Council Regulation (EC) 1198/2006 of 27 July 2006 on the European Fisheries Fund allows for the eligibility of expenditure under this Fund until 31 December 2015, as set out in Article 55.1 and the closure guidelines set out in Commission Decision C (2013) 4879. This Regulation lays down in Chapter I, Priority Axis 1, measures for the adaptation of the Community fishing fleet, Articles 21 and 24, the possibility of granting aid to shipowners and crew members of fishing vessels which may be affected by the measures to adapt the fishing fleet.

On the other hand, Article 129 (2) of Regulation (EU) No 508/2014 of the European Parliament and of the Council of 15 May 2014 on the European Maritime and Fisheries Fund and repealing Regulations (EC) No 508/2014 Council Regulation (EC) No 2328/2003, (EC) No 861/2006, (EC) No 1198/2006 and (EC) No 791/2007, and Regulation (EU) No 1255/2011 of the European Parliament and of the Council, allows the continuation of aid approved by the Commission on the basis of the Regulation (EC) Council Regulation (EC) No 1198/2006 of 27 July 2006. The aid referred to in this order is part of the Operational Programme for Community Intervention of the European Fisheries Fund for the 2007-2013 programming period, approved by Decision C (2007) 6615 of 13 December 2007.

The Operational Programme of the European Maritime and Fisheries Fund has not been approved and, therefore, aid for the temporary cessation of fishing activities provided for in that Fund cannot be applied, also, that the period of validity of the European Fisheries Fund extends until 31 December 2015.

It is necessary to amend the temporary scope of Order AAA/175/2012 of 30 January 2012 laying down the regulatory bases for the granting of aid to shipowners or owners of Spanish fishing vessels affected by the the temporary cessation of the fishing activity published in the Official Gazette of the State of the 30th, of February 4, in order to enable the granting of aid to the temporary cessation of the fishing activity during the year 2015 in the frame of the European Fisheries Fund.

The processing of this Order has met with the processing of consultations with the Autonomous Communities and the cities of Ceuta and Melilla, as well as the sector concerned.

In its virtue, I have:

Single item. Amendment of Order AAA/175/2012 of 30 January 2012 laying down the regulatory bases for the granting of aid to the shipowners or owners of Spanish fishing vessels affected by the temporary cessation of the activity fishing.

Article 1 of Order AAA/175/2012 of 30 January 2012 laying down the regulatory basis for the granting of aid to the shipowners or owners of Spanish fishing vessels affected by the temporary cessation of the fishing activity is replaced by the following:

" Article 1. Object.

By this order the regulatory bases are established for the period 2012-2015 for the granting of aid for the competitive competition procedure, to the shipowners or owners of Spanish fishing vessels that can be affected by measures for the temporary cessation of fishing activities, as laid down in Council Regulation (EC) 2371/2002 of 20 December 2002 laying down measures on the conservation and sustainable exploitation of fisheries the fisheries resources under the common fisheries policy, as set out in the Regulation (EC) 1198/2006, of the Council of 27 July 2006 on the European Fisheries Fund (EFF) and in accordance with Royal Decree 1549/2009 of 9 October on the management of the fisheries sector and adaptation to the European Fisheries Fund, as well as the Operational programme for Community action by the European Fisheries Fund for the programming period 2007-2013. '

Final disposition first. Competence title.

This order is dictated by the state competence in the management of the fisheries sector, in accordance with the provisions of Article 149.1.19ª of the Constitution.

Final disposition second. Entry into force.

This order shall enter into force on the day following that of its publication in the "Official State Gazette"
