Royal Decree 553/2004 Of 17 April, Whereby The Ministerial Departments Are Restructured.

in accordance with Article 2.2.j of Law 50/1997 of 27 November of the Government, it is for the President of the Government to create, modify and delete, by royal decree, the ministerial departments, as well as the secretaries of state.

In order to develop the government's political program, achieve maximum efficiency in its action and the greatest rationality in the operation of the General Administration of the State, it is considered necessary to reform the current Ministerial structure.

In its virtue, on the proposal of the President of the Government,

D I S P O N G O:

Article 1. Ministerial departments.

The General Administration of the State is structured in the following ministerial departments:

Ministry of Foreign Affairs and Cooperation.

Ministry of Justice.

Ministry of Defense.

Ministry of Economy and Finance.

Ministry of Interior.

Ministry of Public Works.

Ministry of Education and Science.

Ministry of Labor and Social Affairs.

Ministry of Industry, Tourism and Trade.

Ministry of Agriculture, Fisheries and Food.

Ministry of the Presidency.

Ministry of Public Administration.

Ministry of Culture.

Ministry of Health and Consumer Affairs.

Ministry of Environment.

Ministry of Housing.

Article 2. Ministry of Foreign Affairs and Cooperation.

1. It is for the Ministry of Foreign Affairs and Cooperation to address the foreign policy and the international development cooperation policy, in accordance with the Government's guidelines and in accordance with the principle of (a) unity of action abroad, as well as the exercise of the other powers hitherto conferred on the Ministry of Foreign Affairs.

2. The Ministry of Foreign Affairs and Cooperation is structured in the following higher bodies:

(a) The Secretary of State for Foreign Affairs, who will be in charge of assisting the Minister directly in the formulation and implementation of Spain's foreign policy.

b) The Secretariat of State for the European Union, which will be in charge of assisting the Minister directly in the formulation and implementation of the policy of Spain in the European Union.

(c) The Secretariat of State for International Cooperation, which will assume the powers of the Ministry in the field of international cooperation so far exercised by the Secretariat of State for International Cooperation and for Latin America.

Article 3. Ministry of Justice.

1. It is up to the Ministry of Justice to propose and implement the Government's policy for the development of the legal system, without prejudice to the powers of other departments, the Government's relations with the administration of Justice, with the General Council of the Judiciary and with the Fiscal Ministry, through the State Attorney General, and international legal cooperation, as well as the other functions attributed to it by the legal system.

2. The Ministry of Justice shall have the office of the Ministry of Justice.

Article 4. Ministry of Defense.

1. It is for the Ministry of Defence to exercise all the powers and powers conferred on it by the legal system as a body responsible for the ordination, coordination and implementation of the Government's general guidelines on policy. The defence.

2. This ministry will have, as a higher body, the Secretariat of State of Defense, as well as the others provided for in the legal order and, specifically, in the legislation on the bases of the military organization.

Article 5. Ministry of Economy and Finance.

1. It is up to the Ministry of Economy and Finance to propose and implement the Government's policy on economic, public finances, budgets and expenditure and public enterprises, as well as the rest of the powers hitherto attributed to the the Ministries of Economy and Finance, with the exception of those that this royal decree attributes to the Ministry of Industry, Tourism and Commerce.

2. The Ministry of Economy and Finance is structured in the following higher bodies:

(a) The Secretariat of State of Finance and Budget, which will assume the current responsibilities of the Secretariat of State of Finance and the Secretariat of State for Budgets and Expenses.

b) The Secretary of State for Economic Affairs, which will maintain its current powers and assume those of the International Finance Directorate General and those concerning prices, tariffs, tolls and regional incentives of the Secretariat of State of Energy, Industrial Development and Small and Medium Enterprises.

Article 6. Ministry of the Interior.

1. It is up to the Ministry of the Interior to propose and implement the Government's policy on citizen security, the promotion of the conditions for the exercise of fundamental rights and the exercise of the command of the Forces and State Security Bodies, and maintains the other powers and powers conferred on it by the legal system, with the exception of those attributed to the Delegation of the Government for Foreign Affairs and Immigration and to the Government Delegation for the National Plan on Drugs.

2. This ministry will have the Secretariat of State for Security as the higher body.

Article 7. Ministry of Development.

1. It is up to the Ministry of Public Works to propose and implement the Government's policy on infrastructure and land transport of state, air and maritime competition, and to maintain its current powers, with the exception of this royal decree attributes to the Ministry of Housing.

2. The Ministry of Public Works shall have the Secretariat of State for Infrastructure as the higher body.

Article 8. Ministry of Education and Science.

1. It is up to the Ministry of Education and Science to propose and implement the Government's policy on education, sport and universities, as well as the policy of promoting and coordinating overall scientific research and technological innovation.

To do this, it will assume the powers so far attributed to the Ministries of Education, Culture and Sport and of Science and Technology, with the exception of those that this royal decree attributes to the Ministry of Industry, Tourism and Commerce and to the Ministry of Culture.

2. As the higher body of the Ministry of Education and Science, the Secretariat of State of Universities and Research will assume the powers currently attributed to the Secretariat of State for Scientific and Technological Policy of the Ministry of Science. and Technology, as well as the General Directorate of Universities of the Ministry of Education, Culture and Sport.

Article 9. Ministry of Labour and Social Affairs.

1. The Ministry of Labour and Social Affairs is the department responsible for the proposal and implementation of the Government's policy on employment, management and regulation of employment and social security, as well as the direction of the policies of the social cohesion, welfare, promotion of equality, protection of the child and care for families. It is also up to him to develop the Government's policy on immigration, immigration and asylum.

To do this, it will assume, in addition to the powers that it currently has, those of the Delegation of the Government for Foreign Affairs and Immigration.

2. The Ministry of Labour and Social Affairs is structured in the following higher bodies:

(a) The Secretary of State for Social Security.

b) The Secretary of State for Social Services, Family and Disability, who will assume the powers hitherto exercised by the General Secretariat of Social Affairs.

c) The Secretary of State for Immigration and Emigration, who will assume the responsibilities of the Delegation of the Government for Foreign Affairs and Immigration.

Article 10. Ministry of Industry, Tourism and Trade.

1. The Ministry of Industry, Tourism and Trade is the department responsible for the proposal and implementation of the Government's policy on industrial development, trade policy, energy, small and medium-sized enterprises, tourism and telecommunications. To this end, it will assume the powers hitherto attributed to the Ministry of Economy, through the Secretariats of State of Trade and Tourism and Energy, Industrial Development and Small and Medium Enterprises, with the exception of the corresponding to the General Directorate of International Financing and those relating to regional prices, tolls and incentives. It will also assume the powers hitherto conferred on the Ministry of Science and Technology, through the Secretariat of State of Telecommunications and the Information Society.

2. The Ministry of Industry, Tourism and Trade will be structured in the following higher bodies:

(a) The Secretary of State for Tourism and Trade, who will assume the powers until now attributed to the Secretary of State for Trade and Tourism, with the exception of those relating to international financing.

b) The Secretary of State for Telecommunications and the Information Society.

Article 11. Ministry of Agriculture, Fisheries and Food.

The Ministry of Agriculture, Fisheries and Food is the department responsible for the proposal and implementation of the Government's policy on agriculture, fisheries, rural development and food, and maintains its current powers.

Article 12. Ministry of the Presidency.

1. The Ministry of the Presidency is the department responsible for the preparation, development and follow-up of the legislative program, immediate support to the Presidency of the Government, assistance to the Council of Ministers, the Delegation of the Government, the General Commission of Secretaries of State and Undersecretaries and, in particular, the Government in its relations with the General Cortes, the exercise of the functions of inter-ministerial coordination entrusted to it and the other has been granted, in particular those provided for in Law 50/1997 of 27 November 1997, Government.

2. The Ministry of the Presidency is structured in the following higher bodies:

(a) The Secretariat of State for Relations with the Courts.

b) The Secretary of State for Communication.

Article 13. Ministry of Public Administration.

1. It is up to the Ministry of Public Administration to prepare and implement the Government's policy on administrative organization, public service, relations and cooperation with the autonomous communities and the entities that make up the the local administration, and coordination of the General Administration of the State throughout the national territory, without prejudice to the competences of the other ministries in relation to the peripheral services of these, as well as the rest of the powers entrusted to it by the legal system.

2. The Ministry of Public Administration will have the Ministry of State for Territorial Cooperation, as the ministry's top body, which will assume the responsibilities of the former State Secretary of the State of Territorial Organization, with the exception of those relating to the organisation of the peripheral administration.

Article 14. Ministry of Culture.

The Ministry of Culture will assume the powers of the Ministry of Education, Culture and Sport, through the Secretariat of State for Culture, on the promotion, protection and dissemination of historical heritage. Spanish, state and arts museums, book, reading and literary creation, cinematographic and audiovisual activities and state archives and libraries, as well as the impetus of cultural cooperation actions and, in coordination with the Ministry of Foreign Affairs and Cooperation, of relations International cooperation in the field of culture.

Article 15. Ministry of Health and Consumer Affairs.

The Ministry of Health and Consumer Affairs is responsible for the proposal and implementation of the Government's general guidelines on health, planning and health care and consumption policy, as well as the exercise of powers of the General Administration of the State to assure citizens of the right to health protection. To this end, in addition to its current powers, it will assume the responsibility of the Government Delegation for the National Plan on Drugs.

Article 16. Ministry of the Environment.

The Ministry of the Environment is the department responsible for the proposal and implementation of the Government's policy on nature conservation, sustainable development, environmental impact and plant management, the fauna, habitat and natural ecosystems, as well as collaboration with the autonomous communities for the performance of the actions that correspond to these matters.

Article 17. Ministry of Housing.

The Ministry of Housing will exercise the powers that, in accordance with the provisions of Article 149.1 of the Constitution, correspond to the General Administration of the State in matters of housing and land. The public bodies entrusted with the exercise of powers and the provision of services or activities aimed at promoting access to housing shall be assigned to this ministry.

Single transient arrangement. Subsistence of existing structures.

Subsystems, until the implementation of the real decrees of basic organic structure of the ministerial departments, the executive organs, units and posts of the ministerial departments object of suppression or of restructuring.

Single repeal provision. Regulatory repeal.

As many provisions of equal or lower rank are repealed, they oppose the provisions of this royal decree.

Final disposition first. Removal of organs.

The following ministerial departments and higher bodies of the General Administration of the State are abolished:

Ministry of Foreign Affairs.

Ministry of Finance.

Ministry of Education, Culture and Sport.

Ministry of Economy.

Ministry of Science and Technology.

Secretary of State for European Affairs.

Secretary of State for International Cooperation and for Latin America.

Secretary of State for Finance.

Secretary of State for Budgets and Expenses.

Delegation of the Government for Immigration and Immigration.

Secretary of State for Education and Universities.

Secretary of State for Culture.

Secretary of State for Public Administration.

Secretary of State for Territorial Organization of the State.

Secretary of State for Water and Coast.

Secretary of State for Trade and Tourism.

Secretary of State for Energy, Industrial Development and Small and Medium-sized Enterprises.

Secretary of State for Science and Technology Policy.

Final disposition second. References to the deleted organs.

The references of the legal order to the bodies which, by this royal decree, are deleted will be understood to be made to those who, by this same norm, are created and replaced or assume their competences.

Final disposition third. Membership of public bodies.

The public bodies will be assigned to the ministerial departments in accordance with the distribution of competences established in this royal decree, and in the terms that will be determined in the actual decrees by which they are approve the corresponding organic structure.

Final disposition fourth. Budgetary changes.

Ministry of Economy and Finance will make the necessary budgetary changes to comply with the provisions of this royal decree.

Final disposition fifth. Entry into force.

This royal decree will enter into force on the day of its publication in the "Official State Gazette".
