Article 20 of the Organic Law 15/1999 of 13 December on the Protection of Personal Data establishes that the creation, modification or deletion of automated files of Public Administrations will only be possible be made by means of a general provision published in the Official Journal of the State or in the Official Journal.

This same requirement was already imposed in article 18 of the Organic Law 5/1992, of October 29, of Regulation of the Automated Treatment of Personal Data, which was repealed by the aforementioned Organic Law 15/1999. In accordance with the provisions laid down in Article 18, the Order of 4 October 1999 was adopted in order to update the list of automated files of personal data of the Ministry of Public Works. This relationship, contained in the Annex to that Order, has undergone several subsequent amendments, as a result of the need to incorporate new files into existing ones or to delete some of them.

It is currently necessary to make a new modification in the indicated relation of automated files of personal data of the Ministry of Public Works, in the sense of creating a new file that assists the Department in the management of human resources, especially in the pension plan of the General Administration of the State.

In its virtue, I have:

First. Extension of the Annex to the Order of 4 October 1999.

The new creation file, called \" Badaral 3 \ ", is included in the annex to this Order, which is incorporated into the set of automated files of personal data of the Ministry of Public Works, listed in the Annex of the Order of 4 October 1999.

The body responsible for this file is the Department's Undersecretary. The Subdirectorate-General for Human Resources shall be, within the aforementioned management body, the competent unit to which the rights of access, rectification and cancellation may be exercised. Moreover, the following ends are included in this file: name of the file, purpose and uses, persons to whom the data refer, procedure of data collection, basic structure of the file, transfers of personal data measures and security measures.

The security measures contained in the corresponding section of this file are those that are applicable in accordance with the provisions of Royal Decree 994/1999 of 11 June 1999 on the Security measures for automated files containing personal data.

Second. Entry into force.

This Order will take effect the day after its publication in the \" Official State Bulletin \ ".

Basic structure: Identification of the holder (DNI/NIF, surname and first name, date of birth, sex), professional address, administrative profile (type of relationship with the Administration, group, body or category), administrative situation and position of work, seniority, situation in the pension plan and contributions made by the Ministry of Public Works as a promoter.
