The Court of Justice of the European Union, in its judgment of 3 April 2014, has stated that the requirement of a maximum age for vehicles for the complementary private transport of goods constitutes a measure restrictive of imports of vehicles. It is therefore necessary to remove the requirement for the maximum age of vehicles attached to supplementary private transport authorisations as set out in Order FOM/734/2007 of 20 March 2007 for the development of the Regulation of the Law on the Management of Land Transport in the field of authorizations for the carriage of goods by road.

In its virtue, ears the National Committee of Road Transport and the National Council of Land Transports, as well as the competent transport bodies of the Autonomous Communities and the cities of Ceuta and Melilla, according to the Council of State and under the authorization contained in the 11th additional provision of the Regulation of the Law on the Law of the Land Transports, I have:

Single item. Amendment of Order FOM/734/2007 of 20 March 2007 for the development of the Regulation on the Law on the Management of Land Transport in the field of road haulage authorisations.

Order FOM/734/2007 of 20 March 2007 for the development of the Regulation of the Law on the Management of Land Transport in the field of authorizations for the carriage of goods by road is hereby amended as follows: following terms:

1. The content of Article 31.1 is amended as follows:

" 1. Those who wish to obtain a supplementary private transport authorization must, together with the fulfilment of the requirements laid down in Article 30, have at least one vehicle in any of the arrangements provided for in the Article 5.2. "

2. The second paragraph of Article 32.1 and Articles 35 and 36 are deleted.

Final disposition. Entry into force.

This order shall enter into force on the twentieth day of its publication in the "Official State Gazette".
