The current basic organic structure of the Ministry of Foreign Affairs and Cooperation was established by Royal Decree 1416/2004 of 11 June. In the period since its entry into force, the need to review and update on three specific aspects has been highlighted in order to achieve the greatest possible adjustment between the functions it develops and the structure of the structure. formal to give them organic support. The creation of this Directorate-General is the result of a deep reflection of the Government, following the terrorist attacks in Madrid on 11 March 2004, on the nature of these new threats, as well as a careful evaluation of the actions taken. In this way, with the creation of the new Directorate-General and with the improvement in the analysis and planning processes that it will bring, it is hoped to achieve an improvement in the quality of the corresponding actions and programmes in terms of efficiency and efficiency, which will ultimately guarantee the most economical and effective allocation of public resources allocated by Spain to international development cooperation. Finally, the third amendment introduced is born out of the need to provide the Directorate General of the External Service with the department of a more structured structure with the functions that correspond to it, and thus overcome certain limitations that have been made manifest. In particular, it is considered necessary to spin off the current General Administration and Control Subdirectorate of Management in the new General Financial Management Subdirectorate and the Management Control Division, to provide the Directorate-General for instruments of efficiency and rationalisation of its complex functions. The new Division of Control of Management will assume the functions of control of expenses and revenues of the ministry, especially in the economic-administrative field of the Representations in the exterior, that are more than 200, and this through the carrying out inspections, drafting regulations and manuals and training foreign ministers, with the necessary independence and personnel. The Financial Management Subdirectorate-General shall assume the other functions of the current General Administration and Management Control Subdirectorate, in particular as regards the compilation of accounting documents of all the operating expenditure (Chapter II) of the Ministry, as well as other appropriations relating to official visits, travel, service compensation, review of consular collection, etc., with the exception of Article 21 appropriations. In its virtue, at the initiative of the Minister for Foreign Affairs and Cooperation, on a proposal from the Minister of Public Administration and after deliberation by the Council of Ministers at its meeting on 24 June 2005,

Single item. Amendment of Royal Decree 1416/2004 of 11 June amending and developing the basic organic structure of the Ministry of Foreign Affairs and Cooperation.

Royal Decree 1416/2004 of 11 June, amending and developing the basic organic structure of the Ministry of Foreign Affairs and Cooperation, is amended as follows:

One. Article 1 (3) (a) shall be worded as follows:

" (a) The Secretariat of State for Foreign Affairs and for Latin America, on which the following management bodies depend: 1. The Directorate-General for Foreign Policy. 2. The Directorate-General for Foreign Policy for Europe and North America. 3. The Directorate-General for Foreign Policy for Latin America. 4. The Directorate-General for Foreign Policy for the Mediterranean, the Middle East and Africa. 5. The Directorate-General for Foreign Policy for Asia and the Pacific. 6. Directorate-General of the United Nations, Human Rights and Multilateral Organizations. 7. Directorate-General for International Eco-nomic Relations. 8. The Directorate-General for International Affairs on Terrorism, Non-Proliferation and Disarmament. "

Two. Article 1 (3) (c) shall be worded as follows:

"(c) The Secretariat of State for International Cooperation, on which the Directorate-General for Development Policy Planning and Evaluation depends."

Three. Article 3 is worded as follows:

" Article 3. Directorate-General for Foreign Policy.

1. The Directorate-General for Foreign Policy collaborates with the Secretary of State for Foreign Affairs and for Latin America, who directly depends on the functions of assistance to the Minister for Foreign Affairs and Cooperation in the formulation and implementation of the external policy in its global approach and objectives and, in particular, in the fields of the common foreign and security policy and the defence of the European Union, ensuring that the Spanish foreign policy is consistent with the common strategies, common positions and common actions taken by the European Union. 2. In his capacity as Political Director, the Director General of Foreign Policy represents Spain at the meetings of the Political and Security Committee of the European Union, when he meets in the formation of Political Directors, and he also exercises the coordination work on the Directorate-General for Foreign Policy for Europe and North America; the Directorate-General for Foreign Policy for Latin America; the Directorate-General for Foreign Policy for the Mediterranean, the Middle East and Africa; the Directorate-General for Foreign Policy for Asia and the Pacific; the Directorate-General for Nations United, Human Rights and Multilateral Organizations; the Directorate-General for International Economic Relations, and the Directorate-General for International Affairs on Terrorism, Non-Proliferation and Disarmament. In this condition, it promotes the achievement of the objectives and the execution of the own projects of the foreign policy of Spain in each of the areas referred to. 3. They are directly dependent on the Director-General for Foreign Policy, in addition to the management bodies listed in the previous paragraph, the following bodies, with an organic level of sub-directorate-general: (a) The General Foreign Policy Subdirectorate, to which the coordination and monitoring of the issues relating to Spanish foreign policy is concerned. (b) The Subdirectorate-General for Common Foreign and Security Policy, to which the coordination and monitoring of the participation of Spain in the common foreign and security policy of the European Union, and the preparation and monitoring of the meetings of the General Affairs and Foreign Affairs Council and the Political and Security Committee, both of the European Union, on matters relating to the common foreign and security policy. 4. It is also up to this Directorate-General to be the Ambassador to the Special Mission for Peacekeeping Operations, with the functions of assisting in the design and execution of the participation of Spain in these operations, and coordination with the different units of the Ministry of Foreign Affairs and Cooperation and other relevant Government departments to this effect. "

Four. Article 8 is worded as follows:

" Article 8. Directorate-General of the United Nations, Human Rights and Multilateral Organizations.

1. It is up to the United Nations Directorate-General, Human Rights and Multilateral Organizations to draw up, propose and implement Spain's foreign policy in the field of the United Nations and multilateral organizations, as well as of human rights and international security. In particular, it is for the exercise of the following tasks: (a) the political and legal activities related to the action of both the main organs of the United Nations and the subsidiary bodies, committees and working groups dependent on those. b) The coordination of the Spanish position in the international technical agencies and their subsidiary bodies, in the specialized agencies of the United Nations system and in the economic and social sector of the organization. c) Coordination, together with the relevant Directorates-General, of Spain's foreign policy in the field of the protection and promotion of human rights. d) The elaboration of the Spanish positions on international security and defense issues, both at the multilateral and bilateral level. 2. For the purpose of fulfilling the functions identified, the Directorate-General shall be structured in the following bodies, with an organic level of sub-directorate-general: (a) The United Nations Subdirectorate-General, which corresponds to the exercise of the function set out in subparagraph (a) of the previous paragraph. (b) The General Subdirectorate of Technical International Bodies, which corresponds to the exercise of the function set out in subparagraph (b) of the previous paragraph. (c) The Office for Human Rights, which corresponds to the exercise of the function set out in paragraph (c) of the previous paragraph. (d) The Deputy Director-General for International Security Affairs, to which the exercise of the function referred to in paragraph (d) of the previous paragraph corresponds. "

Five. Articles 10, 11, 12 and 13 become Articles 11, 12, 13 and 14 respectively.

Six. A new Article 10 is introduced, with the following wording:

" Article 10. Directorate-General for International Affairs on Terrorism, Non-Proliferation and Disarmament.

1. It is up to the Directorate-General for International Affairs on Terrorism, Non-Proliferation and Disarmament to draw up, propose and implement the interests of Spain's foreign policy in the field of international terrorism, non-proliferation and disarmament. In particular, it is the responsibility of the following tasks: (a) the coordination of the institutional representation of Spain in the multilateral fora, in collaboration with the relevant departments, and in the field of the competences of the Ministry of Foreign Affairs and Cooperation. (b) the political and legal activities related to these matters both of the main organs of the United Nations and of its subsidiary bodies, committees and working groups which are dependent on them, without prejudice to the powers of other ministries. (c) The coordination of the Spanish representation in international bodies with competence in the field of terrorism, non-proliferation and disarmament in the field of the own competences of the Ministry of Foreign Affairs and Cooperation. (d) the overall coordination of the action of the Ministry of Foreign Affairs and Cooperation, in the field of its powers, in the initiatives and monitoring of international issues of terrorism, non-proliferation, disarmament and new threats, without prejudice to the powers of the Secretariat of State for the European Union. e) Monitoring of disarmament and arms control activities and negotiations within the framework of the United Nations and other specific fora in which Spain participates, as well as the monitoring of the general verification of the agreements disarmament and arms control of which Spain is a party. f) The continued analysis of terrorism as a new strategic element in the definition of the actions of the Ministry of Foreign Affairs and Cooperation. 2. For the fulfilment of these tasks, the Directorate-General is structured in the following bodies: (a) The Subdirectorate-General for International Affairs of Terrorism, which is responsible for the exercise of the tasks set out in paragraphs (a), (b), (c) and (d) of the previous paragraph, in the forums and areas of its powers, as well as the function set out in paragraph (f) of the previous paragraph. (b) the General Sub-Directorate for Non-Proliferation, which is responsible for the exercise of the functions set out in paragraphs (a), (b), (c), (d) and (e) of the previous paragraph, in the forums and areas of its powers. 3. The ambassadors on special mission to be appointed in the areas of their competence shall also be responsible for this Directorate-General. "

Seven. Article 14 shall become Article 15 and the wording of paragraph 3 shall become as follows:

" 3. It is directly dependent on the Secretary of State, in addition to the management body referred to in Article 1.3.c), the General Subdirectorate of Cultural and Scientific Programmes and Conventions, which performs the following functions: (a) Planning and evaluation The European Union's external relations in the field of culture, science, technology and the environment, with other countries and with international organizations. (b) The coordination of the external relations of Spain with the various ministerial departments and other public and private administrations and entities in the areas mentioned. (c) the preparation, negotiation and proposal of international agreements and conventions, the organization of the joint commissions that develop them in the field of their competences and the management of the actions derived from them. (d) The assurance and coordination of the institutional presence of Spain in international cultural or scientific bodies. "

Eight. Articles 15 and 16 become Articles 17 and 18.

Nine. A new Article 16 is introduced, with the following wording:

" Article 16. Directorate-General for Planning and Evaluation of Policy for Development.

1. It is the responsibility of the Directorate-General for Planning and Evaluation of Policies for Development, under the Ministry of State of International Cooperation, the formulation, planning, monitoring and evaluation of Spanish policy. cooperation for international development. In particular, it is responsible for the following tasks: (a) to draw up the Director-General for International Cooperation and the annual plans. (b) Develop and follow thematic and territorial strategies (cross-cutting, sectoral and strategic-country strategies) in these areas. c) Ensure the active and useful participation of Spain in the OECD Development Assistance Committee. d) To participate, in collaboration with the organs of the State Administration that have assigned competences in this field, in the elaboration of the Spanish position in the international organizations of development, as well as in the elaboration of the European Union's external cooperation policy. (e) to carry out the secretariat of the advisory bodies provided by the Spanish legislation (Cooperation Council, Inter-Ministerial Commission and Interterritorial Commission) and to deal with the relations with its members. f) To advise on the implementation of Law 23/1998, of July 7, of International Cooperation for Development, and on its development. (g) Develop the monitoring, coordination and evaluation of the official Spanish development assistance. (h) Evaluate international cooperation policies, instruments, interventions, programmes and projects. In the case of programmes and projects financed by the official aid for the repayable development and the debt reduction and relief schemes, this assessment shall be carried out in accordance with the management ministry of each instrument. 2. For the purpose of fulfilling the functions identified, the Directorate-General shall be structured in the following bodies: (a) The General Sub-Directorate for Development Planning and Policies, which is responsible for the exercise of the functions provided for in the paragraphs (a), (b), (c), (d), (e) and (f) of the previous paragraph. (b) the Development Policy Assessment Division, with the organic level to be determined in the employment relationship, to which the exercise of the functions provided for in paragraphs (g) and (h) of the previous paragraph corresponds. "

Ten. Article 17 becomes Article 19, which is worded as follows:

" Article 19. Directorate-General of the Foreign Service.

1. It is for the Directorate-General of the External Service, under the immediate dependence of the Deputy Secretary, the exercise of the functions relating to internal arrangements, economic and financial management, personnel management, wealth management and works, administrative information, IT planning and assistance and communications. In particular, it is for the exercise of the following tasks: (a) the infrastructure and security of the department. (b) the management of the cases of official and labour staff, both at home and abroad, as well as their remuneration. (c) the accounting and budgetary management and monitoring of appropriations in Chapter II of the budget. (d) control of expenditure and revenue of the ministry and consular collection. (e) The management and budgetary control of the items in Chapter VI of the budget and of the acquisition, construction and maintenance of buildings. f) The elaboration and execution of the department's computer plans, both inside and outside, technical assistance to the users and the management of the department's communications. 2. The following units are dependent on the General Directorate of the External Service, with an organic level of general sub-direction: (a) The General Office, which corresponds to the exercise of the function provided for in paragraph (a) of the previous paragraph. (b) the General Staff Subdirectorate, which corresponds to the exercise of the function provided for in paragraph (b) of the previous paragraph. (c) The General Financial Management Subdirectorate, which corresponds to the exercise of the function provided for in paragraph (c) of the preceding paragraph, with the exception of the appropriations in Article 21 of the budget. (d) The General Subdirectorate for Economic and Monetary Affairs, to which the exercise of the function referred to in paragraph (e) of the preceding paragraph corresponds, as well as the accounting and budgetary management and monitoring of the appropriations of Article 21 of the budget. (e) The Subdirectorate-General for Information and Communications, which corresponds to the exercise of the function provided for in paragraph (f) of the previous paragraph. 3. It also depends on the Directorate-General of the External Service the Division of Management Control, with the organic level to be determined in the relation of jobs, to which the exercise of the functions provided for in the (d) in paragraph 1. '

Once. Articles 18 and 19 become Articles 20 and 21 respectively.

Single additional disposition. Removal of organs.

The following department management bodies are deleted:

(a) With an organic level of general direction: 1. The Directorate-General for International Affairs on Terrorism, the United Nations and Multilateral Agencies.

2. The Unit for the Coordination of the Participation of Spain in the United Nations Security Council.

b) With general sub-direction organic level:

1. The Subdirectorate General for International Affairs of Disarmament.

2. The Subdirectorate General for Planning and Evaluation of Development Policies. 3. The Deputy Director General for Administration and Management Control.

Single transient arrangement. Units and jobs with lower organic level than general sub-direction.

Units and jobs with a lower organic level than a general sub-directorate will continue to remain and will be paid from the same budgetary appropriations until the corresponding relations of the jobs adapted to the organic structure of this royal decree. The units and places of work in the deleted organs, or whose organic dependence has been modified by this royal decree, shall be provisionally assigned, by means of a decision of the Deputy Secretary, and, if necessary, after agreement of the Secretary of State responsible in each case, until the new relationship of jobs, to the regulated bodies in this royal decree, according to the attributions that they are assigned.

Single repeal provision. Regulatory repeal.

The Royal Decree 1289/2002, of 5 December, is repealed, creating the Unit for the Coordination of the Participation of Spain in the United Nations Security Council.

Final disposition first. Powers of development.

The Minister of Foreign Affairs and Cooperation is hereby authorized to adopt the necessary measures for the development and execution of this royal decree.

Final disposition second. Entry into force.

This royal decree will enter into force on the day following its publication in the "Official State Gazette".
