Article 2 of Royal Decree 915/2002 of 6 September 2002 on the organisation and operation of the Defence Delegations sets out the criteria to be followed for the new territorial deployment of delegations and Sub-delegations of Defence and their Delegated Offices.

Article 5 and the Final Disposition second to the Royal Decree, provides that the Minister of Defense will determine the Submissions of Defense that will be integrated in each Delegation, as well as the structure of each of the Delegations and Subdelegations of Defense, expressly establishing the services, units and dependencies to be integrated into the functional areas of them.

It is also necessary to lay down the basic criteria for governing the various organs and functional areas which are generally composed of the delegations and the subdelegations of defense and their delegated offices.

In its virtue, according to the powers conferred on me by Article 5 and the final disposition of Royal Decree 915/2002 of 6 September 2002 and with the prior approval of the Minister of Public Administration, I have:

First. Purpose. This Order is intended to establish the territorial implementation and structure of the Delegations and Submissions of Defense and their Delegated Offices and to establish the basic criteria for the different organs and functional areas which are generally composed of them.

Second. Scope. This Order will apply to the territorial bodies that make up the peripheral structure of the Ministry of Defense, in accordance with Royal Decree 915/2002 of 6 September on the organization and operation of the the Defence Delegations.

Third. Territorial implementation.-The following delegations, Defense Subdelegations and Delegated Offices are established:

a) Delegation of Defense in Seville, based in the city of Seville and Subdelegations in the provinces of Almeria, Cadiz, Cordoba, Granada, Huelva, Jaén and Malaga, based in their capitals, and Offices Delegate in the localities of Algeciras (Cádiz) and San Fernando (Cadiz). It shall cover the territory of the provinces concerned.

b) Delegation of Defense in Zaragoza, based in the city of Zaragoza and Subdelegations in the provinces of Huesca and Teruel, based in their capitals.

It will cover the territory of the provinces mentioned.

c) Delegation of Defense in Asturias, based in the city of Oviedo. It will cover the territory of the province of Asturias.

d) Delegation of Defense in the Balearic Islands, based in the city of Palma de Mallorca, with Office Delegate in the town of Mahon on the island of Menorca.

It will cover the territory of the Balearic archipelago.

e) Delegation of Defense in the Palmas, based in the city of the Palmas de Gran Canaria, a Subdelegation in the province of Santa Cruz de Tenerife, based in its capital. It will cover the territory of the Canary Islands.

f) Delegation of Defense in Cantabria, based in the city of Santander. It will cover the territory of the province cited.

g) Delegation of Defense in Toledo, based in Toledo and Subdelegations in the provinces of Albacete, Ciudad Real, Cuenca and Guadalajara, based in their capitals. It shall cover the territory of the provinces concerned.

h) Delegation of Defense in Valladolid, based in the city of Valladolid and Subdelegations in the provinces of Avila, Burgos, León, Palencia, Salamanca, Segovia, Soria and Zamora, based in their capitals.

It will cover the territory of the provinces mentioned.

i) Delegation of Defence in Barcelona, based in the city of Barcelona and Subdelegations in the provinces of Girona, Lleida and Tarragona, based in their capitals. It shall cover the territory of the provinces concerned.

j) Delegation of Defence in Ceuta, based in the city of Ceuta. It will cover the territory of the city cited.

k) Delegation of Defence in Badajoz, based in the city of Badajoz and Subdelegation in the province of Cáceres, based in its capital. It shall cover the territory of the provinces concerned.

l) Delegation of Defense in A Coruña, based in the city of A Coruña, Subdelegations in the provinces of Lugo, Ourense and Pontevedra, based in their capitals, and a Delegate Office in the town of Ferrol (A Coruña). It shall cover the territory of the provinces concerned.

m) Delegation of Defence in Madrid, based in the city of Madrid and a Delegate Office in the town of Alcalá de Henares. It will cover the territory of the province cited.

n) Delegation of Defense in Melilla, based in the city of Melilla. It will cover the territory of the city cited.

o) Delegation of Defense in Murcia, based in the city of Murcia and a Delegate Office in the town of Cartagena. It will cover the territory of the province cited.

p) Delegation of Defense in Navarre, based in the city of Pamplona. It will cover the territory of the province of Navarra.

q) Delegation of Defense in La Rioja, based in the city of Logroño. It will cover the territory of the province cited.

r) Delegation of Defence in Valencia, based in the city of Valencia and Subdelegations in the provinces of Alicante and Castellón de la Plana, based in its capitals. It shall cover the territory of the provinces concerned.

s) Delegation of Defense in Alava, based in the city of Vitoria and Subdelegations in the provinces of Guipuzcoa and Vizcaya, based in its capitals.

It will cover the territory of the provinces mentioned.

Fourth. Structure of the Defence Delegations.

1. The Defence Delegations shall be structured in general in accordance with the following composition:

(a) A Management Body whose holder shall be the Delegate.

b) A General Secretariat.

c) The functional areas deemed necessary, depending on the volume of activity to be carried out at each Delegation.

2. The structure, particularized, of each of the Defence Delegations shall be as detailed in the Annex which is inserted after this Order.

Fifth. Delegate.

1. A Delegate shall be present at the head of each Defense Delegation, whose appointment shall be the responsibility of the Minister of Defense, on the proposal of the Deputy Secretary of Defense, between General Officers or Officers in the situation of active or reserve service.

2. The Delegate is the head of the Defense Delegation and directly responsible for its good governance and functioning. It will have the functions assigned to it by Royal Decree 915/2002, of 6 September, with its exercise, in respect of the staff and facilities of the centres, services, units and dependencies organically integrated in the Delegation, to the Following subjects:

a) Security.

b) Organization.

(c) Interior Regime.

d) Discipline.

3. With regard to the non-integrated organizations that are located in the Delegation, the Defense Delegate will have the consideration of Chief of Base or the Office of the Armed Forces. As soon as they relate to the exercise of these functions, the holders of those bodies will be subordinate to the Defense Delegate.

4. The holders of the other centres or bodies, not without any incardinate in the structure of the Armies, which radiate within the territorial scope of the Delegation, shall be particularly obliged to provide all the cooperation necessary for the Defense to facilitate the surveillance and protection of the effective functioning of the military administration in the territorial area expressed.

5. The Delegate shall constitute the ordinary course of relations with the central organs of the Department, as well as, without prejudice to the powers conferred upon the Government's Delegates and Subdelegates, with the civil and military authorities of the the province within its demarcation and in terms of its competence.

6. With respect to support to the organs of the Military Jurisdiction and the General Intervention of the Defense, the Delegate will be responsible for managing the same in accordance with the provisions of article 4.2 of Royal Decree 915/2002, of September 6 and which, as far as the organs of military jurisdiction are concerned, will be specified in the following:

(a) To transfer, to the bodies which are organically dependent, with the human and material means of the Delegation, of the applications they carry out, in each of the following matters:

Indemnities for service reason.

Material.

Bibliography.

Management of vacancies.

Infrastructure (when they are not located at the headquarters of the Delegation).

And in general any other necessary for the life and functioning of such organs.

(b) Manage the indemnities to which the experts and witnesses are entitled to be heard by the military courts and tribunals, where those who do not belong to the military administration are alleged to be in charge of such compensation. shall be borne by the unit, centre or body in which they are destined or, failing that, of the Army to which they belong.

Sixth. Secretary-General.

1. In each of the delegations of defence there shall be a General Secretariat, except in those where, in the light of its activity, it is not judged necessary in determining its particular structure.

2. In addition to the tasks assigned to him by Royal Decree 915/2002, of 6 September, he will perform the functions of Manager of the areas of personnel, patrimony and prevention of occupational risks, except that the volume of work of the Delegation advises to appoint an exclusivity Manager for any of those areas.

3. The Secretary-General's appointment shall be the responsibility of the Deputy Secretary of Defense, on the proposal of the Technical Secretary General, between officers in active or reserve status.

Seventh. Managers of the functional areas.

1. In the Defense Delegations, they will be grouped by homogeneous sectors of activity, the functional areas that, according to the volume of activity that they have to perform, will be determined in the particular structure of each of them.

2. At the head of each functional area there will be a Manager, who will depend organically on the Defense Delegate.

3. The different functional areas existing in the Defence Delegations will develop the tasks that for each of them are established in this Order, under the immediate responsibility of the Area Manager and the functional dependency of the organs senior officials of the Department and of the public bodies assigned to them which are competent for the matter.

4. The functional areas may provide services to other delegations or sub-delegations, by resolution of the Deputy Secretary of Defense, on a proposal from the head of the higher body or director of the Department or the public body attached to it. That is functionally dependent.

5. The appointment of the Area Managers shall be the responsibility of the Deputy Secretary of Defense, on a proposal from the head of the upper body or director of the Department or the public body attached to it, of which it is functionally dependent, between Officers in active duty or reserve status.

6. In cases of vacancy, absence or disease of the Manager of a functional area, if the solution provided for in paragraph 4 above is not adopted, the corresponding Delegate or Subdelegate shall designate another manager of the Delegation as an alternate or Sub-delegation, subject to the authorization of the Secretary-General and with a favourable report from the higher or steering body of the Department or the public body attached to it, of those who are functionally dependent on the areas of the alternate and of the suple.

Eighth. Recruitment Area.

1. Under the functional dependency of the General Directorate of Military Recruitment and Teaching, it corresponds to the recruitment area of the Defence Delegations:

(a) Provide and disseminate information to the public on the various forms of access to military training and on the condition of a voluntary reserve.

b) Promote the recruitment of applicants for access to military training and a voluntary reserve.

(c) Meet the tasks that point to the Defence Delegations the provisions relating to the system of compulsory reservists.

d) Control and manage temporary and volunteer reservists.

(e) Those others entrusted to him by the Director General of Military Recruitment and Teaching in the field of obtaining resources of military personnel, specific regime of the military personnel of troops and marineria and for the return to the civilian life of the military personnel with a service relationship of a temporary nature.

2. It also corresponds to the recruitment area of those Delegations and Submissions of Defense to be determined to act as a Selection Center in the selection processes for skills/continuous selection for access to military education training and in the determination of the skills of the reservists or those who are to be determined.

3. In cases where no recruitment area has been established in the structure of the Defence Delegation, its functions shall be developed by the Secretary-General, who shall act under the functional dependency referred to.

Ninth. Personnel Area.

1. Under the functional dependency of the Directorate-General for Personnel, it corresponds to the personnel area of the Defence Delegations:

(a) The processing or instruction of the files, applications and, where appropriate, sheets of services of the military personnel in the administrative situations of special services, voluntary leave with loss of destination, suspense (i) employment and suspended duties where the cessation of the employment is carried out, and the reserve is not allocated to it, as well as to retired military personnel whose residence is located within its territorial scope.

(b) The management of staff who are on active duty, are to be assigned to their destination and their residence within the territorial scope of the Delegation, when they are entrusted by the bodies responsible for the management of the personnel in the Common Armies and Corps.

c) The processing, as soon as they exist, of the matters related to the useful mutilations.

(d) The exercise of the powers delegated to it or attributed to it in relation to all civil, official or labour personnel, who serve in units, centers or military agencies that radiate within their scope territorial.

e) The processing of applications for scholarships and other assistance, promoted by the Ministry of Defense.

f) And, in general, those other functions entrusted to him, related to the administration of personnel and to social action not linked to the logistical needs of the Armies.

2. In cases where no staff area has been established in the structure of the Delegation, the functions referred to in the preceding paragraph shall be developed by the General Secretariat, which shall act under the functional dependence of the Directorate-General. General of Personnel.

10th. Housing Area.

1. Under the functional dependence of the Management of the Institute for Housing of the Armed Forces, the housing areas will exercise, in their territorial demarcation, the functions entrusted to them or delegated by the Managing Director General of the referred to as autonomous body, in matters of support for the geographical mobility of the members of the Armed Forces and for the management, maintenance, conservation and disposal of buildings.

2. Likewise, they will be able to manage the funds, derived from the operations of the administrative or commercial budget of the Institute for Housing of the Armed Forces, which the Managing Director General of the aforementioned autonomous agency will make available in terms that you determine.

3. In the Defense Delegations in which a housing area is not established, the Secretary General will assume the functions that the Managing Director of the Institute for Housing of the Armed Forces expressly entrusts in this matter.

4. The legal assistance and the financial control of the different housing areas will be exercised, respectively, by the Legal Counsel and the Delegation of the Institute for Housing of the Armed Forces.

11th. Area of Heritage.

1. Under the functional dependency of the General Directorate of Infrastructure, it corresponds to the area of Heritage of the Defense Delegations:

(a) The control of the inventory, the payment of taxes and the registration of the property of the buildings affected to the Ministry of Defense and the public bodies attached to it.

b) The control, tracking, and, if any, report of the real estate leases.

c) The follow-up and, where appropriate, report of the cases of expropriation, cession, reversion and attachment of buildings affected to the Ministry of Defense and to the public bodies attached to it.

d) The follow-up and, where appropriate, report of the files to be followed on easements and limitations for reasons of interest to the National Defense, in accordance with the provisions of the legislation on the subject.

e) And, in general, the functions entrusted to him by the Director General of Infrastructure in matters of control, management and use of buildings, urban plans and forced expropriation.

2. In cases where no area of Heritage has been established in the structure of the Delegation, the functions referred to in the preceding paragraph shall be developed by the General Secretariat, which shall act under the functional dependence of the Directorate Infrastructure General.

12th. Infrastructure and Defense Equipment Area.

1. Under the functional dependency of the Management of Infrastructure and Defense Equipment, it corresponds to the area of Infrastructure and Equipment of Defense of the Defense Delegations to exercise the tasks entrusted to it by the Managing Director of the said autonomous body, in order to facilitate and expedite the management of it, within the functions of the acquisition, disposal and management of real estate and real rights, movable property, armaments and equipment and of the other Body in accordance with the rules of its Staff Regulations.

2. The legal assistance and the financial control of the different areas of Infrastructure and Equipment of Defense will be exercised, respectively, by the Legal Counsel and the Delegation of the Management of the Infrastructure and Defense Equipment.

13th. Area of Military Constructions.

1. Under the functional dependency of the Management of the Military Construction Service, it is up to the Military Building Area of the Defense Delegations to carry out the tasks entrusted to it by the Managing Director of that autonomous body, in the field of works management, means for the execution and exercise of the contracting authority, within the tasks of carrying out works which are the responsibility of the Service in accordance with its regulatory standards.

2. They may also manage the funds, arising from the operations of the administrative or commercial budget of the Management of the Military Building Service, which the Managing Director of the said autonomous body makes available to them. terms that you determine.

3. The legal assistance and the financial control and financial control of the different areas of Military Construction will be exercised, respectively, by the Legal Counsel and the Delegation of the Management of the Military Service of Buildings.

14th. Industrial Inspection Area. -Under the functional dependence of the General Directorate of Armament and Material, the Industrial Inspection Area of the Defense Delegations will exercise the tasks assigned to it by the Director General in the field of quality inspection and industrial safety, within the functions of technical and economic inspection of industrial activity related to goods and services for defense, of quality assurance of the armament and material of defence and compliance with the regulations on industrial safety and on the powers of the weapons and explosives regulations, which correspond to that Directorate-General in accordance with its regulatory standards.

15th. Area of Occupational Risk Prevention. -Under the functional dependency of the Directorate-General for Personnel, the Department of Defense Industrial Risk Prevention will exercise the tasks entrusted to it by the Director General of Staff for the implementation of preventive activities in the field of safety at work, hygiene at work, ergonomie-psychopathology and the monitoring of the health of workers, in units, centres and agencies dependent on Ministry of Defense assigned to you by the aforementioned Directorate General.

sixteenth. Area of Cria Caballar.

1. Under the functional dependency of the Fund for the Operation of the Cría Caballar and Creta Services, the area of Cria Caballar of the Defense Delegations, will exercise the tasks assigned to them by the Secretary General of the autonomous agency. the regulations in force attribute to the Fund of Exploitation of the Services of Cría Caballar and Traces, in the aspects related to the promotion of the equine animal husbandry and the management of the Genealogical Books of the pure equine races.

2. They will be able to manage the funds, which are derived from the operations of the administrative or commercial budget of the Fund for the Operation of the Cría Caballar and Traces, which the President of the autonomous agency will make available to him. in terms that you determine.

seventeenth. Legal Advice.

1. With functional dependence on the General Legal Counsel of the Defense and with comparable treatment to the functional areas, it corresponds to the Legal Advisory of the Defense Delegations:

a) To issue the legal reports that are requested by the Delegate and by the Managers of the different functional areas, aimed at ensuring the legality and the necessary coordination and unit of criteria.

b) To ensure, in the exercise of their advisory functions, by the general principles of performance and functioning of the Public Administrations.

2. The Legal Counsel shall perform its functions within the territorial scope of the corresponding Delegation of Defense, resulting also in the application of the provisions regarding the functional areas in paragraph 7. 4 of this Order.

3. The Heads or Directors of the units, centres or military agencies which radiate in the territorial area referred to in the preceding paragraph and who do not have their own Legal Adviser may request the delegate from which he is organically dependent. Legal Advisory the designation of a Military Legal Body Officer with a destination in the same, in order to form part of the Contracting Tables to be constituted for the award of contracts whose celebration corresponds to them and, in general, to provide them with the legal advice they need.

4. The appointment of the Legal Adviser shall be the responsibility of the Deputy Secretary of Defense on the proposal of the Technical Secretary General, among officers in active duty or reserve status.

Eighteenth. Structure of the Subdelegations.

1. The Defence Submissions shall be structured in general in accordance with the following composition:

a) Subdelegate.

b) Support Body.

c) Functional Areas.

2. In the structure of the Subdelegations, the functional areas referred to in this Order may be established, in accordance with the volume of activity to be performed, provided that all the provisions for the areas of the sub-delegations are applied. Delegations.

3. The structure, particularized, of each of the Subdelegations of Defense shall be as detailed in the Annex which is inserted after this Order.

Nineteenth. Subdelegates.

1. At the head of each Subdelegation of Defense there will be a Subdelegate, whose appointment will be the Assistant Secretary of Defense at the proposal of the Technical Secretary General, among officers in active or reserve service situation.

2. The Subdelegation is the Head of the Subdelegation and directly responsible for its good governance and operation and will exercise, in its field of competence, the same tasks that the Defense Delegate has in its demarcation.

3. Under the direction of the Subdelegation, it is for the Head of the support body to exercise over all the services, units and dependencies of the Subdelegation the functions related to the following subjects:

a) The management of personnel.

b) The economic-financial administration.

c) The inner regime.

d) The administrative information, the file, and the general log.

e) Common and ancillary services.

4. At the front of each functional area there will be a Manager, which will depend organically on the Subdelegation of Defense, resulting in everything else of application the provisions for the Managers of areas of the delegations.

Twenty. Delegated Offices.

1. The Delegated Offices shall be responsible for managing, within their territorial scope of action, the matters entrusted to it by the other bodies of the Delegation or the corresponding Subdelegation of Defence and to deal with any documents are received from or addressed to them.

2. The appointment of the head of the Delegated Offices shall be the responsibility of the Deputy Secretary of Defense on the proposal of the Technical Secretary General, among officers in active or reserve service.

3. The Delegated Offices shall have a general structure as follows:

a) Chief.

b) Support Body.

c) Functional Areas.

4. In the structure of the Delegated Offices, the functional areas referred to in this Order may be established, in accordance with the volume of activity to be carried out, in accordance with all the provisions of the provisions of this Order. Delegations.

5. At the front of each functional area there will be a Manager, who will depend organically on the Head of the Delegate Office, resulting in everything else of application the provisions for the Managers of areas of the Delegations.

6. The structure, particularized, of each of the Delegated Offices shall be as detailed in the Annex which is inserted after this Order.

Single additional disposition. Heritage of the Institute for Housing of the Armed Forces. -As set out in the 11th section. Area of Heritage, of this Ministerial Order, will not be applicable to the buildings that are part of the patrimony of the Institute for Housing of the Armed Forces or are under his administration, which will be governed by the law established in the Law 26/1999, of 9 July, of measures to support the geographical mobility of the members of the Armed Forces and provisions for development.

Single transient arrangement. Reserve of the military service. -Corresponding to the area of recruitment of the Defense Delegations the management of those who are in the reserve of the military service, as long as they remain in the same according to the Transitional Provision Twentieth of Law 17/1999, of 18 May, of the Staff Regulations of the Armed Forces.

Single repeal provision. Regulatory repeal-The following provisions are repealed:

(a) Order 44/1994, of 9 May, for the implementation of the Defense Delegations in Cantabria, Cuenca, Jaén, Lugo, Orense, Palencia, Teruel and Zamora.

(b) Order 72/1994 of 5 July 1994 establishing the Defence Delegations in Albacete, Ávila, Huelva and Soria.

c) Order 94/1994, dated 6 October, implementing the Defence Delegations in Alicante, Cádiz, Girona, Granada and Guadalajara.

(d) Order 118/1994 of 7 December, implementing the Defence Delegations in Asturias, Badajoz, Baleares, Barcelona and Seville.

e) Order 18/1995, of January 30, for which the Delegation of Defense is established in Navarre.

f) Order 75/1995, of 18 May, for which the Defense Delegations are implanted in Alava, Ciudad Real, Huesca, Las Palmas, Pontevedra, Segovia and Tarragona.

(g) Order 111/1995 of 25 July, implementing the Defence Delegations in Burgos, León, Murcia, Toledo, Vizcaya and Zaragoza.

(h) Order 134/1995, of 18 October, implementing the Defence Delegations in Almeria and Malaga.

(i) Order 154/1995 of 1 December 1995 implementing the Defence Delegations in Castellón, Guipúzcoa, Lleida, Salamanca, Santa Cruz de Tenerife and Valladolid.

j) Order 14/1996, of 23 January, for which the Delegation of Defence in Cordoba is implanted.

(k) Order 39/1996 of 29 February, implementing the Defence Delegations in Cáceres, La Coruña, La Rioja, Madrid and Valencia.

(l) Order 18/1997 of 5 February, amending in part Order 39/1996 of 29 February for the implementation of the Defence Delegations in Cáceres, La Coruña, La Rioja, Madrid and Valencia.

m) Order 54/1996, of 29 February, on the peripheral structure of the defence in the cities of Ceuta and Melilla.

And how many provisions of equal or lower rank in what are opposed to what is set forth in this Order.

Final disposition first. Staff template.

1. Before 30 December 2003, the Deputy Secretary of Defense will approve the organic and destination templates of the different delegations and subdelegations of defense and their delegated offices.

2. For the definition of the establishment plan of each of the Delegations and Submissions of Defense and their Delegated Offices, the criteria of the economy of the media, the unification of common services and the adequacy of the structure and volume of activity for each of them.

3. This template will not increase the allocation of military and civilian personnel to existing stocks in all the agencies that are integrated in the new template, nor will their approval increase public expenditure.

Final disposition second. Staff affected by the reorganisation.

1. The Assistant Secretary of Defense will make the necessary organic adaptations, so that the same administrative and remuneration conditions that currently have in their home units will be maintained for all affected personnel, with the denominations of the new structure established by this Order.

2. The civil servants and employees affected by this Ministerial Order will apply the provisions in force in case of restructuring of centres and establishments.

Final disposition third. Compensation of expenses. -The centers, services, units and dependencies of the Autonomous Bodies that after the organic integration, are physically installed in dependencies of the Delegations, Subdelegations of Defense or their Offices Delegate, satisfy the share of current expenditure on goods and services which are imputable to them, on the basis of the facilities they occupy.

Final disposition fourth. Faculty of Development.-The Assistant Secretary of Defense is empowered to dictate how many instructions he deems necessary for the development and execution of this Order, which in no case may increase public expenditure and which must be fully implemented before 31 December 2003.

Final disposition fifth. Entry into force. This Order shall enter into force on the day following that of its publication in the Official Gazette of the State.

TRILLO-FIGUEROA AND MARTINEZ-CONDE

ANNEX

First. Delegation of Defence in Seville.

1. The delegation of Defence in Seville, based in Seville, and Subdelegations of Defence in the provinces of Almeria, Cadiz, Cordoba, Granada, Huelva, Jaén and Malaga, based in the respective capitals, will cover the territory of the the provinces mentioned and will be structured in the following bodies:

(a) Governing Body whose holder shall be the Delegate.

b) General Secretariat.

c) Legal Advice.

d) Recruitment Area.

e) Housing Area.

f) Cría Caballar area.

g) Infrastructure and Defense Equipment Area.

h) Military Building Area.

i) Industrial Inspection Area.

2. The following services, units and units based in the capital of Seville will be integrated into the Defence Delegation in Seville:

a) In the Recruitment Area, the Recruitment Centre of the Defence Delegation in Seville.

b) In the Housing Area, the Delegation of the Institute for Housing of the Armed Forces of Seville.

c) In the area of Cria Caballar, the Delegation of Cria Caballar in Andalusia.
