Key Benefits:
Law 29/2006 of 26 July on the guarantees and rational use of medicinal products and medical devices establishes in Article 73 that medicinal products may be exported by laboratories and wholesale warehouses which comply with the requirements legally established, and that the export of authorised and registered medicinal products shall be notified by the exporter to the Spanish Agency for Medicinal Products and Sanitary Products. Subsequently, the Royal Decree 824/2010 of 25 June, regulating the pharmaceutical laboratories, the manufacturers of active principles of pharmaceutical use and the foreign trade of medicines and medicines in research, development this Article establishing that this activity may be carried out by the marketing authorisation holder, by the manufacturing and/or importing laboratories as well as by the distribution entities.
The export notifications mentioned above allow for the prior verification by the Spanish Agency of Medicines and Health Products of the inclusion in these exports of medicinal products that could be found with supply problems, as well as follow the movements of some drugs more susceptible to diversion to the illegal market.
Order SPI/2136/2011 of 19 July, laying down the procedures for sanitary control at the border of the pharmaceutical inspection and regulating the Information System for the Pharmaceutical Inspection of External Health, applies to medicinal products for human use and their raw materials, medical devices, cosmetics and their plant raw materials and personal care products and biocidal products for clinical and personal use. A non-exhaustive list of consignments under control is given in Annex I to that order.
The Pharmaceutical Inspection Services at the border, in accordance with the provisions of the aforementioned Order SPI/2136/2011 of 19 July 2011, carry out health checks on imports and exports, allowing for the production of documentary control, identity control and physical control of the product itself, as deemed necessary.
However, it is necessary to exempt from certain border controls the operations taking place with Switzerland, Turkey and Andorra, as set out below.
The Mutual Recognition Agreement on medicinal products between the European Union and Switzerland, as well as the extensive commercial exchange and proximity of the territory allow for a knowledge and exchange of information. Sufficient to exempt imports of medicinal products for human use, originating in and from Switzerland, carried out by pharmaceutical laboratories, as well as exports carried out by laboratories, from border controls pharmaceuticals, or by distribution entities. This is without prejudice to the rules applicable to the foreign trade in medicinal products as set out in Royal Decree 824/2010 of 25 June 2010.
The characteristics of Switzerland referred to in the preceding paragraph, as well as the Agreement between the European Community and the Swiss Confederation on mutual recognition in conformity assessment, published in the The Official Journal of the European Union (EUDOEU) on 30 April 2002, which lists among the products covered by its scope medical devices, also allows the exemption of controls on imports of medical devices originating and Switzerland provenance.
Furthermore, Decision No 1/2006 of the EC-Turkey Association Council of 15 May 2006 on the application of Article 9 of Decision No 1/95 of the EC-Turkey Association Council concerning the establishment of the The final stage of the customs union allows the exemption of controls on imports of medical devices from Turkey, whether they are products originating in Turkey or put into free circulation in Turkey.
In the case of exports of medicinal products for human use to the Principality of Andorra, taking into account that the offices of pharmacy of the Principality, are supplied to a large extent of authorized medicines in Spain and In any case, the control of the previous notifications made to the Spanish Agency for Medicines and Health Products has been carried out, it is considered that it can also be exempted from the sanitary control in the export at the border to this country when it is carried out by the pharmaceutical laboratories and the entities of distribution, provided that the final destination of medicinal products for human use is the supply of medicinal products in the Principality itself. The aim of this exemption is to speed up the administrative procedures to facilitate adequate continuity in these supplies, a day on many occasions.
It is also important to mention the Agreement on the European Economic Area, signed in Oporto on 2 May 1992, which involved the free movement of goods between the contracting parties. The contracting parties are the Member States of the European Union as well as the Kingdom of Norway, the Republic of Iceland and the Principality of Liechtenstein, and therefore these countries have the same consideration as the other Member States for the purposes of of sanitary control on import or export.
In turn, it is appropriate to specify in relation to the scope of Order SPI/2136/2011 of 19 July 2011 that raw materials of human origin for the manufacture or control of medical devices for "in vitro" diagnosis they require health control at the border, so it is necessary to introduce them into the scope of the border control.
Moreover, it is also necessary to include a point on the customs procedures that require pre-import sanitary control, thus being the one that is included in the import, both the release for free circulation as the inward processing and re-import arrangements, within the framework established by Regulation (EC) No 450/2008 of the European Parliament and of the Council of 23 April 2008 establishing the Community Customs Code (modernised customs code), Council Regulation (EEC) No 2913/92 of 12 October 1992, approving the Community Customs Code, Commission Regulation (EEC) No 2454/93 of 2 July 1993 laying down certain detailed rules for the application of Regulation (EEC) No 2913/92 and subsequent application results.
It is also necessary to mention that these health controls on imports are also applicable to products from a third country and that they originate in a country of the European Economic Area.
This order is approved in use of the rating attributed to the Ministry of Health, Social Services and Equality by the final provision of Royal Decree 1418/1986 of 13 June on the functions of the Ministry of Health and Consumer Affairs. in the field of external health, guaranteeing, as regards the processing of personal data, the respect of the Organic Law 15/1999, of 13 December, of Protection of Personal Data, and its regulations of development.
In the preparation of this order, the autonomous communities and the cities of Ceuta and Melilla, the sectors affected, have been heard, and the mandatory report of the Spanish Data Protection Agency has been obtained.
In its virtue, I have:
Single item. Amendment of Order SPI/2136/2011 of 19 July laying down the procedures for sanitary control at the border of the pharmaceutical inspection and regulating the Information System for the Pharmaceutical Inspection of External Health.
Order SPI/2136/2011 of 19 July, laying down the procedures for sanitary control at the border of the pharmaceutical inspection and regulating the Information System for the Pharmaceutical Inspection of Foreign Health, is hereby established. modified as follows:
One. Article 2 (1) is worded as follows:
" 1. This order shall apply to the following products:
(a) medicinal products for human use, including their bulk and intermediate products.
(b) pharmaceutical raw materials for the manufacture of medicinal products for human use.
c) sanitary products, including their bulk and intermediate products.
(d) raw materials of human origin intended for the manufacture or control of "in vitro" diagnostic medical devices.
e) cosmetics and personal care products, including their bulk and intermediate products.
(f) plant raw materials for the manufacture of cosmetics.
g) products for clinical and personal use, including their bulk and intermediate products. "
Two. The following paragraphs 3 and 4 are added to Article 2, with the following wording:
" 3. The pre-import health check shall apply, within the customs procedures of the European Union established for this purpose, both to the release for free circulation and to the inward processing arrangements and to the reimportation.
4. In case of suspicion of diversion to the illicit market of a commodity, the Pharmaceutical Inspection Services at Frontera may carry out the appropriate sanitary controls. "
Three. The wording of Article 3 (1) is amended and a new paragraph 3 is added, in the following wording:
" 1. Products falling within the scope of this order which are imported from non-Community countries or which are destined for non-Community countries shall be subject to systematic health checks at the border of entry or exit from the territory of the Community. national, as appropriate, taking into account the details specified in Annex I. " 3. Without prejudice to the necessary compliance with the other applicable requirements laid down in the current legislation, they are excluded from prior health control:

Products from a third country that originate from a European Economic Area country
Article 12. Sanitary control.
The importation of products originating in a country of the European Economic Area and the origin of a third country shall be considered for all purposes as imports from a third country and shall therefore require sanitary control in border. "
Five. A new additional provision, numbered as a second, is added, passing the current single additional provision to be numbered as first, in the following tenor:
" Additional Disposition Second. Sanitary control of products with destination or origin in the cities of Ceuta and Melilla.
1. The sanitary control of products destined for the cities of Ceuta and Melilla will be governed by the following criteria:
(a) The importation of products from third countries destined for the cities of Ceuta or Melilla shall require sanitary control at the border in the abovementioned cities, as appropriate in each case.
b) The shipment of products from other Spanish territories (peninsular and Balearic islands and Canary Islands) destined for the cities of Ceuta or Melilla will not require any type of sanitary control, either in origin or in destination.
c) The dispatch of products from any country of the European Economic Area to the cities of Ceuta or Melilla shall not require any health control at destination, except for narcotic drugs and psychotropic.
2. The sanitary control of the products originating in the cities of Ceuta and Melilla will be governed by the following criteria:
(a) The export to third countries of medicinal products for human use from the cities of Ceuta or Melilla will require sanitary control at the border in these same cities.
(b) The consignment of medicinal products for human use originating in the cities of Ceuta or Melilla and destined for other Spanish territories (peninsular and Balearic islands and Canary Islands) will not require sanitary control at source (Ceuta or Melilla), however, will require sanitary control in the customs offices nearest to the cities of destination.
(c) The consignment of medicinal products for human use originating in the cities of Ceuta or Melilla and destined for any country of the European Economic Area shall not require control at origin (Ceuta or Melilla), except for products narcotic and psychotropic, and health checks will be carried out at the border on the peninsula and in the Balearic and Canary Islands in case these are the entry points. "
Six. The wording of the second final provision is amended as follows:
