Royal Decree 1599/1997 of 17 October on cosmetic products collected in a single text all the existing legislation on this subject, adapting to Community legislation. Orders of 4 June 1998, 26 April 1999, 3 August 2000 and Orders SCO/249/2003, SCO/1448/2003, SCO/2592/2004, SCO/3664/2004, SCO/54/2005 and SCO/3691/2005 have amended the Annexes to this royal decree.

This royal decree has been amended by Royal Decree 2131/2004 of 29 October and Royal Decree 209/2005 of 25 February.

Council Directive 76 /768/EEC of 27 July 1976 on the approximation of the laws of the Member States relating to cosmetic products has been the subject of successive amendments, the most recent of which have been by Commission Directives 2005 /42/EC of 20 June 2005 and Commission Directive 2005 /52/EC of 9 September 2005.

By this provision these directives are transposed into our legal order, in accordance with the provisions of the final provision of Royal Decree 1599/1997 of 17 October 1997.

In its virtue, according to the State Council, I have:

Article first. Amendment of Annexes II, III, IV and VI to Royal Decree 1599/1997 of 17 October.

Royal Decree 1599/1997 of 17 October on cosmetic products is amended as follows:

One. The following reference numbers are added in Annex II:

" 1133. Oil from the root of the costus (Saussurea Lappa Clarke) (CAS 8023-88-9), used as a fragrance ingredient.

1134. 7-ethoxy-4-methylcoumarin (CAS No 87-05-8), used as a fragrance ingredient.

1135. Hexahydrocoumarin (CAS No 700-82-3), used as a fragrance ingredient.

1136. Balm of Peru (name INCI: Myroxylon pereirae; No. CAS 8007-00-9), used as a fragrance ingredient. "

Two. In Part 2 of Annex III, column g is amended as follows:

a) For order numbers 1, 2, 8, 13, 15, 17, 23, 30, 34, 40, 41, 42, 43, 45, 46, 51, 52, 53, 54, 57, 59, and 60, the date "31-12-2005" is replaced by "31-08-2006".

b) For order numbers 3, 4, 5, 6, 7, 9, 10, 11, 12, 14, 16, 18, 19, 20, 21, 22, 24, 25, 26, 27, 28, 29, 31, 32, 33, 35, 36, 37, 38, 39, 44, 47, 48, 49, 50, 55, 56 and 58, the date "31-12-2005" is replaced by "31-12-2006".

Three. In Part 1 of Annex IV, the colours CI 12150, CI 20170 and CI 27290 are deleted.

Four. The first part of Annex VI is amended as follows:

a) The reference number 53 is replaced by the following:

Article 2. Time limit for placing on the market, sale or disposal.

As of 31 March 2006, cosmetic products that do not comply with the provisions of the first article of this order may not be marketed or sold to the final consumer.

Final disposition first. Incorporation of European Union law.

By this order, Commission Directive 2005 /42/EC of 20 June 2005 amending Council Directive 76 /768/EEC on cosmetic products for the purposes of adapting its Directive 2005 /42/EC is incorporated into Spanish law. Annexes II, IV and VI to technical progress, and Commission Directive 2005 /52/EC of 9 September 2005 amending Council Directive 76 /768/EEC on cosmetic products in order to adapt Annex III thereto to progress technical.

Final disposition second. Entry into force.

This order shall enter into force on the day following that of its publication in the "Official State Gazette".
