Articles 2.3 of the General Regulation on the collection of social security, adopted by Royal Decree 1415/2004 of 11 June 2005 and 4.2 of Order TAS/1562/2005 of 25 May 2005 laying down rules for the application of Council Regulation (EC) No 1415/2004 and the development of the said general regulation, attribute to the executive collection units of the General Treasury of Social Security the competence to regularise the payment by the responsible persons, to ensure the enforced execution of the assets of the debtors of the Social Security, as well as to realize how many others (a) any duties levied on an executive basis are not expressly attributed to other bodies of that common service of social security, without prejudice to the other functions which the Director-General may assign to them. The implementation of the executive collection units in the field of the provincial addresses of the General Treasury of Social Security has been carried out by the Ministerial Orders of 11 March 1987, 7 March 1990, 22 of March 1993 and 29 March 2000, and its current number is 290. It is now necessary to proceed to the reorganization of the executive collection units of the Provincial Directorate of the General Treasury of Social Security in Malaga, by creating a new unit, based in Estepona, whose implementation will allow a more efficient management of the position currently assumed by the Executive Collection Unit based in Marbella. In its virtue, in accordance with Articles 34.2 and 67.2.b) of Law 6/1997, of 14 April, of the organization and operation of the General Administration of the State, and 25.f) of Law 50/1997 of 27 November, of the Government, on the proposal of the Ministers of Labour and Social Affairs and Public Administrations, I have:

Article 1. Creation of a social security executive collection unit.

A new executive collection unit of Social Security is established, which is dependent on the Provincial Directorate of the General Treasury of the Social Security of Malaga and based in Estepona.

Its territorial scope of action, with the consequent modification of the demarcations of the existing executive collection units existing in the provincial directorate, will be fixed by the Director General of the General Treasury for Social Security, in accordance with Article 4.2 of Order TAS/1562/2005 of 25 May 2005 laying down rules for the implementation and development of the general regulation on the collection of social security, adopted by Royal Decree 1415/2004 of 11 June.

Article 2. Organic structure.

The new social security executive collection unit will have the organic structure to be determined in the employment relationship of the General Social Security Treasury.

Single transient arrangement. Validity of actions up to the implementation of the new executive collection unit.

The acts and formalities performed by the current executive collection units of the Provincial Directorate of the General Treasury of the Social Security of Malaga in the administrative procedures of the award will be valid and shall have full effect on those procedures which are continued by the newly established unit, as a result of the establishment of its territorial scope for action and the implementation by the Director-General of the General Treasury of Social Security, irrespective of whether the person responsible for the payment has or is not domiciled in the demarcation of the executive collection unit to be followed by the procedure.

Final disposition first. Ratings.

1. The Secretary of State for Social Security and the Deputy Secretary for Labour and Social Affairs are empowered to resolve, in the field of their respective powers, any questions of a general nature to be raised in the application of this order.

2. The Director General of the General Treasury of Social Security is empowered to put into operation the unit of executive collection that is created by this order, as well as to modify the location of its headquarters according to the needs of the collection organisation.

Final disposition second. Entry into force.

This order shall enter into force on the day following that of its publication in the "Official State Gazette".
