The social, economic, environmental, ecological and cultural functions of the mountains require that, for their sustainable management and for the improvement and conservation of forest genetic resources, forest materials reproduction of the species and hybrids used in selecolas are phenotypic and genetically of high quality, as well as appropriate to the conditions of the environment in which they are used.

The Order of 21 January 1989 regulating the marketing of forest reproductive material and the Order of 21 January 1989 on the external quality standards of forest materials (a) reproduction is made available on the market and incorporated into our legal order, respectively, Council Directive 66 /404/EEC of 14 June 1966 on the marketing of forest reproductive material and their amendments, as well as Council Directive 71 /161/EEC of 30 March 1971 on quality standards of the forest reproductive material placed on the market in the Community and its modifications.

The Council of the European Union has considered it appropriate to promulgate Council Directive 1999 /105/EC of 22 December 1999 on the marketing of forest reproductive material, which it recovers and updates the two directives mentioned above.

Royal Decree 1356/1998 of 26 June lays down the rules applicable to the production, placing on the market and use of forest reproductive material of species not subject to Community legislation.

This royal decree incorporates into our internal order Directive 1999 /105/EC and the peculiarities of the Spanish forest situation that were contemplated in the aforementioned Royal Decree 1356/1998, repealing, in turn, the Real Decree 1356/1998 and the abovementioned orders of 21 January 1989.

In the elaboration of this royal decree, the autonomous communities and affected sectors have been consulted.

In its virtue, on the proposal of the Minister of Agriculture, Fisheries and Food and the Minister of the Environment, after the approval of the Minister of Public Administration, in agreement with the State Council and prior deliberation of the Council of Ministers at its meeting on 7 March 2003,

CHAPTER I

General provisions

Article 1. Scope of application.

1. This royal decree shall apply to production with a view to the marketing and marketing of forest reproductive material of the forest species and their artificial hybrids listed in Annex I.

2. The measures set out in this royal decree shall not apply to forest reproductive material in the form of plants or parts of plants for which it is demonstrated that they are intended for purposes other than selviculture.

In such cases, the materials must be accompanied by a label or other document required by other Community or national provisions applicable to such materials for the purpose in question. In the absence of such provisions, where a supplier is engaged in both materials intended for selviculture and materials which are shown to be intended for other purposes, the latter must bear a label or document in which the supplier is the indication shall be: 'not intended for forest uses'.

3. The measures included in this royal decree shall not apply to forest reproductive material for which it is demonstrated that they are intended to be exported or re-exported to third countries.

Article 2. Definitions.

For the purposes of this royal decree, it is understood by:

(a) Forest reproductive materials: fruits and seeds, parts of plants and plants used for the multiplication of forest species and their artificial hybrids. They are:

1. Fruit and seeds: pineapples, seeds, fruits and seeds intended for the production of plants.

2. ° Parts of plants: stem, leaf and root cuttings, explants or embryos for micropropagation, yolks, acoes, roots, barbs for grafts, varetas or any part of a plant intended for the production of plants.

3. Plants: plants obtained from fruits and seeds, from parts of plants or plants from natural regeneration.

b) Base material for the production of forest reproductive material. Includes the following types:

1. Seed Source: trees located within a harvest zone of fruits and seeds.

2. ° Rodal: delimited population of trees with sufficient uniformity in their composition.

3. Huerto seed: plantation of selected clones or families, sufficiently isolated to avoid or reduce pollination from external sources, managed for the production of frequent seed crops, abundant and easy to collect.

4. Family progenitors: trees used to obtain progeny, by controlled or free pollination, of an identified parent used as a female, with the pollen of a parent (frataunas) or a series of Identified or unidentified progenitors (semitraunts).

5. ° Clon: group of individuals (ramets) originating from a single individual (ortet) by vegetative propagation, such as by cutting, micropropagation, grafting, acode or division.

6. ° Clone mixture: mixture of clones identified in defined proportions.

c) Autoctono and indigenous: a native source of seed or indigenous bearing is the one that has been normal and continuously regenerated well by natural processes, well regenerated, either from reproduction materials collected in the same seed or rodent source, either from seed sources or indigenous stands within a reduced distance.

An indigenous seed source or indigenous bearing is an indigenous seed or seed source, or a seed or seed source artificially grown from seeds whose origin is from the same region of provenance.

d) Origin: for a seed source or native rodal, it is the place in which the trees grow. For a non-native seed or bearing source, it is the place from which the seeds or the plants were initially introduced. The source of a seed or rodent source may be unknown.

e) Provenance: place where any forest mass is vegan.

(f) Region of provenance: for a given species or subspecies: the region of provenance is the zone or group of areas subject to sufficiently uniform ecological conditions in which seed sources are found or stands that have similar phenotypic or genetic characteristics, taking into account altitude limits, where appropriate.

g) Production: includes all phases of production of fruits and seeds, the transformation of fruits into seed and the cultivation of plants from seeds and parts of plants.

h) Marketing: exposure for sale, sale and sale or delivery to a third party of forest reproductive material, including delivery in compliance with a service contract.

i) Lot: set of single-product units, identifiable by the homogeneity of their composition and origin.

j) Supplier: any natural or legal person professionally engaged in the marketing or import of forest reproductive material.

k) Competent authority:

1. The General Administration of the State, with regard to the management and coordination of production with a view to the marketing and marketing of forest reproductive material, as well as the external trade assumptions of those products.

2. The competent bodies of the Autonomous Communities, in respect of the implementation of the operations necessary for the authorization of the basic materials and the control of production with a view to the marketing and marketing of forest reproductive material.

3. The Autonomous Communities shall communicate to the Ministry of Agriculture, Fisheries and Food the competent authority on their territory in order to inform the European Commission.

4. Also, the delegations or management agencies which, in accordance with the current law, may carry out the competent authorities, must be notified to that department, so that through the corresponding channel, in your case, request prior authorisation from the European Commission.

l) Forest reproductive materials are subdivided according to the following categories:

1. Identified: reproduction materials obtained from basic materials which may be either a seed source or a rodal located within a single region of origin and which satisfy the requirements laid down in Annex II.

2. Selected: Reproduction materials obtained from base materials corresponding to a rodal located within a single region of provenance, which have been selected phenotypically at the population level and which satisfy the requirements set out in Annex III.

3. Skilled: Reproduction materials obtained from basic materials corresponding to seed gardens, parents of families, clones or mixtures of clones, the components of which have been individually selected Phenotypically and satisfy the requirements laid down in Annex IV. It is not strictly necessary that the tests have been started or finished.

4. Controlled: Reproduction materials obtained from base materials that correspond to stands, seed orchards, parents of families, clones or mixtures of clones. The superiority of the reproductive material must have been demonstrated by comparative or estimated trials from the genetic evaluation of the components of the basic materials. The basic materials shall meet the requirements set out in Annex V.

CHAPTER II

Production of forest reproductive materials

Article 3. Authorization of the basic materials.

1. Only authorised base materials shall be used for the production of forest reproductive material intended for marketing.

2. Base materials can only obtain the status of authorized:

(a) If they satisfy the requirements set out in Annexes II, III, IV or V of this royal decree, as regards the production of identified, selected, qualified and controlled forest reproductive material, respectively, and (b) If they are referred to a unit called 'admission unit', which shall be identified by a single reference in the relevant register.

3. The approval of the basic materials for the production of identified, selected, qualified and controlled forest reproductive material shall be carried out by the competent authority of the respective autonomous community, which shall communicate These materials shall be based on the Directorate-General for Conservation of Nature, which shall in turn communicate it to the Directorate-General for Agriculture.

4. Once the basic materials for the production of selected, qualified and controlled forest reproductive material are authorized, they must be inspected at regular intervals by the competent organ of the respective community. in order to verify that they continue to comply with the conditions under which they were authorised and in the event that the authorisation for the legally established procedure is not to be withdrawn, which will in any event respect the hearing of the interested.

5. When establishing, in accordance with the relevant Community procedure, the specific conditions for the conservation of plant genetic resources used in selviculture, to take account of in situ conservation and use sustainable use of plant genetic resources through the cultivation and marketing of forest reproductive material of non-improved species and varieties that are naturally adapted to local and regional conditions and when they are threatened by genetic erosion, the requirements laid down in paragraph 1 may not be required 2 and Annexes II, III, IV and V, provided that specific conditions are laid down in accordance with the relevant Community procedure.

6. In those cases where, on the basis of the provisional results of the genetic evaluation or the comparative tests referred to in Annex V, it can be assumed that the basic materials, after completion of the tests, are to be complied with. the criteria for the authorisation of this royal decree, the basic materials for the production of the controlled forest reproductive material for a maximum period of ten years may be authorised in all or part of the territory.

Article 4. Genetically modified organisms.

Base materials consisting of a genetically modified organism will only be authorized if they do not pose a risk to human health or the environment. For this purpose, an environmental risk assessment must be carried out and authorised, in accordance with the provisions of the rules in force on those organisms.

Article 5. Requirements for forest reproductive material.

1. Forest reproductive material from authorised base materials shall meet the following requirements:

(a) Materials of the species listed in Annex I may be placed on the market only if they belong to the categories "identified material", "selected material", "qualified material" or "controlled material" and basic materials from which they come meet the requirements laid down in Annexes II, III, IV and V respectively.

(b) The materials of the artificial hybrids listed in Annex I may be placed on the market only if they belong to the categories "selected material", "qualified material" or "controlled material" and the basic materials of the which come meet the requirements laid down in Annexes III, IV and V respectively.

(c) The materials of the artificial species and hybrids listed in Annex I, when they are vegetatively multiplied, may be marketed only if they belong to the categories "selected material", "qualified material" and 'controlled material' and the basic materials from which they come satisfy the requirements laid down in Annexes III, IV and V respectively; in the case of propagating material of the category 'selected material', they may be marketed if they have spread massively from seeds.

(d) Material of the artificial species and hybrids listed in Annex I which are wholly or partly composed of genetically modified organisms shall not be placed on the market unless they belong to the category 'controlled material' and the basic materials from which they come comply with the requirements set out in Annex V.

2. The categories under which reproduction materials from the different types of basic materials may be placed on the market are determined in the table in Annex VI.

3. Forest reproductive material of artificial species and hybrids listed in Annex I may be placed on the market only if they comply with the relevant requirements laid down in Annex VII.

4. By way of derogation from paragraph 1, the competent authority may authorise suppliers to obtain and market adequate quantities of:

(a) Forest reproductive material, provided that it is demonstrated that they are intended for the conduct of trials, scientific purposes, selection works or genetic conservation purposes.

(b) Fruit and seeds which are clearly not intended for forestry purposes.

5. Following compliance with the conditions to be laid down in accordance with the Community procedure, the placing on the market of propagating material from base materials which do not satisfy all the requirements of the Community procedure may be authorised. appropriate category according to paragraph 1 of this Article.

Article 6. Regions of provenance.

1. In the case of basic materials intended for the production of propagating material of the categories "identified material" and "selected material", for the relevant species, the regions of provenance shall be demarcated.

2. The regions of provenance of the basic materials intended for the production of propagating material of the categories 'identified material' and 'selected material', for the species listed, are set out in Annex XI.

3. For the authorisation of new regions of origin of any species or for the modification of the existing regions of provenance, the following procedure is established:

a) For those species whose area of distribution exceeds the territory of an autonomous community, the Directorate General of Conservation of Nature, prior to the report of the National Institute of Agricultural Research and Technology Food and the competent bodies of the autonomous communities concerned will propose to the Directorate-General for Agriculture the delimitation of the necessary regions of origin which will be defined by administrative, geographical and altitude.

In the light of these proposals, the Directorate-General for Agriculture will carry out the authorization of the regions of origin.

(b) In the case of species whose area of distribution is exclusively included in the territory of an autonomous community, the delimitation and authorization of the regions of provenance shall be carried out by the competent authority of the the autonomous community, which will bring them to the attention of the Directorate-General for Agriculture.

4. The Ministry of Agriculture, Fisheries and Food will publish in the "Official State Gazette" the national catalogue of the regions of origin, which will include the situation maps of these regions. The Ministry shall send the above maps to the European Commission and to the other Member States, through the appropriate channel.

Article 7. National Register and National Catalogue of Base Materials.

1. The General Directorate of Conservation of Nature, in collaboration with the competent organs of the autonomous communities, will establish a national registry of the base materials of the species regulated by this royal decree, for the production of of the identified, selected, qualified and controlled forest reproductive material.

This national registry shall contain the data set out in Annex X, relating to each admission unit with its unique registration reference, which shall be provided by the competent body of the respective autonomous community.

2. The Directorate-General for Conservation of Nature shall draw up a summary of the said register in the form of a national list to be referred to as the national catalogue of basic materials, which shall be communicated to the Directorate-General for Agriculture for its publication in the Official Gazette of the State and its submission to the European Commission, in accordance with the model laid down in Commission Regulation (EC) No 1597/2002 of 6 September 2002 laying down detailed rules for the the implementation of Council Directive 1999 /105/EC, with regard to the format of the national lists of base materials of the forest reproductive material.

The following data will be extracted from the Register for the preparation of the aforementioned National Catalogue:

a) The botanical name of the species.

b) Category of forest reproductive material.

c) Target of forest reproductive material.

d) Type of base material.

e) Registration reference, identification code of the source material or code of the region of provenance.

f) Situation: location name and, according to category:

1. º For "identified material": region of provenance, province, municipal term, latitude and longitude or range of latitude and longitude, and, where applicable, number of public utility and/or number of cast.

2. º For "selected material": region of provenance, province, municipal term and geographical location, defined by latitude and longitude or range of latitude and longitude.

3. º For "qualified material": the exact position or geographical positions in which the base materials are maintained.

4. º For "controlled material": the exact geographic situation or situations in which the base materials are maintained.

g) Altitude or altitude strip.

h) Surface: extension of seed sources, stands or seed gardens.

i) Origin: it will be indicated whether the base materials are indigenous or indigenous, not indigenous or non-indigenous, or if their origin is unknown; for non-indigenous or non-indigenous base materials, the origin must be reported, if knows.

j) In the case of controlled materials, they must be indicated if they are genetically modified.

Article 8. Harvesting, seed extraction and plant production.

1. For the collection of forest reproductive material of the regulated species, for which the corresponding base material catalogues have been established, the following requirements shall be met:

(a) Any collector who intends to collect fruits, seeds and parts of plants of authorized base material shall notify the competent authority of the respective autonomous community of the intention of proceed to such collection.

The competent authority shall establish, where appropriate, the technical conditions to be observed during collection.

(b) When the harvest of fruits, seeds or parts of plants requested is complete, the collector shall inform the competent authority of the respective autonomous community in writing of the quantity of material collected, which, once it has been established that the lot of fruit, seeds or parts of plants harvested is derived from a duly authorised base material, it shall issue the appropriate standard certificate showing the single registration reference, providing the relevant information as set out in Annex VIII.

2. In the case of seed extraction, the supplier shall inform the said organ in writing, before placing on the market, of the quantities obtained in accordance with lots, with an indication of the identity and quantity of the batch of fruit of the seed. which come from.

3. In the case of plant production, the supplier shall communicate to that organ the quantities of plant to be produced, in accordance with lots, indicating the identity of the seed lots or parts of plants from which they are derived and the quantity of kilograms of seed or the number of multiplication elements used in their production.

4. Where further vegetative propagation is envisaged in accordance with Article 9.2, a new standard certificate shall be issued.

5. Where mixtures are made in accordance with Article 9 (3) (a), (b), (c) or (e), the competent authority of the respective autonomous community shall ensure that the references in the register of the components of the mixtures are not are identifiable and a new pattern certificate must be issued for the mixture or other document identifying it.

Article 9. Production process.

1. During all phases of the production process, the reproductive material shall be kept separate by reference to the individual units of admission.

Each batch of reproductive materials will be identified by the following data:

a) Spain code and number of the master certificate.

b) The botanical name of the species.

c) Category of forest reproductive material.

d) Objective.

e) Type of base material.

f) The reference of the record or, if applicable, the summary of the record, or the identity code of the region of provenance.

g) Region of provenance (for propagating material of the categories "material identified" and "selected material" or for other reproductive material if applicable).

h) Where applicable, if the origin of the basic materials is indigenous or indigenous, not indigenous or non-indigenous or of unknown origin.

i) In the case of fruits and seeds, the year of maturation.

j) Age and type of plants, brinzales or cuttings, and the type of crop used (repon, transplant or container).

k) If genetically modified.

2. Without prejudice to the provisions of Article 5 (1) and Article 5 (1) (c), the competent authority of the respective autonomous community may provide for provisions relating to the further vegetative propagation of a single unit. for admission to the categories "selected material", "qualified material" and "controlled material". In such cases, the materials shall be kept separate and identified as such.

3. Without prejudice to the provisions of paragraph 1 of this Article, it is accepted:

(a) Within the same region of provenance, the mixing of propagating material from two or more units of admission within the category "identified material" or category "selected material".

(b) When mixtures of propagating material are made within a single region of provenance from seed and rodland sources of the "identified material" category, the new mixed batch shall be classified as "reproduction material from a seed source".

(c) Within the same region of origin, when mixtures of propagating material from non-indigenous or non-indigenous base materials are made with other materials from source materials of unknown origin, the new batch of the mixture is classified as 'of unknown origin', not the mixtures of propagating material from indigenous or indigenous base materials with those of non-indigenous or non-indigenous origin or unknown origin are permitted.

(d) Where mixtures are made in accordance with paragraphs (a), (b) or (c), the identification code of the region of provenance may be replaced by the reference of the register referred to in paragraph 1 (f).

e) The mixing of propagating material from different years of maturation from a single unit of admission.

(f) When mixtures are made in accordance with the previous paragraph (e), that the ripening years and the proportion of materials of each year are recorded.

CHAPTER III

Marketing of forest reproductive materials

Article 10. Tagged.

1. Propagating material may be placed on the market only in lots which comply with Article 9 and are accompanied by a label and a supplier's document.

In the case of seeds, in each package containing the seeds, a supplier label shall be affixed, containing at least the data set out in Annex IX, paragraph A.

In addition, each seed consignment shall be accompanied by a supplier document containing at least the data set out in Annex IX, paragraph B.

In the case of plants or parts of plants, each consignment shall be accompanied by the appropriate supplier's labels for correct identification. Each of these labels shall contain at least the data set out in Annex IX, paragraph C.

In addition, a supplier document containing at least the data set out in Annex IX, paragraph D.

shall be accompanied with each consignment of plants or parts of plants.

2. In the case of seeds, the supplier's document referred to in paragraph 1 shall include the following data, as far as possible, assessed by internationally recognised techniques:

(a) Purity: The percentage by weight of pure seeds, other seeds and inert matter of the product marketed as seed lot.

b) The percentage of germination of pure seeds, or in case the percentage of germination is impossible or very difficult to determine, the percentage of viability, indicating the method used.

c) The weight of 1,000 pure seeds.

d) The number of germinable seeds per kilo of product marketed as seed or, where this is impossible or very difficult to determine, the number of viable seeds per kilogram.

3. In order to be able to dispose rapidly of the seed of the current harvest, even if the germination study provided for in paragraph 2 (b) has not been completed, the marketing limited exclusively to a first purchaser is authorised. The supplier shall declare as soon as possible that it fulfils the conditions laid down in paragraphs (b) and (d) of paragraph 2, so that the supplier may proceed to post-marketing.

4. The requirements laid down in paragraph 2 (b) and (d) shall not be required in the case of small quantities of seed. The determination of the quantities and conditions is governed by Commission Regulation (EC) No 2301/2002 of 20 December 2002 laying down detailed rules for the application of Council Directive 1999 /105/EC on the concerns the definition of small quantities of seeds.

5. Parts of plants of Populus spp., may be placed on the market only if the EC classification number, in accordance with paragraph 2.b) of Part C of Annex VII, appears on the label or in the supplier's document.

6. The colour of the supplier's label shall be yellow for the reproduction materials of the category "material identified", green for those of the category "selected material", pink for those of the category "qualified material" and blue for the of the category "controlled material".

7. In the case of forest reproductive material derived from basic material which is composed of genetically modified organisms, any label or document, official or of any other type, relating to the lot shall be clearly indicated by this done.

Article 11. Packaging.

The fruits and seeds will be marketed only in sealed containers. The sealing system shall be of the type that is unusable once the container has been opened.

CHAPTER IV

Control measures

Article 12. Supplier registration, official control system and annual declaration.

1. Each Autonomous Community shall establish a register in which the suppliers of forest reproductive material domiciled in its territorial scope must register, and shall communicate to the Directorate-General for Agriculture, at intervals. monthly, the relationship of registered providers.

2. A national register of forest reproductive material suppliers shall be provided by the Directorate-General for Agriculture, which shall include all suppliers registered in the Autonomous Communities.

3. Any supplier who proposes the establishment, or in his case variation, of a field of mother plants for the production of forest reproductive material from a basic material of type clones or mixture of clones shall notify the competent authority of the respective autonomous community, in order to obtain the relevant authorisation.

The agency will produce a record of the fields of mother plants, which will be communicated to the Directorate General of Conservation of Nature for the inclusion of its data in the National Register of Base Materials.

4. The competent authority of the respective autonomous community shall ensure, by means of an official control system, that propagating material from individual or batch intake units remains clearly identifiable. throughout the process from collection to delivery to the final consumer. Official inspections of registered suppliers shall be carried out on a regular basis.

The official control system will be communicated to the Directorate General of Agriculture, which will bring it to the attention of the competent bodies of the rest of the autonomous communities.

5. In order to ensure mutual administrative assistance between the Member States of the European Union and, in particular, when forest reproductive material is transferred from Spain to another Member State, the supplier shall communicate this to the competent body of the respective autonomous community, which shall, in turn, send duly completed to the Directorate-General for Agriculture the model of the information document set out in the Annex to Regulation (EC) No 1598/2002 of the Commission of the European Parliament of 6 September 2002 laying down detailed rules for the application of Council Directive 1999 /105/EEC as regards mutual administrative assistance between official bodies.

The rules for such mutual administrative assistance shall be established in accordance with the provisions of that Regulation (EC) No 1598/2002.

6. Any supplier shall carry a record-book in which the movements of the forest reproductive material which the suppliers and the recipients of the materials are placed on the market shall be reflected in the batch. It shall also keep the certificates and/or documents certifying the origin of the lots retained and marketed.

The said book-registration and the supporting documentation shall be made available to the competent authority of the Autonomous Community.

7. Each supplier shall make an annual declaration at the end of each marketing year concerning the quantities produced and marketed of forest reproductive material by species and categories. This declaration shall be sent by the supplier to the competent body of the respective Autonomous Community.

8. In the first half of each year, the Office shall send to the Directorate-General for Agriculture a summary of the above statements concerning the previous marketing year for the compilation of national statistics.

9. Representatives of the Directorate-General for Agriculture and the Directorate-General for Conservation of Nature may accompany the experts of the European Commission and the representatives of the competent bodies of the autonomous communities in the cases where on-the-spot checks are carried out, in particular to verify compliance with the requirements set out in this Royal Decree.

CHAPTER V

Authorizations to prohibit the marketing of forest reproductive material, less stringent requirements, and imports from third countries

Article 13. Bans on marketing.

1. The competent authorities shall ensure that the material which is on sale in accordance with the provisions of this Royal Decree is not subject to any restrictions on the marketing of its characteristics, requirements in respect of examination and inspection, labelling and sealing other than those referred to therein.

2. In accordance with the provisions of Commission Regulation (EC) No 1602/2002 of 9 September 2002 laying down detailed rules for the application of Council Directive 1999 /105/EC as regards the authorisation of a State Member to prohibit the placing on the market of the end user of certain forest reproductive material, the Ministry of Agriculture, Fisheries and Food, through the appropriate channel, will request from the European Union the authorization to prohibit the placing on the market of the final user, for sowing or planting, of specific reproduction in all or part of the territory, where one of the following conditions is present:

(a) That the use of these reproductive materials, due to their phenotypic or genetic characteristics, could have a negative impact on forestry, the environment, genetic resources or diversity. genetics of the species in all or part of the Spanish territory, based on tests related to the region of provenance or origin of the material, or on the results of tests or scientific research carried out at the appropriate place, within or outside the European Union.

b) That, in the light of the known results of scientific trials or research, or of the results obtained from the forest practice on the survival and development of the plants as regards the morphological and physiological characteristics, the use of such reproductive material could have negative effects on selviculture, on the environment, on genetic resources or on the genetic diversity of species in the all or part of Spain.

Article 14. Less severe requirements.

When temporary supply difficulties arise for final consumers of forest reproductive material that meet the requirements of this royal decree, and which cannot be overcome at Union level The Ministry of Agriculture, Fisheries and Food, through the appropriate channel, on a proposal from the Directorate-General for the Conservation of Nature or the competent bodies of the Autonomous Communities, shall ask the Commission to European, in accordance with the relevant Community procedure, authorization to allow for the marketing, for a specified period, of forest reproductive material of one or more of the species regulated by this royal decree that satisfy less severe requirements.

When such a measure is adopted, the labels and documents of the supplier required under Article 10.1 shall specify that the materials in question are "subject to less stringent requirements".

Article 15. Imports from third countries.

1. It may be possible to import from third countries forest reproductive material intended for marketing, if it has previously been determined, by the Council of the European Union, that these materials offer the same guarantees as regards the acceptance of its basic materials and of the measures adopted for its production, which the reproductive material produced within the European Union, in accordance with Community rules.

2. As long as the provisions of paragraph 1 are not decided, the Ministry of Agriculture, Fisheries and Food may, after authorization in accordance with the relevant Community procedure, allow the importation of the said forest materials. of reproduction provided that they offer, in all respects, guarantees equivalent to those of the forest reproductive material produced in the European Union.

In particular, such imported materials shall be accompanied by a standard certificate or an official certificate issued by the country of origin, indicating such guarantees, as well as the records with the relevant details. to all consignments to be exported, which shall be provided by the supplier of the third country.

CHAPTER VI

Other Provisions

Article 16. Species exemption.

The Ministry of Agriculture, Fisheries and Food, through the appropriate channel, may request from the European Commission, in accordance with the relevant Community procedure, the exemption, in whole or in part, of the the provisions of this royal decree with regard to certain forest species which are not important for their use for selviculture purposes.

Article 17. Plant health conditions for forest reproductive material.

Forest reproductive material shall, where appropriate, comply with the relevant plant health conditions laid down in Royal Decree 2071/1993 of 26 November 1993 on protective measures against introduction and dissemination in the national territory and the European Economic Community (today, European Union) of organisms harmful to plants or plant products, as well as for export and transit to third countries.

Article 18. Sanctioning regime.

In case of non-compliance with the provisions of this royal decree, the regime of infractions and penalties provided for in Law 11/1971, of March 30, of Semillas and Plants of Vivero, and in Royal Decree 1945/1983, will apply. of 22 June on the regulation of infringements and penalties in respect of the defence of the consumer and of agri-food production.

Additional disposition first. The validity of the regions of origin and the base materials.

The regions of origin and the basic materials for the production of the forest materials of reproduction of the categories "material identified", "selected material" and "controlled material" are still in force prior to this royal decree.

Additional provision second. Validation of basic materials.

Base materials for the production of reproductive forest materials with less severe requirements authorized to date are authorized as basic materials for the production of reproductive material of the "identified material" category.

The seed orchards authorized as basic materials for the production of reproduction materials of the category "selected material" prior to this royal decree are authorized as basic materials for the production of forest reproductive material of the category "qualified material", in accordance with Article 2.l) and Annex VI of this royal decree.

Additional provision third. Regulation of other important forest species for selviculture in Spain.

By virtue of the forecast laid down in Article 3 (2) of Directive 1999 /105/EC, this royal decree shall also apply to the species listed in Annex XII.

The regions of origin of the basic materials for the production of propagating material of the categories "identified material" and "selected material" are listed in Annex XIII.

Additional provision fourth. Amendment of Royal Decree 2488/1994 of 23 December, determining the functions of the National Commission for the Protection of Nature, the rules governing its operation are dictated and the specialized committees are established attached to it.

1. A paragraph e) is added to Article 5.1 of Royal Decree 2488/1994, with the following wording:

" (e) Committee for the Improvement and Conservation of Forest Genetic Resources, which will have the purpose of carrying out the necessary coordination for the development, execution and monitoring of the production and marketing of materials Forest reproduction, between the competent bodies of the General Administration of the State and the Autonomous Communities. "

2. Article 5 (3) of Royal Decree 2488/1994 is amended by adding a paragraph with the following text:

" The Committee for the Improvement and Conservation of Forest Genetic Resources will be composed of a representative of each of the Autonomous Communities, two representatives of the Ministry of the Environment, one of whom will exercise the A representative of the Ministry of Agriculture, Fisheries and Food and a representative of the Ministry of Science and Technology. The representatives of the ministerial departments shall be appointed by the respective holders. "

First transient disposition. Authorization for the marketing of stocks.

The stocks of forest reproductive material accumulated before 1 January 2003, which must be communicated to the competent authority of the Community, shall be placed on the market until their completion. Autonomous within two months from the date of publication of this royal decree. Where such forest reproductive material is placed on the market, the supporting documentation shall specify such a circumstance with the text 'pre-existing lot' (Article 28.3 of Council Directive 1999 /105/EC).

Second transient disposition. Transitional period for the production of controlled reproduction material.

1. Within ten years from 1 January 2003, with a view to the admission of basic materials for the production of controlled propagating material (to which the Order of 21 January 1989 was not applicable, for which the Commission has not yet published the order of 21 January 1989), the results of comparative tests which do not satisfy the requirements laid down in Annex V

be used in Spain for the marketing of forest reproductive material.

These tests must have started before 1 January 2003 and have shown that the reproduction materials from the basic materials are superior to the witnesses for any of the characters selected.

2. Within ten years from 1 January 2003, with a view to the acceptance of the basic materials for the production of controlled reproductive material of all the artificial species and hybrids referred to in this royal decree, the results of genetic evaluation tests which do not satisfy the requirements laid down in Annex V may be used in Spain.

These tests must have started before 1 January 2003 and have shown that the reproduction materials from the basic materials are superior to the witnesses for some of the characters selected.

3. In the case of new artificial species and hybrids which may be added later than those listed in Annex I, the transitional period shall be determined in accordance with the relevant Community procedure.

4. After the expiry of the said transitional period, the results of the comparative and genetic evaluation tests may be used in Spain once the relevant Community procedure has been authorised.

Transitional provision third. Adaptation of mother plant fields.

Suppliers who have implanted the fields of mother plants referred to in Article 12.3, and who do not have the corresponding authorization, shall notify the competent authority of the respective Autonomous Community, in the two months from the date of entry into force of this royal decree, in order to be adapted to what the competent body has for that purpose.

Single repeal provision. Repeal of regulations.

All provisions of the same or lower rank are repealed in what they oppose to what was established in this royal decree, and in particular:

(a) Royal Decree 1356/1998 of 26 June 1998 laying down the rules applicable to the production, placing on the market and use of propagating material of species not subject to Community legislation.

(b) The Order of 21 January 1989 regulating the marketing of forest reproductive material.

(c) The Order of 21 January 1989 on the external quality standards of forest reproductive material which are placed on the market.

Final disposition first. Competence title.

This royal decree is dictated by the exclusive competence attributed to the State by Article 149.1.13. of the Constitution, in the field of bases and general coordination of economic activity, and by Article 149.1.23. to issue basic legislation on the protection of the environment and on forests and forest exploitation. Articles 15 and 17, which are issued under the exclusive competence conferred on the State by Article 149.1.10. of the Constitution in the field of foreign trade, are exempted from the foregoing.

Final disposition second. Regulatory enablement and enforcement.

The Ministers of Agriculture, Fisheries and Food and the Environment are empowered to dictate, in the field of their respective competences, the necessary rules for the application of the provisions of this royal decree.

Final disposition third. Amendment of the Annexes.

1. The Annexes IX, X, XI, XII and XIII may be amended by common agreement between the Ministers for Agriculture, Fisheries and Food and the Environment.

The amendment to Annex XII shall be made after a mandatory report of the Committee for the Improvement and Conservation of Forest Genetic Resources, following the relevant consultations and on a proposal from the competent authorities.

2. The Ministers for Agriculture, Fisheries and Food and the Environment may jointly amend Annex I and the Annexes not included in the previous paragraph, provided that the amendment is imposed by Community legislation and is accommodated in the she.

Final disposition fourth. Entry into force.

This royal decree will enter into force on the day following its publication in the "Official State Gazette".

ANNEX II

Minimum requirements for the authorisation of basic materials intended for the production of propagating material of the category "identified material"

The base material types will be a seed source or a rodent.

1. The units of admission may be the bearing and, in the case of a seed source, the mount or a geographical area with defined limits.

2. The region of provenance, the situation and the altitude or range of altitude of the place where the forest reproductive material is collected shall be declared.

3. The origin of the basic material must be declared, being indigenous or indigenous, not indigenous or non-indigenous, or of unknown origin.

In the case of non-indigenous or non-indigenous origin, the region of origin of the material used for the repopulation (through historical data or other appropriate means) shall be indicated, and its origin must be declared, if known.

4. The seed source or the bearing must be located within a single region of provenance.

5. The surface of the seed source must be such that it contains one or more groups of well-distributed trees and in number and density sufficient to ensure adequate interpollination.

6. The basic materials referred to above shall be subject to a formal inspection when the reproductive material is intended for specific selviculture purposes.

ANNEX III

Minimum requirements for the authorisation of basic materials intended for the production of propagating material of the category "selected material"

Generalities: a rodal will be authorized as a base material for the production of reproduction material of the category "selected material" (select rodal) after properly evaluating the numbered requirements of 1, 2, 3, 4, 5, 6, 7, 11 and 12, taking into account the specific objective for which forest reproductive material is intended-requirements numbered 8, 9, 10, 13, 14, 15 and 16-and the average values in the region of origin to which it belongs. The specific objective shall be indicated in the national register.

1. Origin: to be determined, by historical data or other appropriate means, if it is an indigenous or indigenous, non-indigenous or non-indigenous bearing, or if its origin is unknown and, for non-indigenous base materials, its source, if known.

2. Insulation: the selected stands must be located at a sufficient distance from the lowest quality bearing of the same species or with any bearing of species or varieties related to which they may form hybrids. Particular attention shall be paid to this requirement when stands that surround indigenous or indigenous stands are non-indigenous or non-indigenous or of unknown origin.

3. Effective population size: select stands must be integrated by populations with a sufficient number of trees, density and distribution so that adequate interpollination is ensured and the unfavourable effects of the inbreeding.

4. Age and development: select stands must consist of trees of an age or stage of development that allow the criteria given for selection to be clearly judged.

5. Uniformity: select stands must show a normal degree of individual variation in the morphological characters. If necessary, the lower trees should be removed.

6. Adaptive capacity: adaptation to the dominant ecological conditions in the region of provenance must be evident.

7. Health and resistance: the trees of the selected stands must be free from attacks by harmful organisms and present resistance to the climatic and adverse location conditions of the place where they are growing, except as regards the damage caused by the contamination.

8. Production by volume of wood: it shall normally be greater than the average observed in masses of the same region of origin under similar ecological and management conditions.

9. Quality of wood: it will be valued for those of the highest quality. The proportion of individuals with the best characteristics will be higher than the average observed in masses in the same region of origin.

10. Shape or pattern of growth: they must present particularly good morphological characteristics, especially straight and circular trunks, the inclination and bifurcation of the shaft, the angle and thickness of the branches and good natural pruning. In addition, the proportion of trees that present hanging or reversed fiber should be low.

11. Access: the select roll will be easily accessible, especially in the time of harvesting of the forest reproductive material.

12. Delimitation: it must have clear boundaries, which will be supported in the geographical or dasocratic divisions of the mountains.

When the primary target of selection is cork production, the following characteristics are considered:

13. Production of cork: the average production of cork from the select film will be higher in quantity and quality than the average observed in the region of origin. The quality will be analysed by tasting in the tree. Exceptionally, a rodent can be admitted as a select without performing the tasting for not being the year of the uncorché, and in this case it is necessary to perform the tasting when it comes to the turn of the discorche.

14. Sanitary state of the cork: the trees of the selected stands, in an important proportion, must be free from the attacks of organisms harmful to the cork.

When the primary target of selection is the production of fruit, the following characteristics shall be considered:

15. Fruit production: the average production of fruit per hectare per year must be higher than the average observed in masses of the same region of origin with similar treatments.

16. Health status of the fruit: the trees of the selected stands, in an important proportion, must be free from the attacks of organisms harmful to the fruit.

When the main objective of the selection includes several of the above, or is a multifunctional objective, the characters that may be applicable, as indicated above, will be appropriately valued.

ANNEX IV

Minimum requirements for the authorisation of basic materials intended for the production of propagating material of the category "qualified material"

1. Vegetable garden:

(a) The relevant competent body must approve and record the type, purpose, design, cross-check scheme and arrangement of the field, components, isolation and situation, as well as any change of those elements.

(b) Component clones or families shall be selected for their exceptional character and shall be considered in particular requirements 4, 6, 7, 8, 9, 10, 13, 14, 15 and 16 of Annex III.

(c) Component clones or families shall be planted or must have been planted in accordance with a plan approved by the competent authority and established in such a way that each component can be identified.

(d) The clarification carried out on the seed gardens shall be described in conjunction with the selection criteria used for such clarification and shall be recorded by the competent body.

e) The seed orchards shall be managed and the fruits shall be harvested in such a way as to achieve the objectives pursued. In the case of a seed garden intended for the production of artificial hybrids, a verification test shall determine the percentage of hybrids existing in the reproductive material.

2. Parent (s):

(a) Progenitors shall be selected for their exceptional character and shall be considered in particular requirements 4, 6, 7, 8, 9, 10, 13, 14, 15 and 16 of Annex III, as well as their ability to combine.

(b) The said competent body should approve and register the target, the cross-breeding scheme, the pollination system, the components, the isolation and the situation, as well as any significant changes to those conditions. elements.

(c) The competent body must approve and record the identity, number and proportion of parents in a mix.

(d) In the case of progenitors intended for the production of artificial hybrids, a verification test shall determine the percentage of hybrids in the propagating material.

3. Clones:

(a) Clones shall be identifiable by distinctive characters which have been admitted and registered by that competent body.

(b) The value of individual clones shall be established by experience or demonstrated by sufficiently long experimentation.

(c) Ortets used for the production of clones shall be selected for their exceptional characters and shall be considered in particular requirements 4, 6, 7, 8, 9, 10, 13, 14, 15 and 16 of Annex III.

(d) The competent authority shall restrict admission to a maximum number of years or to a maximum number of ramets produced.

4. Mixture of clones:

(a) The mixture of clones shall comply with the requirements in paragraphs (a), (b) and (c) of paragraph 3.

(b) The competent authority shall approve and record the identity, number and proportion of clones consisting of a mixture, as well as the method of selection and the basic raw material. Each mixture must contain sufficient genetic diversity.

(c) The competent authority shall restrict admission to a maximum number of years or to a maximum number of ramets produced.

ANNEX V

Minimum requirements for the authorisation of basic materials intended for the production of propagating material of the category "controlled material"

1. Requirements for all tests:

a) Generalities: Base materials must satisfy the relevant requirements of Annexes III or IV.

The tests established for the admission of the basic materials must be prepared, presented, carried out and their results interpreted in accordance with internationally recognized procedures. For comparative trials, the reproductive material to be controlled should be compared with one or more of the supported or pre-selected models.

b) Characters to be examined:

1. º The tests must be designed for the evaluation of certain characters, which must be indicated for each test.

2. The adaptation, growth and factors of biotic and abiotic importance will be calibrated. In addition, other characters, considered important for the specific purpose intended, shall be evaluated in relation to the ecological conditions of the region in which the test is carried out.

c) Documentation: Documents should describe the places where the test is performed, including the situation, climate, soil, previous uses, establishment, management and any damage due to abiotic/biotic factors, and be provision of the relevant competent body. The age of the materials and the results at the time of the assessment should be included in the register of that competent body.

d) Installation of the tests:

1. Each sample of reproductive material shall be grown, planted and managed in the same way as the types of plant materials permit.

2. º Each experiment must be set in a valid statistical profile with sufficient number of trees so that the individual characteristics of each component to be checked can be evaluated.

e) Analysis and validity of results:

1. Data from experiments should be analyzed using internationally recognized statistical methods and results should be presented for each character examined.

2. The methodology used for the test and the data of the results obtained may be freely available.

3. The region should also be exposed, suggesting the likely adaptation in the country in which the test was carried out and the characteristics that could limit its usefulness.

4. º If during the tests it is found that the reproductive material does not have at least the characteristics of the base materials, or of resistance similar to that of the base materials against harmful organisms of economic importance, such propagating material shall be disposed of.

2. Requirements for the genetic evaluation of the components of the basic materials:

(a) The components of the following basic materials can be genetically evaluated: Seed gardens, family progenitors, clones and clones mixtures.

b) Documentation: For the admission of basic materials the following additional documentation is required:

1. The identity, origin, and genealogy of the components evaluated.

2. The cross-breeding scheme used to produce the reproductive materials used in the assessment test.

c) Test procedures: The following requirements must be met:

1. º The genetic value of each component must be estimated in two or more places where the evaluation test is performed, one of which, at least, must be found in an environment corresponding to the suggested use of the materials.

2. The estimated superiority of the propagating material to be marketed shall be calculated on the basis of those genetic values and the specific cross-breeding scheme.

3. The trials of the assessment and the genetic calculations must be approved by the competent body.

d) Interpretation:

1. º The estimated superiority of the reproductive materials will be calculated using a reference population for each character or group of characters.

2. º It shall be declared if the calculated genetic value of the reproductive material is less than the reference population for any major character.

3. Requirements for comparative testing of propagating material:

a) Sampling of reproductive materials.

1. The sample of the reproduction materials for the comparative test must be truly representative of the reproductive material from the base materials to be admitted.

2. The reproductive material produced in a sexual manner for the comparative test shall be collected in years of good flowering and production of fruits/seeds; artificial pollination may be used; and collected by methods to ensure the representativeness of the samples obtained.

b) Witnesses:

1. The results of the witnesses used for comparative purposes in the tests must have been known, if possible, for a sufficiently long period in the region in which the test is to be carried out. The witnesses represent, in principle, materials whose usefulness for the selviculture has been demonstrated at the time of the start of the test, and in the ecological conditions for which the certification of the materials is proposed. They shall, as far as possible, proceed with selected stands according to the criteria set out in Annex III or the officially supported base materials for the production of controlled materials.

2. º For the comparative test of artificial hybrids, the species of the two progenitors shall, if possible, be included among the witnesses.

3. Whenever possible, several witnesses should be used. Where necessary and justified, witnesses may be replaced by the most appropriate materials submitted to the test or by the average of their components.

4. º In all trials the same witnesses will be used in as wide a range of location conditions as possible.

c) Interpretation:

1. It must be demonstrated, at least for an important character, a statistically significant superiority with respect to witnesses.

2. It shall be clearly reported if there is any character of economic or environmental importance that presents significantly lower results than witnesses and their effects shall be compensated by favourable characters.

4. Conditional admission: The prior assessment of early trials may constitute the basis for conditional admission. Claims of superiority based on an early assessment must be re-examined within a maximum of 10 years.

5. Early tests: The competent authority may accept tests of nursery, greenhouse and laboratory for conditional admission or final admission, if it can be demonstrated that there is a close correlation between the characteristic measure and the characters that would normally be evaluated in field trials.

Other characters to be tested shall comply with the requirements referred to in paragraph 3.

External quality requirements for forest reproductive materials

PART A

Requirements for lots of fruits and seeds of the species listed in Annex I

1. Lots of fruit and seeds of the species listed in Annex I shall not be placed on the market unless they have a minimum specific purity of 99 per 100.

2. Without prejudice to the provisions of paragraph 1, in the case of closely related species listed in Annex I, excluding artificial hybrids, the specific purity of the batch of fruits or seeds shall be declared if it does not reach 99 per 100.

3. The presence of harmful organisms that reduce the value of seed use shall only be tolerated to the least possible extent.

PART B

Requirements applicable to plant parts of the artificial species and hybrids listed in Annex I

The parts of plants of the artificial species and hybrids listed in Annex I shall be of fair and commercial quality. The quality and commercial quality shall be determined according to the general characteristics, the health status and the size criteria. In the case of "Populus spp.", it may be stated that the additional requirements laid down in Part C. are fulfilled.

PART C

Requirements relating to external quality standards applicable to stem and stranding staquillas used for the multiplication of "Populus sp."

1. Staquillas:

(a) The stem staquillas which present one of the following defects shall not be considered as full and commercial quality:

1. The wood has more than two vegetative periods.

2. The staquillas have less than two well-shaped buds.

3. They are affected by necrosis or damage caused by harmful organisms.

4. º Present signs of desiccation, asphyxiation, mouldering or rottenness.

b) Minimum dimensions of stem staquillas:

1. Minimum Length: 20 cm.

2. Minimum Top Dieter:

CE Class 1: 8 mm.

CE Class 2: 10 mm.

2. Varetas:

(a) The varetas or stakes that have some of the following defects shall not be considered as full and commercial quality: wood has more than three vegetative periods; they have fewer than five well-shaped buds; they are affected by necrosis or damage caused by harmful organisms; signs of desiccation, asphyxiation, mouldering or rottenness; wounds other than those caused by pruning; they have ramifications; they have a curvature excessive.

PART E

Plants shall not be marketed unless 95 per 100 of each batch is of full and commercial quality.

1. Plants which have some of the following defects shall not be considered to be of fair and commercial quality:

a) Herides other than those caused by pruning or injury due to the boot damage.

b) Absence of yolks susceptible to producing an apical outbreak.

c) Multiple Tallos.

d) Shaped root system.

e) Signs of desiccation, reheating, mouldering, rottenness or damage caused by harmful organisms.

f) Unbalance between the air part and the radical part.
