Key Benefits:
Both the current Article 153 of the General Budget Law, whose
recast text was approved by Royal Legislative Decree 1091/1988, 23
September, as in article 86.2 of the new Law 47/2003, of 26 of
November, General Budget, partially in effect from January 1
of 2004, as set out in its final disposal fifth, state that

The Sectoral Conference of Labor Affairs, at the meeting held
on March 16, 2004, agreed to the objective criteria of the distribution
territorial for the 2004 economic year, as well as the distribution
resulting from grants for support programs
to the creation and promotion of employment, pre-retirement aid ordinary
in the Social Security system, occupational vocational training,
workshop-workshops, trades houses and workshops. The Council of
Ministers, at their meeting on 14 May 2004, decided to formalise them,
so the distribution of the allocated amounts should be done
to each Autonomous Community,
Consequently, I have arranged:
Article 1. Object.
Give publicity to the objective criteria of territorial distribution
of the grants for creation support programs
and promotion of employment and pre-retirement aid in the
Social Security system for workers affected by
processescompany restructuring, occupational vocational training,
workshops, offices and workshops for employment, for the financial year
of 2004, listed in Annex I of this Order, in which they appear
also the amounts and, where applicable, the corresponding percentages
to each of the Autonomous Communities.
Article 2. Justification.
1. Ended the 2004 economic year and no later than 31
March 2005, Autonomous Communities will refer to the body
corresponding from the Ministry of Labour and Social Affairs, a state
understanding of commitment of credits, of recognized obligations
and payments made by managed grants, funded
with state funds allocated in 2004.
Running the grants managed by the Communities
Stand-alone, such as credit commitments, recognized obligations, and
payments made, in accordance with your budget
application, will be imputed to the exercise for which they were distributed
territorially such grants.
The supporting documents will conform to the models that appear
as Annexes number II and shall be signed by the operator of the managing centre
of the grant or grants to which, if applicable, it will give its conformity
the Financial Controller or Financial Officer. These documents
supporting documents must be accompanied by the computer media which is
determine in the corresponding Resolution.
2. As provided for in the first paragraph of Article 60 of the
Law 24/2001, of December 27, of Fiscal, Administrative Measures
and the Social Order, with respect to the operational programs that are indicated
in the additional provision third of this Order, object of co-financing
by the European Social Fund, the Autonomous Communities will assume the
financial liability arising from compliance with requirements
referred to in the Community legislation applicable to the Funds
European Union Structural Funds.
The Directorate General of the Social Economy, Autonomous Work
and the European Social Fund, and the State Employment Public Service,
holders of the credits referred to in the preceding paragraph shall agree to
the suspension of the bookies from the same to the Communities
Stand-alone, run-time, power-holders, when they are not
credit, in the terms and deadlines provided for in Community legislation,
compliance with the conditions required for the justification of the
help by contributing information and documentation
relative to the management performed.
For possible inclusion in payment requests to the Fund
European Social, as provided by Royal Decree 683/2002, of 12
July, and the European Regional Development Fund, Article 12 of the Royal
Decree 1330/2000 of 7 July, the Autonomous Communities will
to the Directorate-General of the Social Economy, Autonomous Work and
from the European Social Fund and the State Employment Public Service, in respect of
to the programs whose management they were both entrusted with before the
transfer, data and supporting documents to be determined in the Resolutions
corresponding to the time limits which are also set out in those deadlines.
3. The resulting funds remaining at the end of each exercise
to be held by the Autonomous Communities will follow
maintaining the specific target for which they were transferred and will be used
in the following financial year, as a cash situation at the source, for
granting new grants, as set by the fifth rule
of article 86.2 of Law 47/2003, of November 26, General
Budget.
Article 3. Programmes for the Promotion of Employment, the National Plan of
Occupational and Occupational Vocational Training, Houses of
Jobs and Job Workshops.
1. The Autonomous Communities may order and, where appropriate,
redistribute according to your management needs and depending on the specifics
of the collectives to attend, the amounts initially allocated for
the program blocks listed in subsection 1 " Programs
Promotion of Employment "under the" Employment programmes " section of Annex I
of this Order, understanding that the redistribution is only
you can perform between the different programs of each of the blocks
cited with the letters: A) Temporary hiring plans
of unemployed workers; B) actions to improve the occupation of
the jobseekers, and C) promotion of activity.
Autonomous Communities, however, will ensure at least
the year 2004, a budget execution of the amounts initially
assigned in the percentage terms that are expressed below
for programmes co-financed by the European Social Fund which are
indicate:
Temporary hiring plans for unemployed workers in
collaboration with Local Corporations: 40%.
Hiring unemployed through collaboration with
Non-profit institutions: 40%.
Recruitment of Employment and Local Development Agents: 40%.
Professional Guidance for Employment and Self-Employment: 65%.
I + E in Local Corporations: 20%.
I + E in Companies: 50%.
Autonomous Employment Promotion Program: 40%.
2. In order to have a support that allows to properly collect
the necessary information from the Employment Promotion Programmes, they must
to be completed by the Autonomous Communities states
supporting documents relating to Annexes II.5 and II.6. It will also be
necessary to provide, together with Annex II.6, the computer files in which
identify recipients and beneficiaries of co-funded actions
by the European Social Fund, which will be developed according to the
technical specifications set out in Annex II.7, in such a way as to be cited
Annex II-6, constitutes a global certification of operations
individualised in the computer file (Annex II-7).
3. The Autonomous Communities must complete Annex II.3,
that collects the breakdown of the justification for the Training actions
Occupational Professional of the National Training and Insertion Plan
Professional, subject to co-financing by the European Social Fund through
of the Operational Programs of "Employment Promotion" and according to the criteria
selection set in the corresponding Add-ons of the
Program.
Also, those responsible for the management transferred to the Communities
Stand-alone shall accompany the said annex, the corresponding endorsement
identifying the supporting state, which will include the relationship
individualized of certified operations, using the appropriate
IT media that the State Employment Public Service puts to
provision of the Autonomous Communities, or, by means of files which
meet the technical specifications validated for this purpose.
4. The Autonomous Communities will ensure in 2004 a
budget implementation, in the programmes referred to in this Article,
to allow fulfillment of the commitments that you have acquired in the
Public Service Plurirregional Operational Programs
Employment Promotion State Employment and Business Initiative and
Continuing Training " for actions co-financed by the Social Fund
European.
Article 4. Modernisation of Public Employment Services.
The amounts allocated in this program will be dedicated to execution
of the following measures: Human media increase, modification
of the network of employment offices, employment office equipment,
deployment and development of the SISPE (Information System for the
Public Employment Services), new utilities for improvement of the
service, or those that are set in the corresponding convention
of modernization to subscribe between the Public Service of State Employment
and the Autonomous Communities.
The Head of the Community's Public Employment Service
Autónoma justify in the months of October 2004 and January 2005 to the
State Employment Public Service the effective application of the amounts
assigned, with a description of each of the detailed metrics
in the previous paragraph of this article.
Article 5. Support for ordinary retirement in the system of the
Social Security.
Regarding pre-retirement aids in the system
of Social Security, and for the purposes of knowing full credit to transfer,
the comprehensive state referred to in Article 2 of this Order,
along with possible additional requests from the reservation
set, must work with the Department within the maximum time of
one month from the publication of the Annual Distribution Order.
Article 6. Support programmes for job creation in cooperatives
and labor societies.
Autonomous Communities must complete Annex II-8 of
this Order that collects the certification of support actions
to job creation in cooperatives and labor societies
co-financed by the European Social Fund in its Operational Programmes: Initiative
Business and Continuous Training of Objectives 1 and 3.
Similarly, Objective 1 Autonomous Communities must
complete Annex II-9, which collects the certification of the actions
aimed at supporting businesses related to the social economy,
co-financed by the European Regional Development Fund in its Programme
Operational: Improving the Competitiveness and Development of Productive Fabric
Additional disposition first.
To the Autonomous Communities that assume the management of these aids
throughout the present economic year they will be transferred to them
remaining remaining in the Central Administration on date
where the handover of functions for the
is effectiveterritorially distributed funds by applying the criteria
listed in this Ministerial Order.
Additional provision second.
The amounts agreed for the Autonomous Communities that you assume
transfers in the course of 2004 will experience the right fit
arising from obligations recognised by the Public Employment Service
State up to date of effectiveness of corresponding agreements
of transfers, as well as the result of the application to the current budget
of expense commitments, from previous exercises, pending
of the regulatory recognition of obligations by the Agency.
Additional provision third.
In accordance with the provisions of Article 2.2 of this Order and
in compliance with the provisions of the second paragraph of Article 60
of Law 24/2001, of December 27, of Fiscal, Administrative Measures
and from the Social Order, will be the subject of co-financing by the Social Fund
European Public Service Entitlement Operational Programs
State Employment and the General Directorate of the Social Economy, Labor
Stand-alone and the European Social Fund listed below,
in terms that are indicated:
1. The Occupational Vocational Training actions of the Plan
National Training and Vocational Integration will be the subject of co-financing
by the European Social Fund through the Operational Programs of
Employment Promotion, approved by the European Commission for the
period 2000-2006 and according to the selection criteria set in the
Program Add-ons.
2. In the actions of the School and Workshop programs of
Trades and Employment Workshops, will be co-financed by the Social Fund
European, through the "Employment Promotion" Operational Programmes,
grants corresponding to all training costs
and performance and wage costs for participating workers,
scholarships to students from Workshop Schools and Crafts and all of them
the grants for expenses of the Promotion and Development Units.
3. They shall also be the subject of co-financing by the Social Fund.

Operational Programme "Employment Promotion".
Professional Guidance for Employment and Self-Employment (Order of 20

Local Public Employment (Objective 1 areas exclusively) (Order of 26
October 1998, BOE of November 21).
Autonomous Employment Promotion Program (Order of 21 February
of 1986, BOE of 27 February and Order of 22 March 1994, BOE 12

Hiring unemployed through collaboration with
Non-profit institutions (Order of 19 December 1997, BOE

These effects will also be considered those other actions and
concepts whose co-financing by the European Social Fund is approved
by the relevant bodies of the European Union.
4. The actions aimed at incentivizing the incorporation of
unemployed as worker partners or worker partners to cooperatives and
working societies, hiring managers, advising for
the constitution or improvement of companies in the social economy, as well as
to the formation, dissemination and promotion of the related social economy
directly to the promotion of employment, they will be cofinanced
theBusiness Initiative and Continuous Training Operational Programs
Objectives 1 and 3 of the European Social Fund.
Additional provision fourth.
From the amount of credits commitments, the reintegrals will be minated
obtained by the Autonomous Community from exercises
above, completing in the form indicated in the corresponding
annexes to this Order.
Additional provision fifth.
In reason of management by the Autonomous Communities of actions
co-financed by the European Social Fund and the European Fund of
Regional Development through State Funds Distributed for
this financial year, corresponding to the programs
State Employment Public Service, "Fomento
"of Employment "and" Business Initiative and Continuing Training ", and the
Directorate-General for Social Economy, Autonomous Work and the Fund
European Social, Business Initiative and Continuing Training and Improvement
of the Competitiveness and Development of the Productive Fabric, and at the end of
enable compliance with the provisions of Article 8 of the Regulation
commission Regulation (EC) No 438/2001 of 2 March 2001 on the Communities
Stand-alone, duly completed, with periodicity
as referred to in Commission Regulation (EC) 1681/1994 of 11
July 1994, to the Directorate General of the Public Employment Service
State (Economic and Budgetary Management Subdirectorate General)
or to the Directorate-General of the Social Economy, Autonomous Work
and the European Social Fund (General Development and Development Subdirectorate
)Business and Entity Registry), as appropriate based on

I. Employment programmes (competences assumed by the Communities
Standalone of programs managed by the Public Employment Service
State)
The 21st Sectoral Conference for Labor Affairs agreed to the
cast criteria that will generally be applied to the different
epigraps that, in the budget chapter of the Public Employment Service
State, approved by Law 61/2003, of December 30, of Budgets
State Generals for 2004, correspond to the Communities
Standalone with management transferred.
Also agreed that, when the sum of the different items to
transfer to an Autonomous Community by application of these criteria
is less than the sum of what was allocated in the previous year,
will supplement up to that figure from funds than in the Budget Law
are for the management of the State Employment Public Service. This
add-on is distributed among the different items in proportion to the
decrease that would suffer in absolute terms each of those
items.
The amounts that are, in application,
detailed belowcriteria, correspond to each Autonomous Community. The funds are
expressed in thousands of euros.
These figures correspond to the competencies that each Community
Autónoma had assumed office until January 1, 2004. If any Community
Autónoma assumed management competencies later, the funds
to be assigned to the same criteria, by deducting the
quantis that the State Employment Public Service has executed at the level
recognized obligation up to date of transfer effectiveness, as well
such as credit updates derived from exercise commitments
previous and that are pending execution by the Service
State Employment Public.
The general distribution criterion takes into account, on the one hand, unemployment
registered, which is set to 80% and, on the other hand, the number of
Unoccupied Plaintiffs (DENOS), which is set at 20%.

The budget for this grant is divided into two parts:
maintenance of posts and job creation.
First, the Maintenance portion is assigned,
as a result of multiplying 50 per 100 of the sum of the S.M.I. (yearly)
+ 2% of the S.M.I., by the number of the template, increased in a
8% (according to the latest available data) from the Special Centers for Employment
of each Community.
The remaining budget, is assigned to Create a shape positions
proportional to the disabled applicants registered in each Community
Autonomy, according to the same data as point 2, having on
account does not enter Navarre in the distribution.

III. Prior to ordinary retirement aid in the System
of Social Security
Criteria for the territorial distribution of these grants for
the 2004 economic exercise:
First. -Setting up a reservation on initial credit by virtue
from article 153 of the General Budget Law, to cover up
to unforeseen needs that arise during the execution of the
budget, both in the Autonomous Communities that have assumed management
of the aids, such as those to which the
was not transferredcompetence, as well as those managed by the General Work Address, in
use of your own competition.
Considering the expense forecasts reported by the
Communities affected, the reserve has been estimated at 15%.
Second. -As in previous years, the rubric is maintained
" Obligations derived from the competencies of the General Directorate of
Job " under which the intended mount is contemplated to cover the
financing of the aid of workers of public enterprises and of the
supra-regional scope, the concession of which is the responsibility of the Directorate
General of Work.
Third. -The difference between the initial credit and the sum of the two
previous headings will be the credit to be distributed.
The total of the credit to be distributed will be allocated to the Communities
Autonomic that have assumed the management of the aids, the quantities obtained
to apply the percentage of occupied population aged 55 and over, in relation to
with the national total, according to the annual average Active Population Survey,
of 2003.
