The requirements for obtaining, as well as the privileges, the titles, licences and ratings of the pilots of civil aircraft have been established by Royal Decree 270/2000 of 25 February, determining the conditions for the exercise of the functions of the flight crew of civil aircraft and, in their development, by the Order of 21 March 2000 adopting the joint aviation requirements for the licences of the crew of flight (JAR-FCL) concerning the conditions for the exercise of the functions of the pilots of the aeroplanes civil and civil aviation authorities and the Order of 21 March 2000 laying down the joint aviation requirements for flight crew licences (JAR-FCL), relating to the medical-aircraft organisation, medical certificates of Class 1 and Class 2 and medical requirements for aircraft and civilian helicopter flight personnel.

The entry into force of the above rules has deprived the provisions of the provisions of the provisions of the Annex to the Order of 14 July 1995 on securities, and civil aviation licences, on the basis of the provisions of paragraphs 1.2.1 and 1.2.2.2 of the acceptance of the training and experience acquired in ways other than the general system established by that Order to obtain the titles, licences and ratings of the pilots of the civil aircraft. This applies in particular to those who have acquired training and experience as pilots of aircraft at the service of the Spanish Armed Forces.

However, recently by Order FOM/876/2003, of 31 March, which partially modifies the said Order of 21 March 2000, the JAR-FCL rule 1,020 has been adopted on loans for military service, which it establishes ' The military personnel of a flight crew applying for licences and ratings specified in JAR-FCL shall make their request to the Authority of the State in which they serve or have served. The knowledge, experience and expertise acquired in the service of the Armed Forces shall be accepted for compliance with the relevant requirements of the JAR-FCL licenses and ratings, at the discretion of the Authority. The JAA will be informed of the policy followed for this acceptance. The privileges of these licences shall be restricted to aircraft registered in the issuing State of the licence until the requirements laid down in Appendix 1 to the JAR-FCL 1,005 are met. '

It is therefore necessary to complete this forecast and to this effect this Order regulates the assessment of the theoretical knowledge, instruction and flight experience as a pilot of military aircraft acquired at the service of the Forces Spanish navies for obtaining the titles and licenses and certain required ratings for the pilots of civil aircraft, although the privileges that such licenses and ratings will be exercised will be exercised exclusively in airplanes of Spanish licence fee until all the requirements laid down are met by the holder for the transformation of national efficiency licences into effective licences in all States which have adopted the requirements with-together of aviation for flight crew licences (JAR-FCL) relating to the conditions for the exercise of the functions of the pilots of the civil aircraft.

The final provision of Royal Decree 270/2000, dated February 25, enables the Minister of Public Works to develop regulations.

In its virtue, on the proposal of the Ministers of Defense and Development, with the prior approval of the Minister of Public Administrations and in agreement with the State Council, I have:

Article 1. Object and scope of application.

1. It is the purpose of this Order to regulate the acquisition of aeronautical titles and licences, the use of instrumental flight rating and the required class or type ratings for pilots of civil aircraft that correspond to the aircraft. theoretical knowledge and flight instruction and experience acquired as a pilot at the service of the Spanish Armed Forces.

2. What is available in this Order will be applicable to all those who provide or have served in the Spanish Armed Forces as a military military aircraft pilot.

Article 2. Effectiveness of licenses and ratings.

The titles, licenses and ratings to be obtained in accordance with the provisions of this Order shall confer the privileges set forth in Article 5 of Royal Decree 270/2000, but in order to exercise them in registration planes. Spanish according to what is set in the JAR-FCL rule 1,020.

Article 3. Get requirements.

1. In order to obtain the securities, licences and ratings referred to in Article 1 (1), the staff referred to in paragraph 2 of the same Article shall comply with the requirements laid down in Article 4 of Royal Decree 270/2000 and its development standards for the pilots of civil aircraft, with the particularities set out in this Order.

2. For the purposes of accreditation of these requirements, the theoretical knowledge, flight instruction and flight experience as a pilot acquired by such personnel at the service of the Spanish Armed Forces shall be recognized by the Directorate General of Civil Aviation, provided that they are in accordance with the provisions of this Order and, in particular, in their Annexes.

Exceptionally, if the person concerned claims theoretical knowledge, flight instruction or flight experience as a pilot not referred to in those Annexes, the collegiate body established by Article 7 of this Order shall carry out a comparative analysis between the accredited and the requirements required by Royal Decree 270/2000 and its implementing rules to obtain such securities, licences and ratings. The result of this analysis, which will have the character of a mandatory and non-binding report, will be elevated to the Directorate General of Civil Aviation in order to produce the corresponding resolution.

3. (a) The persons concerned shall always exceed a specific flight skill test for each licence and rating they intend to obtain and perform in accordance with the provisions of the joint aviation requirements for the licences of the flight crew-aircraft-(JAR-FCL 1) for each case, without prejudice to the specific features set out below for active duty military pilots.

(b) For active-duty military pilots it will be acceptable for the exceeding of such skill test to be certified by military pilots who hold civil licenses and are designated and authorised as flight examiners. exclusively for these purposes by the Directorate General of Civil Aviation, on a proposal from the Directorate-General for Military Recruitment and Teaching, on the initiative of the Air Force Teaching Directorate.

(c) In addition to the Air Force Teaching Directorate, according to the Directorate General of Civil Aviation, it will be up to the call and organization of the skill tests referred to in the paragraph previous.

(d) In any case, the aeroplane types or classes, from those listed in Annex 3 to this Order, in which the skill tests are carried out must have been recognised in advance, by means of a decision of the Directorate-General of Civil aviation, as acceptable for the proper conduct of the skill tests required for the procurement of each of the civil licenses and ratings.

4. Applicants must also be in possession of the relevant military certificate of flight fitness in force; or, alternatively, have been in the last three years and be holders of a private pilot's licence or authorisation. of the Directorate General of Civil Aviation to carry out the test of the in-flight expertise.

Article 4. Accreditation of the procurement requirements.

Compliance with the procurement requirements will be documented by:

(a) Minimum age: National identity card, passport or any other official document that allows you to be aware of the age of the person concerned.

b) Theoretical knowledge and flight instruction: Certification of the theoretical knowledge and flight instruction acquired as a pilot in the service of the Spanish Armed Forces, issued by the Directorate of Teaching of the Air Force. Where appropriate, and in respect of the required supplementary training, certification of the training received at a flight school (FTO) accepted, issued by the Directorate General of Civil Aviation.

c) Experience: Certification, issued in accordance with the JAR-FCL rule 1,080, accredited to the flight hours made as a pilot in the service of the Spanish Armed Forces, with an indication of the type and class of aircraft in which have been carried out and the operational procedures followed when carrying out the procedures, issued by the Air Force Teaching Directorate.

(d) Psycho-physical aptitude: A medical certificate certifying that the assessment is carried out and valid in accordance with the requirements laid down for civil pilots. For military pilots in active duty, the military medical certificate issued by the Center for the Instruction of Aerospace Medicine (C.I.M.A.) that meets at least equal requirements shall be valid.

e) Military aptitude for piloting aircraft: A certified copy of the corresponding military certificate of flight fitness or certification that it has been issued by the Directorate of Education of the Army in the last three years. Air.

f) Test of in-flight expertise: Report in official format issued by the approved examiner to record the passing of the test, conducted in the form for each case to establish the joint aviation requirements for the licences of the flight crew-aircraft-(JAR-FCL 1) and always in a type or class of aeroplane recognised for that purpose.

Article 5. Application procedure through the organs of the Ministry of Defense.

1. The professional military pilots of military aircraft in active duty, special services, voluntary leave in the cases (e) and (f) of Article 141 (1) of Law 17/1999, of 18 May, of the Staff Regulations of the Armed forces or in reserve situation, will direct the requests made under this Order to the General Directorate of Military Recruitment and Teaching. It shall send them, together with the documentation supporting the fulfilment of the required requirements, to the Directorate-General for Civil Aviation.

2. The Directorate-General for Civil Aviation shall, on a reasoned basis, decide on applications within six months from the date on which they are received. After that period of time without any express resolution being notified, the application shall be deemed to be rejected in accordance with the provisions of the additional provision twenty-ninth of Law 14/2000 of 29 December of Tax Measures, administrative and social order.

3. Against the decisions referred to in the preceding paragraph, the persons concerned may bring an appeal.

Article 6. Procedure for direct application to the Directorate-General for Civil Aviation.

1. Other subjects falling within the scope of this Order, who are not in the situations listed in Article 5 (1) or who have ceased to serve in the Spanish Armed Forces, shall make their request. directly to the Directorate General of Civil Aviation.

2. In this case, the persons concerned shall, prior to the performance of the skill test, make a request to the Directorate-General for Civil Aviation in order to be certified as a pilot flight experience and, where appropriate, the theoretical training and flight experience to be accredited is determined.

Once accredited to the Directorate General of Civil Aviation the theoretical and practical training and flight experience as a pilot acquired at the service of the Spanish Armed Forces and, where appropriate, the pending completion, said Directorate-General shall inform the person concerned that he may carry out the required flight skill test, which shall be carried out within six months of receipt of the relevant notification. For the purposes of this test it is necessary to be in possession of the corresponding medical certificate in accordance with the provisions of Article 4 (d) of this Order.

This test shall be completed before the General Directorate of Civil Aviation, requesting the corresponding title, license and rating, to which any document referred to in Article 4 shall be accompanied. which is no longer in the possession of the administrative body. If the medical certificate referred to in the preceding paragraph has been invalid, no further medical certificate of valid psycho-physical fitness shall be provided on that issue.

3. The Directorate-General for Civil Aviation shall, on a reasoned basis, decide on the requests provided for in this Article within six months. After that period of time without any express resolution being notified, the application shall be deemed to be rejected in accordance with the provisions of the additional provision twenty-ninth of Law 14/2000 of 29 December of Tax Measures, administrative and social order.

4. Against the decisions referred to in the preceding paragraph, the persons concerned may bring an appeal.

Article 7. Inter-ministerial committee.

1. As a collegiate body of study and advice for the best application of the provisions of this Order, the Advisory Commission on Accreditation and Valuation, attached to the Directorate General of Civil Aviation and formed by three representatives of the Ministry of Development and three of the Ministry of Defense.

2. The representation of the Ministry of Public Works will be composed of three officials who occupy a position of level 22 or higher in the Directorate General of Civil Aviation. The holder of this management body shall appoint the three representatives of the Ministry of Public Works and, of the latter, to whom the Presidency of the Commission is to exercise.

The representation of the Ministry of Defense will be made up of three officers of the General Air Force Corps, appointed by the Director General of Military Recruitment and Teaching on the proposal of the Director of Education Air Army.

3. In addition, he shall act as the Secretary of the Commission, an official of the Directorate-General for Civil Aviation, who is responsible for a position of 22 or higher level and designated for this function by the head of that management body. The Registrar may participate in the deliberations of the Commission, but shall not be entitled to vote.

4. For the purposes of this Order, the Commission shall exercise the following tasks:

(a) Develop and raise to the Directorate General of Civil Aviation the reports provided for in Article 3 (2) and the Additional Disposition second to this Order.

b) Inform the administrative resources that the personnel included in the field of application of this Order are against the resolutions of the Directorate General of Civil Aviation dictated in execution of what in the same sets.

c) Carry out any other study or report that is requested by the Directorate General of Civil Aviation for the implementation of this Order and propose criteria for action in relation to this application.

5. They may be invited to attend the meetings of the Commission, representatives of administrative bodies and public bodies and bodies whose opinion is deemed to be of interest for the matters to be dealt with as advisers.

Additional disposition first. Theoretical training and flight instruction of professional military pilots in active duty status.

1. The Directorate General of Civil Aviation will credit those military flight schools, for which the General Directorate of Military Recruitment and Teaching requests, on a proposal from the Air Force Teaching Directorate, as training centres for the procurement of the civil pilot licences and ratings referred to in this Order by professional military pilots in active duty.

2. Such accreditations shall be by the time limits set for the flight schools (FTO) of the civil aircraft pilots in the joint aviation requirements for the flight-plane crew (JAR-FCL 1) licences. Their procurement and renewal shall require the assessment by the Directorate-General of Civil Aviation of such Schools, in accordance with the criteria laid down for the flight schools (FTO) of the pilots of civil aircraft, without prejudice to the peculiarities resulting from the specific specificities of the military organisation.

3. The Directorate-General for Civil Aviation shall be responsible for monitoring compliance with these requirements.

Additional provision second. Acceptable flight time for compliance with the required experience requirements for obtaining the commercial pilot's license.

1. For the purpose of fulfilling the flight experience requirements required for obtaining the commercial pilot licence for Spanish registration aircraft, the flight time effected in accordance with Articles 3 and 4 shall be accepted. of this Order.

2. However, the military personnel of a military aircraft pilot who completed their training prior to the year 2000, after a favourable report from the inter-ministerial committee set up under Article 7 of this Order, will be accepted hours, from among all voladas as pilot-in-command, in cross-country flight and in instrumental conditions, that are necessary to complete the total number of hours of flight experience required.

The certification of these last hours, issued by the body responsible for the flight records of the Armed Forces in which such data are shown and endorsed by the Air Force Teaching Directorate, will be specific, not being subject to what is set in the JAR-FCL 1.080 rule.

Additional provision third. Acceptable flight time for compliance with the required experience requirements for obtaining the air line transport pilot licence.

In order to comply with the flight experience requirements required to obtain the pilot licence for the carriage of an airline for Spanish registration aircraft, the flight time effected in accordance with the requirements of this Directive shall be acceptable. the joint aviation requirements for flight-plane crew licences (JAR-FCL 1), in accordance with the operational procedures determined by the regulatory regulation of commercial air transport operations by aeroplanes Civil and multi-pilot aircraft types listed in Annex 3 to this Order.

Additional provision fourth. Acceptable flight time for the revalidation and renewal of civil licenses and ratings that enable the exercise of functions in Spanish aircraft.

1. The revalidation and renewal of the civil licenses and ratings obtained under this Order shall require the carrying out of the relevant proficiency check in the type or class of aeroplane recorded as a rating in the license, which must be among the recognized as acceptable to perform the skill test required for obtaining it.

2. For the revalidation or renewal of the air transport pilot licence and, in general, in all cases where, in addition to the carrying out of the relevant competition verification, a flight time is required, the Directorate-General for Civil aviation will be able to accept the flight time taken at the service of the Spanish Armed Forces to the military pilots, while the civil licenses and ratings that are the holders empower them to exercise the corresponding functions. exclusively on Spanish-registered aircraft.

By resolution of the Directorate General of Civil Aviation the administrative elements relating to such acceptance will be determined. In any event, such flight time, in order to be acceptable, must have been carried out in accordance with the operational procedures determined by the regulatory regulations for commercial air transport operations by civil aircraft and in the Multi-pilot aeroplane types listed in Annex 3 to this Order, certifying by certificate of the body responsible for the flight records of the Armed Forces in which such data are entered and endorsed by the Army's Directorate of Education Air.

Additional provision fifth. Acceptable flight time for compliance with the requirements of Appendix 1 to the JAR-FCL 1.005.

1. In order to comply with the flight experience requirements set out in Appendix 1 to the JAR-FCL 1.005 for the processing of professional licences and the instrument flight rating, the flight time may be cumulated the relevant civil aircraft, either in the types of multi-pilot aircraft listed in Annex 3 of this Order, in accordance with the joint aviation requirements for the flight crew licences (JAR-FCL 1), according to the operational procedures determined by the regulatory rules of the operations of commercial air transport by civil aircraft.

The flight time performed on the types of multi-pilot aircraft listed in Annex 3 shall be accredited by certificate of the body responsible for the flight records of the Armed Forces in which the data and the visa are displayed. by the Directorate of Teaching of the Air Force.

2. For compliance with the flight experience requirements required by Appendix 1 to the JAR-FCL 1.005 for the transformation of the private pilot licence, all flight time to the service of the Armed Forces shall be acceptable. Additional provision seventh. Acceptance of the flight time for the accreditation of the capacity to perform the skill test for the air transport licence (Aplane) [ATPL (A)] by the pilots joining the Spanish Armed Forces being already holders of a commercial pilot licence [CPL (A)] with instrument flight rating [IR (A)] JAR-FCL.

1. Pilots joining the Spanish Armed Forces being already holders of a commercial pilot licence [CPL (A)] with instrument flight rating [IR (A)] not restricted to Spanish aircraft, may apply for the Directorate General of Civil Aviation which, for the purposes of accreditation of the required flight experience in the JAR-FCL 1.280 to perform the skill test for the air transport licence (ATPL (A)), is also computed on time of flight effected at the service of the Spanish Armed Forces, provided that the same is carried out in accordance with the joint aviation requirements for flight crew licences-avion- (JAR-FCL 1), in accordance with the operational procedures determined by the rules governing air transport operations commercial by civil aircraft and in the types of multi-pilot aircraft listed in Annex 3 to this Order.

2. The flight time carried out on the types of multi-pilot aircraft listed in Annex 3 shall be accredited by the persons concerned by a certificate of the body responsible for the flight records of the Armed Forces in which the data and the visa are included. by the Directorate of Teaching of the Air Force.

The flight time for commercial air transport operations on civil aircraft, which would have been carried out prior to their incorporation into the Spanish Armed Forces or once they have ceased to provide service in they shall be accredited by those concerned in the form set out in the joint aviation requirements for the flight-aeroplane-(JAR-FCL 1) licences and the provisions laid down for their implementation.

First transient disposition. Temporary derogation from the requirement laid down in Article 3 (4

The time limit for the requirement laid down in Article 3 (4) of this Order shall not apply until four years after the entry into force of this Order. Until that date, the requests made under this Order will also be resolved, provided that the person concerned has been in possession of the relevant military certificate of flight fitness in force in the last seven years.

Second transient disposition. Requests made prior to the entry into force of this Order.

In accordance with the provisions of this Order, applications shall be made for the obtaining of the required titles, licenses and ratings for the pilots of civil aircraft that have been formulated after entry. in force of the said Order of 21 March 2000.

Repeal provision. Regulatory repeal.

Any provisions of equal or lower rank are repealed as set forth in this Order.

Final disposition first. Amendment of the Annexes to this Order.

The Director General of Civil Aviation is empowered to amend the Annexes to this Order, subject to the report of the Inter-Ministerial Commission provided for in Article 7 thereof, in order to keep them permanently updated with arrangements for training effectively followed in the military flight schools and the aircraft used by the Spanish armed forces.

Any resolution of the Director General of Civil Aviation agreeing to amend the Annexes to this Order must be published in the "Official State Gazette".

Final disposition second. Application of this Order.

The Deputy Secretary of Defense and the Directorate General of Civil Aviation, within the scope of their respective powers, shall take the necessary measures to implement the provisions of this Order.

Final disposition third. Entry into force.

This Order shall enter into force on the day following that of its publication in the "Official State Gazette".

2. 2. Accreditation of the flight experience: The accreditation of the flight experience shall be carried out in accordance with the JAR-FCL rule 1,080 (c) (1), (2), (4) and (5) of the Annex to Order FOM/876/2003 of 31 March for which the Order is partially amended of 21 March 2000 laying down the joint aviation requirements for flight crew (JAR-FCL), relating to the conditions for the exercise of the functions of the pilots of civil aircraft, without prejudice to the particularities resulting from the provisions of this Order.
