promotion the economic development of the region, within the objectives set by the national economic policy and the economic public sector of Castilla-La Mancha.

Finally, Royal Decree 1064/1983, of 13 April, determines the rules and procedure to be followed by the transfer of functions and services of the State Administration to the Autonomous Community of Castilla-La Mancha.

In accordance with the provisions of the Royal Decree cited above, which also regulates the operation of the Joint Transfer Commission provided for in the transitional provision of the Statute of Autonomy of Casti lla-La Mancha, At its meeting on 13 December 2002, the Commission adopted the appropriate agreement, the practical virtue of which requires its approval by the Government through Royal Decree.

In its virtue, in compliance with the provisions of the said transitional provision fifth of the Statute of Autonomy of Castilla-La Mancha, on the proposal of the Minister of Public Administrations, and after deliberation by the Council of Ministers at their meeting on 20 December 2002,

D I S P O N G O:

Article 1.

The Agreement of the Joint Committee on Transfers provided for in the fifth transitional provision of the Statute for the Autonomous Community of Castilla-La Mancha, adopted by the plenary session of the Commission at its meeting on 13 December, is hereby approved. In 2002, by which the functions and services in the field of work management, employment and training are transferred to the Autonomous Community of Castilla-La Mancha, and which is transcribed as an annex to this Royal Decree.

Article 2.

Consequently, the functions and services, as well as the goods, rights, obligations, personal means and corresponding budgetary appropriations, are transferred to the Autonomous Community of Castilla-La Mancha in the terms of the which result from the Agreement itself and from the annexed relations.

Article 3.

The transfer referred to in this Royal Decree shall be effective from the date specified in the Agreement of the said Joint Committee, without prejudice to the National Employment Institute (INEM), or other competent bodies produce, until the entry into force of this Royal Decree, where appropriate, the administrative acts necessary for the maintenance of the services in the same system and level of operation as they were at the time of the adoption of the Agreement.

Article 4.

The budgetary appropriations to be determined in accordance with the Annex's ratio No 4 shall be given on the basis of the corresponding budgetary concepts and transferred by the Ministry of Finance to the concepts or, in their case, subconcepts which are enabled in the INEM budget, in accordance with the provisions of the recast text of the General Budget Law.

Single end disposition.

This Royal Decree shall enter into force on the day following that of its publication in the "Official Gazette of the State".

CERTIFICATE

That an Agreement on the transfer to the Autonomous Community of Castilla-La Mancha of the functions and services of the management entrusted to it was adopted at the plenary session of the Joint Committee on Transfers, held on 13 December 2002. the National Institute of Employment, in the field of work, employment and training, in the following terms:

(A) Constitutional, statutory and legal rules in which the transfer is covered.

The Constitution, in Article 149.1. 13.a, reserves the exclusive competence to the State on the basis and coordination of the general planning of the economic activity, establishing in the same article 149.1.7.a, that the State has exclusive competence in the field of legislation without prejudice to their execution by the bodies of the Autonomous Communities.

In article 149.1.30.a of the Constitution, the exclusive competence of the State on the regulation of the conditions for obtaining, issuing and approval of academic and professional titles and basic standards for the development of Article 27 of the Constitution; Article which recognises, for its part, the role of the public authorities in the general programming of the teaching, inspection and approval of the education system, in order to ensure compliance of the laws. Article 30 of the Organic Law 1/1990, of 3 October, of General Management of the Educational System, refers to the organization of occupational vocational training to its specific regulations of a working nature.

The Statute of Autonomy of Castilla-La Mancha, approved by Organic Law 9/1982 of 10 August, and reformed by Organic Laws 7/1994, of 24 March, and 3/1997, of 3 July, has in its article 33.11 which corresponds to the Board of Communities, in terms that establish laws and regulations that in the development of their legislation dictate the State, the executive function in labor matters, and in article 37.one it is established that it corresponds to the Autonomous Community competence for legislative development and the implementation of education throughout its extension, levels and (a) degrees, modalities and specialties, in accordance with the provisions of Article 27 of the Constitution and Organic Laws, which, in accordance with Article 81 (1) thereof, develop and without prejudice to the powers conferred on the State by the Article 149.1.30.a and of the high inspection for its compliance and guarantee.

On the other hand, Article 31.1.120, also of the aforementioned Statute of Autonomy, provides that the Board of Communities of Castilla-La Mancha has exclusive competence in the area of economic activity planning and promotion the economic development of the region, within the objectives set by the national economic policy and the economic public sector of Castilla-La Mancha.

Finally, the fifth transitional provision of the Statute of Autonomy of Castilla-La Mancha and Royal Decree 1064/1983 of 13 April 1983 lay down the form and procedure to which the transfer of functions and duties are to be adjusted. services of the State Administration to the Autonomous Community of Castilla-La Mancha.

It is therefore appropriate for the Autonomous Community of Castilla-La Mancha to assume the functions of management of labour, employment and training which the State Administration has been carrying out.

B) Functions and services of the State Administration that assumes the Autonomous Community of Castilla-La Mancha.

The management functions which, in the field of employment, employment and training, are being carried out by the National Employment Institute (INEM) are transferred to the Autonomous Community of CastillaLa Mancha, and consequently the Autonomous Community assumes, within its territorial scope, the functions and services corresponding to that management, and in particular those listed below:

1. In the field of intermediation in the labour market.

(a) The functions of execution, in matters of employment intermediation, and in particular those referred to in Article 42 (2) and (3) of Law 51/1980, of 8 October, Basic Employment, on the registration and registration of the job seekers, and the obligation of the workers to communicate the termination of the contract of employment.

(b) The implementing functions relating to the obligation of employers to register or, where appropriate, to communicate employment contracts, as laid down in Article 16.1 of the Royal Decree of 24 March 1995, of 24 March 1995, the recast text of the Law on the Workers ' Statute is adopted, as well as the communication to the employment office of the termination of the employment contract, in accordance with Article 42.3 of Law 51/1980, of 8 October, Basic Employment.

(c) The authorization of the placing agencies, whose scope of action does not exceed that of the territory of the Autonomous Community of Castilla-La Mancha, in the terms provided for in Article 16.2 of the Royal Legislative Decree 1/1995, On 24 March, the recast text of the Law on the Workers ' Statute and Royal Decree 735/1995 of 5 May 1995 on the regulation of non-profit making agencies and integrated services for employment was adopted.

In the case of placement agencies whose activity is not limited to the territorial scope of CastillaLa Mancha and consequently does not correspond to their authorization to this Autonomous Community, a mandatory report of the Autonomous Community of Castilla-La Mancha prior to its authorisation by INEM. The authorization of the agencies for placement by the INEM, with respect to the territorial scope of this Autonomous Community, must be adopted in compliance with the operational criteria established by the Autonomous Community of Castilla-La Mancha in its territorial area.

(d) The functions of INEM in the territory of the Autonomous Community of Castilla-La Mancha, relating to the activities of the EURES Network (European Employment Services), as defined in the European Commission Decision of 22 October 2000. 1993 (OJ L 274/32).

In any case, the Information System supported by the IT Network and the EURES Database, administered directly by the European Commission (Directorate-General for Employment and Social Affairs), and supported by the system, will be used. State IT, ensuring coordination between the Euroadvisers of the Autonomous Community of Castilla-La Mancha and those integrating the rest of the EURES State Network.

The INEM will incorporate the financing of the activities to be carried out under the EURES Network in CastillaLa Mancha to the Financing Convention which, on an annual basis, subscribes with the European Commission provided for in agreement with the criteria established by the European Commission, by the EURES Working Party, and according to the needs for action identified, and the financial possibilities identified by the European Commission.

2. Functions of management and control of employment policies.

(a) The management and control measures, in the area of Castilla-La Mancha, of grants and public aid for employment policy, which the State Administration grants through the National Institute of Employment (INEM), and which are identified in the attached ratio number 1.

(b) The organisation and articulation in the field of Castilla-La Mancha, of the agreements with the associated entities of the integrated services for employment, in the terms provided for in Title II of Royal Decree 735/1995, of 5 of This is the first time that the Commission has been in a position to take the necessary steps to ensure that the European Parliament has the right to take the necessary steps.

c) The management and control of the national programs of workshop schools and houses of trades regulated by the Order of the Ministry of Labor and Social Affairs of 14 November 2001. The management and control of the employment workshops, regulated by Royal Decree 282/1999 of 22 February, developed by the Order of 14 November 2001, and the issue of the corresponding certificates of professionalism, Similarly, under the conditions laid down in Royal Decree 797/1995, cited above.

(d) The Autonomous Community of Castilla-La Mancha shall exercise in its territorial scope the functions conferred on INEM, with the exception of those relating to unemployment benefits, relating to the Employment Promotion Funds.

e) The Autonomous Community of Castilla-La Mancha shall manage the funds of the grants which are not part of the actual cost assumed, in accordance with the law of the State, given its nature as national and employment funds, Article 18 (2) of the Organic Law 9/1992, of 23 December, of transfers of powers to the Autonomous Communities that acceded to autonomy through Article 143 of the Constitution.

3. National Occupational Vocational Training Centres

The ownership of the National Occupational Vocational Training Centres, which in number two are located in Ciudad Real, Calle Vicente Aleixandre, number 2, and in Guadalajara, Calle Regino Pradillo, number 3. Such centres shall, through the corresponding financing by INEM, carry out the tasks assigned to them by Articles 17 et seq. of Royal Decree 631/1993 of 3 May 1993, the regulator of the National Training Plan and Professional Integration.

To this effect, the precise mechanisms will be articulated to ensure an adequate collaboration between the two

Administrations, both through the Coordination and Monitoring Committee set up in the first subparagraph of paragraph (c) .6 of this Agreement, as well as through the collaboration agreement on the National Training Centres. In particular, in order to ensure and enhance the functions conferred on the two National Occupational Vocational Training Centres which are assumed by the Autonomous Community of Castilla-La Mancha, the Commission may formulate agreed proposals for the qualification of the National Centre in favour of another centre, bringing together appropriate resource and location conditions.

4. Provincial Executive Committees and Labour Recruitment Monitoring Committees

The Autonomous Community of Castilla-La Mancha will appoint the President and one of the vocal representatives of the Public Administration in the INEM Provincial Executive Commissions in each of the five provinces that set up the Autonomous Community of Castilla-La Mancha.

Likewise, the Autonomous Community of Castilla-La Mancha will exercise, in the field of this Autonomous Community, the functions attributed so far to the National Institute of Employment in the Commissions for the Follow-up of the Contracting Labour, regulated in Royal Decree 355/1991 of 15 March.

5. Sanctioning power

The Autonomous Community of Castilla-La Mancha shall carry out enforcement tasks relating to the fulfilment of the obligations of employers and workers and, where appropriate, the power of penalties, in the field of employment in terms of establishes the law of the State.

The Autonomous Community of Castilla-La Mancha shall require and verify the fulfilment of the obligations as claimants of employment of the applicants or beneficiaries of unemployment benefits referred to in paragraphs (c), (d), (g), (h) (i) Article 231 of the recast text of the General Law on Social Security, adopted by the Royal Decree of Law 1/1994 of 20 June, and Article 10 (2) of Royal Decree 735/1995 of 5 May 1995, and shall communicate, where appropriate, the non-compliances of those obligations to the managing body of the benefits for the purposes sanctioning that they are responsible for.

C) Concurrent and shared functions between the State Administration and that of the Autonomous Community and institutional forms of cooperation.

1. Exchange of information and permanent cooperation, aimed at achieving better knowledge of the labour market, guaranteeing the compensation of offers and demands between offices, the principles of equal rights, free movement, discrimination and work throughout the national territory for workers.

2. The recording and processing of information derived from actions relating to the functions of intermediation in the labour market shall, in any event, ensure the transparency and accessibility of the public system of State employment, establishing a communications methodology to enable effective coordination and to ensure a system of national information, the overall management and coordination of which is the responsibility of the National Employment Institute. Such a system will at all times allow for the transparency and validity of information and equal access for users and managers.

3. In order to ensure the current level of use of statistics for State purposes, the Autonomous Community of Castilla-La Mancha shall provide INEM with information enabling it to compile statistics on the performance of the tasks. transferred, in accordance with the current definitions or those which, where appropriate, are established by the Coordination and Monitoring Committee referred to in paragraph 6 of this paragraph, in such a way as to ensure their coordination and integration with the rest of the of the statistical information at the State level. For its part, the INEM will provide the Autonomous Community of Castilla-La Mancha with information on the same subjects.

4. In order to carry out the annual implementation report which the INEM presents annually to the European Social Fund for the co-financing of grants in employment, training, workshop schools and employment and employment workshops, in its Case, the Autonomous Community of Castilla-La Mancha will provide the INEM with the necessary information to ensure the correct elaboration of the payment requests in each of the programs in accordance with the requirements required by the regulations Community for its clothing.

5. This cooperation between the two administrations will, in any case, guarantee the coordination between the management, payment and control of unemployment benefits and the monitoring of the collective of jobseekers, to whom the policies of (i) employment being transferred

6. In order to ensure the proper coordination referred to in this Agreement, a Joint Committee on Coordination and Monitoring of Joint Composition and consisting of eight persons shall be set up: four designated by the State Administration and four by the Administration of the Autonomous Community.

Also, through the appropriate collaboration agreements between the National Institute of Employment and the Administration of the Autonomous Community, the terms of the cooperation between the two administrations for coordination will be regulated. for the management of employment and the management of unemployment benefits; for the exchange of information and statistics; for the coordination of functions and actions which fall within the competence of one administration in relation to the national centres of Occupational training referred to in paragraph B) .3 of this Agreement and for regulating the functions and operating arrangements of that Commission.

The collaboration agreement for the coordination of employment and the management of unemployment benefits, referred to in the preceding paragraph, shall be signed within a maximum of three months from the date of effectiveness. of the transfer.

In any case, in the transitional period between the date of effectiveness of the transfer and the date of subscription of the abovementioned agreement, the Autonomous Community of Castilla-La Mancha and the National Institute of Employment will collaborate. in the management of employment and in the management of unemployment benefits on the same terms as in each employment office, acting in advance of the transfer.

D) Goods, rights and obligations of the State that are transferred.

1. They are transferred to the Autonomous Community of Castilla-La Mancha, for the effectiveness of the functions that are the subject of the transfer, the real estate and rights that are detailed in the attached relation number 2.

2. By way of derogation from the previous paragraph, the works of conditioning of the Office of Employment of La Solana (Ciudad Real), on the road of Valdepeñas, without number, shall be financed by the National Institute of Employment until its completion.

3. The payment corresponding to the contracts of experts providing courses of the FIP Plan, in the National Centres of Occupational Training transferred to the Autonomous Community of Castilla-La Mancha, which would not have been completed by the date of effectiveness of the transfer, will be assumed, until its extinction, by the National Institute of Employment.

4. Within one month of the date of the effectiveness of this Agreement, the corresponding records for the delivery of buildings and the reception of furniture, equipment and inventoried material shall be signed.

E) Personal that is transferred.

1. The personal means to be transferred are nominally referred to in the attached relation number 3, and will become dependent on the Autonomous Community of Castilla-La Mancha in the terms legally provided for by the Statute of Autonomy and other rules in each applicable case and in the same circumstances as specified in its personnel files.

2. The Ministry of Labor and Social Affairs will notify those interested in the transfer, as soon as the Government approves this Agreement by Royal Decree. A certified copy of all the files of such staff transferred, together with the certificates of holding referred to the amounts due, shall also be forwarded to the competent bodies of the Autonomous Community of Castilla-La Mancha. during 2002.

3. With regard to the staff being transferred, and which may be affected by the Employment Plan of the National Employment Institute, approved by Resolution of the Secretariat of State for Public Administration of 19 June 1995 ("Official Journal of the European Union"). State " number 149, 23), its incorporation into the Civil Service of the Autonomous Community of Castilla-La Mancha shall be carried out in the terms resulting from the execution of the same, in accordance with the specifications laid down in the corresponding Supplementary agreement to this transfer.

F) Job vacancies that are transferred.

G) Final assessment of financial charges for functions and services that are transferred:

1. The provisional valuation in the 1999 base year corresponding to the annual effective cost of the means to be transferred to the Autonomous Community of Castilla-La Mancha amounts to EUR 9,513,698,18. This assessment will be reviewed in the terms laid down in Article 16.1 of Law 21/2001 of 27 December 2001 on tax and administrative measures for the new system of financing of the Autonomous Communities. of common rules and cities with Autonomy Statute.

2. The financing, in euro 2002, which corresponds to the annual cash cost, is the one collected in the ratio number 4.

3. As long as the revision of the Sufficiency Fund is carried out, as a result of the incorporation of the cash for this transfer at the same time, this cost will be financed by consolidation in Section 32 of the General of the State, of the appropriations relating to the various components of this cost, for the amounts to be determined, which are subject to updating by the general mechanisms provided for in each Budget Law.

4. Moreover, in accordance with the commitments made by the National Employment Institute for the creation and joint use by the State Administration and the Autonomous Administrations of a network of National Centres, and for the purposes of provide the necessary equipment to the centre of Ciudad Real, transfer to the Autonomous Community of Castilla-La Mancha, for one time and without integrating into the actual cost of the transfer, the amount of EUR 2,704,554,47, which may also be for the adequacy and improvement of the employment offices that are transferred.

1. The transfer of functions and services covered by this Agreement shall be effective from 1 January 2003.

2. However, the Ministry of Labour and Social Affairs and the National Employment Institute will continue to manage the services and budget appropriations that are necessary to maintain the continuity of those services, up to the day 31 March 2003, unless both administrations agree to extend or reduce this transitional period.
