Article 3.1 of Law 41/1995, of 22 December, of local television by terrestrial waves, states that the Government is responsible for the approval of the national technical plan of local digital television in view of the requests submitted by the autonomous communities, taking into account the available frequencies. A frequency is available when, used in a radio station with specific characteristics, it is radioelectrically compatible with other legally established stations, i.e. it does not cause interference on other stations or receive interference from them.

The transitional provision second to the law of the aforementioned law granted a period of time, which ended on 31 March 2003, for the competent bodies of the autonomous communities to submit their requests for local digital television. The applications submitted by the Autonomous Communities raise the coverage of the entire population in each of their respective regional territorial areas.

Moreover, the national technical plan for terrestrial digital television, approved by Royal Decree 2169/1998 of 9 October 1998, in accordance with the additional 44th of Law 66/1997 of 30 December 1997, tax, administrative and social order measures, determined the frequency bands for terrestrial digital television and, in particular, local coverage transmitters.

These frequency bands, attributed internationally to the television service, are widely used in Spain by television stations with analogue technology, and this circumstance will be maintained until the end of the year. of its emissions, initially planned for before 1 January 2012.

Therefore, at present, the frequencies available to meet the requests of the autonomous communities are scarce, both because of the high total number of the demarcations requested and, in general, for their wide range geographical spread which, at times, present such irregular terrain and contain such scattered locations that it is not possible to determine a multiple, radioelectrically compatible channel, which ensures the coverage of all of them.

To the extent that spectrum capacity allows, the national technical plan of local digital television establishes multiple channels to obtain coverage of provincial and regional capitals and municipalities. with a population of more than 100,000 inhabitants. However, in practice, the putting into service of some of these multiple channels will require the prior modification of the analogue television station broadcast channels. At present, it is difficult to determine the analogue television stations which will be affected because it depends on the actual sites where the local digital television stations are located and their technical characteristics. projected radiation, so its identification will be made when these variables are known from the technical projects of the facilities.

Additionally, the plan also includes coverage of municipalities with a population of less than 100,000 inhabitants when it has been possible to determine available frequencies or a next frequency availability is foreseen. Although the needs of local coverage raised by the autonomous communities exceed the capacity of the radio spectrum available in the frequency bands attributed internationally to the service of television, due to its current use by analogue television stations, it has been sought to satisfy, to the greatest extent possible, the objectives of local coverage taking into account the orography of the land and considering the peculiar characteristics of this technology, which allows to group relatively close localities for be covered with the same multiple channel. Unmet needs can be reconsidered when the cessation of television broadcasts with analogue technology occurs.

In some demarcations, to obtain complete coverage of the entire service zone, the installation of more than one station in the same multiple channel will be necessary, constituting a single frequency network.

In this sense, it should be recalled that, in accordance with Article 3.2 of Law 41/1995 of 22 December, each multiple channel will have the capacity to broadcast at least four digital television programmes, including data associated with each program. The number of television programs in each multiple channel is a function of technical parameters such as the modulation of the carriers, the rate of coding against errors, and the interval between symbols, which are not imposed by the Plan. national digital television technician.

In short, the national technical plan of local digital television is based on the needs presented by the autonomous communities, considering the current capacity of the spectrum of radio frequencies attributed to the television service, in view of its wide occupation by legally established analogue television stations, and the limitations resulting from international coordination, as well as radio compatibility between communities adjacent autonomous regions, preserving the right to equitable access to resources Of all these. It is understood that this right means that applications from each Autonomous Community cannot be detrimental to the applications of the neighbouring communities.

A particular case of radio planning is the cities of Ceuta and Melilla because of their coastal situation, in an area where there are phenomena of intense spread over warm sea routes, and by the difficulties of international radio coordination. The coverage of local digital television in these two cities is obtained by taking advantage of the available capacity of the multiple channels included in the national technical plan of terrestrial digital television, approved by Royal Decree 2169/1998, October 9, for regional territorial coverage.

Once the project of the national technical plan of the local digital television has been elaborated, in accordance with article 24.1 of Law 50/1997, of 27 November, of the Government, the process of hearing to the communities has been verified autonomous and taken into consideration their allegations.

Secondly, this royal decree establishes the date of the start of television broadcasts, with digital technology, by the public authorities of the third autonomous channels, which will be produced before 1 January. of 2005, as well as the obligations to cover their digital emissions. Such competence, as well as the other powers conferred on it by the Agency, shall be carried out by the Ministry of Science and Technology, as long as such an autonomous body is not effectively constituted.

In accordance with the powers conferred by Article 149.1.21. of the Constitution, and Articles 43 and 44 of Law 32/2003 of 3 November, General Telecommunications, the elaboration and approval of the plans of The use of radio spectrum corresponds to the State, and is approved by the Government, which in this case is carried out under the second transitional provision of Law 41/1995, of 22 December, of local television by terrestrial waves. Article 1. Approval of the national technical plan for local digital television.

1. In accordance with the exclusive powers conferred on the State by Article 149.1.21. of the Constitution, and in accordance with the provisions of Article 44.1.b) of Law 32/2003 of 3 November, General Telecommunications, and Article 3.1 of Law 41/1995, of 22 December, of local television by terrestrial waves, is approved the national technical plan of the local digital television, which is inserted after this royal decree.

2. When the time limit referred to in paragraph 5 of the second transitional provision of the

Article 2. Interim frequency reserve.

Article 3. Technical characteristics.

1. 3. Article 4. Installing more than one station.

1. In accordance with Article 20 of Law 41/1995 of 22 December 1995 on local television by land waves, prior authorisation by the Secretary of State for Telecommunications and the Information Society shall be required when, To obtain complete coverage of the entire service area, the installation of more than one station is necessary. Article 5. Number of programs on each multiple channel.

Article 6. Additional data services.

2. In the provision of additional data services, up to 20 percent of the digital transmission capacity of the multiple channel may be allocated, provided that a satisfactory quality of service is ensured.

3. For the remainder of the digital transmission capacity of the multiple channel used for the transmission of local digital television programmes, all information related to them shall be included.

Article 7. International coordination.

The technical characteristics of the local digital television stations will be subject to the changes that may result from the implementation of the international coordination procedures provided for in the Stockholm, of 23 June 1961, in the Geneva Agreement of 8 December 1989, and the Chester Agreement of 25 July 1997, as well as in any other subsequent international agreements which might bind the Spanish State to the the framework of the International Telecommunication Union (ITU) or the European Conference of Postal and Telecommunications Administrations (CEPT).

Article 8. Fee for radio public domain reservation.

The entities authorised to provide the local digital television service shall satisfy the fee for radio public domain reservation, as set out in paragraph 3 of Annex I to Law 32/2003 of 3 November, General of Telecommunications, and shall become due in accordance with the provisions of the legislation in force, without prejudice to other fees or taxes that are required by the rules applicable by the various public administrations.

Article 9. Rate calculation.

Article 10. Technical inspection of the facilities.

1. After the completion of the facilities and prior to the commencement of the service, the State Radiocommunications Agency shall be required to carry out the technical inspection of the facilities. Additional provision fourth. Date of the start of television broadcasts, with digital technology, by the regional public authorities.

Article 7. Technical specifications of the transmitters.
