The order of the Ministry of agriculture, fisheries and food of March 22, 1999, amended by order of 3 March 2000, established the rules for the award of grants to institutions, companies and professionals, related to the production and marketing in the agricultural sector, which provide Department information about accounting, statistical data and agricultural prices; all this taking into account the requirements laid down in the regulation of the procedure for the granting of public subsidies, approved by Royal Decree 2225 / 1993 of December 17.
On the other hand, the Royal Decree 376/2003 of 28 March, which establishes the organizational structure of the Ministry of agriculture, fisheries and food, has determined that perform at their statistical functions related to the activities of the Department by the Directorate-General of economic planning and institutional coordination, through the Subdirectorate-General of food and agriculture statistics.
The management of the aid provided for in this order corresponds entirely to the General Administration of the State, in response to its object lies on a field of exclusive competence of the State, as it is the statistics for State purposes, and the need to ensure equality in the perception of aid by potential beneficiaries.
In addition, paragraph 6 of article 81 of the revised text of the Act General budget, approved by Royal Legislative Decree 1091 / 1988, of 23 September, has, that the Ministers will establish the appropriate regulatory basis for the provision of subsidies.
By virtue, I have: article 1. Object.
This order is to establish the regulatory bases and the call, for the year 2003, on a competitive basis, subsidies to institutions, companies and professionals, related to the production and marketing in the agricultural sector, to provide agricultural prices, accounting and statistical data.
Article 2. Beneficiaries.
Beneficiaries of these grants may be entities or companies legally constituted, as well as professionals involved in production and the agricultural commercialization, which meet the following technical requirements: 1) collaboration in statistical data and agricultural prices: be entities, companies or professionals with implementation in the agricultural markets of provincial, regional or national level.
Have technical ability to present data with the formalities required by the rules of the European Union, that is applicable in each case.
(2) accounting data to the programme of the network accounting agrarian national collaboration: be owner of farm with an average annual turnover equal to or exceeding 15,000 Euros.
Article 3. Applications.
Applications for grants shall be addressed to the Minister of agriculture, fisheries and food and check, before May 30, 2003, in the General registry of the Department or any of the places referred to in article 38.4 of law 30/1992, of 26 November, legal regime of public administrations and common administrative procedure.
Requests shall be adjusted, in each case, to models which are attached as annexes I and II to this provision.
In case of request for the first time grant for collaboration on statistics of agricultural prices (annex I), will be accompanied to the request an example with: prices, trade positions, specifications and, where appropriate, traded volumes of those products that want to collaborate.
Article 4. Instruction and motion for a resolution.
The statement of the procedure will be conducted by the General Sub-Directorate of agri-food statistics, of the Directorate-General of economic planning and institutional coordination. Such a Subdirectorate-General shall have power to collect how many reports it deems necessary, in order to assess applications in accordance with the assessment criteria set out in this standard and the relevant statistical programs, as well as to evacuate the hearing process, as necessary, in accordance with the provisions of article 84 of the law 30/1992, of 26 November Legal regime of public administrations and common administrative procedure, preparing to effect the corresponding motion for a resolution, in which the ratio of applicants for which proposes the granting of the subsidy, the amount thereof and the valuation criteria used must be expressed.
Article 5. Resolution.
Regulated by this provision grants will be awarded by the Minister of agriculture, fisheries and food or by the body that has delegated this competence.
This resolution will be motivated, published a summary of its contents in the "official bulletin of the State", which shall indicate the place where you will find the Bulletin Board that will be exposed to its full contents and term during which such public exposure will take place.
The resolution of the procedure, which will put an end to the administrative procedure, expressing the ratio of applicants who are granted the subsidy and the amount granted, by expressly stating that the remaining requests will be ignored.
Article 6. Deadline for resolution of the procedure and effects.
Once the maximum period to resolve the procedure, which will be six months, counted from the day of the publication of this order in the "official bulletin of the State", without that has relapsed express resolution, means that it is rejecting the grant award.
Article 7. Financial year to which the data refer.
Subsidies granted in a given year, for information and statistics of agricultural prices, it will be by the data for that year.
Given the special technical characteristics of processing, accounting data subject of grant in one year will be those corresponding to the previous financial period.
Article 8. Selection criteria.
The selection of applications will be made by the application of the following criteria: 1) partners in statistical data and agricultural prices: to) contribution by the applicant's data regarding representative agricultural products in the geographical area over which advises.
(b) analysis of a history of collaborations in the supply, the Ministry of agriculture, fisheries and food, content data analogous to the object of this order.
((2) collaborators in accounting data: a) representativeness of the agricultural holding on the predominant type of holdings in the area in which it is located.
(b) orientation of the productive activity of the farm to the market.
(c) analysis of a history of collaborations with exploitation in supply, the Ministry of agriculture, fisheries and food, content data analogous to the object of this order.
Article 9. Amount and limits.
Grants will be awarded on an annual basis, only once and in amounts proportional to the volume and complexity of data to provide. However, settle the following maximum limits on quantities to receive per partner per year, depending on the type of data: statistical and agricultural price data: 2,206-Euros.
Accounting data: 126 Euros.
Article 10. Payment.
The payment of the subsidies shall be carried out after checking that the information received match the content, time and form established.
Article 11. Control.
Control of compliance with the object, terms and purpose of the grant shall be made in accordance with provisions of the consolidated text of the General Law on budget, approved by Royal Legislative Decree 1091 / 1988, of 23 September.
Where it is necessary to reinstate the amounts received in respect of subsidy, is will follow the procedure laid down in article 8 th of the regulation of the procedure for the award of grants and public subsidies, approved by Royal Decree 2225 / 1993, of 17 December, and in accordance with the provisions of the General budget law.
Article 12. Statistical confidentiality.
Individual statistical data shall be protected by statistical confidentiality, under the terms established by law 12/1989, of May 9, public statistics function.
First additional provision. Limit of recipients.
The maximum number of recipients of subsidies in 2003 may not exceed as set out in annex III.
Second additional provision. Applicable regulations.
In all matters not provided for in the present order shall apply as laid down in articles 81 and 82 of the General budget law and the regulation of the procedure for the granting of public subsidies, approved by Royal Decree 2225 / 1993 of December 17.
The order of March 22, 1999, by which establish the rules for the award of grants to institutions, companies and professionals, related to the production and marketing in the agricultural sector, who provide data and statistical, financial and agricultural prices, and the order of 3 March 2000 amending it are hereby repealed.
Sole final provision. Entry into force.
This provision will enter into force the day following its publication in the "official bulletin of the State".
