Royal Decree 1599/1997 of 17 October on cosmetic products collected in a single text all the existing legislation on this subject, adapting to Community legislation. The orders of 4 June 1998, 26 April 1999, 3 August 2000 and 5 February 2002, amended the Annexes to this Royal Decree for the first, second, third and fourth time respectively.

Two new adaptations have now been made to the technical progress of the Annexes to the Cosmetic Framework Directive 76 /768/EEC, by Commission Directives 2003 /1/EC and 2003 /16/EC.

By this provision these directives are transposed to our positive right, in accordance with the provisions of the final provision of Royal Decree 1599/1997, amending for the fifth time the Annexes to the Royal Decree of the Decree.

In its virtue, I have:

First. -Annexes II and III to Royal Decree 1599/1997 of 17 October on cosmetic products are amended as follows:

1. In Annex II

(a) In order No 417 the phrases:

" A) the skull, including the brains and eyes, the tonsils and the spinal cord of:

bovine animals over 12 months of age.

animals of the ovine and caprine species of more than 12 months of age showing in the gums a definitive incisor and derived ingredients. '

"B) the spleen of the ovine and caprine animals and derived ingredients."

is replaced by the following text:

" As of the date referred to in Article 22 (1) of Regulation (EC) No 999/2001 of the European Parliament and of the Council, the specified risk materials as set out in Annex V to that Regulation, and the ingredients derived therefrom. "

Until that date, the specified risk materials, as listed in Chapter A of Annex XI to Regulation (EC) No 999/2001, and the ingredients derived therefrom.

b) "In order number 449, the CAS number 95-15 -2 is replaced by the number" CAS 93-15 -2 ".

2. In Part 2 of Annex III.

In reference numbers 61 and 62, Musk xylene and Musk Ketone, in column g), the date 28.02.2005 is replaced by '30.09.2004'.

Second. Since the entry into force of this Order, cosmetic products which do not comply with the first subparagraph of point 1 (a) of this Regulation may not be placed on the market, sold or transferred to the final consumer. This Ministerial Order.

Third. This Order shall enter into force on the day following that of its publication in the Official Gazette of the State.
