The Royal Decree 118/2001 of 9 February, for the Management of Official Publications, regulates the editorial activity of the various ministerial departments and establishes the fundamental lines of the organization of the In order to improve the regulatory framework already established by Royal Decree 379/1993, of March 12 and to adapt it to the current aims of the editorial activity of the Administration.

This new regulation and the amendments made by Law 6/1997 of 14 April of the Organization and the Functioning of the General Administration of the State, make it necessary to update the regulations governing the composition and Operation of the Publications Advisory Commission of the Department, set up by Order of 31 May 1994, as well as the functions of the Publications Centre of the Ministry of Foreign Affairs.

In its virtue, with the favorable report of the Coordinating Board of Official Publications and after the approval of the Minister of Public Administrations, I have had to dispose:

First. The Publications Advisory Commission:

1. The Publications Advisory Committee of the Ministry of Foreign Affairs shall be composed of the following members:

President: The Assistant Secretary of the Department or his delegation, the Technical Secretary General.

Vice President: The Technical Secretary General.

Vocals: A representative of each of the higher bodies, the Directorates-General and the agencies and entities with editorial activity of the Department.

The Deputy Director-General of the Budget Office of the Department and the Deputy Secretary-General responsible for the Publications Centre, who will act as the Secretary of the Commission, will also be part of it.

2. The Members of the Publications Advisory Committee shall be appointed by the head of the body representing officials with the level of the Deputy Director-General or assimilated, in accordance with Article 6 of Royal Decree 118/2001, without prejudice to be accompanied by the official of any level they deem appropriate.

3. Meetings of the Publications Advisory Committee may be incorporated, with a voice but without a vote, by decision of the President, acting as advisers, the officials of the Department and its public bodies which, by their expertise, are judged to be necessary to intervene in some specific aspect.

Second. Functions.

The following functions are for the Publications Advisory Commission:

a) To inform, in advance of its referral to the Board of Coordination of Official Publications, the proposal of the Department in relation to the General Plan of Official Publications of the General Administration of the State.

b) To inform, in advance of their referral to the Board of Coordination of Official Publications, the proposals for editing that must be included in the Editorial Program of the Department and the revision of the Department, which, if necessary, will be carried out, must be in line with the criteria and objectives contained in the General Plan for Official Publications of the General Administration of the State in force.

c) Inform and propose the necessary criteria for the marketing regime of the official publications of the Department, as well as its official distribution, in which the diplomatic missions and offices should be included consular.

d) Report the draft rules affecting the Department in the field of official publications.

e) Orienting the department's publishing and broadcasting activities, providing advice on how many issues relate to those.

f) To advise the Technical General Secretariat on how many subjects they refer to official publications.

g) Track the Editorial Program and report the Department's Annual Report Memory.

(h) Constituency, where appropriate, special commissions for the treatment of specific topics of their competence.

In particular, a special committee could devote itself to the study of originals whose publication is proposed, and would be made up of senior Department officials, as well as other persons whose advice is deemed appropriate in the function of each topic.

Third. Operation.

The Publications Advisory Committee shall meet, precept, for the exercise of the powers provided for in the second paragraph of this Order, at least twice a year, and as many times as its President considers it. convenient.

Fourth. Regulatory standards.

Without prejudice to the peculiarities provided for in this Order, the Commission shall be governed by the provisions of Chapter II of Title II of Title II of Law No 30/1992 of 26 November 1992 on the Legal Conditions of Employment Public administrations and the Common Administrative Procedure.

Fifth. Duties of the Secretariat of the Publications Advisory Committee.

The functions of the Secretariat of the Publications Advisory Commission will be as follows:

(a) Provide technical assistance to the plenary and special committees and promote the implementation of the agreements.

b) Ensure coordination between the DGs, entities and autonomous bodies of the Department, in matters relating to the powers of the Commission.

c) Issue certification of the inclusion of publications in the Editorial Program of the Department, for the purposes of Article 9 of Royal Decree 118/2001.

d) To know the inclusions in the Editorial Program of the Department that for reasons of necessity and urgency, have been agreed after their approval or their review.

(e) To convene the meetings of the Commission on the order of its President, as well as the summons to the members of the Commission.

(f) to receive the members ' acts of communication with the Commission and, therefore, the notifications, requests for data, corrections or any other kind of writing from which they must be aware.

g) Prepare the dispatch of the cases, write and authorize the minutes of the sessions.

h) Exorder certifications from approved queries, opinions, and agreements.

Sixth. Relationship with the Official Publications Coordination Board.

The Technical General Secretariat of the Ministry of Foreign Affairs is the liaison body of the Department's Publications Advisory Commission with the Official Publications Coordination Board.

Seventh. The Publications Centre.

1. The Publications Centre of the Ministry of Foreign Affairs is the Unit of the Technical General Secretariat responsible for executing the editorial and broadcasting activity of the Department. This Unit is integrated into the Technical General Secretariat.

2. They are the functions of the Publications Center:

a) Develop the proposal of the Department in relation to the General Plan of Official Publications of the General Administration of the State.

b) Develop the project of the annual Editorial Program of the Department, based on the proposals made by the higher and managerial bodies and by the organizations and entities with editorial activity, within the framework established by the General Plan and in accordance with the available budgetary resources. This programme shall contain the information required in Article 4. 2.1 of Royal Decree 118/2001 of 9 February.

c) Coordinate the activity of the various Department of the Department, promoting the achievement of the objectives outlined in the General Plan for Official Publications and the implementation of the Editorial Program of the Department, controlling their compliance and imparting the precise instructions for this.

d) Manage, in coordination with the different Publishing Units, the editing, distribution and sale, if any, of the official publications.

e) Propose to the Secretary-General Technical the sales prices to the public of the publications of the Department, taking into account its cost of production and what to this effect it can establish the General Plan of Publications of the General Administration of the State and the Coordination Board for Official Publications.

f) Develop the Department's Annual Report Memory.

g) Any other activity that is determined by the Department by its connection to the editorial process.

Eighth. Elaboration of the annual Editorial Programme.

1. The Technical General Secretariat shall request from the higher bodies, Directorates-General, autonomous bodies and departmental entities, the referral within the time limit determined by the proposals that they wish to include in the Program. Annual editorial of the Department.

The Editorial Programme shall be drawn up in due time for referral to the Coordination Board for Official Publications within the time limit, without prejudice to its subsequent adequacy to the priorities, criteria and objectives set out in the the corresponding exercise of the General Plan of Official Publications of the General Administration of the State, once approved by the Council of Ministers.

3. The proposals for publications carried out by the various units will individually collect the information provided for in art. 2.1 of the R.D. 118/2001.

4. Publications shall be included in the Editorial Programme in any of the forms of co-edition even if they do not involve any budgetary cost, provided that any sign of official identification appears in the work in question.

Ninth. Approval of the Editorial Programme.

The approval of the annual Editorial Program and, if applicable, its revision in the second half of the year, corresponds to the Department's holder, after the report of the Advisory Committee on Publications of the Ministry and the Board of Directors of the Coordination of Official Publications.

For reasons of necessity and urgency, the holder of the Department may agree to the inclusion of publications in the Editorial Program, subject to the procedures provided for in Royal Decree 118/2001, upon request of the Body, body or entity proposing, addressed to the Chair of the Publications Advisory Committee of the Department who will move it to the Office with its report.

Of these inclusions, the Secretariat of the Coordination Board for Official Publications will be informed.

10th. Identification Number of Official Publications (NIPO).

All publications included in the Editorial Program will have an identification number (NIPO) that will be assigned by the Secretariat of the Coordination Board for Official Publications, upon request of the Publishing Unit made through the Publications Centre of the Technical General Secretariat.

11th. Requirements for the performance of official publications.

The proposals for authorization of expenditure for the implementation of the official publications will be accompanied by the NIPO and the certification of the Secretariat of the Advisory Commission of Publications of the Department, accreditative of its inclusion in the Editorial Program of the same.

Official publications must comply, in addition to the regulations in force in the matter of ISBN, ISSN and legal deposit, as well as the provisions of Royal Decree 1465/1999, of 17 September establishing criteria of image The institutional and the printed material of the General Administration of the State is regulated and regulated.

The bar code must also be printed on the fourth cover page of the venal character publications.

12th. Autonomous bodies and entities governed by public law.

The self-governing bodies and public law entities attached to the Department which, by reason of their competence, have to elaborate and disseminate publications, may edit, distribute and market their own publications, integrated into the Editorial Program of the Department, in accordance with the provisions of art. 4.2 of Royal Decree 118/2001.

13th. Impact on public expenditure.

This Order does not imply an increase in public expenditure.

14th. Repeal of rules.

The Order of the Ministry of Foreign Affairs of 31 May 1994 was repealed and regulated by the Publications Advisory Committee of the Ministry of Foreign Affairs.

15th. Entry into force.

This Order shall enter into force on the day following that of its publication in the "Official State Gazette".
