Organic Law 8/1985 of 3 July, which regulates the law of education, empowers the government in Article 14 to regulate the minimum requirements necessary for the provision of teaching with a guarantee of quality.

Likewise, the aforementioned organic law conditions the opening and operation of private educational institutions to the prior administrative authorization granted once the minimum requirements have been met, which, according to Article 14 of the The law is regulated by the Government.

Royal Decree 1004/1991, of 14 June 1991, complied with the legal mandate by laying down the minimum requirements necessary for the provision of the general rules of procedure laid down in Law 1/1990 of 3 October General of the Educational System.

The promulgation of the Organic Law 10/2002, of 23 December, of Quality of Education, and in particular the principles of quality of the educational system collected in it, makes it necessary a review of the established requirements In this royal decree and its adaptation to the modifications introduced in the new ordination of the educational system.

This provision aims at the establishment of the above minimum requirements which ensure the quality of the teaching of general arrangements and allow the flexibility necessary to adapt the structure and the organisation of the centres to social needs.

In the elaboration of this royal decree, the autonomous communities and the General Council of Professional Training have been consulted, and the School Council of the State has issued a report.

In its virtue, on the proposal of the Minister of Education, Culture and Sport, with the prior approval of the Minister of Public Administrations, in agreement with the Council of State and after deliberation of the Council of Ministers in its Meeting of 5 December 2003,

D I S P O N G O:

CHAPTER I

General character provisions

Article 1. Minimum requirements for schools providing general school teaching.

The teaching centres which provide school teaching of general status must meet the minimum requirements for academic qualification of teachers, number of student-teachers, teaching and sports facilities, and number of School posts which are set out in this royal decree.

Article 2. Authorization to open and operate private educational institutions.

1. The authorisation of the opening and operation of private educational establishments shall be granted subject to compliance with the requirements laid down in this royal decree.

2. In no case shall the number of units in operation in the various centres exceed the number of units authorised by each unit.

3. Failure to comply with the minimum requirements by a private educational establishment shall determine, subject to the instruction of the relevant file, which shall ensure the hearing of the centre holder and the granting of a time limit for the remedy of deficiencies; and by means of a reasoned decision, the withdrawal of the authorisation to open and operate the authorisation.

Article 3. Generic name of the centres.

1. The generic name of the public institutions will be the children's school, primary school and secondary education institute, according to the education, primary education or compulsory secondary education, respectively. Baccalaureate and/or Vocational Training

The generic name of the private centers will be the center of children's education, center of primary education and center of secondary education, according to them, respectively, Child Education, Primary Education or Secondary Education Compulsory, Baccalaureate and/or Vocational Training. Vocational training centres may be called vocational training centres for those centres which exclusively provide vocational training courses of medium or higher grade.

3. The teaching centres which provide two or more educational levels of those referred to in Article 7 of Law 10/2002 of 23 December, of Quality of Education, will have the generic name corresponding to the above mentioned levels. the previous paragraphs of this Article.

Article 4. Conditions of habitability and safety of the centres.

The teaching centers must meet the hygienic, acoustic, habitability and safety conditions that are stated in the legislation in force, in addition to the requirements set forth in this royal decree. The spaces in which the teaching practice will be developed will have to have ventilation and natural lighting.

Article 5. Architectural conditions of the centres.

The teaching centers must have architectural conditions that allow access, circulation and communication of students with physical, mobility or communication problems, in accordance with the provisions of the legislation applicable to the promotion of accessibility and removal of barriers.

Article 6. Technical regulations.

The competent educational authorities may lay down the technical regulations necessary to specify the architectural conditions of the centres.

Article 7. Number of school posts.

For the purposes of this royal decree, the number of school posts will be understood as the number of pupils a centre can attend simultaneously, in order to ensure that the conditions of quality required for the imparting of the teaching.

CHAPTER II

From the teaching centers that provide Children's Education

Article 8. Units of the centers that provide Children's Education.

Teaching centres that provide Child Education must have a minimum of three units, without prejudice to the provisions of the third provision.

Article 9. Facilities and material conditions of the centers that provide Children's Education.

1. Educational institutions that provide Child Education must be located in exclusively educational use, with independent access from the outside and at least the following facilities and material conditions:

a) A classroom for each unit with a surface of two square meters per school position, and which will have at least 30 square meters.

b) A playground, for the exclusive use of the centre, with a surface which, in no case, may be less than 150 square metres. In the event that the centre has a number of units exceeding six, the area of the playground will be increased by 50 square metres per unit.

c) A toilet per classroom, which will have the appropriate facilities depending on the number of students.

d) A multi-purpose room of 30 square meters.

e) Asean for the staff, separated from the units and the services of the children.

f) A management office, a secretary, and a faculty room for centers with six or more units.

2. In schools located in the same building or school grounds, the playground of primary education centres covers the requirement of the playground for Child Education, provided that it is guaranteed for pupils at this level of education. use of such an independent time dependency.

Article 10. Number of pupils in the centres that provide Children's Education.

1. The teaching centres that provide Children's Education will have at most 25 students per school unit.

2. The number of school posts in the educational establishments providing for the Education of Children shall be set out in the relevant provisions authorising their opening and operation, taking into account the maximum number of pupils per school unit which is established in the previous paragraph, and the facilities and material conditions established in this royal decree.

3. The educational administrations will determine the maximum number of students for the units that integrate students with specific educational needs that will have the necessary and adequate resources for the attention of this type of students.

Article 11. Teachers of the centers that provide Children's Education.

Children's Education will be taught by teachers with the corresponding specialty. The teaching centres that provide Children's Education must have at least one teacher in the Child Education specialist or a teacher of Basic General Education, specialist in pre-school, for each unit.

CHAPTER III

From teaching centers that deliver Primary Education

Article 12. Units of the centres that provide Primary Education.

Primary Education teaching centres shall have at least one unit for each course, except as provided for in the third provision.

Article 13. Facilities and material conditions of the centres providing Primary Education.

1. Teaching centres which provide Primary Education must be located in separate areas, intended exclusively for school use, and must have at least the following facilities and material conditions:

a) A classroom per unit, whose surface area will be 1.5 square meters per school position. In no case will they have less than 30 square meters.

b) Two spaces of 20 square meters per six units for the doubling of groups and activities of support and pedagogical reinforcement.

c) A 100-square-meter multi-purpose use room, which can be shared with movable partitions, in order to be used for the teachings of Music and for tutoring or other activities.

d) A playground of at least three square metres per school place and at least a surface of 44 per 22 metres, which can be used as a polideportive track.

e) A library of at least 45 square metres, which will contribute to the achievement of the centre's curricular objectives and which has sufficient bibliographic and equipment funds to speed up its management and the promotion of reading in students.

f) A covered space for Physical Education and Psychoptricity, which will have a surface area of 200 square meters. This room will include spaces for changing rooms, showers and warehouse.

g) Toilet toilets and sanitary-sanitary services in number appropriate to the capacity of the centre, both for pupils and for teachers.

h) A management office, a secretary and a teacher room of adequate size to the number of authorized school positions.

(i) suitable spaces for meetings of pupils ' associations and parents of pupils, in the case of centres supported by public funds.

j) A 40-square-meter computer science classroom, which favors teaching and learning through information and communication technologies.

2. Teachers who provide primary education will be able to use the multi-purpose use room for computer science, not to have free space for this activity.

3. In schools authorized to provide Primary Education and Compulsory Secondary Education, located in the same school building or building, the compulsory secondary education computer system covers the requirements of the computer science classroom. Article 14. Number of pupils in the centres providing Primary Education.

1. Teachers who provide primary education will have at most 25 pupils per school unit.

2. The number of school posts in the teaching centres to be provided by Primary Education shall be set out in the relevant provisions authorising their opening and operation, taking into account the maximum number of pupils per school unit which is established in the previous section and the material facilities and conditions established in this royal decree.

3. The educational administrations will determine the maximum number of students for the units that integrate students with specific educational needs that will have the necessary and adequate resources for the attention of this type of students.

Article 15. Teachers of the schools that provide Primary Education.

1. Primary Education will be taught by teachers.

2. The teaching centers that provide Primary Education will have at least one teacher for each group of students, and will guarantee, in any case, the existence of the specialist teachers provided for in Article 19 of the Organic Law 10/2002, 23 December, Quality of Education.

CHAPTER IV

Of the teaching centers that provide High Education and Baccalaureate Education

Article 16. Units of the centers that provide Secondary Education Mandatory and Baccalaureate.

1. The teaching centres which provide compulsory secondary education must have at least one unit for each course of the stage.

2. The teaching centers that provide the Baccalaureate will offer, at least, two modalities of those provided for in Article 35.3 of the Organic Law 10/2002, of 23 December, of Quality of Education, and will have at least four units.

Article 17. Facilities and material conditions of the centres providing compulsory secondary education.

1. The teaching centres which provide compulsory secondary education shall be located in separate buildings, intended exclusively for school use and shall have at least the following facilities and material conditions:

(a) A classroom per unit with a surface area of 1.5 square metres per school post which, in no case, will have less than 40 square metres.

b) A workshop room of 100 square meters for every 20 units or fraction.

c) Three classrooms of 45 square meters each, for Music, Computer and Plastic activities for every 20 units or fraction.

d) A laboratory of Experimental Sciences of 60 square meters for every 20 units or fraction that responds to the new needs of the itineraries established in the Organic Law 10/2002, of December 23, of Quality of the Education.

e) A playground of at least three square metres per school place and at least a surface area of 44 per 22 metres, which can be used as a polideportive track.

f) A library of 60 square metres, which contributes to the achievement of the centre's curricular objectives and which has sufficient bibliographic and computer equipment to speed up its management and the promotion of reading in the students.

g) A gym with a surface of 480 square meters and which will include changing rooms, showers and warehouse.

h) Toilet and sanitary services in number adequate to the capacity of the center, both for students and teachers.

i) A management office, a secretary and a teacher room of adequate size to the number of authorized school positions.

j) Appropriate offices for meetings of students ' associations and parents of students, in the case of centres supported by public funds.

2. In the centres with 12 primary education units and eight compulsory secondary education units, located in the same building or school, the classroom and the classrooms of Music, Plastics and Computer of Secondary Education cover the requirement of the multi-purpose or multi-purpose classroom of Primary Education.

Article 18. Facilities of the centres that provide Baccalaureate.

1. Teaching centres which provide Baccalaureate shall be located in separate buildings, intended exclusively for school use and shall have at least the following facilities:

(a) A classroom per unit with an area of 1.5 square meters per school position, which will have at least 30 square meters.

b) A computer room of 60 square meters per 12 units or fraction.

c) A gym with a surface area of 480 square meters, which will include changing rooms, showers and warehouse.

d) A library of 75 square metres, which contributes to the achievement of the centre's curriculum objectives and which has sufficient bibliographic funds and equipment to speed up its management and the promotion of reading in the students.

e) Toilet and sanitary services in number appropriate to the capacity of the center, both for students and teachers.

f) A playground of at least three square metres per school place and at least a surface area of 44 per 22 metres, which can be used as a polideportive track.

g) A management office, a secretary and a teacher room of adequate size to the number of authorized school positions.

(h) suitable spaces for meetings of pupils ' associations and parents of pupils in the case of centres with public funds.

2. Depending on the modalities of the Baccalaureate, the centres must also have the following facilities:

(a) For the mode of Arts: two different classrooms of 90 square meters each, equipped with the necessary means, including the computer, and the appropriate facilities to the options provided for this modality.

b) For Science and Technology mode:

1. Three distinct laboratories of Physics, Chemistry and Biology and Geology, with an area of 60 square meters each, with the necessary conditions of safety and equipment, including the computer.

2. A 90-square-meter drawing room that allows the information technologies applied to the design to be available.

3. A 120-square-meter classroom with sufficient means to enable students to use information and communication technologies.

c) For the mode of Humanities and Social Sciences: a classroom of 120 square meters for the practice of different subjects. However, if the centre had a classroom for information and communication technologies, the corresponding space would be used for one and another effect.

Article 19. Teaching centers that teach different teachings in the same building or school grounds.

1. In the case of educational establishments providing Primary Education and Compulsory Secondary Education located in the same building or school premises, the following common facilities shall be considered:

a) The library, which in this case will not be less than 90 square meters.

b) The gym, with a surface area of 480 square meters.

c) The playground.

d) The management offices, the secretariat and the teachers ' room.

2. In the case of educational establishments providing compulsory secondary education and secondary education, the centres shall meet the conditions specified in Articles 17 and 18, with the following provisos:

(a) The gym, the library, the computer room, the playground, the secretariat, the offices and the teachers ' room will be considered common facilities.

b) The laboratories for Baccalaureate cover the requirement of the Experimental Science laboratory for compulsory secondary education.

3. In the case of teaching centres which provide compulsory secondary education or secondary education and vocational training, common facilities are considered to be used for similar purposes depending on the length of time used, intended for each of the teachings.

Article 20. Number of pupils in the centres providing compulsory secondary education and Baccalaureate.

1. The teaching centres which provide compulsory secondary education and Baccalaureate will have a maximum of 30 and 35 pupils per school unit respectively.

2. The number of school posts in the educational establishments providing compulsory secondary education and secondary education shall be laid down in the relevant provisions authorising the opening and operation of those institutions, taking into account the (a) Articles 17 and 18 and the maximum number of pupils per school unit as laid down in the previous paragraph.

3. The educational administrations will determine the maximum number of students for the units that integrate students with specific educational needs that will have the necessary and adequate resources for the attention of this type of students.

Article 21. Requirements for teaching teaching in compulsory secondary education and Baccalaureate.

1. In order to teach in compulsory secondary education and in the Baccalaureate, they will be essential requirements:

a) Be in possession of the title of Doctor, Licensed, Engineer or Architect, or of title declared equivalent to those for the purposes of teaching.

(b) In those subjects to be determined, by virtue of their special relationship with vocational training, the equivalences, for the purposes of the teaching function, of titles of Technical Engineer, Technical Architect or University diploma.

c) To be in possession of the professional title of didactic specialization referred to in Article 58 of the Organic Law 10/2002, of 23 December, of Quality of Education, or equivalent.

2. Teachers of compulsory secondary education and secondary education shall also be required to establish a specific qualification for the respective subjects. For these purposes, the Ministry of Education, Culture and Sport, after consultation with the Autonomous Communities, will determine the agreement of the degrees with the different subjects.

Article 22. Minimum number of teachers in the compulsory secondary education and secondary schools.

The minimum number of teachers in the compulsory secondary and secondary education centres will be the one needed to cover the timetable set out in the various programmes and curricula.

Article 23. Requirements for the provision of professional initiation programmes.

1. Professional initiation programmes shall be provided in the secondary education establishments which the educational authorities determine, in the light of the characteristics, needs and interests of their recipients, of the conditions of the cultural, social and labour environment and organisational factors.

2. For the purpose of bringing together the requirements to be laid down for the provision of the relevant professional modules, at least to a qualification in the national catalogue of professional qualifications, public administrations promote the participation of other institutions and entities.

3. For the delivery of the professional modules integrated in the programmes of professional initiation, it will be possible to hire as specialist teachers to qualified professionals who develop their activity in the field of work, attending to their qualification and the needs of the system. In the case of public institutions, the educational authorities may establish temporary and administrative contracts with these professionals. These teachers will not be required to be in possession of the title established in Article 58 of the Organic Law 10/2002, of December 23, of Quality of Education.

4. In addition, other professionals with appropriate qualifications may be able to provide support to students with specific educational needs.

Article 24. Requirements for educational institutions to offer educational projects that strengthen or extend certain aspects of the curriculum.

The educational institutions that offer educational projects that reinforce or expand certain aspects of the curriculum related to the linguistic, humanistic, scientific, technological, artistic, sports and technologies of the the information and communications must meet the requirements set by the educational administrations, without prejudice to the fulfilment of the minimum requirements laid down in this royal decree.

CHAPTER V

Of the teaching centers that provide Vocational Training

Article 25. Centres providing vocational training.

Middle-grade and upper-grade vocational training may be taught at:

(a) Teaching centres in which compulsory secondary education or Baccalaureate is provided. In this case, the vocational training courses will be organised independently of the other lessons, although they will be able to have common human and material resources.

b) Teaching centres dedicated exclusively to providing vocational training.

Article 26. Spaces and facilities of the centres providing vocational training.

1. The minimum requirements for training spaces for the delivery of vocational training courses will be those laid down in Article 4 of this royal decree and in Articles 19 and 20 of Royal Decree 777/1998 of 30 April 1998. certain aspects of the organisation of vocational training in the field of education are developed, in the real decrees governing the securities not covered by Royal Decree 777/1998 of 30 April 1998 and other legislation specifies that, to this end, the Government establishes.

Article 27. Number of pupils in the centres providing vocational training.

1. Teachers who provide vocational training will have at most 30 pupils per school unit.

2. The number of school posts in the educational establishments providing vocational training shall be set out in the relevant provisions authorising their opening and operation, taking into account the material facilities and conditions. corresponding.

Article 28. Requirements for teaching in vocational training.

1. In order to teach in mid-and higher-grade vocational training, it will be essential requirements:

a) Be in possession of the title of Doctor, Licensed, Engineer or Architect or of title declared equivalent to those for the purposes of teaching. The Government may establish for certain areas or areas the equivalence, for the purposes of teaching, of other qualifications, provided that they guarantee the appropriate knowledge.

b) To be in possession of the professional title of didactic specialization referred to in Article 58 of the Organic Law 10/2002, of 23 December, of Quality of Education, or equivalent.

2. For certain modules, the competent educational authorities may authorise their delivery by qualified professionals who carry out their activities in the field of work, taking into account their qualifications and the needs of the system.

Article 29. Minimum number of teachers in the centres providing vocational training.

1. The minimum number of teachers in the centres providing vocational training will be the number needed to cover the timetable set out in the various programmes and curricula.

2. The educational administrations will determine the maximum number of students for the units that integrate students with specific educational needs, which will have the necessary and appropriate resources for the attention of this type of students.

Additional disposition first. Centers that teach adult learning.

1. The educational institutions created or authorized under this royal decree may be authorized to teach the corresponding teaching to adult persons, in accordance with the programs that the effect will be established, if not It is a matter of course for the lessons learned by the pupils in the school, especially in terms of their schedule.

2. Regardless of the above, there may be specific Adult Education Centres, which will be governed by existing legislation.

Additional provision second. Special Education Centres.

The competent educational administrations will adapt the provisions of this royal decree to the centers of special education referred to in article 45 of Law 10/2002, of 23 December, of Quality of Education.

Additional provision third. Centres that cater to special populations.

1. Educational institutions providing educational or primary education to the population of special socio-demographic or school characteristics are exempted from the requirements laid down in Articles 8 and 12 as regards the number of units to be counted by the centres.

2. In accordance with the above paragraph, institutions may be set up or authorised to deliver Child or Primary Education with an appropriate number of units

to the population that should be cured these educational levels, taking into account the provisions on maximum teacher/pupil ratio per school unit. These units will be able to group students from different levels, or from different courses of the same level.

3. In the cases referred to in this provision, support teachers or specialist teachers may attend several centres.

4. For the purposes provided for in this provision, the competent educational authorities shall adapt the requirements laid down in Chapters II and III to the special characteristics and dimensions of these centres.

Additional provision fourth. Teaching centres recognised by international agreements.

The Ministry of Education, Culture and Sport will be able to adapt the provisions of this royal decree to schools whose specific character is recognized by international agreements of a bilateral nature.

Additional provision fifth. Centers located in buildings of historical-artistic interest.

In the case of approved educational institutions, located in buildings considered to be of historical-artistic interest or located in historic helmets, educational administrations will be able to make the demand more flexible. requirements laid down in Articles 13, 17 and 18, in particular as regards the gym, and may use such facilities located elsewhere, provided that the hygiene conditions are in any case ensured, (a) the quality of the information and the quality of the information provided for in Article 4; the educational services they provide.

First transient disposition. Applications for authorisation from new centres.

1. Applications for authorization of new centers submitted after the entry into force of this royal decree, or which are in the process at that time, must refer to the teachings established by the Organic Law 10/2002, December 23, Quality of Education.

2. In the application, in addition to the authorization for the above mentioned teachings, authorization may be requested to impart, provisionally, those teachings of the system established by Law 1/1990 of 3 October of General System Educational, which would not have been extinguished according to Royal Decree 827/2003 of 27 June, establishing the timetable for the implementation of the new management of the education system.

3. The centre must meet the minimum requirements laid down in this royal decree.

Second transient disposition. Children's education centers authorized as incomplete.

1. Educational institutions of Child Education with definitive authorization for one or two units, with the exception of Child Education centres approved as incomplete for attending to populations of special socio-demographic characteristics or They will have to complete the minimum of three units consisting of Early Childhood Education prior to the beginning of the 2004/2005 course.

2. From the beginning of the 2004/2005 year, the centres referred to in the previous paragraph which have not obtained the required authorisation shall no longer have the status of centres authorised to teach the teaching of Child Education. Law 10/2002, of 23 December, of Quality of Education.

Single repeal provision. Regulatory repeal.

1. The entry into force of this royal decree will be repealed by Royal Decree 1004/1991 of 14 June, establishing the minimum requirements of the centres which provide non-university general regime teaching.

2. As many provisions of equal or lower rank are repealed, they oppose the provisions of this royal decree.

Final disposition first. Competence title.

This royal decree, which is issued under the provisions of Article 149.1.1.a and 30.a of the Constitution and in Article 14 of Law 8/1985, of July 3, which regulates the law of education, is of a basic standard.

Final disposition second. Development enablement.

It is for the Minister of Education, Culture and Sport and the competent bodies of the Autonomous Communities, within the scope of their respective competences, to dictate how many provisions are necessary for development and implementation. of the provisions of this royal decree.

Final disposition third. Entry into force.

This royal decree will enter into force on the day following its publication in the "Official State Gazette".
