Key Benefits:
Law 12/1989, of May 9, of the Public Statistical Function, enables
to the National Institute of Statistics for research, development,
perfecting and applying the statistical methodology, so it turns out
opportune for the INE to be called annually, by means of a contest
public on competitive competition, post-graduate scholarships
that want to start on the methods and techniques used in the investigation
statistics. To this end, the successful recipients of the scholarships will participate in
research tasks and training activities to be established
in the various programs that the INE develops annually.
Therefore, this Ministry has considered it appropriate to draw up an
Order establishing the regulatory general bases for the concession
of postgraduate scholarships in statistics, in accordance with the scheme
set out in Articles 81 and 82 of the recast text of the General Law
Budget and the Procedure for Concession Regulation
Aid and Public Grants approved by Royal Decree 2225/1993,
of December 17.
In its virtue, prior to the report of the State of
StateDepartment, available:
Article 1. Purpose of the grants.
The object of the grants whose concession is regulated in this Order
is the promotion and promotion of statistical research, as well as the
development and implementation of statistical processes, through training
of postgraduates.
Article 2. Requirements for applicants.
May be beneficiaries of the scholarships provided for in this Order
those natural persons who meet the following conditions:
a) Possession of Spanish nationality or being a national of a member country
of the European Union, resident in Spain at the time of incorporation
to the scholarship, possessing full capacity to work.
b) Being in possession of the degree of licentiate, engineer or architect,
to have been obtained for the last four years to be counted
since the publication of the call for scholarships. The titles achieved
abroad or in non-state Spanish centers must be
validated or recognized, or documented to be documented by this
processing that validation and recognition at the time of request
the grant, being subject to its award, in the latter case, to the
obtaining such validation or recognition.
c) Find the day in compliance with all your obligations
taxes and social security.
Article 3. Calls.
According to the provisions of article 4.3 of the Royal Decree
2225/1993, of 17 December, approving the Regulation of the
procedure for the granting of aid and public subsidies, the
convocation of the scholarships referred to in this Order will be initiated on its own initiative
by Resolution of the Presidency of the INE, to be published in
the "Official State Gazette" and will conform to the provisions of the present
Order, completing at the following ends:
a) Indication of the disposition that establishes the regulatory bases,
and the Official Gazette of the State in which it is published.
b) The purpose, conditions and purpose of the grant of the grant.
c) Determination that the award is made on a scheme
competitive concurrency, through the appropriate contest.
d) Deadline for submission of applications, which will not be less than fifteen
days from the date of publication of the calling resolution, as well
as the resolution of the procedure, which is also to notify
the resolution.
e) Requirements, or supplemental documentation and
criteriavaluation.
f) The budget credit to which the grants and the amount of
are chargedthe same.
g) Composition of the study and assessment committee.
h) Form and means in which communications will be performed and
notifications, especially awards.
i) Indication that the resolution that agrees or denies the concession
of the scholarships puts an end to the administrative route and against it can be brought in
replacement potestative resource according to the provisions of the articles
116 and 117 of Law 30/1992, of November 26, of Legal Regime
of Public Administrations and Administrative Procedure
Common in its wording given by Law 4/1999, of January 13, by
the amendment of Law 30/1992 or, directly, contentious appeal
administrative within two months from the next day
to the notice or publication of the judgment before the Courts
Central Administrative-Management, in accordance with the Law
29/1998, July 13, regulator of such Jurisdiction.
The Resolution that approves the call will set the duration of the
scholarships. It may also provide for extension, for half-yearly periods,
of all or some of the grants awarded, until you complete a period
maximum of twenty-four months, upon reasoned proposal from the tutor of
the training action and conditional on budgetary availability,
elevated to the INE Presidency for its resolution.
Article 4. Commission of study and assessment.
Submitted applications and documentation will be studied and
valued by a Commission, chaired by the Presidency of the INE or in
who delegates, will be named by this one for each call.
The functioning of the Commission will be in accordance with the Organ regime
Collegiate established in the Law of Legal Regime of the
Public Administrations and the Common Administrative Procedure.
It will also act as a manager for how many events are
derive from the call, its development, and resolution of incidents that
could be considered, including the proposal for resolution of scholarships to
grant.
Article 5. Grant of scholarships.
The scholarships referred to in this Order shall be granted by way of
administrative resolution, by the INE Presidency, in accordance with
the provisions of article 81.3 of the recast text of the General Law
Budget, in its wording given by Law 31/1991, of 30 of
December, General State Budget for 1992, prior to entry
budget for this purpose.
The resolution of the call will be published in the " Official Gazette
of the State ", and the grant of the scholarships will be notified to each of
the beneficiaries.
Article 6. Obligations of the beneficiaries and conditions for granting.
1. The enjoyment of the scholarships referred to in this Order will be
incompatible with any other grant of similar characteristics granted
by public or private bodies, Spanish or foreign, in
temporary match with the granted.
2. Beneficiaries will participate in the statistical programmes which
establish the National Statistics Institute, attending meetings
and the activities to be determined. Within the maximum period of three months,
since the end of the scholarship, they must present a memory about
the acquired knowledge and the or the statistical programs in which
have participated.
3. The granting and enjoyment of scholarships does not imply a labor relationship
or the scholar's statutory with the body.
4. The beneficiary will be obliged to provide information about the information
be requested by the Court of Auditors, the General Intervention of the
State Administration or the National Statistics Institute itself,
about the grant awarded.
Article 7. Realization of the payment.
Payment will be performed on twelve natural mensualities for an amount
equal to the twelfth part of the total grant each mensuality, quantity
to which the discounts and holds that come in agreement will apply
with the tax provisions in place.
In case of extension, the total amount of the grant, as well as the payment,
will increase in as many mensualities as the scholarship is extended.
Article 8. Measures to ensure the good end of scholarships.
1. Amendment of the grant resolution of the grant. All
altering the conditions taken into account for the granting of the
grant, and, in any case, concurrent obtaining of other scholarships, in
statistical matters, granted by other Administrations or entities, Public
or private, national or international, will result in the modification of
the adjudication resolution, with the payee having to proceed to the
refund of the amounts received.
2. Refund of the amount of the grant. The reimbursement of the amounts
received shall be carried out by the system set out in Article 8
of the Rules of Procedure for the granting of aid and
public subsidies, approved by Royal Decree 2225/1993, of 17 of
December.
The reimbursement of the amounts received in respect of the
grants or public aid and, consequently, the resolution of the
granting and requiring the interest of late payment from the time of the
payment of the grant, in the amount set out in Article 36 of the recast text
of the General Budget Law, when any of the
the circumstances provided for in Article 81 (9) of that Law.
3. Incorporation of alternates. The assessment committee will raise with
the proposal to award a supplementary list of alternates, by
order of precedence, for the case to be given waivers or
revocations among the successful recipients of the scholarships, in the first six months
training.
Article 9. Responsibility and sanctioning regime.
Recipients of the grants provided in this Order are subject to
to the regime of administrative violations and sanctions established in the
article 82 of the recast text of the General Budget Law, in the
wording given to it by article 16.3 of Law 31/1990, of 27
December's General Budget of the State for 1991.
Single repeal provision.
This Order repeals ECO Orders 558/2002, February 22
and ECO 3449/2002, December 20, as well as how many provisions
of equal or lower rank are opposed to the provisions of the Order itself.
Final disposition first. Powers of development.
The INE Presidency is empowered to dictate how many resolutions
consider necessary for the application of this Order.
Final disposition second. Applicable rules.
For all those extremes not foreseen in this Order are
will apply the provisions of Articles 81 and 82 of the General Budget Law
and in Royal Decree 2225/1993, of December 17.
This Order shall enter into force on the day following that of its publication
in the "Official State Bulletin".
