Law 8/2003 of 24 April on animal health provides in Articles 18 and 24 that, where the existence of a notifiable disease is confirmed or subject to intra-Community or international restrictions, or officially declare the extinction of a disease, the Ministry of Agriculture, Fisheries and Food shall communicate in the form and time limits laid down, such impact to the health authorities of the European Union, as well as to third countries and international bodies with whom such an eventuality would have been concluded.

Royal Decree 2459/1996 of 2 December, establishing the list of notifiable diseases and providing the rules for their notification, complies with the provisions of Council Directive 82/894/EEC, of 21 December 1982 on the notification of animal diseases in the Community and the obligations which Spain has as a member of the World Organisation for Animal Health.

The International Committee of the World Organisation for Animal Health decided in May 2005 to create a single list of notifiable diseases, by deleting the above lists A and B, and to amend the criteria. and the periods for the notification of these diseases, and include the obligation to send half-yearly reports on the health status of the Member States. It is therefore necessary to amend Royal Decree 2459/1996 of 2 December, in order to adapt it to the new system of notification of diseases of the World Organisation for Animal Health.

Reasons for legal certainty, given the scope of the amendments to be made to Royal Decree 2459/1996 of 2 December, advise the approval of a new royal decree.

This provision has been submitted to the autonomous communities and to the entities representing the interests of the sectors concerned.

This royal decree is dictated by the habilitation contained in the fifth final provision of Law 8/2003, of April 24, of animal health.

By virtue of the proposal of the Minister for Agriculture, Fisheries and Food, in agreement with the Council of State and after deliberation by the Council of Ministers at its meeting on 11 May 2007,

D I S P O N G O:

Article 1. Object.

This royal decree aims at determining the diseases of animals subject to compulsory declaration in the field of Spain, the European Union and the World Organisation for Animal Health, as well as the requirements for notification.

Article 2. Definitions.

1. For the purposes of this royal decree, the definitions contained in Article 3 of Law 8/2003 of 24 April of animal health shall apply.

The definitions contained in Chapter 1.1.1 of the World Organization for Animal Health and Chapter 1.1.1 of the Sanitary Code for Animals are also applicable. Aquatic from the World Organization, both codes are available in Spanish on the website www.oie.int.

2. In addition, primary focus shall be any focus that does not relate from the epizootiological point of view with an earlier focus tested in the same province, or the first occurrence in another different province.

Article 3. Official declaration and semi-annual communication of animal diseases.

1. The competent authorities shall make the official declaration of the diseases of the animals listed in Annex I.

2. This declaration shall be made immediately in the case of:

(a) The first occurrence in Spain, in an area or in a compartment, of a disease or infection of one of the diseases listed in Annex I.

(b) The reappearance of a disease or infection listed in Annex I after having stated that the focus has been extinguished.

(c) The first occurrence of any new strain of a pathogenic agent of one of the diseases listed in Annex I.

d) The sudden and unexpected increase in the distribution, incidence, morbidity or mortality of one of the diseases listed in Annex I.

e) Any emerging disease with an important morbidity or mortality rate, or with the potential to be a zoonosis, even if it is not included in Annex I.

(f) Any changes observed in the epidemiology of one of the diseases listed in Annex I, including a change of host, pathogenicity or strain, especially if it may have zoonotic effects.

3. The competent authorities shall, for information purposes, carry out a six-monthly communication on the diseases listed

Annex I.

Article 4. Communication to the Ministry of Agriculture, Fisheries and Food.

1. The competent authorities shall communicate to the Ministry of Agriculture, Fisheries and Food, through the Directorate-General for Livestock, the official declaration of the animal diseases listed in Annex I, through the Directorate-General for Livestock coordination of the measures to be taken and for its notification to the World Organisation for Animal Health and, in the case of diseases listed in Annex I. A for notification to the European Commission and to the other States members.

2. Such notification shall be made immediately after the official declaration is made in the event of any of the circumstances described in Article 3.2 or in the case of a primary focus of the diseases included in the Annex I. A, providing all the data included in Annex II. The information set out in Annex III shall be sent weekly until the outbreak of the outbreak. These data will be supplied by individualized foci.

In the case of classical swine fever, in addition, the information provided shall be in accordance with the data set out in Annex IV, and a report shall be sent as soon as possible in accordance with the data set out in Annex V.

The extinction of disease outbreaks shall be reported immediately, in accordance with the data provided for in Annex VI.

3. The competent authorities shall forward to the Ministry of Agriculture, Fisheries and Food, through the Directorate-General for Livestock, a semi-annual communication of the health situation in their respective territorial area with regard to diseases. in Annex I, by means of two annual reports, one for the first half of the current year before 15 July of each year, and for the second half of the year before 15 January of the following year, for the purposes of the notification to the World Organisation for Animal Health and the coordination of measures which have to be adopted.

Article 5. Notification to the Commission of the European Union, the Member States and the World Organisation for Animal Health.

1. The Ministry of Agriculture, Fisheries and Food, through the Directorate-General for Livestock, shall notify the Commission of the European Union and the other Member States:

a) Before twenty-four hours from the receipt of the corresponding data:

1. The primary focus of the diseases listed in Annex I. A that would have been declared on the national territory.

2. The deletion, after extinction of the last focus, of the restrictions that would have been applied as a result of the occurrence of the diseases listed in Annex I.A.

(b) The first working day of each week, the secondary foci of the diseases listed in Annex I. A which would have been declared on the national territory. The notification shall cover each week ending at midnight on Sunday preceding the notification.

These notifications shall include the information set out in Annex II.

In the case of classical swine fever the information provided shall be in accordance with the data set out in Annex IV, and a report shall be sent as soon as possible in accordance with the data set out in Annex V.

2. The Ministry of Agriculture, Fisheries and Food, through the Directorate-General for Livestock, shall immediately notify the World Organisation for Animal Health of the information on the official declaration which the competent authorities shall carry out. of any of the diseases listed in Annex I, in the event of any of the circumstances described in Article 3.2. The organisation shall also be notified of the extinction of the foci by providing the data set out in Annex VI.

The information listed in Annex III shall be sent weekly, until the outbreak of the outbreak or the disease becomes endemic.

The information which, on the diseases listed in Annex I, shall be transmitted by the competent authorities in accordance with the provisions of Article 4.3, shall be submitted to the World Organisation for Animal Health.

3. Notifications shall contain the information required by the questionnaires established by the World Organisation for Animal Health.

Single additional disposition. Animals attached to the Ministries of Defense and Interior.

In relation to animals attached to the Ministries of Defence and the Interior and their public bodies, the provisions of the third provision of Law 8/2003 of 24 April on animal health shall apply.

Single repeal provision. Regulatory repeal.

The Royal Decree 2459/1996 of 2 December, establishing the list of notifiable diseases, is hereby repealed and the regulations are given for notification.

Final disposition first. Competence title.

This royal decree is issued in accordance with the provisions of Article 149.1.16 of the Constitution, which gives the State exclusive competence in the field of basic and general health coordination.

Final disposition second. Incorporation of European Union law.

This royal decree incorporates into national law Council Directive 82/894/EEC of 21 December 1982 on the notification of animal diseases in the European Union.

Final disposition third. Development and modification faculty.

1. The Minister for Agriculture, Fisheries and Food is empowered to make, in the field of his powers, the provisions necessary for the fulfilment and implementation of the provisions of this royal decree.

2. The Minister for Agriculture, Fisheries and Food is also empowered to amend the content of the Annexes to this royal decree, in order to adapt them to the amendments introduced by Community legislation or to changes introduced by the Directive. World Organisation for Animal Health, or for urgent animal health reasons.

Final disposition fourth. Entry into force.

This royal decree will enter into force on the day following its publication in the "Official State Gazette".

In case of confirmation in holdings or zones approved or exempted pursuant to Royal Decree 1882/1994 of 16 September 1994 laying down animal health conditions applicable to the placing on the market of aquaculture animals and products, infections of infectious haematopoietic necrosis, infectious salmon anaemia and viral haemorrhagic septicaemia shall be reported as primary foci. The name and description of the holding or approved zone shall be included.

ANNEX IV

Supplementary information in case of classical swine fever

1. Date on which the existence of classical swine fever was suspected.

2. Date on which classical swine fever has been confirmed; methods used for such confirmation.

3. Location of the infected holding and distance to which the nearest pig holdings are located.

4. Number of pigs and category of pigs (breeding, fattening, piglets *) on the holding.

5. For each category of pigs (breeding, fattening, piglets *), the number of pigs in which the existence of classical swine fever and the degree of mortality of the disease has been established.

6. If the disease has not taken place on a holding, indication of its possible confirmation in a slaughterhouse or in a means of transport.

7. Confirmation in primary cases (**) in feral pigs.

* Lechones: animals less than three months old, approximately.

** For "primary cases" in wild boar, cases occurring in exempted areas, i.e. outside the areas subject to restrictions due to classical swine fever in feral pigs, shall be understood.

ANNEX V

Classical Swine Fever Report

1. Date on which the pigs in the holding were killed and destroyed.

2. Where the derogation provided for in Article 6 of Royal Decree 1071/2002 of 18 October 2002 laying down minimum measures for the control of classical swine fever has been applied, the number of pigs to which it has been given death and destruction and the number of pigs whose slaughter has been delayed, as well as the time limit for carrying out such slaughter.

3. Any information concerning the possible origin of the disease or the origin of the disease when it has been determined.
