Royal Decree 1599/1997 of 17 October on cosmetic products collected in a single text all the existing legislation on this subject, adapting to Community legislation. Orders of 4 June 1998, 26 April 1999, 3 August 2000 and Orders SCO/249/2003, SCO/1448/2003, SCO 2592/2004, SCO/3664/2004, SCO/544/2005, SCO/3691/2005 and SCO/747/2006 have amended the Annexes to this royal decree.
This royal decree has been amended by Royal Decree 2131/2004 of 29 October and Royal Decree 209/2005 of 25 February.
Council Directive 76 /768/EEC of 27 July 1976 on the approximation of the laws of the Member States relating to cosmetic products has been the subject of successive amendments, the last of which were by Commission Directive 2005 /80/EC of 21 November 2005.
By this provision, this directive is transposed into national law, in accordance with the provisions of the final provision of Royal Decree 1599/1997 of 17 October 1997.
In its virtue, I have:

Two. The first part of Annex III is amended as follows:
a) The reference number 19 is deleted.
(b) In the reference number 1a, in column b, the words 'Boric acid, borates and tetraborates' are replaced by: 'Boric acid, borates and tetraborates, except the substance number 1184 of Annex II'.
(c) In reference number 8, in column b, the words " m-and p-phenylenediamine, its N-substituted derivatives and their salts; N-substituted derivatives of or-phenylenediamine (1), with the exception of derivatives listed in any other part of this Annex 'is replaced by:' p-phenylenediamine, its N-substituted derivatives and their salts; N-substituted or N-substituted derivatives of the (1), excluding those already mentioned in this Annex '.
Article 2. Time to market.
From 22 August 2006, cosmetic products that do not comply with the requirements of the first article may not be marketed.
Article 3. Time limit for sale or transfer.
From November 22, 2006, cosmetic products that do not conform to the requirements of the first article may not be sold or transferred to the final consumer.
Final disposition first. Incorporation of European Union law.
By this order, Commission Directive 2005 /80/EC of 21 November 2005 amending Council Directive 76 /768/EEC on cosmetic products for the purposes of Directive 2005 /80/EC is incorporated into national law. adapt its Annexes II and III to technical progress.
Final disposition second. Entry into force.
This order shall enter into force on the day following that of its publication in the "Official State Gazette".
