Key Benefits:
The Regulation on the Registration of Varieties of Horticultural Species, adopted by the Order of 23 May 1986, sets out the characteristics to be observed in the identification tests, and the specific conditions and the methodology for the performance of these tests, indicating, in turn, the precise tests for the determination of the agronomic value or the use, in the species in which this evaluation is required for the registration in the Varieties Registry Commercial of varieties of such species.
This Regulation incorporates Commission Directive 2003 /91/EC of 6 October 2003 laying down detailed rules for the application of Article 7 of Council Directive 2002/55/EC as regards the provisions of Directive 2003 /91/EC of the European Parliament and of the Council characters which the examinations must analyse at least and the minimum conditions for examining certain varieties of horticultural plant species. The previous Directive has been amended on a number of occasions, the last of which was by Commission Directive 2006 /127/EC of 7 December 2006 amending Commission Directive 2003 /91/EC of 6 October 2003 on the laying down detailed rules for the application for the purposes of Article 7 of Council Directive 2002/55/EC, in respect of the characters which the examinations must analyse at least and the minimum conditions for examining certain varieties of species of horticultural plants, replacing Annexes I and II. Order APA/530 /2004 of 13 February amending the Regulations for the registration of varieties in the Register of commercial varieties, corresponding to horticultural species, cereals, maize, oilseeds and textiles, potatoes, fodder, In the case of the Commission, the Commission, in the light of the Commission's proposal, has been in the process of being able to take the necessary measures to ensure that the aid is granted to the Member State concerned. and D, and without reflecting in the text the reference to the new annexes, these annexes are now replaced by the new E and F, which correspond to the new Annexes I and II of the Directive which is incorporated, amending in turn paragraph 10, in order for them to be referred to in the text. Accordingly, this order incorporates the said Directive, amending paragraph 10 and creating Annexes E and F to the Order of 23 May 1986. In the preparation of this order, the autonomous communities and the sectors affected have been consulted. In its virtue, I have:
Single item. Amendment of the Order of 23 May 1986 approving the Regulation on the registration of varieties of horticultural species.
The Order of 23 May 1986 approving the Regulation on the registration of varieties of horticultural species is hereby amended as follows: Paragraph 10 is replaced by the following:
" Ten. As regards the distinction, stability and homogeneity for the species listed in Annex E, the performance of official examinations for the admission of varieties shall comply with the conditions laid down in the 'Protocols for examinations'. (a) of distinction, homogeneity and stability ', as provided by the Management Board of the Community Plant Variety Office (CPVO) referred to in that Annex.
With regard to the distinction, stability and homogeneity, the varieties of the species listed in Annex F shall comply with the examination guidelines of the International Union for the Protection of Obtentions. Plants (UPOV) referred to in that Annex. At least all the characters referred to in the first paragraph and all the characters marked with an asterisk of the examination guidelines referred to in the second subparagraph shall be covered, provided that the expression of some of them do not prevent the observation of others, or the environmental conditions in which the test is carried out, do not prevent the expression of some of them. Without prejudice to the provisions of the preceding paragraph, the characters to be observed during the conduct of the identification tests shall be determined by the Spanish Plant Variety Office, or the National Commission for the Estimation of Varieties. '
Two. Annexes 1 and 2 are replaced by those which, as Annexes E and F, are set out in the Annex to that order.
Single transient arrangement. Varieties which are in the process of admission.
Those varieties which have begun official examinations, for admission to the common catalogue of horticultural plants, before 1 July 2007, may be accepted if they comply with the provisions of the Order of 23 May 1986, by which the Regulation on the registration of varieties of horticultural species which were in force before the present amendment is approved.
Single end disposition. Entry into force.
This Order shall enter into force on the day following that of its publication in the "Official State Gazette".
