Royal Decree 2611/1996 of 20 December 1996 on the control of national programmes for the eradication of animal diseases establishes the movement of bovine, ovine and caprine animals, depending on the outcome of the implementation of those programmes. In order to clarify certain aspects of this system of movements, it is necessary to specify the criteria for the health status of pre-bait and bait holdings, providing for certain transitional arrangements for these same purposes.

In the elaboration of this royal decree, the autonomous communities and the sectors affected have been consulted.

In its virtue, on the proposal of the Minister of Agriculture, Fisheries and Food and, as a substitute for it and in accordance with Royal Decree 45/2004, of 12 January, for which the Minister of Public Administrations is available Replace the Minister of Agriculture, Fisheries and Food in the elevation to the Council of Ministers of the draft Royal Decree amending Royal Decree 2611/1996 of 20 December 1996 regulating the national programmes of eradication of animal diseases, in agreement with the Council of State and prior deliberation of the Council of Ministers at its meeting on 16 January 2004,

D I S P O N G O:

Single item. Amendment of Royal Decree 2611/1996 of 20 December on the regulation of national programmes for the eradication of animal diseases.

Royal Decree 2611/1996 of 20 December 1996 on the national programmes for the eradication of animal diseases is amended as follows:

One. Article 3 (G), (H) and (I) shall be worded as follows:

" G) Operation of bait or bait: that which is dedicated to the fattening of bovine animals, or of the ovine and/or caprine species, with direct and exclusive subsequent destination to the slaughterhouse. Animals of the bovine species shall not be mixed with ovine and/or caprine animals on the same premises of the same baiting. Those with officially free bovine brucellosis-free status, officially free of bovine tuberculosis and officially free of enzootic bovine leucosis, or in the case of ovine and caprine species, shall be the qualifying baits. status of officially brucellosis-free status. However, animals coming from a qualified bait may transit through other baiting or concentration centres, provided that they are qualified, before being slaughtered in the slaughterhouse. The rating of the baiting shall be governed by the provisions of Annex 6.

h) "prebait" exploitation means that which is only available to bovine, ovine or caprine animals of age up to eight months, and the subsequent direct destination of which may be other than other holdings of pre-bait or concentration centres, provided that they are qualified, or directly the slaughterhouse or a bait.

Those of bovine animals with a status officially free of bovine brucellosis, officially free of bovine tuberculosis and officially free of enzootic bovine leucosis, or of bovine, or of bovine animals, shall be ovine or caprine animals free or officially free of brucellosis, as provided for in Annex 6.

Animals of the bovine species with ovine and/or caprine animals may not be mixed in the same premises on the same prebait holding.

(i) Bovine Breeding: that which has breeding females, intended for the production of milk or calves to be sold at weaning, or to be primed. They shall be supplied only from breeding or breeding holdings of heifers. Breeding holdings may have the following guidelines:

(a) Exploitation for milk production: the production and, where appropriate, the marketing of milk or milk products, and in which the cows are subjected to milking for that purpose.

(b) Exploitation for the production of meat: the production of calves intended for the production of meat, so that cows are not subjected to milking for the purpose of marketing milk or products dairy.

c) Mixed exploitation: the one that brings together several productive orientations. "

Two. Article 17 (4) is worded as follows:

" 4. Where, at the request of a party, control tests are carried out on animals from pre-bait holdings or slaughter animals, and as a result of which animals are diagnosed with unfavourable results, their The Commission will not be compensated for this. "

Three. Article 42 (4) is worded as follows:

" 4. The competent bodies of the autonomous communities shall take the necessary measures to ensure that only the following direct movements of animals to or from the holding of prebait or bait are carried out:

(a) Animals from holdings of type M4 may be used for any holding of prebait or baiting, and for holdings of type M3 or type M2 negative only for pre-bait or fishing operations. qualified.

(b) From non-qualified pre-bait holdings, animals may be moved only to non-qualified baiting, and from the qualified, to any qualifying pre-bait holding or to baiting. '

Four. The third transitional provision is worded as follows:

" Transitional provision third. Movement of cattle from the national territory.

Six. A new Annex 6, which is annexed to this royal decree, is added.

Single end disposition. Entry into force.

This royal decree will enter into force on the day following its publication in the "Official State Gazette".

" ANNEX 6 Health rating of pre-bait and bait holdings All tests shall be carried out at the request of the holder of the pre-bait or bait holding, running the cost of the holding.

The procurement, maintenance, suspension, recovery or withdrawal of the status for the exploitation of qualified prebait or baiting shall be governed by the provisions of paragraphs I and II of Annex I to Royal Decree 1716/2000 of 13 October. for cattle, and in Chapter I or Chapter II of Annex A to Royal Decree 2121/1993 of 3 December 1993 for sheep or goats, with the following specialties:

(a) For the purpose of obtaining the title, in cattle, the holding shall be composed exclusively of animals from herds officially free of tuberculosis, officially free of brucellosis and officially free of enzootic bovine leucosis, and that after its composition the tests provided for in Annex I to Royal Decree 1716/2000 of 13 October, with a favourable result, have been carried out.

(b) For the maintenance of the title, the tests carried out for obtaining the title shall be valid for one year for the purpose of carrying out the annual tests required under the national eradication programmes. of tuberculosis and bovine brucellosis, or of ovine and caprine brucellosis, which are carried out in the corresponding autonomous community.
