The Advisory Council for the Promotion of Trade with West Africa was created by Law 19/1994 of 6 July, amending the Economic and Fiscal Regime of the Canary Islands, with the aim of promoting commercial relations with the African countries in this area. The composition and functions of this Council, composed of representatives of the General Administration of the State, the Autonomous Administration and the exporting sector, was established by Royal Decree 417/1996 of 1 March. The time since its adoption and the changes in the administrative organization, both state and regional, require the necessary updates in the composition of its members. In its virtue, on the proposal of the Minister of Industry, Tourism and Trade, with the prior approval of the Minister of Public Administrations and after deliberation of the Council of Ministers at its meeting on 13 October 2005,

Single item. Amendment of Royal Decree 417/1996 of 1 March, regulating the composition and functions of the Advisory Council for the Promotion of Trade with West Africa.

Royal Decree 417/1996, of March 1, which regulates the composition and functions of the Advisory Council for the Promotion of Trade with West Africa, is amended in the following terms: One. Article 2 is worded as follows:

" Article 2. Composition.

1. The Advisory Council for the Promotion of Trade with West Africa (CAPCAO) shall be composed of the following members: (a) President: the Secretary of State for Tourism and Trade, whose vote shall be settled. (b) First Vice-President: the Minister of Economy and Finance of the Government of the Canary Islands. (c) Second Vice-President: the Government Delegate in the Autonomous Community of the Canary Islands. d) Third Vice President: the Minister of Industry, Trade and New Technologies of the Government of the Canary Islands. (e) Vice-President: The Secretary-General of Foreign Trade of the Ministry of Industry, Tourism and Trade. f) Vocals: 1. The Director General of Trade and Investments of the Ministry of Industry, Tourism and Trade. 2. The Director General for Cooperation with Africa, Asia and Eastern Europe of the Spanish Agency for International Cooperation. 3. Executive Vice President of the Spanish Institute of Foreign Trade (ICEX). 4. The Director General of Relations with Africa of the Government of the Canary Islands. 5. The Director General of Economic Promotion of the Government of the Canary Islands. 6. The Presidents of the Official Chambers of Commerce, Industry and Navigation of Las Palmas and Santa 7. The CEO of the company PROEXCA. 8. The Regional Directors of Trade of Las Palmas and Santa Cruz de Tenerife. 2. Adscrito to the Advisory Council for the Promotion of Trade with West Africa, a Committee is created Executive whose object will be support to the Advisory Board by monitoring and boosting the actions necessary to implement the agreements adopted by the Council, and shall exercise those other tasks assigned to it by the Council. Its composition will be as follows: a) President: the Secretary General of Foreign Trade of the Ministry of Industry, Tourism and Trade. (b) Vocals: 1. The Director-General for Relations with Africa of the Government of the Canary Islands. 2. A representative of PROEXCA. 3. A representative of the Official Chambers of Commerce, Industry and Navigation of Las Palmas and Santa Cruz de Tenerife. 4. representative of the Spanish Institute of Foreign Trade (ICEX). 5. A representative of the Regional Directorate of Trade of Las Palmas and the other one by Santa Cruz de Tenerife. 3. Without prejudice to their status as members of the Advisory Board and its Executive Committee, they shall act as secretaries of the Advisory Board, on an annual basis, the representative of the Regional Trade Directorate of Las Palmas and Santa Cruz de Tenerife. 4. Meetings of the Council and its Executive Board may be attended, with a voice but without a vote, by those persons related to the export sector who are proposed by the President or Vice-Presidents in the case of the Advisory Board, or by the President. or the vowels in the case of the Executive Committee. "

Two. Article 3 is worded as follows:

" Article 3. Appointment and mandate.

1. The members of the Executive Committee shall be appointed by the Secretary of State for Tourism and Trade on a proposal from the corresponding organs of the General Administration of the State, the Administration of the Autonomous Community of the Canary Islands or the entities represented. 2. The term of office of the members of the Advisory Board and of the Executive Committee, except for those who are for the purpose of the office, shall be two years, although it may be renewed for equal periods. In the case of vacancy, absence, illness or any other legal cause, the Chairman of the Advisory Board shall be replaced by the Deputy President in accordance with the order provided for in Article 2.1. The President of the Executive Committee shall be replaced by the person appointed. The vowels who are responsible for his position shall appoint, in the case of vacancy, absence or illness, an alternate. In the case of other vowels, the alternate shall be appointed by the represented entities. "

Three. Article 5 (1) is worded as follows:

" 1. The Advisory Council for the Promotion of Trade with West Africa (CAPCAO) will meet at least once a year on a proposal from the President or First Vice President. The Executive Committee shall meet at least twice a year on a proposal from the President. "

Additional disposition first. Organic references.

All the references contained in Royal Decree 417/1996, of 1 March, regulating the composition and functions of the Advisory Council for the Promotion of Trade with West Africa, to the Minister of Trade and Tourism They shall refer to the Minister for Industry, Tourism and Trade.

Additional provision second. Constitution of the Advisory Board.

The Advisory Council for the Promotion of Trade with West Africa (CAPCAO) will be constituted within three months of the entry into force of this royal decree and the administrations and entities represented in it will be propose to its representatives within 20 days, counted from the date of entry into force.

Additional provision third. Financing.

The approval of this royal decree will not be able to increase public spending.

Single end disposition. Entry into force.

This royal decree will enter into force on the day following its publication in the "Official State Gazette".
