Law 12/1989, of May 9, public statistics service, empowers the National Institute of statistics for research, development, improvement and application of statistical methodology, making it timely for INE convene annually, by means of public tender on a competitive basis, scholarships for postgraduates who wish to engage in the methods and techniques used in statistical research. To this end, recipients of the scholarships will participate in research and training activities to be established in the different programs that INE develops annually.
For this reason, this Ministry has considered convenient to prepare an order which set the General bases regulating for the granting of scholarships in statistics, in accordance with the regime established in articles 81 and 82 of the consolidated text of the General budget law and the rules of procedure for the award of grants and public subsidies approved by Royal Decree 2225 / 1993 , 17 December.
By virtue, the advocacy of the State Department report, available: article 1. Object of the scholarships.
The object of scholarships whose concession is regulated in the present order is fostering and promotion of statistical research, as well as the development and implementation of statistical processes, through the training of postgraduates.
Article 2. Applicant requirements.
They may be beneficiaries of scholarships provided for in the present order those individuals who meet the following conditions: to) have Spanish nationality or be a national of a member country of the European Union, resident in Spain at the time of joining the scholarship, possessing full capacity to act.
(b) be in possession of the title of licenciado, engineer or architect, which must have been obtained during the last four years starting from the publication of the scholarships. Titles achieved abroad or in Spanish non-State centres shall be confirmed or recognised, or it should justify documented that it is pending the validation and recognition at the time of applying for the scholarship, adjudication, being subject in the latter case, to obtain such recognition or recognition.
(c) found a day in all its tax obligations and against Social Security.
Article 3. Calls.
In accordance with the provisions of article 4.3 of the Royal Decree 2225 / 1993, of 17 December, which approves the regulation of the procedure for the award of grants and public subsidies, the scholarships referred to in this order will start from office by resolution of the Presidency of the INE, which shall be published in the "official bulletin of the State" and shall be subject to the provisions of this order (, by completing the following ends: to) indication of the provision establishing the regulatory bases and of the Official Gazette in which it is published.
(b) object and purpose of the grant conditions.
(c) determination that the award is made in a competitive concurrency, by using the appropriate competition regime.
(d) deadline for submission of applications, which shall not be less than fifteen days from the date of publication of the organizing resolution, as well as the resolution of the procedure, that it is also to notify the resolution.
(e) requirements, or documentation and assessment criteria.
(f) budgetary credit which are imputed scholarships and amount thereof.
(g) composition of the Commission's study and assessment.
(h) form and means that there will be communications and notifications, especially the awards.
(i) indication that the resolution that you remember or denied scholarships award puts an end to the administrative procedure and against it can be reconsideration of replacement pursuant to the provisions of articles 116 and 117 of the law 30/1992, of 26 November, legal regime of public administrations and common administrative procedure in the wording given by the law 4/1999 January 13, by which the law 30/1992 amending or, directly, contentious resource in the period of two months counted from the day following the notification or publication of the decision before the courts Central of the contentious-administrative, in accordance with the law 29/1998, of July 13, regulator of the jurisdiction.
Resolution that approves the call shall fix the duration of the scholarship. You can also set the extension, by six-month periods, of all or some of the scholarships awarded, up to a maximum period of 24 months, prior motivated proposal of the tutor of action training and conditioned to the budgetary availability, elevated to the Presidency of the INE for its resolution.
Article 4. Commission of study and assessment.
Requests and documentation presented will be studied and evaluated by a Commission chaired by the Presidency of the INE or delegated, will be named by this for each call.
The functioning of the Commission is set to the regime of collegiate bodies established by law legal regime of public administrations and common administrative procedure.
Act, in addition, this Committee as Manager of many acts arising from the call, its development and resolution of incidents that may arise, including resolution of the scholarship grant.
Article 5. Granting of scholarships.
The scholarships referred to in this order shall be granted by administrative decision, by the Presidency of the INE, in accordance with the provisions of article 81.3 of the consolidated text of the General Law on budgetary, editorially given by law 31/1991 of 30 December, General State budget for 1992, prior budgetary appropriation for this purpose.
The resolution of the announcement will be published in the "official bulletin of the State", and the granting of scholarships shall be notified to each of the beneficiaries.
Article 6. Obligations of the beneficiaries and conditions of award.
1. the enjoyment of the scholarships referred to in this order shall be inconsistent with any other similar scholarship granted by agencies, public or private, Spanish or foreign, in temporary coincidence with the granted.
2. the beneficiaries will participate in the statistical programmes which establish the National Institute of statistics, attending meetings and activities to be determined. Within a maximum period of three months from the completion of the scholarship, they must submit a report on the knowledge acquired and the statistical programs in which they have participated.
3. granting and enjoyment of scholarships does not imply employment or statutory relationship of the fellow with the Agency.
4. the insured will be obliged to provide the information request you by the Court of Auditors, the General intervention of the administration of the State or the National Institute of statistics, about the scholarship granted.
Article 7. Realization of payment.
The payment will be made in twelve monthly installments-natural by an amount equal to the twelfth of the total of the scholarship each monthly payment, amount which apply discounts and deductions which may be applicable in accordance with the tax regulations.
In the case of extension, the total amount of the grant as well as the payment, it will increase in as many months as extension of the scholarship.
Article 8. Measures to ensure the fruition of the scholarships.
1. modification of the resolution of the grant. Any alteration of conditions taken into account for the granting of the subsidy, and, in any case, the concurrent collection of other scholarships, statistical, granted by other administrations or agencies, public or private, national or international, will lead to the modification of the resolution for the award, and must the beneficiary proceed to the reinstatement of perceived quantities.
2. reimbursement of the amount of the scholarship. The reinstatement of the perceived amounts will be held by the system established in article 8 of the regulation of the procedure for the award of grants and public subsidies, approved by Royal Decree 2225 / 1993 of December 17.
Shall be the reimbursement of the sums received in concept of subsidies or State aid and, consequently, the resolution of the concession and the demand of the interest of delay from the moment of the payment of the scholarship, in the amount set in article 36 of the consolidated text of the General Law on budgetary, when any of the circumstances provided for in point 9 of article 81 of the Act.
3. incorporation of alternates. The Commission's assessment rise with the proposal to award a complementary list of alternates, in order of priority, for the case that resignations or revocations among recipients of the scholarships, in the first six months of training.
Article 9. Liability and penalties.
The beneficiaries of the grants arranged in this order are subject to the administrative offences and sanctions regime established in article 82 of the consolidated text of the General Law on budgetary, in the wording given to it by article 16.3 of law 31/1990, of 27 December, the State budget for 1991.
Sole repeal provision.
This order repeals the orders ECO 558/2002 of 22 February and ECO 3449/2002, of 20 December, as well as how many provisions of equal or lower rank to oppose provisions of the order itself.
First final provision. Schools of development.
It empowers the Presidency of INE so that it dictate how many resolutions it deems necessary for the implementation of this order.
Second final provision. Applicable regulations.
For all those ends not provided for in this order shall apply as provided in articles 81 and 82 of the General Budget Bill and the Royal Decree 2225 / 1993 of December 17.
This order shall enter into force the day following its publication in the "official bulletin of the State".
